सा.का.िन. 231(अ).—सफेद मूसली ेणीकरण और िचह्नांकन िनयम, 2017 िजन् ह े कृिष उपज ( ेणीकरण और िचह्नांकन) अिधिनयम, 1937 (1937 का 1) की धारा 3 ारा दत् त शि य का योग करते हुए भारत के राजप , असाधारण, भाग-II, खण् ड 3, उप खण् ड (i) म अिधसूचना संख् यांक सा.का.िन. 505(अ), तारीख 13 मई, 2016 ारा ऐसे सभी व् यि य से िजनके इससे भािवत होने की संभावना थी, उस तारीख से िजस तारीख को भारत के राजप म कािशत उक् त अिधसूचना की ितयां जनता को उपलब् ध करा दी गई थी म पतालीस िदवस की अविध के भीतर आक्षेप और सुझाव आमंि त करते हुए उक् त अिधसूचना की ितयां जनता को तारीख 13 मई, 2016 को उपलब् ध करा दी गई थी;

उक् त िनयम , के संबंध म जनता से कोई आक्षेप अथवा सुझाव ाप् त नह हुए ह;

अत: अब केन् ीय सरकार कृिष उपज ( ेणीकरण और िचह्नांकन) अिधिनयम, 1937 (1937 का 1) की धारा 3 ारा दत् त शि य का योग करते हुए िनम् निलिखत िनयम बनाती ह,ै अथार्त्:-

1. स ंिक्षप् त नाम, लागू होना और ारम् भ.—(1) इन िनयम का नाम सफेद मूसली ेणीकरण और िचह्नांकन िनयम, 2017 ह ै।

(2) ये िनयम िलिलयािसया पिरवार के कलोरोपाइटम बोरीिविलयनम एल के रूट टयूबर से ाप् त सफेद मूसली पर लागू ह गे।

(3) ये िनयम सरकारी राजप म उनके कािशत होने की तारीख को वृत् त ह गे ।

2. पिरभाषाए.ं—(1) इन िनयम म, जब तक िक संदभर् से अन् यथा अपेिक्षत न हो –

(क) ‘’कृिष िवपणन सलाहकार’’ से भारत सरकार का कृिष िवपणन सलाहकार अिभ ेत ह ै;

(ख) ‘’ ािधकृत पैकर’’ से ऐसा कोई व् यि या व् यि य का समूह अिभ ेत ह ैिजसे इन िनयम के अधीन ेणी मानक और िविहत ि या के अनुसार, सफेद मूसली का ेणीकरण और उन् ह िचह्नांिकत करने के िलए ािधकार माण-प अनुदत् त िकया गया हो ;

(ग) ‘’ ािधकार माण प ’’ से िकसी व् यि या व् यि य के िकसी िनकाय को सफेद मूसली का ेणीकरण और िचह्नांकन करने और उन पर ेणी अिभधान िचह्न लगाने के िलए ािधकृत करते हुए साधारण ेणीकरण और िचह्नांकन िनयम, 1988 के उपबंध के अधीन जारी िकया गया माण प अिभ ेत ह ै;

(घ) ‘’साधारण ेणीकरण और िचह्नांकन िनयम’’ से कृिष उपज ( ेणीकरण और िचह्नांकन) अिधिनयम, 1937 (1937 का 1) की धारा 3 के अधीन बनाए गए साधारण ेणीकरण और िचह्नांकन िनयम, 1988 अिभ ेत ह ;

(ड़) ‘’ ेणी अिभधान िचह्न’’ से िनयम 5 म िन दष् ट एगमाकर् अिधिचह्न अिभ ेत ह ै;

(च) ‘’अनुसूची’’ से इन िनयम के साथ संलग् न अनुसूची अिभ ेत ह ै।

(2) उन शब् द और पद के जो इन िनयम म युक् त ह और पिरभािषत नह ह, िकन् तु कृिष उपज ( ेणीकरण और िचह्नांकन) अिधिनयम, 1937 (1937 का 1) और साधारण ेणीकरण और िचन् ह िनयम, 1988 म पिरभािषत ह,ै के वही अथर् ह गे जो उक् त अिधिनयम और उक् त िनयम म ह ।

3. ेणी अिभधान.—सफेद मूसली की क् वािलटी को दिशत करने के िलए ेणी अिभधान अनुसूची-2 की सारणी के स् तम् भ 1 म िदए गए के अनुसार ह गे ।

