technical statements from experts. It all began in May of 2002 when the
county awarded a contract to ADS. A water supply well was dug below the level of pota-ble water to bring hot water to the surface to power a heat pump to heat the water in the swimming pool at the Okeechobee County Sports Complex. Another well, an injection well, was dug to return used water to the same level it came from in a closed loop. In dealing with injection wells, DEP has strict rules to ensure water from the level below the level of potable water does not mix with potable water. The return well, for some reason, did not take all the water from the source well and began leaking to the sur-face. Since 2002 the county has spent over $290,000 in engineering and drilling expens-es on the injection well, not counting legal fees. Both the county and ADS have received notifi cations of noncompliance from DEP.
At least one previous settlement offer from DEP to ADS involving payment of a fi ne was turned down by ADS.
The current proposed settlement states “no party to the action acknowledges any fault, or liability to the other...” The county would pay $150,000 to ADS and each party would pay their own fees and costs.
Turning to the fi nancial overview, there is good news. Overall, revenues exceed ex-penditures by 17 percent as compared to the budget. However, the general fund and agri-civic enterprise fund have not received the targeted revenues to meet current ex-penditure levels. Therefore the fund balance is being depleted to meet expenses. Staff an-ticipates revenues in the general fund to be about 3.7 percent less than budgeted.
In other action, the board is expected to make appointments to the agri-civic center advisory committee, the library advisory board, planning board/board of adjustments and appeals, Treasure Coast Community Ac-tion Agency Advisory Board, and the con-struction industry licensing board.

account the amount of people dying before age 75, the number of days a person report-ed in poor physical and mental health, and looked at several other factors.
Okeechobee had a large population who did little or no exercising, and had 80 percent report they had few fruits and vegetables in their diet. Over 28 percent of the population was described as obese, the study conclud-ed.
The report also concluded that 7,655 lo-cal residents had no health insurance cov-erage and that the area had a shortage in community health centers and health care professionals.
The report also indicated the area had a status less than favorable in infectious dis-eases like hepatitis A.
The average life expectancy in Okeecho-bee was 74.6 years old. That compared to 76.5 for the nation. Of those surveyed, 22.9 percent reported fair or poor health which compared with the national rate of 17.1 per-cent.
The report also reported that 57 percent of the population had a high school diploma and nine percent had college degrees.
There was also a higher than average rate of adult smoking, 26 percent, binge drinking 16 percent, teenage birth rate, and motor ve-hicle crashes in Okeechobee.
The report found that while injuries ac-counted for 81 percent of the deaths for ages 24 and under, cancer and heart disease ac-counted for 60 percent of the deaths of per-sons between 45 and 64.
The report also indicated that 24 percent of Okeechobee children lived in poverty.
Each county is ranked within the state due to key factors like smoking, obesity, access to primary care providers, rates of violent crimes, air pollution levels, and even liquor store density.
The report is the fi rst time that research-ers have examined the multiple factors that affect health in each county in all 50 states.
The rankings showed that people who live in healthier counties tend to have higher education levels, are more likely to be em-ployed, have access to more health care providers, and have more access to healthier foods, parks and recreational facilities. Wis-consin University Offi cials said the report is designed to mobilize community leaders to take action and invest in programs and policy changes that make their counties healthier places to live. More information on the report can be obtained online at www.countyhealthrankings.org.

around 10:54 p.m. Saturday, Feb. 20, when a bicyclist crossed the road in front of their unmarked unit. Detective Bart Potter and Detective Javier Gonzalez stopped the bicy-clist and told Robert Anthonie Woods that he could not ride the bike after dark since it had no lights.
According to the detectives’ report, as they spoke with Woods he appeared to be very nervous and kept putting his hands in his pockets. Fearing the 21-year-old Woods may have a weapon, Detective Gonzalez be-gan to pat down the bicyclist.
During the pat down Detective Gonzalez reportedly found a brick-shaped substance in Woods’ pocket. When the detective placed Woods under arrest and then hand-cuffed him, Woods pulled away and alleg-edly tried to run. However, Detective Gonza-lez grabbed the hood on Woods’ jacket and pulled him to the ground.
