We are extremely relieved that AutoMaidan activist Dmytro Bulatov was found alive, but shocked and outraged at the torture inflicted upon him by his abductors. In order to ensure that it is taken seriously in its efforts to eliminate violence, the Government of Ukraine must take full responsibility for the timely investigation, capture, and prosecution of those responsible for this heinous crime.

We remain deeply concerned by reports of the other 27 missing protesters and continue to urge the Government of Ukraine to find those who are missing and bring the perpetrators of all those who have disappeared to justice. Merkel backs Ukrainian opposition as army warns of war

German Chancellor Angela Merkel has thrown her support behind the Ukrainian opposition and urged President Viktor Yanukovych to deliver on his promises to roll back anti-protest laws.

"We think the opposition`s claims are justified. It should be possible to protest freely. It should be possible to express one`s opinion. And there is, I think, a great need for change in Ukraine," Merkel said Friday (31 January) during a press conference in Berlin.

She was speaking alongside Polish Prime Minister Donald Tusk, who had travelled to the German capital to talk exclusively about the situation in Ukraine, where violence continues and where the army on Friday warned of civil war.

Romanian President Traian Basescu on Friday told press in Berlin that it was the "EU`s failure" not to have recognised that countries that used to be part of the Soviet Union had a different sensitivity to the EU and Nato than former Communist countries such as Poland, parts of the former Yugoslavia or Romania.

"In our countries there was no opposition to Nato and the EU. But in all the Eastern Partnership countries [Ukraine, Moldova, Belarus, Georgia, Azerbaijan and Armenia] there is a sizeable parliamentary and public opposition to euro-atlantic integration," Basescu said.

The Prime Minister of Poland Donald Tusk admitted in a press conference in Berlin that as a neighbouring state, Poland is drafting contingency plans in case civil war breaks out in Ukraine.

"The countries bordering Ukraine, particularly the countries of the Visegrad group [Poland, Hungary, Slovakia and the Czech Republic] are of course preparing for various scenarios," Tusk said.

A team of experts from the four Visegrad countries are also drafting contingency plans for potential interruptions in the gas supplies to Europe which transit Ukraine, he added.

"We are focusing on avoiding such situations, that these contingencies are not needed," Tusk said.

Foreign Policy: White House joins with Congress to take aim at Ukraine

The Obama administration has been fighting with Congress for months, but the two sides are working together to lay the groundwork for punitive new sanctions against Ukraine. 

With the violent political crisis there gathering steam by the day, the administration is working with powerful members of Congress -- including one of their biggest and most vocal critics -- to identify individual members of the Ukrainian government or security forces that could be targeted down the road.

A State Department official said that the administration hasn`t determined whether to implement the sanctions. Still, the fact that punitive measures are even under consideration highlights the administration`s growing disapproval of the violence spreading throughout the Ukraine -- and its potential willingness to act.

"It`s a shot across the bow to those Ukrainian officials who we believe are responsible for the violence," said a congressional aide recently briefed by the State Department, one of the two government agencies that would be involved in any sanctions work.

Kerry says Ukraine`s president must do more to end crisis

BERLIN (Reuters) - U.S. Secretary of State John Kerry said on Friday concessions made by Ukraine`s President Viktor Yanukovich to the opposition were still not sufficient to defuse the country`s political crisis.

Kerry, speaking with German Foreign Minister Frank-Walter Steinmeier during a visit to Berlin, also said "outside powers" should not get involved in a crisis that he said was for the Ukrainian people to resolve.

The offers of President Yanukovich have not yet reached a level that would be sufficient regarding the reforms", Keery said, according to a German translation of his remarks.

Yanukovich has accepted the resignation of his government and has offered an amnesty from prosecution for peaceful protesters, in a gesture towards the demonstrators camped out in Kiev. However, they and the main opposition leaders are pressing on with their protests.

(Reuters) - U.S. Secretary of State John Kerry will meet key Ukrainian opposition figures on Friday on the sidelines of a security conference in Munich, a senior U.S. official said on Thursday, his first meeting with some of the leaders of an anti-government uprising against President Viktor Yanukovich.Washington has welcomed talks in recent days between Yanukovich and the opposition groups to end two months of protests that began when Yanukovich rejected an EU trade deal in favor of closer ties and a financial bailout with Russia.

Human Rights Watch calls for investigation into attacks on journalists in Ukraine. During its ongoing investigation of the government response to protests in Kiev, Human Rights Watch documented 13 cases in which the police beat journalists or medical workers, shot them with rubber bullets, or injured them with stun grenades. Ukrainian nongovernmental groups documented more than 60 such cases. Available evidence suggests that in many cases police deliberately targeted journalists and medics who were not participating in the protests.

International Federation of Journalists launches campaign to protect journalists in Ukraine

in response to the desperate situation, the International Federation of Journalists (IFJ) and the European Federation of Journalists (EFJ) have launched the Ukraine Crisis campaign – #SOS_KIEV - which is calling on the Ukrainian government to respect press freedom and end attacks against journalists in the country.