4. क् वािलटी.—इन िनयम के योजन के िलए सफेद मूसली की क् वािल टी अनुसूची–2 म यथािविन दष् ट के अनुसार होगी ।

5. ेणी अिभधान िचह्न.— ेणी अिभधान िचह्न म ािधकार माण प की संख् या, ‘’एगमाकर् ’’ शब् द, वस् तु का नाम और अनुसूची 1 म िदए गए िडजाइन के सदशृ ेणी अिभधान को सिम्मिलत करते हुए िडजाइन से िमलकर बना ‘’एगमाकर् अिधकार िचह्न’’ होगा ।

6. पै कग करने की प ित : (1) सफेद मूसली की पै कग कपड ेसे बने नए, स् वच् छ और शुष् क आधान म अथवा पोलीवोवन थैल िजनकी भीतर की लाइिनग फूड ेड साम ी की हो अथवा ोली ोपाइलीन अथवा पोलीईथाइलीन से बने पाउच अथवा ोली ोिपलाइन अथवा पोलीइथाइलीन से लेिमनेिटड कागज के थैल या जो कृिष िवपणन सलाहकार ारा या साधारण ेणीकरण और िचह्नांकन िनयम के िनयम 11 के अनुसार उसके ारा ािधकृत िकसी अिधकारी ारा अनुमोिदत अन् य िकसी खा ेणी साम ी म की जाएगी ।

(2) पै कग साम ी कीट या फफंूद संदषूण से मुक् त होगी और अन् य िवषैले पदाथर् या अवांछनीय गंध या उत् पाद के सुवास से मुक् त होगी ।

(3) सफेद मूसली की पै कग िविधक माप िवज्ञान (पैकेज की गई वस् तुएं) िनयम, 2011 के उपबंध के अनुसार पैक आकार म अथवा कृिष िवपणन सलाहकार ारा समय-समय पर जारी िकए गए अनुदशे के अनुसार होगी ।

(4) समान लॉट या बैच के छोटे पैक आकार की ेणीकृत साम ी और ेणी को ेणी अिभधान िचह्न के साथ उसके सम् पूणर् ब् यौर के साथ बड़े आधान म पैक िकया जा सकेगा ।

(5) त् येक पैकेज म समान कार की तथा समान ेणी अिभधान की सफेद मूसली होगी ।

(6) त् येक पैकेज उिचत और सुरिक्षत रूप से बंद और मुहरबंद िकया जाएगा तािक िकसी तरह के संदषूण को रोका जा सके।

7. िचह्नाकंन की प ित.—(1) ेणी अिभधान िचह्न त् येक पैकेज पर कृिष िवपणन सलाहकार या साधारण ेणीकरण और िचह्नांकन िनयम 11 के अनुसार, इस िनिमत् त उसके ारा ािधकृत िकसी अिधकारी ारा अनुमोिदत रीित से सुरिक्षत रूप से िचपकाया जाएगा या मुि त िकया जाएगा ।

(2) त् येक पैकेज पर ेणी अिभधान िचह्न के अितिरक् त िनम् निलिखत िविशष् टयां स् पष् टत: पहचाने जाने योग् य रूप म िचह्नांिकत की जाएंगी, अथार्त :-

(क) वस् तु का नाम;

(ख) ेणी;

(ग) िकस् म या व् यवसाय नाम (वैकिल्पक);

(घ) लॉट संख् या;

(ड़) पै कग की तारीख;

(च) पै कग के स् थान का पता;

(छ) शु भार;

(ज) पैकर का नाम और पता;

(झ) अिधकतम खुदरा मूल् य (सभी कर सिहत);

(ञ) मास.............वषर्..............से पूवर् उपभोग के िलए सव त् तम;

(ट) िविधक माप िवज्ञान (पैक की गई वस् तुएं) िनयम, 2011, खा सुरक्षा और मानक अिधिनयम, 2006 (2006 का 34) या तत् समय वृत् त िकसी अन् य िविध के अधीन कृिष िवपणन सलहकार ारा या साधारण ेणीकरण और िचह्नांकन िनयम के अनुसार उसकी ओर से ािधकृत िकसी अिधकारी ारा जारी अनुदशे के अधीन िविन दष् ट कोई अन् य िविशि यां ।