But, the hood then ripped off and Woods got to his feet and fl ed the area on foot, con-tinued the report. The two detectives gave chase but lost Woods when he ran around a mobile home and then into a dark wooded area, stated the report.
That brick-shaped substance allegedly found on Woods was fi eld tested and indi-cated a positive result for the presence of marijuana. The report went on to state that the suspected pot weighed about 116 grams with packaging. As detectives Gonzalez and Potter searched for Woods they walked around a home on N.E. Second St. and no-ticed a man through the a sliding window
that resembled Woods. According to the re-port, he was lighting what appeared to be a smoking pipe.
The report goes on to state that they also heard a woman’s voice as well as the voice of a small child in the home. When they went to the door they not only smelled mari-juana, but also saw a small child.
The report states that the man they saw was not Woods. However, they eventually arrested another man in the home as well as the woman.
Bret N. Sizemore, 18, Okeechobee, was arrested on misdemeanor charges of pos-session of marijuana under 20 grams and possession of drug paraphernalia. He was booked into the Okeechobee County Jail under a bond of $1,500.
The woman, Jessica Mea Eaton, 23, N.E. Second St., was arrested on a felony charge of child abuse. She was booked into the county jail under a bond of $2,500.
As the two detectives continued their search in the 6300 block of N.E. Ninth Lane shortly after midnight, they came upon a small patch of suspected pot plants in an open fi eld. Their report states that they pulled up the 23 plants and turned them over to an evidence custodian for destruc-tion. The plants, added the report, weighed 5.73 ounces with packaging.
Around 4 a.m. Woods, N.E. Second St., entered the sheriff ’s offi ce and surrendered to the detectives. He was charged with the felonies of escape and possession of mari-juana over 20 grams. He was booked into the county jail under a bond of $7,500.
Records indicate that he has been re-leased on bond. As of Monday afternoon, no one has been arrested in connection with the found marijuana plants.

Arrest Report
By Eric KoppOkeechobee News
A man became angered when he was refused service at a local bar and attacked the bar owner with a pool cue, then hit the owner with his truck, according to the sher-iff ’s offi ce reports.
Juan Pedro Zuniga Mesa, 28, S.R. 70 W., Okeechobee, was arrested early Monday, Feb. 22, on felony charges of aggravated battery with a vehicle and three counts of aggravated assault. He was also arrested on misdemeanor charges of battery, leaving the scene of an accident with property damage and criminal mischief.
Although Mesa had been booked into the Okeechobee County Jail, his bond had not been set as of newspaper deadline Tuesday.
An arrest report by Deputy Howard Pick-ering of the Okeechobee County Sheriff ’s Offi ce (OCSO) stated that Mesa went to the Las Palmas Bar, 4026 S.R. 70 W., at 2:13 a.m. Monday and became enraged when he was told the bar was closing and he could not be served alcohol.
Armed with a pool cue, Mesa reportedly went after bar owner Jose Baltazar Vargas and backed him against a wall outside the
bar. When Miguel Juarez Benavides inter-vened, Mesa tried to hit him with the stick, stated the report.
Mr. Benavides was able to get the cue away from Mesa but the enraged man then attacked Mr. Benavides with his fi sts, the re-port continued. Deputy Pickering said Mr. Benavides suffered cuts and bruises from the attack.
The two men were separated and Mr. Be-navides and Mr. Vargas went back inside to clean the bar.
A few minutes later they heard what they thought were gunshots. When they went outside to investigate they reportedly saw Mesa using a pull strap with a hook on an outside door to the bar. At this point, stated Deputy Pickering, Felix Morales came out of the bar and when Mesa saw him he tried to hit Mr. Morales with his pickup truck. How-ever, the vehicle hit Mr. Vargas instead.
Mr. Vargas was allegedly knocked to the ground and reportedly suffered a laceration to his knee.
The vehicle sped away, but was stopped later on S.W. 48th Ave. and the driver placed under arrest, the deputy stated.

An Okeechobee woman entered into a plea agreement with the state and will spend the next nine months under house arrest.
Chenise Victoria Bullard, 19, N.E. 64th Ave., went before Circuit Court Judge Rob-ert Belanger on Wednesday, Feb. 17, and en-tered a plea of no contest to felony charges of dealing in stolen property and giving false information to a pawnbroker.