This campaign page contains updates and analysis about the situation for journalists in Ukraine, information about how affiliates across the world can show their support, and practical guidance for journalists working on the ground such as safety advice and how to apply for the IFJ Safety Fund.

Violence against journalists in Ukraine continues to escalate. The latest figures estimate that over 150 journalists have been injured since the protests in Kiev began, with 42 journalists (view this list) injured in protests in mid-January, while reports abound of journalists being threatened, intimidated and forced to leave the country.

The United States applauds Chairman-in-Office Burkhalter’s efforts to encourage a peaceful solution in Ukraine by offering OSCE expertise, assistance, and mediation.  Sustained international engagement and support will be necessary to help bring about a successful political solution to this crisis.

US State Department calls on Kyiv to set up task force to investigate events

Washington – The U.S. State Department is concerned about the situation in Ukraine, State Department Spokesperson Jen Psaki said at a briefing on Thursday.

Washington looks forward to a peaceful settlement of the political crisis in Ukraine, she said.According to her, U.S. Secretary of State John Kerry expressed his concern about the violation of human rights in Ukraine, as well as the fact that people disappear and die and urged the Ukrainian government to establish a special legal commission to investigate these crimes.

Psaki also stressed that the decision to impose sanctions against representatives of the authorities and the opposition in Ukraine had not been made yet.

The consultations with the Congress do not mean that the decision has been made, she said.As reported, the U.S. administration and congressmen were discussing possible financial sanctions against representatives of the authorities and opposition leaders in Ukraine if violence escalates in the political crisis gripping the country, congressional aides have told reporters.

Can I say that I am glad to be back here in Kyiv. It is always for me a privilege to have the opportunity to meet with you all here. But I would not want anyone to think that in the interim – since the time when I was here last year – that the situation here has been anything other than on the top of our agenda. From my discussions with the Presidents, to the Foreign Affairs Council, in my bilateral talks with Member States and indeed in my contacts with my colleagues across the world, not least in the United States, Canada, other countries. But I have come back in the wake of other visits from colleagues and envoys on my behalf to have an opportunity to talk with people here and to both get my own view and assessment but also to give perhaps some thoughts on the situation. As ever, the European Union does so in the spirit of friendship. This is your country. The country and the future of the country will be determined by the people of Ukraine.

In the course of my discussions today, I have met with civil society people – many young people especially – who are deeply engaged in the discussion on the future of the country. I have to say that I have been very shocked by the reports that many have been giving me on the situation. And of course one of the most important aspects that we need to address is the prevention of violence and intimidation. I am very worried about people who appear to be missing. There is much talk when you discuss this with many people about the concept of people almost being taken hostage. And wherever it comes from, the sense of violence and intimidation, it must stop.

But we have also talked about the future and in discussions elsewhere, including with President Yanukovych, it seems to me that there are very particular points that I just want to mention. The first, as I`ve said, is that it is important, time-critical to stop any sense of violence and intimidation. The dialogue that has happened from time to time needs to become a real dialogue. It seems to me that from looking from the outside, from the information we have, that there is a real opportunity that must be grabbed right now, to get a serious dialogue going between different parties, people, in order to try and address the concerns the people generally have about the future of the country and to bring people together. And I really hope that this will happen – and of course if there are ways in which we can help we are pleased to do so, but this is and must be Ukrainian led, and it is really important that it goes forward.

We are very conscious about what is happening in the Rada, in the Parliament today, and the passing we hope of the Amnesty Law and the importance moving on from that – from the work that is going on – to think about the Constitution and constitutional reforms. We have heard a great deal about that today as well and I think that is important.

And then moving further forward, to think about forthcoming elections, free and fair elections, that will take place in the future and the importance of engagement of those who can help support that process. So these are short and longer term issues that in the course of my discussions have been on the top of the agenda. And as I began, it is always a privilege to be here and I hope that we will see real progress in these coming days.  During his second visit to Kiev today, the President of the European Economic and Social Committee will launch a dialogue EU-Russia-Ukraine and deliver a speech at Maidan on 30/01/2014

Following up on his first visit on 23-25 December last year, the EESC president aims to establish an open dialogue between the civil societies of Ukraine, Russia and the European Union. Taking place on 30 January, the tripartite meeting will gather the presidents of three Committees: Yuri Kulik, president of the National Tripartite Social and Economic Council of Ukraine (NTSEC), Eugenie Velikhov, president of the Civic Chamber of the Russian Federation (Russia) and Henri Malosse, president of the European Economic and Social Committee (EU).

On 21 January, Malosse invited Ruslana Lyzhychko and Oleksiy Honcharuk to a debate during the EESC`s plenary session in Brussels, demonstrating European civil society`s support to its Ukrainian counterpart. This allowed the institutions of the European Union to hear what Ukrainian citizens expect of them. The fruitful debate was followed by a resolution adopted by the Committee of the situation in Ukraine.

