ONE-YEAR CONTRACTUAL WARRANTY
BABOLAT warrants to the original purchaser that the BABOLAT PLAY (the “Product”) is free from defects in material or workmanship, under normal use for a period of one year from the date of purchase. This warranty is only valid for purchases made directly from authorized BABOLAT dealers. Authorized BABOLAT dealers can be found at www.Babolat.com. BABOLAT will not accept any returns directly from original purchasers. The warranty is nontransferable. This warranty includes sensors. However, BABOLAT does not warrant that the electronic or software operation of the Product will be uninterrupted or error-free, or that all such errors may be corrected. BABOLAT is not responsible for any loss of software programs, data or other information contained on the storage media or any other part of the serviced products. BABOLAT disclaims the provision of or failure to provide support or other services, information, software, and related content through the product. This contractual Warranty does not apply to: (1) protective coatings that are designed to diminish over time, unless failure has occurred due to a defect in materials or workmanship including but not limited to scratches, dents and broken plastic on ports; (2) damage caused by use with another product; (3) damage caused by accident, abuse, misuse, liquid contact, fire, or other external cause; (4) damage caused by operating the Product outside BABOLAT’s published guidelines; (5) Products which had their electronic module housings opened or otherwise tampered with; and (6) defects caused by normal wear and tear or otherwise due to the normal aging of the Product, or if any serial number has been removed or defaced from the Product. (7) consumable parts or accessories, such as batteries and USB cable, unless damage has occurred due to a defect in materials or workmanship.
If the Product is defective, return it with a legible copy of the proof of purchase and a written description of the problem to the place of purchase within one year of the date of purchase. Authorized BABOLAT dealer will then contact BABOLAT to process the warranty return or service. You are responsible for any necessary shipping charges for returned or replaced products. BABOLAT will decide, at its discretion, to repair or replace any product found to be defective. Any replacement under this warranty will only be made with the same or similar product of the same or similar value and will not include cash, credits, or other types of products. BABOLAT strives to provide a timely warranty process and will work to perform its obligations under this warranty within 30 days, under normal conditions, after the warranted product is returned to an authorized BABOLAT dealer as set forth above. This period may be extended if replacement products are out of stock or other unusual circumstances require longer. All repaired or replacement product will be covered for one year from the date of the original purchase. BABOLAT shall not be liable for incidental or consequential damages, during warranty service the contents of the storage media will be deleted and reformatted. If BABOLAT determines that the problem with the Product is not covered under this Contractual Warranty, we will notify you and inform you of service or replacement alternatives that are available to you on a fee basis. Repair or replacement as provi-ded under this warranty is the exclusive remedy of the consumer, except for the warranties contained in this Contractual warranty, BABOLAT makes no other warranty of any kind, express or implied, in fact or by law, whether of merchantabtility, fitness for any particular purpose or otherwise. Your sole and exclusive remedy under this Contractual warranty shall be product repair or replacement as provided herein. In the event of any dispute regarding the Product, the Purchaser and BABOLAT agree to resolve any Claims only by BIN-DING ARBITRATION that must be brought in Denver, Colorado. Such arbitration will be conducted under the Streamlined Arbitration Rules of JAMS. For the purposes of this section, references to “Purchaser” include the original purchaser, their family members, beneficiaries, and assigns, and references to “Claim” shall include any dispute, claim or controversy arising from or relating to: (1) the Product, whether based in contract; tort; fraud; misrepresentation; state or federal statute, regulation, ordinance; or any other legal or equitable theory, and (2) this Contractual Warranty. There shall be no right or authority for any Claims to be arbitrated on a class action basis. This Dispute Resolution agreement is part of a transaction involving interstate commerce and is governed by the Federal Arbitration Act, which governs its enforcement and interpretation.
No other person or company is authorized to change this Contractual Warranty, and your dealer is solely res-ponsible for any other additional warranties. Some states and countries do not allow limitation on consequential damages or how long an implied warranty lasts, or exclusion of all or certain types of damages, so the above limitations may not apply to you. This Contractual Warranty gives you specific legal rights, and you may also have other additional rights, which vary from countries. The foregoing is without prejudice to other legal rights that may arise under applicable national legislation.