(3) पैकेज पर िचह्नांकन के िलए युक् त स् याही ऐसी होगी जो सफेद मूसली को संदिूषत न करे ।

(4) ािधकृत पैकर, कृिष िवपणन सलाहकार या इस िनिमत् त साधारण ेणीकरण और िचह्नांकन िनयम के िनयम 11 के अनुसार उसके ारा ािधकृत िकसी अिधकारी से पूवर् अनुमोदन अिभ ाप् त करने के पश् चात ेणीकृत पैकज पर अपना िनजी व् यापार िचह्न या व् यापार ांड िचह्नांिकत करेगा । परंतु इन िनयम के अनुसार ेणीकृत पैकेज पर लगाए गए

ेणी अिभधान िचह्न ारा उपदिशत क् वािलटी से िभन् न क् वािलटी उपदिशत न होती हो ।

8 ािधकार माण प की िवशषे शत.—(1) साधारण ेणीकरण और िचह्नांकन िनयम के िनयम 3 के उपिनयम (8) म िविन दष् ट शत के अितिरक् त त् येक ािधकृत पैकर कृिष िवपणन सलाहकार ारा समय-समय पर िविन दष् ट सभी अन् य अनुदशे का पालन करेगा ।

(2) ािधकृत पैकर सफेद मूसली की क् वािलटी का परीक्षण करने के िलए साधारण ेणीकरण और िचह्नांकन िनयम के िनयम 9 के अनुसार, कृिष िवपणन सलाहकार या इस िनिमत् त उसके ारा ािधकृत िकसी अिधकारी ारा अनुमोिदत रसायनज्ञ ारा बंध की जा रही अपनी स् वयं की योगशाला स् थािपत करेगा या िकसी अनुमोिदत राज् य ेणीकरण

योगशाला या सहकारी या एसोिसएशन योगशाला या िनजी वािणिज्यक योगशाला के साथ सम् पकर् करेगा ।

(3) पिरसर को स् वास् थ द और स् वच् छता की दशा के साथ उिचत संवातन तथा अच् छी काश व् यवस् था म रखा जाएगा । इन काय म लगे कािमक का अच् छा स् वास् थ् य होगा और वे िकसी संचारी, संसग या सं ामक रोग से मुक् त ह गे ।

(4) ािधकृत पैकसर् के पास पक् के फशर् वाली स् वास् थ् य द भंडारण सुिवधाएं ह गी और वे कृन् तक और कीट के उत् पीड़न से मुक् त ह गी ।

(5) ािधकृत पैकसर् और अनुमोिदत रसायनज्ञ, परीक्षण, ेणीकरण, पै कग, िचह्नांकन, सीलबंद और अिभलेख के अनुरक्षण संबंधी कृिष िवपणन सलाहकार या साधारण ेणीकरण एवं िचह्नांकन िनयम के अनुसार इस िनिमत् त उसके

ारा ािधकृत िकसी अिधकारी ारा समय-समय पर जारी सभी अनुदशे का अनुपालन करगे ।

1 सफेद मूसली को मानव उपयोग हेतु िलिलयािसया (Liliaceae) पिरवार के क् लोरोपाइटम बोरोिविलयनम एल. (Chloropytum borivilianum L.) पौधे के रूट ूबसर् से अिभ ाप् त िकया जाता ह ै।

2 न् यूनतम अपके्षाएं : (1) सफेद मूसली िनम् न कार की होगी :-

(क) स् वच् छ और शुष् क;

(ख) आकार, आकृित और रंग म एक समान;

(ग) रंग म सफेद;

(घ) श् लेषमक;

(ड़) िमलाय रंजक पदाथर् से मुक् त;

(च) कंृतक के बाल और मल मू से मुक् त;

(छ) जीिवत और मृत कीट और कीट िवखंडन से मुक् त;

(ज) फफंूद या कीट भाव से मुक् त;

(ii) सफेद मूसली के दशेी व् यापार के िलए खा सुरक्षा और मानक(संदषूक, िवषैले पदाथर् और अवशेष) िविनयम, 2011 और खा सुरक्षा और मानक(खा उत् पाद मानक और खा योजक) िविनयम,2011म यथा िन दष् ट अनुसार धाित्वक संदषूक के अवशेषी स् तर , कीटनाशक , नाशीजीव नाशक , जीवाणु संबंधी अपेक्षा , फसल, संदषूक , ाकृितक रूप से उत् पन् न होने वाले िवषैले पदाथर् तथा अन् य खा सुरक्षा संबंधी अपेक्षा के मामले म ितबंध का अनुपालन होगा ।