U.S. wants new government to meet Ukrainian people`s aspirations for European future

U.S. State Department spokesperson Jen Psaki has put forward the criteria with which, according to the U.S. side, a new Ukrainian government must comply. 

"We have urged the Ukrainian government and the opposition to ensure that the new government is one that fosters political unity, economic health supported by the IMF, and meets the Ukrainian people`s aspirations for a European future," she said at a briefing on Wednesday.

Recalling that U.S. Vice President Joe Biden had recently spoken by phone with Ukrainian President Viktor Yanukovych three times, Psaki said: "It`s been about all of these issues that Vice President Biden expressed are important to move forward on as the [Ukrainian] government looks to what they should do next."

OSCE Chair welcomes steps to de-escalate situation in Ukraine

BERN, 28 January 2014 – The OSCE Chairperson-in-Office, Swiss Foreign Minister Didier Burkhalter welcomed today’s developments in Ukraine and appealed to all sides to remain engaged in political dialogue.“I welcome the steps taken today, such as the revocation of recent legislative amendments,” Burkhalter said. “I hope these steps will help to de-escalate the tensions and bring Ukraine closer to a peaceful resolution of the current crisis by democratic means.”

“I appeal to all sides to stay engaged in efforts to reach necessary compromises in a broad political dialogue. And I urge everyone to refrain from violence and measures which could lead to further escalation of the stand-off and plunge the country into a deeper crisis,” Burkhalter said. VIENNA, 28 January 2014 - OSCE Representative on Freedom of the Media Dunja Mijatović today welcomed the agreement between President Viktor Yanukovych and Ukrainian opposition leaders to repeal recent controversial legislation on public protests, including provisions limiting media freedom. “This is an important step. Ukraine, caught in a tug-of-war for influence between Moscow and Brussels, has been rocked by protests since it walked away from the EU association deal two months ago. On Tuesday, Prime Minister Mykola Azarov resigned and deputies rolled back anti-protest laws to try to defuse the crisis.

Member States are mobilized on good terms with the Commission services to help resolve the crisis .

Our position remains the same, we call for dialogue between Yanukovych and opposition representatives with whom we are in regular contact. Yes, I went to meet members of the opposition in Kiev as well as members of the government.

Thanks to this vigilance, the draconian laws , laws that were taken last week to limit demonstrations, were revoked this morning. This afternoon , the Rada ( Parliament ) session held in Kiev for amnesty demonstrators .

"I am deeply concerned by the situation in Ukraine.

The violence needs to stop and both sides need to reduce the tensions. I am alarmed by reports that the government is planning to declare a state of emergency. This would trigger a further downward spiral for Ukraine which would benefit no-one. I also urge the leaders of the opposition to dissociate themselves from those who resort to violence.

The only solution to the crisis is a political one. What is urgently needed is a genuine dialogue to build a new consensus on the way forward. I hope that the Ukrainian parliament will set a clear path during tomorrow’s session towards a political solution. This must include revoking the package of laws passed on 16 January.

WARSAW, 27 January 2014 – The OSCE Chairperson-in-Office, Swiss Foreign Minister Didier Burkhalter, today met the Director of the OSCE Office for Democratic Institutions and Human Rights (ODIHR), Ambassador Janez Lenarčič, to discuss the situation surrounding anti-government protests in Ukraine, the need for greater efforts to protect human rights defenders, and the Swiss Chairmanship’s priorities in the areas of human rights, democracy and the rule of law.

Burkhalter expressed his concern about the situation in Ukraine and underlined the need to find a political solution, without delay.

“Switzerland, holding the OSCE Chairmanship, has submitted a proposal to Prime Minister Mykola Azarov to take advantage of OSCE tools and instruments in order to facilitate dialogue to defuse the crisis in Ukraine,” he said. “This offer remains open.”

Lenarčič provided the Chairperson-in-Office with further information on a review ODIHR is conducting of a set of amendments passed in Ukraine on 16 January to laws related to public assemblies, among other issues.“The amendments, and the manner in which they were passed, contributed to the tense and, tragically, deadly situation surrounding the demonstrations in Kyiv,” Lenarčič said. “Like all OSCE participating States, Ukraine has committed itself to promote and respect the right to freedom of peaceful assembly. Our Office is reviewing the amendments to determine to what degree they are in line with OSCE commitments.”

The legal review is being carried out following a request by the Committee on Human Rights, National Minorities and Interethnic Relations of the Verkhovna Rada – Ukraine’s parliament – and will be published in early February.

Burkhalter also underlined the value of independent institutions within the OSCE.

“The Swiss Chairmanship attaches great importance to reviewing and improving the implementation of existing OSCE commitments on human rights,” he said. “Combatting torture, the respect for minority rights, promoting democratic elections and strengthening the rule of law in combatting terrorism will be at the forefront of the 2014 Swiss Chairmanship.