BABOLAT garantit à l’acheteur initial que le produit BABOLAT PLAY (ci-après dénommé le « Produit ») est exempt de tous vices de fabrication ou de main d’œuvre, dans le cadre d’un usage normal et pour une période d’un an à compter de la date d’achat. La présente garantie est valable uniquement pour les achats opérés directement auprès des fournisseurs autorisés de BABOLAT. La liste des fournisseurs autorisés de BABOLAT peut être consultée sur www.Babolat.com. BABOLAT n’acceptera aucun retour direct des acheteurs initiaux. La garantie est incessible. La présente garantie porte également sur les capteurs. Toutefois, BABOLAT ne garantit aucunement le fonctionnement ininterrompu ou exempt d’erreurs des applications électroniques ou logicielles du Produit, pas plus qu’elle ne garantit que ces erreurs pourront être corrigées. BABOLAT décline toute responsabilité du fait de la perte de programmes logiciels, de données ou d’autres informations dispo-nibles sur les supports de stockage ou toute autre partie des Produits proposés par nos services. La présente garantie ne s’applique pas aux éléments suivants : (1) revêtements de protection conçus pour diminuer avec le temps, sauf si le dysfonctionnement est dû à un vice de fabrication ou de main d’œuvre, y compris, notamment, les rayures, bosselures et plastique entamés au niveau dlies ports ; (2) dommage causé par l’utilisation d’un autre produit ; (3) dommage causé par un accident, une exploitation abusive, une utilisation incorrecte, un contact avec un liquide, un incendie ou toute autre cause externe ; (4) dommage causé par une utilisation du Produit en violation des directives publiées par BABOLAT ; (5) produits dont les enceintes des modules électroniques sont restées ouvertes ou ont été de toute autre manière altérées ; et (6) défauts causés par l’usure normale ou de toute autre manière par la dégradation normale du Produit ou encore par la suppression ou l’effacement du numéro de série figurant sur le Produit. (7) pièces consommables ou accessoires, tels que batteries et câble USB, sauf si le dommage est dû à un vice de fabrication ou de main d’œuvre.
En cas de défectuosité du Produit, merci de le retourner accompagné d’une copie lisible de la preuve d’achat et d’une description écrite du problème au lieu de l’achat et ce, dans la limite d’un an à compter de la date d’achat. Le fournisseur autorisé de BABOLAT contactera dès lors BABOLAT afin de mettre en œuvre le processus de retour dans le cadre du service de garantie. Vous aurez à votre charge tous les frais d’expédition générés par le retour ou le remplacement des Produits. BABOLAT aura le choix de réparer ou remplacer à sa discrétion ledit produit si il est défectueux. Tout remplacement au titre de la présente garantie donnera uniquement lieu à la mise à disposition d’un Produit identique ou similaire, d’une valeur identique ou similaire, et en aucun cas à la remise d’espèces, à l’octroi de crédits ou de tous autres types de produits. BABOLAT s’efforce de fournir les services couverts par la garantie dans des délais opportuns et exécutera les obligations qui lui incombent en vertu de ladite garantie dans un délai de 30 jours, dans des conditions normales, à compter du retour du produit garanti à l’un des fournisseurs autorisés de BABOLAT, conformément aux modalités susmentionnées. Ce délai pourra être prolongé si les produits de remplacement ne sont pas disponibles en stock ou si des circonstances exceptionnelles l’exigent. L’ensemble des Produits réparés ou remplacés seront couverts par une garantie de un an commençant à courir à compter de la date de l’achat initial. BABOLAT décline toute responsabilité du fait de dommages indirects ou par ricochet ; pendant le service sous garantie, le contenu du support de stockage sera supprimé et reformaté. Si BABOLAT juge que le problème concernant le Produit n’est pas couvert par la présente Garantie contractuelle, elle vous en avisera et vous informera des autres services ou options de remplacement disponibles sur la base d’un paiement à la prestation. Les réparations ou remplacements prévus dans le cadre de cette garantie constituent le recours exclusif du consommateur et, à l’exception des garanties incluses dans la présente garantie contractuelle, BABOLAT n’accorde aucune garantie d’aucune sorte, expresse ou implicite, de fait ou de droit, qu’il s’agisse de la valeur marchande, de l’adéquation à un usage particulier ou de tout autre aspect. Aucune autre personne physique ou morale n’est autorisée à modifier la présente Garantie contractuelle, et votre fournisseur répondra uniquement des garanties supplémentaires éventuelles. BABOLAT nimmt keine Retouren direkt von Erstkäufern entgegen. Die Gewährleistung ist nicht übertragbar. Diese Gewährleistung schließt Sensoren mit ein. Allerdings garantiert BABOLAT nicht, dass die Elektronik oder die Software des Produkts unterbre-chungs- und fehlerfrei funktionieren, oder dass alle diese Fehler korrigiert werden können. (7) Verbrauchsmaterialien oder Zubehörteile wie Batterien und USB-Kabel, es sei denn, der Schaden ist auf einen Material- oder Herstellungsfehler zurückzuführen.