(iii) सफेद मूसली के मामले म धातु , नाशीजीव दवा की अवशेषी सीमा और कोडेक् स एलीमटेिरयस कमीशन ारा यथा िनधार्िरत खा सुरक्षा अपेक्षा और िनयार्त के दशे की अपेक्षा का अनुपालन होगा ।

4 अन् य अपेक्षाएं :

(I) सफेद मूसली की िस्थित ऐसी समथर् होगी िक -

(क) वह पिरवहन और हथालन की िस्थितय को सहन कर सके; और

(ख) उसे गंतव् य स् थान पर संतोषजनक िस्थित म पहॅु चंाया जा सके;

(II) सफेद मूसली को शुष् क स् थान पर भंडािरत िकया जाएगा तथा उसे स् वच् छ और साफ-सफाई वाली दशा म रखा जाएगा।

स् पष् टीकरण:- सारणी के योजन के िलए :-

(1) िवजातीय पदाथर् से अिभ ेत ह ै(1) ऐसे काबर्िनक पदाथर् से ह ैिजसम क् लोरोफाइटम बोिरिविलयनम एल पादप का पत् ता, तना, भसूी तथा अन् य वनस् पित पदाथर् शािमल होते ह ।

(2) अकाबर्िनक पदाथर् म रेत, िम ी, धूल कण तथा अन् य अकाबर्िनक पदाथर् शािमल होते ह ।

NOTIFICATION

New Delhi, the 10th March, 2017

G.S.R. 231(E).—Whereas, the Safed Musli Grading and Marking Rules, 2017, in exercise of the powers conferred by section 3 of the Agricultural Produce (Grading and Marking) Act, 1937 (1 of 1937) was published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i) vide notification number G.S.R. 505(E), dated the 13th May,2016 inviting objections and suggestions from all persons likely to be affected there by within forty five days from the date on which copies of the said notification published in the Gazette of India were made available to the public;

And, whereas, copies of the said notification were made available to the public on 13th May, 2016;

And, whereas, no objections or suggestions have been received from the public in respect of the said rules;

Now, therefore, in exercise of the powers conferred by section 3 of the Agricultural Produce (Grading and Marking) Act, 1937 (1 of 1937), the Central Government hereby makes the following rules, namely:—

1. Short title, application and commencement.—(1) These rules may be called the Safed Musli Grading and Marking Rules, 2017.

(2) They shall apply to Safed Musli obtained from the root tubers of the plant Chloropytum borivilianum L. of the family Liliaceae.

(3) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.—(1) In these rules, unless the context otherwise requires,-

(a) "Agricultural Marketing Adviser" means the Agricultural Marketing Adviser to the Government of India;

(b) "Authorised packer" means a person or a body of persons who has been granted a Certificate of Authorisation to grade and mark Safed Musli in accordance with the grade standards and procedure provided under these rules;

(c) "Certificate of Authorisation" means a certificate issued under the provisions of the General Grading and Marking Rules, 1988 authorising a person or a body of persons to grade and mark Safed Musli with the grade designation mark;

(d) "General Grading and Marking Rules" means the General Grading and Marking Rules, 1988 made under section 3 of the Agricultural Produce (Grading and Marking) Act, 1937 (1 of 1937);

(e) "Grade designation mark" means the Agmark insignia referred to in rule 5;

(f) "Schedule" means Schedules appended to these rules.

(2) Words and expressions used in these rules and not defined but defined in the Agricultural Produce (Grading and Marking) Act, 1937(1 of 1937) and the General Grading and Marking Rules, 1988 shall have the meanings respectively assigned to them in the said Act and rules.

3. Grade designations.—The grade designations to indicate the quality of Safed Musli shall be as set out in column (1) of the Table in Schedule II.

4. Quality.—For the purposes of these rules, the quality of Safed Musli shall be as specified in Schedule II.

5. Grade designation mark.—The grade designation mark shall be “AGMARK insignia” consisting of a design incorporating the Certificate of Authorisation number, the word "AGMARK", name of commodity and grade designation resembling the design as set out in Schedule I.