Foreign Minister Steinmeier on the situation inUkraine: remaining chances of political solution not yet exhausted

Foreign Minister Steinmeier issued the following statement inBerlintoday (26 January) on the situation inUkraine:

As we can see in the televised images emerging from Kyiv and many other parts of Ukraine on a daily basis, the situation is not just tense; it is really serious. The next few days could decide in what direction Ukraine is going to take its future.

There is in my view only one thing we can advise from here, namely that Ukraine’s road to an autonomously determined future will definitely not be reached via violence, whosoever perpetrates it. It is my belief that, however difficult the situation may be, the last remaining chances of a political solution have not yet been exhausted. They need to be sought.

There are clear ways of starting that search, as I see things: the proposals for stricter laws on restricting political options for parties and individuals, which fly in the face of all Ukraine’s regulations, need to be brought back to the table – they need to be withdrawn or at least fundamentally altered.

The Verkhovna Rada, the Ukrainian parliament, will convene on Tuesday coming. That will be an opportunity for Ukraine’s political leaders to demonstrate sincerity in their offers to the Opposition.

We are in close contact with representatives of both sides, members of the Opposition as well as members of the Government. I will be engaged in further talks this afternoon. We are liaising closely with Catherine Ashton and those working on behalf of the European Union to try and prevent further deterioration.

Refrain from violence and make every effort to seek a political solution – that, I believe, is what needs to be done at this time.

Press release of the Delegation of the European Union to Ukraine

EU monitors ongoing trials connected to the current political crisis

Representatives of the EU and its member states have been present as observers in numerous judicial hearings concerning Ukrainian citizens detained in connection with the ongoing political crisis. In particular, we have been observing the habeas corpus proceedings that authorised the 60-day pre-trial detention of several demonstrators. Many of these persons had signs of having suffered severe beating, and gave detailed accounts of torture and inhuman and degrading treatment.

In present circumstances, we have noticed that some Kyiv Courts are working at full capacity, with hearings ongoing till late night hours. It is however important that judicial decisions are adopted on a case-by-case basis in a reasoned, motivated and transparent way, in line with the European Convention on Human Rights and other international obligations of Ukraine. As the Ukrainian Code of Criminal Procedure configures pre-trial detention as an exceptional and subsidiary measure, it is a legitimate social expectation that judicial decisions sufficiently explain and prove the necessity of pre-trial detention versus other alternatives, such as house arrest or release on bail. In a system based on the rule of law, respect of fundamental rights cannot be made conditional on political negotiations.

Considering the high social resonance of these judicial hearings, we deeply regret that representatives of the media have not been allowed to observe and conduct video and audio recordings of these public hearings, a possibility foreseen under Ukrainian law, and encourage Ukrainian authorities to take measures to ensure full transparency in the future. Ukrainian judges have an important responsibility to contribute, through fair trial and independent decision-making, to the resolution of the current crisis.

Donald Tusk fears political crisis in Ukraine can split the country

Prime Minister of Poland Donald Tusk has said the actions of President of Ukraine Viktor Yanukovych and his team throw into question the unity of the state.

"We have no doubt that the administration of President Yanukovych and his behavior have led to this critical moment, when the unity of the Ukrainian state is in question," Polish Radio UNN quotes Tusk as saying on Friday.

The premier stressed that Poland will demonstrate further support of Ukraine`s European choice, but "Ukrainians waiting for the long march."

Poland`s security also depends on peace in Ukraine, he said.

"Ukraine as a rich and peaceful neighbor - this condition is necessary for Poland for our sense of security. Ukraine, divided by internal struggle, and internally divided, sooner or later, would mean a very serious problem for the whole region, not only for the Ukrainians," he said

Harper to call for emergency debate on Ukraine - PM concerned about escalating violence

Prime Minister Stephen Harper will call for an emergency debate on the turmoil in Ukraine when Parliament resumes next week.

"We understand that this violence is occurring because the majority of the population is very worried about the steps taken by their government that very much remind them of their anti-democratic and Soviet past," Harper told reporters on his plane returning from Jordan on Saturday.

"The government of Canada very much shares the concern of the majority of the Ukrainian people,"when it comes to the "growing political conflict and violence," he said in a statement. 

Two Conservative MPs, Ted Opitz and James Bezan, have asked for an emergency debate in the House of Commons, which Harper says his government supports.

Harper took no questions but added, "We will continue to work with our allies and partners to determine what the necessary and the appropriate response to all this should be." 

Anti-government protesters in Ukraine were once again clashing with police on Saturday in the capital, Kyiv. The unrest has spread to many other cities in the country, despite the promise of government concessions.

On Friday, President Viktor Yanukovych promised amnesty to detained activists and a change to harsh anti-protests laws, according to news agencies in Ukraine.

Kiev (25 January) – “I visited Ukraine on behalf of President of the European Commission Jose Manuel Barroso and High Representative/ Vice-President Catherine Ashton on Friday and Saturday. 