A charge of grand theft was dropped by the state. Judge Belanger found her guilty on each count and sentenced her to nine months on community control, which will be followed by three years probation. He also ordered her to pay all court costs, as well as restitution to the victim. “Commu-nity control is designed to be punishment,” Judge Belanger told Bullard as he explained the guidelines of house arrest to her.
Bullard was arrested May 23, 2009, in connection with the theft of a large amount
of jewelry from a home. An arrest report by Deputy Arlene Durbin, of the Okeechobee County Sheriff ’s Offi ce (OCSO), indicated the jewelry had an estimated value of $1,941.
During her investigation, Deputy Durbin found pawn tickets from local pawn shops where Bullard had sold various items of jewelry then signed the pawn tickets. She received approximately $650 for the items, the report indicated. While some of the jew-elry was recovered, the deputy’s report said some of the stolen items had already been sent away to be melted down.
In another Wednesday afternoon case, Judge Belanger revoked the probation of Nicki Louise Osceola and sentenced her to serve 9 months in the Okeechobee County Jail as part of a plea agreement.
Osceola, 25, N.E. Knotts Landing Road, Okeechobee, was arrested Jan. 21 on a war-rant charging her with violation of probation - possession of oxycodone. She was given credit for the 30 days she had already spent in the county jail.

Brighton Field Day• The Brighton Seminole Field Day was
really a nice festival. I enjoyed all of the dancers and the costumes.
• The cost of Native American handi-crafts surprised me. I went out there a couple years ago with a group of school kids. The young girls loved looking at the beautiful clothing, but most of the skirts were $300-$400. I wonder if they sell a lot of clothes?
• Those patterned skirts and jackets take hundreds of hours to make. They cut up the cloth into tiny pieces, fi gure out the pat-terns and carefully sew the pieces together. Even if you paid $400 for a skirt, they would probably make less than $2 an hour. They make them because it is their tradition and because they have requests, they do offer some for sale. The baskets are also quite dif-fi cult to make and there is a lot of tradition involved. If I put that much time and care into making something, I doubt I would sell it for any amount of money.
County fair• I sure am looking forward to the
Okeechobee County Fair. My quilt is almost fi nished and I’m going to enter it into the creative skills competition. Who knows, maybe I’ll win some money. Maybe I’ll try my hand at canning too. I enjoy walking through the exhibition tent, looking at the different exhibits. Last year there were all kinds of exhibits that local folks entered, sewing, food, horticulture. There was also a Lego building contest.
• I love county fairs. I never could fi gure out why Okeechobee didn’t have one; it’s a rural tradition. The Legion fair is a different animal altogether; it really is a carnival. The only thing they have in common is that they both have a midway and rides. In the case of the County Fair, the rides are just a means of creating a draw for folks to participate in the exhibits and such.
• The county fair is expensive. Check out the events/prices and days: $5 per person to get in, $20 for one wrist band for the rides, $10 and up to watch an event like the demo-lition derby or the rodeo.
• Looking again at all the fun things to do at the county fair. I noticed that there’s something here that hits close to my heart, as the mother of a soldier, who’s getting ready to deploy again. Friday night, March 12, I can get in FREE if I bring three items for the forgotten soldier outreach program. This is a great cause, sending care packages to our troops serving in the war zones. I also get to see Hotel California for free. I’ll prob-ably eat at home before I go so I don’t spend any money on food at the fair. Monday night ladies get in free. Guitar Hero competition on Tuesday. Students admission is only $2. That is pretty awesome. I know my boys are psyched about this and are putting their team together to compete.
• Last year, I volunteered at the fair and they gave me a free pass. Anyone who is in-terested in volunteering can check out the fair’s web site for more information.
• Looking at the fair’s web site, most of the concerts and shows are included in the gate ticket price. Just the rodeo and demoli-tion derby cost extra.
Speeding tickets• I was happy to see an offi cer pull
someone over for speeding the other day on Southwest Ninth Street. The posted speed limit is 35. I see very few obeying the speed limit. If the county needs money, then PLEASE patrol here. If you are not from this area, the north side of the street is up on a canal bank and children can easily lose control of a bike, scooter, etc. So the cars or trucks would not be able to stop in time. Slow down. Think. Kids do not, but drivers should! SLOW DOWN.