Wenn das Produkt defekt ist, bringen Sie es mit einer lesbaren Kopie des Kaufbelegs und einer schriftlichen Beschreibung des Problems innerhalb eines Jahres ab Kaufdatum ins Geschäft zurück. Zugelassene BABO-LAT- Händler setzen sich dann mit BABOLAT in Verbindung, um die Rückgabe oder Wartung unter Gewährleis-tung zu bearbeiten. Alle erforderlichen Versandkosten für zurückgegebene oder ersetzte Produkte unterliegen Ihrer Verantwortung. BABOLAT wird das genannte Produkt bei Defekt reparieren oder ersetzen. Diese Frist kann verlängert werden, wenn Ersatzprodukte ausverkauft sind oder andere ungewöhnliche Umstände eine längere Frist erforderlich machen. Sie engagieren sich Streitfälle die das Produkt betreffen ausschließlich über einen regionalen Gerichtshof zu regeln.
Keine andere Person und kein anderes Unternehmen sind berechtigt, diese beschränkte Gewährleistung zu ändern, und Ihr Händler ist allein verantwortlich für alle anderen zusätzlichen Gewährleistungen. Il Prodotto difettoso deve essere riportato presso il rivenditore da cui è stato acquistato con una copia leggibile della prova di acquisto ed una descrizione scritta del problema entro un anno dalla data di acquisto. Il rivenditore autorizzato contatterà BABOLAT per effettuare il reso in garanzia o la riparazione. Il cliente si farà carico dei necessari costi di spedizione per i prodotti resi o sostituiti. BABOLAT riparerà o sostituirà, a sua discrezione, i prodotti riconosciuti difettosi. La sostituzione in garanzia sarà effettuata esclusivamente con un prodotto identico o simile, dello stesso valore o di valore analogo; sono esclusi la restituzione di denaro, le note di credito o la fornitura di altri tipi di prodotto. BABOLAT si impegna ad attivare tempestivamente la garanzia e farà in modo di assolvere ai suoi obblighi di garanzia entro 30 giorni, in condizioni normali, dal reso del prodotto presso un rivenditore autorizzato BABOLAT, come sopra indicato. Tale periodo potrà essere protratto qualora i prodotti da sostituire non siano disponibili in magazzino o per altre circostanze inusuali che possano richiedere tempi più lunghi. Il prodotto riparato o sostituito sarà coperto dalla garanzia di un anno dalla data originaria di acquisto. BABOLAT declina ogni responsabilità per danni accidentali o conseguenti e durante l’assistenza in garanzia il contenuto dei supporti di stoccaggio sarà cancellato e riformattato. Se BABOLAT stabilisce che il problema del Prodotto non è coperto dalla Garanzia Contrattuale , il cliente sarà informato delle soluzioni alternative, a pagamento, di riparazione o sostituzione disponibili. Per il cliente la riparazione o la sostituzione in garanzia sono il solo possibile ricorso. Ad esclusione delle garanzie contenute nella presente Garanzia Contrattuale , BABOLAT non fornisce nessun’altra garanzia, di qualsiasi tipo, espressa o implicita, di fatto o di diritto, in termini di commerciabilità, idoneità ad uno scopo particolare o altro. L’unica e sola soluzione di cui dispone il cliente nell’ambito della presente Garanzia Contrattuale è la riparazione o la sostituzione del prodotto, come qui stipulato. In caso di controversia tra le parti, vi obbligate alla risoluzione della stessa unicamente attraverso attraverso la legislazione territoriale.
Nessuna persona o società è autorizzata a modificare la presente Garanzia Contrattuale ; il proprio rivenditore è il solo responsabile di ogni eventuale ulteriore garanzia aggiuntiva. La presente garantía contractual no se aplica a: (1) revestimientos protectores cuyas característi-cas están destinadas a reducirse con el tiempo, salvo si la deficiencia obedece a vicios de fabricación o mano de obra, incluyendo pero no limitándose a rayaduras, abolladuras y roturas en el plástico a nivel de los puertos; (2) daños causados por la utilización con otro producto; (3) daños causados por un accidente, explotación abusiva, utilización inapropiada, contacto con líquido, fuego u otras causas externas; (4) daños derivados de la utilización del Producto en contravención de las pautas publicadas por BABOLAT; (5) productos cuyos alojamientos de los módulos electrónicos hayan sido abiertos o manipulados de algún otro modo; y (6) defectos causados por el desgate o degradación normal del Producto o si se ha eliminado o alterado el número de serie que figuraba en el Producto. (7) piezas consumibles o accesorios, tales como baterías y cable USB, salvo si el daño se ha producido como consecuencia de vicios de fabricación o mano de obra.