To underline that the EU remains engaged in facilitating a peaceful, negotiated solution out of the crisis, I held talks with President Viktor Yanukovych, leaders of the opposition party Batkivshchyna Arseniy Yatsenyuk, of the party Udar Vitali Klitchko and party Svoboda Oleh Tyahnybok as well as with representatives of the civil society. I have also visited the Maidan square and talked to people there.

In my talks I conveyed deep concerns of the EU about the latest developments and underlined the need to end the cycle of violence, to fight against impunity of perpetrators of human rights violations and to continue an inclusive national dialogue to find a way out of the crisis that threatens to further destabilise the country.

My talks in Kiev showed the need for a series of concrete steps to first start to rebuild trust of people by stopping the spiral of violence and intimidation, to be complemented in a second stage by an inclusive political process leading the stability in Ukraine.

I stressed to my Ukrainian partners that the EU would remain engaged in this process assisting them in de-escalating the situation and finding a way out of the crisis, as demonstrated by the scheduled visit of High Representative/Vice-President Cathy Ashton to Kiev next week.

VIENNA / DAVOS, 24 January 2014 - OSCE Chairperson-in-Office, Swiss Foreign Minister Didier Burkhalter and Ukraine Prime Minister Mykola Azarov have today discussed ways the Organization could help to resolve the crisis in Ukraine.

In a meeting on the margins of the Davos World Economic Forum, Burkhalter proposed that the OSCE, of which Ukraine is a member, could offer its expertise to facilitate dialogue between the government and opposition, and offered  a range of possible activities over the mid- to long-term, such as election support. At the same time, Burkhalter welcomed the request sent to the OSCE Office for Democratic Institutions and Human Rights (ODIHR) by the Committee on Human Rights, National Minorities and Interethnic Relations of the Ukrainian Parliament, the Verkhovna Rada, for a review of the compatibility of the new laws with Ukraine’s OSCE commitments.

Human rights activists call on to end violence

Peaceful protest rallies involving millions of Ukrainians are going on for almost two months. The ruling regime demonstrated total indifference to the protestors’ demands and exercised repressions against them. On January 16, 2014, the parliamentary majority gave full absolution to the law enforcement who committed crimes against peaceful demonstrators by passing laws that practically prevent any form of peaceful protest, dissent and virtually destroy the civil society. These actions clearly demonstrated to the people that the ruling regime does not understand any arguments except force. And this regime will inevitably face a powerful rebuff on the part of the citizens.

These actions provoked radicalization of protests and, eventually, led to the tragic events on Hrushevsky street on January 19 - 22, 2014. More victims will lead to the spread of radical sentiment, involve a growing number of people in the orbit of a violent confrontation with a growing number of dead and injured. Today the main objective is to prevent new victims. And the only opportunity to do this is to start a dialogue. But if the ruling regime continues to act as it did for two months, it will block the path to any dialogue.

People have lost trust in any promises and guarantees of the regime. Therefore, dialogue is only possible upon condition of some preliminary actions on the part of the President, which will provide grounds for the beginning of such dialogue. Therefore, it is urgently needed:

to revoke the repressive laws of January 16;

to dismiss the Minister of Interior Vitaliy Zakharchenko;

to revoke the law indemnifying those guilty of acts of violence during the protests and conduct thorough investigation of the events of the nights of November 30, 2013 and December 1, 2013, as well as other crimes connected with persecution of the participants of peaceful assemblies.

It is also necessary to stop violence and any preparations for the use of violence for the period of negotiations.

Today, the chance for a peaceful resolution of the crisis has not been lost yet.

EU High Representative for Foreign Affairs and Security Policy and European Commission Vice-President Catherine Ashton is to visit Kyiv next week, European Commission spokesperson Olivier Bailly said at a press conference in Brussels on Thursday.

He said that European Commission President Jose Manuel Barroso had announced this during a phone conversation with Ukrainian President Viktor Yanukovych.

Human Rights Council head urgest Ukraine to set free Russian reporter

Ukrainian authorities should release Russian journalist Andrei Kiselyov, who has been taken into custody in Kyiv, head of the Russian president`s Human Rights Council Mikhail Fedotov said.

"The Council is seriously concerned about this situation; it requests that the Ukrainian authorities conduct an immediate inquiry, that they release [the reporter], apologize and provide him with the required medical assistance," Fedotov said at a Council meeting on Thursday.

In his words, those responsible for the detention of the journalists must be punished.

Reports on the detention of Lenta.ru online edition journalist Andrei Kiselyov in Kyiv, where clashes between the opposition and the police had been on for several days, were posted on Thursday.

According to a report posted on the Lenta.ru homepage, Kiselyov was covering the disturbances in the Ukrainian capital city.

The report said he was seized by officers of the Ukrainian Interior Ministry`s Berkut special purpose unit in the morning of January 23. It also said Kiselyov was beaten in the course of his detention.