Loud music• I’m wondering how some people get
away with loud music till all hours of the night. There are state laws against it but when you call the sheriffs department all you get is a run around. Law states that if you can hear it 25 feet beyond their car it is a violation. When you can hear the noise half a mile from your home that’s a bit much. Do they have the right to play music? Yes. Do we have the right not to hear it at the level to where it disturbs others? Yes! Let’s stop the madness.

The 38th annual Teacher and School Relat-ed Employee Recognition Banquet turned out to be an emotional night for Yearling Middle School Media Specialist Donna Garcia.
She took home the Teacher of the Year award in front of a large crowd at the Okeechobee High School Cafeteria in an event themed, “An evening of elegance for achieving excellence.”
“I’m thinking I’m very blessed to work here in Okeechobee County. I absolutely love this district and our children. It is truly an honor,” Mrs. Garcia said afterward, “I was very hum-bled. It is defi nitely something I’ll remember for a very long time.”
Mrs. Garcia thanked her school administra-tors, district administrators, and her husband for their support. She said Yearling Middle School means the world to her.
She stated she originally went to college to study law. When one of her professors suggested she take an education class after she presented a legal brief as an assignment for class, she was hooked on becom-ing a teacher.
“It is all about kids and reading and helping them do better. It’s all about help-ing them get through the rough patches. They need someone who will connect
with them and I found that I could do that,” she added.
Mrs. Garcia said her school will be very ex-cited to get their plaque back for the teacher of the year award.
Other teachers nominated this year includ-ed Lori Howard of Central Elementary School,
Linda Robertson of Everglades Elementary, Patricia Keebler of the Exception Student Edu-cation Program, Brad Mims of New Endeavor High School, Tina Suarez of North Elementary School, Kay Duke of the Okeechobee Fresh-man Campus, Jean Sherlock of Okeechobee High School, Magi Cable of Osceola Middle School, Amy Weber of Seminole Elementary School, and Carrie Thompson of South El-ementary School.
Teacher of the Year Committee Members this year included School Board member In-dia Riedel, 2009 winner Vicki Goggans, and Tara Minton. Goggans presented the award to Garcia.
School Board members David Williams and Indian Riedel helped present the awards to the teachers.
School Board member Joe Arnold pre-sented a plaque for the teacher of the year award to Yearling Middle School Principal Andy Brewer.
Mrs. Goggans and the committee visited each of the classrooms of these teachers. She said she was very impressed with the enthusi-asm the students had in these classrooms.
She said Garcia did a good job of creating a connection with her students, “It comes down to a rapport with them. The kids had a love of reading and were happy to be there.”
Pati Canevari served as the hostess for the evening, Pat McCoy and the crowd sang the National Anthem, and the Okeechobee High School Jazz Ensemble entertained the dinner guests. Approximately 350 people attended the banquet.

Cameron and Adam Tewksbury have had their share of bad breaks in the early stages of the 2010 high school baseball season.
Cameron took a no hitter into the seventh inning of Friday’s game at Port St. Lucie but the bullpen couldn’t hold a two-run lead as the Brahmans lost 3-2.
Adam suffered a fi nger injury in last week’s preseason classic and could be lost for three weeks.
Okeechobee appeared set to win their season opener Friday afternoon as Cameron pitched outstanding baseball. His only blem-ish through the fi rst six innings was when he hit CJ Johnston in the third inning.
Okeechobee High School Brahman hit-ters struggled as well against Port St. Lucie starter Edgar Esquivel, who kept his team in the game almost single handedly. He retired the fi rst 10 batters he faced until Mark Weir doubled in the fourth.
Brahman Coach Dylan Tedders said it was a tough loss for his team, but he felt they could learn something from it, “This one is a game you need early to keep you focused. It lets you know that you have to play seven complete innings to win a baseball game.”
Okeechobee scored single runs in the sixth and seventh innings. Aaron Suarez led off the sixth with an infi eld single that
caromed off the pitcher. After a sacrifi ce by Jake Davenport, Weir singled to center fi eld to make it 1-0.
Jonathan Crawford singled in the seventh and scored on a double by Derrius Bauer.
