MOST RESPECTFULLY SHOWETH ;

1 That the petitioner is the Secretary of the Society toProtect the Constitutional Rights of Sch' Castes and Sch. Tribe

a society registered under the charitable societies Act. Petitioneris entitled under the Ariicle of Associations of the Society tosue and to be sued on behalf of the Society. Petitioner is filingthe above application to implead the petitioner in the above

writ petition in that capacity. The society is tegiaterod in theyear 1983 to protect the interests of the Sch' Castes and Sch'Tribes who are suffering at the hands of so many non-Sch.

Caste and non Soh. Tribe communilies who had, by various

methods, procured the caste names by amending and substitu-'ting Sch. Caste and Tribe names in their basic records like birthcertificate S.S.L.C etc' aud by gbtaining celtificate from theauthorities that they are Sch. Caste or Tribe and usurped thebenefits conferred by the constitutionaland various Acts in the

matter of admission in colleges, professonal and otherwise in

employment in the Government Service etc. under the pretext

that they are of Sch. castes. Many of them merely adopting the

name included in the list of Sch. Caste and Sch' Tribes in the

Sch. castes order 1951 and in thc amendment passod by the

Parliament by Act 10811976 amending Sch' castes and SCh'

Tlibes orders '[976 had obtained admission in Medrcal collego

l. A. S. and other walks of life all over lndia at the expenses

of real SC/ST community. Of late people who are never cate-

gorised as Sch. Castes arrd Sch' Tribes and who were enjoying

of the Government of lndia also. lt is as a result of that the

Government of lndia Sch: Castes Commissioners Report of

ItisonthebasisofthisthatactionwasinitiatedbyC'B'lagainst one l. A. S. officer Mr. Datta who entered service on

the basis of false comrnunity certif icate claiming himself as a

Harijan and got convicted for regorous irnprisonment for twoy"rtt by the Session's Judge of Alipore, Calcutta in October

1982.

While in most of the States such incidents are of stray

nature in Kerala it is being practised on a large scale' Tho

were orders that Thandan other than Ezhavas or Thiyyas were

themselves as Thiyyas or Ezhavas in fundarnental records like

School Register, SSLC Book, Service records and so on wanted

their community to be changed as Thandan other than Ezhavas

in these particular taluks mentioned above. Recant Goverment

order in 1984 has added impetus to this tendency and more

number of people who are Thiyyas oq Ezhavas as per records

like SSLC Book, School register etc' are now coming forwardto change their oommunity to Thandan so that they can avail

all facilrties of reservation and other benefits enjoyed by the

Scheduled Castes.

This Department has no objection in issuing community

certificates to real Thandan but the tendency on the part ofEzhavas or Thiyyas rnainly belonging to Ottapalam, Thalappally

Alathur, Palghat and chittur Tatuks to ehange their cornmunity

to Thandan is really torpedoing the real pulpose and intention

of Government order. I had earl ier laken up this matter in

general with Government in my letter to Director, Kerala State

"Even in the case of castes-tribes retained in the list of Sch

valent in the erstwhile Travancore'Cochi'n area and Malabar

area. But in Travancore-Cochin area there ale also persons

belongingtotheThandancaste'lnMalabarareatherewereonly the iitlu hold"rr. Both are easily distinguishable by their

traditionaloccupation. while the caste of Thandans are coconut

tree ciimbers the title holders of 'Thandan' are really Ezhavas

or Thiyyas. and their traditional occr-ipation is toddy tapping'

The real Thandan do not know toddy tapping' The Tl-randan

community is not available in tlte erstwhile Malabar area' only

Thiyya.lrolding Thandan as title is available. There is no point

is giving any concession norrnally allowed to Sch' Castes to

these peopie. The existinE lists may be amended to that extent

It was to eliminate the bogus clairns a certi{icqte specifying

other than Ezhava or Thiyya was insisted in Malabar area. This

specificatioR was no! insisted in the erstwhile Travancore-Cochin area probably due to the fact that both types of'Thandans' are there and hence the authorities issuing thecertifificate were expected to distinguish the Thandan castefrom the Thandan title holder. As a safeguard to issuing falsecaste certificates in the case of Thandans, it is necessary toimpose the restriction of specifying Thandan other than, Ezhavaor Thiyya in certificates issued in Travancore - Cochin Area. Aslhere are only title holders in Malabar area, the Thandans ofMalabar area need not be considered as Sch. Castes, if theydo not produce dativity certificate of erstwhile Travancore-Cochin atea".

It may also bejnteresting to note that in the census repoftsof 1931.1941 and 1951 1961 & 1971 relating to Palghat areawhich before the formation of Kerala State was formelly underthe Madras Presidency no community caste or race namedThandan has,been rnentioned. The fact is that if such a commu-nity existed it would havb readily found a place in the censusreports (census of lndia 193f volume XIV Madras Part Illmperial and Provincial Tables-Table XVll page 306-Paft I RaceTribe or caste.)

So also in the census of lndia 1941 Volume XIX CochinPart t. Report Part ll Tables relating to Cochin Stateshow ihatthere existed no Thandan Community in the former CochinState.

But the census of lndia 1901 Cochin Chapter Vlll CastesTribe or race-Pages 167,168 and 169 Thandans or Shogansare explalned as here under.

rights of sch. castes ancl sch. tribes I approached the Kerata [-ligh

Court against the oiders of the winding up ol thee nqurinE

When the matter qame up for hearing it was or'rbmitted by

the Government that urgent steps will be taken to get the stay

vacated and that as and when stay is vacated orders will be

issued to proceed. with thq enquiry. But instead of takinE

expertitious steps to get the stay vacatecl Government hastened

to issue the following orders

2 From the very inseption of the constitution various

Goncessions and advantages intended to be given to the mem-

bers of sch. caste & sch. Tribes have regularly been usurped

by other forward cornmuni.ties' The Thandans of Palghat Dist',

who claimed to be Sch' Caste began to usLrp the benefits of

Scholarship, Resorvation and rnany other advantages Gonstitu-

tionaly and legaly due to the Scheduled Caste'