OSCE Chair calls for restraint by all sides in Ukraine

OSCE Chairperson-in-Office, Swiss Foreign Minister Didier Burkhalter today expressed his deep concern about the situation in Ukraine, appealing to all parties to refrain from violence and engage in peaceful dialogue as a necessary first step towards resolving the ongoing crisis.

“I urge all sides to refrain from violence and to seek to stabilize the situation through dialogue involving all parties,” said Burkhalter. “I am deeply concerned about the reported casualties and my thoughts are with the families of the dead and injured”, he continued. “As Chairmanship of the OSCE, Switzerland is ready to assist Ukraine to find a peaceful political way out of this crisis.”

Burkhalter said: “We call upon the Ukrainian authorities to do their utmost to prevent further escalation of tensions, carry out investigations promptly, and bring those responsible for the casualties and violence to justice.”

Burkhalter said: “The OSCE has the necessary tools and the mechanisms to act as an impartial broker in such situations, and it is ready to support the Ukrainian authorities in order to lower tensions and prevent further escalation.”

Attacks on journalists must stop, says OSCE media freedom representative, offers to visit Ukraine

OSCE Representative on Freedom of the Media Dunja Mijatović today called on the Ukrainian authorities to halt the violence against media and thoroughly investigate all incidents involving journalists.

“I am especially alarmed that most of the journalists received injuries from stun grenades and rubber bullets used by the police during recent events,” Mijatović said in a letter to Foreign Minister Leonid Kozhara. “In some cases, journalists reportedly were specifically targeted by the law enforcement despite clear identification as members of the media.”

According to reports, the cases of violence against members of the media are increasing and more than 30 journalists from various media outlets, including Novaya Gazeta, Vesti, Spilno TV, Radio Svoboda, 1+1, 5 Kanal and many others, were severely injured while fulfilling their professional duties covering public protests in Kyiv.

“Journalists’ safety must be guaranteed at all times and those responsible for the crimes against journalists must be brought to justice to prevent an environment of intimidation, fear and impunity,” Mijatović said.

Mijatović expressed her readiness to visit Kyiv to help the authorities find ways to reverse this disturbing trend.

The United States strongly condemns the increasing violence on the streets of Kyiv, which has led to casualties and the shooting deaths of two protesters.  We urge all sides to immediately de-escalate the situation and refrain from violence.  Increased tensions in Ukraine are a direct consequence of the Ukrainian government’s failure to engage in real dialogue and the passage of anti-democratic legislation on January 16.  However, the aggressive actions of members of extreme-right group Pravy Sektor are not acceptable and are inflaming conditions on the streets and undermining the efforts of peaceful protestors.  We likewise deplore violence by unofficial groups known as “titushki.” We also condemn the targeted attacks against journalists and peaceful protestors, including detentions.  The Maidan movement has been defined by a spirit of non-violence that we strongly support.  We urge the Government of Ukraine to take steps that represent a better way forward for Ukraine, including repeal of the anti-democratic legislation and beginning a national dialogue with the political opposition.  The United States has already revoked visas of several people responsible for violence, and will continue to consider additional steps in response to the use of violence by any actors.

Foreign Ministers of Poland and Ukraine speak on the phone

Poland’s Foreign Minister Radosław Sikorski and his Ukrainian counterpart, Leonid Kozhara, spoke on the phone today about the escalation of the situation in Kyiv.

Poland’s top diplomat expressed his deep concern over the violent turn of events in Ukraine and appealed for a sincere dialogue between the authorities and the opposition. Ukraine’s minister presented his assessment of the tragic turn of events leading to deaths during clashes between the police and demonstrators. “We are ready to start a dialogue. We have been taking appropriate actions to bring the situation under control and to reduce the tension,” said Leonid Kozhara.

Radosław Sikorski reiterated that Poland believes “the best guarantee of Ukrainian independence and its future prosperity” is the EU-Ukraine Association Agreement, which Kyiv declined to sign last year. Minister Sikorski warned that further escalation of the tension and violence could distance Ukraine from the EU forever.

Shortly after Poland’s and Ukraine’s foreign ministers held their telephone conversation, Ukraine’s Ambassador to Poland, Markiyan Malski, was called to the Polish MFA. MFA Undersecretary of State Pełczyńska-Nałęcz informed him of Poland’s position on the situation. During their talk, the Polish side expressed its deep concern over the procedure used by Ukraine to adopt new laws and their provisions aimed at restricting civil liberties.

Minister Pełczyńska-Nałęcz said she hoped Ukraine will refrain from further measures that move the country further away from the European Union. She also noted that the violent clashes may have to do with the recently adopted and implemented laws.

German Foreign Minister Frank-Walter Steinmeier is shocked by the news of the deaths of demonstrators in Kyiv and once again calls upon the parties to the conflict in Ukraine to refrain from violence.

He told this to reporters at the Geneva 2 talks on Syria in Montreux, Switzerland.

"Awful pictures came from the Ukrainian capital last night. And the news of the deaths this morning have been stunning. We appeal to both sides: violence will not solve the problem," he said.