Si el Producto es defectuoso, devolverlo junto con una copia legible del comprobante de compra y una des-cripción escrita del problema al lugar de compra en el plazo de un año a partir de la fecha de adquisición. Posteriormente, el distribuidor autorizado se pondrá en contacto con BABOLAT para iniciar el proceso de devolución o mantenimiento en el marco de la garantía. El cliente deberá asumir todos los costes incurridos en el envío de los productos devueltos o sustituidos. BABOLAT tendrá la posibilidad de reparar o remplazar a su discreción el dicho producto si es defectuoso. Las reparaciones o sustituciones estipuladas en este documento constituyen el recurso exclusivo del cliente y, salvo las garantías incluidas en esta garantía contractual, BABOLAT no otorga garantías de ningún otro tipo, expresas o implícitas, de hecho o de derecho, ya sean de comercialización, adecuación para un propósito en particular o demás. BABOLAT gwarantuje pierwotnemu nabywcy, że BABOLAT PLAY (« Produkt ») jest wolny od wad materiałowych i produkcyjnych podczas normalnego użytkowania przez okres jednego roku od daty zakupu. Ni-niejsza gwarancja jest ważna tylko dla zakupów dokonanych bezpośrednio od Autoryzowanych Dystrybutorów firmy Babolat, których można znaleźć na stronie www.babolat.com. BABOLAT nie przyjmuje żadnych zwrotów bezpośrednio od pierwotni nabywcy. Gwarancja nie jest przechodnia. Gwarancja obejmuje czujniki w rakiecie. Żadna inna osoba lub firma nie jest uprawniona do zmiany niniejszej gwarancji, a Twój sprzedawca ponosi wyłączną odpowiedzialność za wszelkie inne dodatkowe gwarancje. Niektóre kraje nie pozwalaja na ogra-niczenia dotyczące szkód wtórnych, długości czasu trwania gwarancji lub wyłączenia niektórych rodzajów uszkodzeń, więc powyższe ograniczenia nie mają wtedy zastosowania. Babolat ručí po dobu jednoho roku od data zakoupení rakety za vady na materiálu či dílenském zpracování pouze tehdy, pokud byla raketa používána běžným způsobem. Tato záruka je platná pouze v případě, že raketa byla zakoupena u autorizovaných Babolat Play dealerů. Autorizované Babolat Play dealery naleznete na www.babolatplay.com. Babolat nepřijímá reklamace přímo od původní kupující. Záruka je nepřenosná. Tato záruka se vztahuje i na měřící senzory. Nicméně Babolat nezaručuje, že elektronické a softwarové díly budou mít neustálý a bezchybný provoz nebo, že všechny chyby mohou být opraveny. Babolat neručí za ztrátu softwa-rového programu, dat nebo jiných informací obsažených na úložném médiu. Babolat se zříká poskytování nebo neschopnosti poskytovat podporu či jiné služby, informace a obsah související s produktem. Pokud je raketa poškozena nebo je nefunkční a je v ochranné lhůtě 1 roku od data zakoupení, reklamujte ji v obchodě, kde jste ji zakoupili. K reklamaci je nutná kopie dokladu o zakoupení a popsání závady. Auto-rizovaný dealer Babolat kontaktuje samotný Babolat ohledně vrácení nebo opravy. Jste zodpovědný za veškeré náklady za dopravu spojené s vrácením či výměnou rakety. BABOLAT opraví nebo nahradí jakýkoli produkt, který dle svého uvážení shledá vadným. Jakákoli náhrada bude provedena stejným nebo podobným produktem, stejné nebo podobné hodnoty. Nelze však vrátit peníze. Na vyřízení reklamace je 30 dní. Tato doba může být prodloužena, pokud vyměňovaný produkt není skladem. Všechny opravené nebo vyměněné produkty mají roční záruku běžící od data zakoupení původního produktu. Babolat nenese zodpovědnost za ztrátu dat z paměti rakety během záručního servisu. Pokud Babolat určí, že na reklamovanou závadu nelze uplatnit záruku, budete o tom vyrozuměn a budete informován o alternativách, které jsou dostupné. Babolat гарантирует первоначальному покупателю, что BABOLAT PLAY ( «Продукт» ) не содержит дефектов материалов или изготовления, при условии нормального использования в течение одного года с даты покупки. Настоящая гарантия действительна только при покупке Продукта непосредственно у авторизованного представителя BABOLAT. Адреса авторизованных дилеров Babolat можно найти на www.Babolat.com. BABOLAT не принимает возвратов непосредственно от оригинальная покупка. Гарантия не подлежит передаче. Эта гарантия включает в себя сенсоры.