6. Method of packing.—(1) Safed Musli shall be packed in new, clean and dry containers made of cloth or poly woven bags with inner lining of food-grade material or pouches made of polypropylene or polyethylene or paper bags laminated with polypropylene or polyethylene or any food grade material as approved by the Agricultural Marketing Adviser or an officer authorised by him in this behalf in accordance with rule 11 of the General Grading and Marking Rules.

(2) The packing material shall be free from insect and fungal infestation and shall not impart any toxic substance or undesirable odour or flavour to the product.

(3) Safed Musli shall be packed in pack sizes as per the provisions of the Legal Metrology (Packaged Commodities) Rules, 2011, or as per instructions issued by the Agricultural Marketing Adviser from time to time.

(4) Graded material of small pack sizes of the same lot or batch and grade may be packed in a master container with complete details thereon along with grade designation mark.

(5) Each package shall contain Safed Musli of the same type and of the same grade designation.

(6) Each package shall be properly and securely closed and sealed so as to preclude any contamination.

7. Method of marking.—(1) The grade designation mark shall be securely affixed to or printed on each package in a manner approved by the Agricultural Marketing Adviser or an officer authorised by him in this behalf in accordance with rule 11 of the General Grading and Marking Rules.

(2) In addition to the grade designation mark, following particulars shall be clearly and indelibly marked on each package, namely :-

(a) Name of the commodity;

(b) Grade;

(c) Variety or trade name (optional);

(d) Lot number;

(e) Date of packing;

(f) Address of the place of packing;

(g) Net weight;

(h) Name and address of the packer;

(i) Maximum retail price (inclusive of all taxes);

(j) Best before__________month______year;

(k) any other particulars as may be specified under the Legal Metrology (Packaged Commodities) Rules, 2011, the Food Safety and Standards Act, 2006 (34 of 2006) or any other law for the time being in force or instructions issued by the Agricultural Marketing Adviser or an officer authorised by him in this behalf in accordance with the General Grading and Marking Rules.

(3) The ink used for marking on packages shall not contaminate the Safed Musli.

(4) The authorised packer, may, after obtaining prior approval of the Agricultural Marketing Adviser or an officer authorised by him in this behalf in accordance with rule 11 of the General Grading and Marking Rules, mark his private trade mark or trade brand on the graded packages which do not indicate quality other than that indicated by the grade designation mark affixed to the graded packages in accordance with these rules.

8. Special conditions of Certificate of Authorisation.—(1) In addition to the conditions specified in the sub-rule (8) of rule 3 of the General Grading and Marking Rules, every authorised packer shall follow all instructions specified by the Agricultural Marketing Adviser from time to time.

(2) The authorised packer shall either set up his own laboratory or have access to an approved State Grading Laboratory or cooperative or association laboratory or a private commercial laboratory manned by a qualified chemist approved by the Agricultural Marketing Adviser or an officer authorised by him in this behalf in accordance with rule 9 of the General Grading and Marking Rules for testing the quality of Safed Musli.

(3) The premises shall be maintained in hygienic and sanitary conditions with proper ventilations and well lighted arrangement and the personnel engaged in these operations shall be in sound health and free from any infectious, contagious or communicable diseases.

(4) The authorised packer shall have storage facilities with pucca floor and free from rodent and insect infestation.

(5) The authorised packer and the aforesaid approved chemist shall comply with all instructions regarding testing, grading, packing, marking, sealing and maintenance of records which may be issued by the Agricultural Marketing Adviser or an officer authorised by him in this behalf in accordance with the General Grading and Marking Rules from time to time.

Schedule II

(Grade designation and quality of Safed Musli)

1. Safed Musli is obtained from the root tubers of the plant Chloropytum borivilianum L. of the family Liliaceae for human consumption.

2. Minimum requirements: (i) Safed Musli shall be –

(a) clean and dry;

(b) uniform in size, shape and colour;

(c) whitish in colour;

(d) mucilaginous;

(e) free from added colouring matter;

(f) free from rodent hair and excreta;

(g) free from living insects, dead insects and insect fragments;

(h) free from fungus infestation and mould growth.

(ii) Safed Musli shall comply with the restrictions in regard to residual levels of metal contaminants, insecticides and pesticides, microbial requirements, crop contaminants, naturally occurring toxic substances and other food safety requirements as specified under the Food Safety and Standards (Contaminants, Toxins and Residues) Regulations, 2011 and the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011, for domestic trade.