Steinmeier urged the Ukrainian leadership to refrain from "coercive methods, which can lead to new victims." "The government must protect peaceful demonstrators," he emphasized.

Statement of the Ukrainian Human Rights Organizations

The Draft Law of Ukraine # 3879 that was passed into law on January 16, 2014 and urgently signed by the President shows that Ukraine has entered an era of reaction and obscurantism.

This law was passed in violation of procedures for drafting, expert evaluation and review by legislative authorities. The law blatantly violates the fundamental freedoms of conscience, opinion, expression, information, assembly, association, movement, property rights and the right to privacy, thereby ignoring relevant constitutional provisions and articles of the UN International Covenant on Civil and Political Rights and the Convention for the Protection of Human Rights and Fundamental Freedoms, as well as the Article # 22 of the Constitution of Ukraine.

It is worth mentioning that this law has entered the term ‘foreign agent’ into modern Ukrainian law vocabulary. Those NGOs that ‘receive funds or other assets from ‘foreign’ sources and participate in political activity in Ukraine, including such participation in the interests of foreign sources’, fall under this category.

Simple linguistic and legal analyses of the latter sentence, which provides the legal definition of the term ‘foreign agent’, suggests that from now on any NGO that receives any kind of grants or other financial support from foreign foundations, embassies, organizations or individual, shall acquire this new discriminating status. The new law binds such NGOs to register, and introduces sanctions for evasion of such registration.

We believe that this law violates the most important principle of constitutional law and order - the rule of law - and violates constitutional rights of Ukrainian citizens and persons without citizenship living in Ukraine.

The term ‘foreign agent’ by itself has a negative meaning and stigmatizes those whom it applies to, as it portrays them as a potential threat, exposing such organization to the risk of potential aggressive social ostracism, expulsion and destruction.

Let us face the truth – this means that the ruling regime declared war against civil society.

Therefore, we hereby declare that we are not going to sign a pact of surrender in the war that we have not started. We will never accept that the authorities force us into social ghettos and hang signs saying ‘foreign agents’ around our necks - just as the Nazis marked the Jewish people with the yellow Star of David during the World War II.

We declare that, in our case, to accept this status of ‘foreign agent’ means to insult the memory of our great predecessors - Oleksa Tykhyi, Yuriy Lytvyn, Valeriy Marchenko, Vasyl Stus, V’yacheslav Chornovil - who gave their lives fighting for the human rights in Ukraine.

We understand the underlying motivation of these obscurantist actions of the ruling regime – being in a state of panic as they are in the face of the organized mass social protests, at any cost, they want to preserve their

privileges in the neo-feudalistic system of power and property distribution that they have established  over the last three years.

All these foolish and short-sighted actions of the ruling regime have only one goal - to win the election of 2015. Therefore, this regime mobilized criminal forces to fight EuroMaidan and enlisted organizations with ‘Black Hundred’-style pogrom ideology. Today, these robbers of the Ukrainian society are targeting civic organizations that create jobs without getting any funds from the state budget and produce a significant share of gross domestic product.

Therefore, Ukrainian society will be forced to adopt new forms of non-violent resistance.

Protestants die because of the arbitrary behavior of the police forces

International human rights protection organization Amnesty International considers the death of people who protested against the government to be the consequence of the arbitrary behavior of police forces during the mass actions.

The organization states, “Law enforcement officers who resort to the excessive use of force should be held responsible for that. We have repeatedly called Ukrainian authorities to bring perpetrators to responsibility. Today’s unlawful violence of the police has caused at least one death. What else should happen for the police officers to be held accountable for the human rights violations?”

Amnesty International highlights that law enforcement officers are allowed to use the shotgun only in cases when it is absolutely necessary in order to prevent the direct threat to life or cause life-threatening injuries.

The organization states that the impunity of the officers of the law enforcement agencies in Ukraine is a huge problem. The decision to allow the use of the shotgun in such context is of a great concern. 

Amnesty International thinks that if the representatives of the Ukrainian authorities are indeed interested in peaceful settlement of the long-lasting political crises in the country, they should respect human rights and not wish to withdraw or limit them by means of adopting radical legislation, destructing the peaceful protests and allowing militia to use the shotgun without any responsibility.

EU actions on Ukraine insufficient, sanctions to be considered if situation worsens - Linkevicius

Lithuanian Foreign Minister Linas Linkevicius has said he believes that the EU`s measures in relation to Ukraine due to the worsening political crisis are insufficient and does not rule out that Brussels will impose sanctions if the situation deteriorates.

He said in an interview with Interfax-Ukraine that relations between Kyiv and Brussels were not the same as before.

"Our relations cannot remain the same. Confidence has fallen, and there is serious disappointment at the non-observance of commitments," Linkevicius said.

He also criticized the position currently adopted by Brussels with regard to Kyiv.