Things looked good on defense as Tewks-bury struck out nine batters through the fi rst six innings. He rarely let a ball get out of the infi eld. St. Lucie hit just two fl y balls to the outfi eld in the fi rst six innings. Jonathan Crawford made a great grab at the fence in left center to rob Tyler Sanchez of a hit in the fourth inning.
Tedders said Cameron had good zip on the ball, had a good curve ball and although on a pitch count, was given some latitude with the no hitter going. Tedders said he ex-pects the Brahmans to do well if Cameron continues to pitch like this.
“The kids will be down. Every loss is bad. We still can take a lot from this. A lot of teaching points can come from a game like this,” he said.
Port St. Lucie began the winning rally as Matt Macedo grounded a base hit up the middle. Crawford relieved Tewksbury and after a pop out by Kyle Romstadt didn’t re-tire a batter. Sanchez singled and Cory Reed was hit by a pitch. A key moment in the game came when Esquivel hit a ground ball to short that could have been a game end-ing double play. The Brahmans misplayed the throw and it ended up in right fi eld. Two runs scored to tie the game. Chris Taylor fol-lowed with a perfect squeeze bunt to the left of the mound. Crawford tried to make a diving catch but was unable to. Reed raced
home from third with the winning run.Tewksbury was philosophical about the
turn of events afterward, “That’s baseball. There’s nothing else to say. It’s a long sea-son. We can just try and come out to do what we’re supposed to do. We won’t quit.
We’ll pick it up and come back out hard next time.”
Okeechobee hosted South Fork on Tues-day night. The boys host Lincoln Park on Friday in their district opener. Friday’s game starts at 7 p.m.

Despite a winless 2009, the fi rst in 30 years at OHS, the Okeechobee Brahman football program is optimistic about their future.
The team’s annual banquet was held Thursday night at the high school. Coach Myron Jackson challenged his players and their parents to rededicate themselves, and make sure they put in time in the weight room and at practice.
“The foundation has been laid for the future. This is my fi rst team. We will be con-nected forever,” he said.
Jackson said the support from the com-munity this year has been unbelievable. He said coming home was very special for him.
“It wasn’t the prettiest picture this year. The picture wasn’t taken on the brightest day. The sun doesn’t always shine. We were a tight group, a little rag tag at times, but we found somebody every week, we came out and played, and played for each other,” he said.
Jackson said the returning players know everything there is to know about playing football at the high school. He does not plan wholesale changes in the defense or in the offense as he will add only one new forma-tion on the offense.
He said the future is bright because only fi ve players graduate. He stated some of the teams Okeechobee played lose between 22 and 29 seniors. He said he has an easy job as most of his positions are fi lled for next year.
Jackson also spoke to the kids about ded-ication to the sport. He said the work they put in now will defi nitely pay dividends in the future.
He said he and the coaching staff are looking forward to having a full season, which includes off season conditioning and spring football, to get the team ready.
In lieu of a most valuable player award, Jackson decided to give out two most im-proved player awards this year. One went to an offensive player, offensive tackle Benja-min Estey, and the defensive award to de-fensive back T.J. Allen.
Coach Jackson said Estey provided the best example of how to work hard and be a team leader this season.
Estey said it was an honor to get the rec-ognition, “I made it everyday to practice and if I didn’t make it I made myself make up for
it. It was an honor to play for this team and give everything I have to it.”
Estey predicted the team will win a few games next year. His goal is to be a team leader, play well, and earn a college football scholarship.
The Brahman award was given to senior Josh McCall. He was one of the two Brah-mans to play in senior all star games this year.
McCall said he felt great when he heard he had won the Brahman award. “It is nice to know you fi nally get something back. I’m happy we set a foundation here. The next couple of years can be successful as long as they keep working hard.”
McCall said he felt great when he played well in the South Central Football All Star Classic in Sebring during December. He said he learned he could keep up with the best.
“I had some questions at fi rst but when I kept up with everybody that was all I could ask for. I just like playing football. I have a blast playing it.”
All athletic trainers, JV players and var-sity players received certifi cates and other awards.
Jackson also handed out special awards to the fi ve senior players who played the entire season for him. They included Allen, Walt Fortner, Josh McCall, Garth Streibel and Justin Conrad.