"In my opinion, our measures are not effective, we could have done more. Sometimes words are not enough, and actions are needed. I will not go into detail. But I cannot look indifferently at the people who have been standing in the cold for two months with flags of the EU and with hope for the future. It`s necessary to help. More concrete measures are needed, and I think that we will come to it if we do not see improvement," Linkevicius said.

He also said that "more concrete measures" concern sanctions.

"If force is used against peaceful demonstrators, there will be consequences. I would not rule out that the issue of sanctions would be discussed in this case. Now it`s not on the agenda, but I would not exclude that in future," Linkevicius said.

He also said that the EU intends to regularly discuss the situation in Ukraine. The next discussion at the level of EU foreign ministers will be held at a meeting of the EU Foreign Affairs Council in February, he said.

"We will return to this issue in February and will regularly return to it, making conclusions about how effective the measures we use are," Linkevicius said.

"No at any form of repression toward the EuroMaidan protest movement in Kiev "asks the EESC 

By inviting two personalities of the EuroMaidan protest movement, the EESC President, Henri Malosse, confirmed the strong support of the European civil society while the Ukrainian Parliament has restricted the legislative framework of the right to protest. Ruslana Lyzhychko, an emblematic figure of the EuroMaidan and Oleksiy Honcharuk, a spokesperson for the movement, discussed with representatives of European civil society the expectations of protesters towards Europe, at the European Economic and Social Committee (EESC) on 21 January 2014.

In December, an EESC delegation led by its president Henri Malosse travelled to Kiev to meet with those protesting against the postponing of the signature of the Association Agreement with the European Union and to understand their expectations. The EESC plenary session was an opportunity to bring the voice of the Ukrainian people to Brussels. "It is the civil society which is in the street today”, declared Henri Malosse. “This mobilization of the Ukrainian people is crucial and historic. Europe must not miss this appointment."

The fact the Ukrainian Parliament has restricted the framework of the right to protest is a worrying sign while the protest has lasted for several months. Right now, it is essential that the EU formally commits to opposing any repression that may be led against this movement.

For Ruslana Lyzhychko, the European and Euro-Atlantic integration is a positive step because it would involve democratic principles and genuine involvement of civil society. "Europe can and must do more”, she said. We expect of it more than just diplomatic support, but real concrete actions to help the Ukrainian people." Among these were mentioned a visa-free regime between the EU and Ukraine, the prospect of accession to the EU, etc.

In December 2013, the EESC President wished that the European perspective allows to strengthen ties between Ukraine and its neighbours: "Choosing Europe does not mean choosing between Brussels and Moscow. This is a process of adhering to values such as democracy, tolerance and respect for others."

CoR President in Kiev to reaffirm local and regional authorities` support for Ukraine`s European integration

The President of the EU`s Committee of the Regions (CoR), Ramón Luis Valcárcel Siso, together with representatives of all political groups in the CoR, will meet on 23 January with regional and local authorities in Ukraine to make a plea that the country remains on the path to European integration.

"For many people in Ukraine, European integration is more than a commercial agreement or a simple piece of paper: it represents a vision for the future, a project offering Ukrainians a perspective of stability, peace, democracy, solidarity and respect for their rights and freedoms", stressed President Valcárcel ahead of the meeting. He added: "In the current situation, Ukrainian civil society needs more than ever the support of the European Union. We need to keep all channels of dialogue open at all levels of government, encourage Ukraine`s government to achieve its declared objective of European integration and reiterate that the EU-Ukraine Association Agreement is still possible".

In this context, the CoR President echoed the EU`s concerns over recent legislation which restricts Ukrainian citizens` fundamental rights, including controls on the rights of assembly and on the freedom of speech and media.

He has also recalled the need to promote local and regional government autonomy and financial independence in the Ukraine as a means to achieve much needed democratic reform.

The CoR delegation will be meeting with Ukrainian members of the Conference of the Regional and Local Authorities for the Eastern Partnership (CORLEAP), as well as representatives of Ukrainian regions and cities` associations. The delegation will recall the conclusions of the last Eastern Partnership Summit in Vilnius which provide a platform for cooperation between local and regional authorities and explicitly recognises the role of local democracy in the Eastern Partnership.

The delegation will also meet government representatives, including the Vice Prime Minister, the minister for regional development and the secretary of state in charge of the relations with the EU, to present the CoR`s views and to explore how local and regional government can play a positive role in facilitating the ties between Ukraine and the EU.

The CoR delegation is also due to meet with Evgeniya Tymoshenko, daughter of the former Ukrainian Prime Minister currently still imprisoned.

Estonia and Other EU Foreign Ministers Express Concern about Developments in Ukraine

Today in Brussels, the foreign ministers of the European Union member states expressed grave concern about the legal acts approved by the Ukrainian government on 16 January, which groundlessly restrict the fundamental rights of citizens and greatly curtail the activities of civil society as well as the media and press. “The adoption of these changes into law threatens efforts to solve the political crisis in Ukraine with democratic measures and is in opposition with the state’s international obligations,” stated Foreign Minister Paet.

According to Foreign Minister Paet, the foreign policy heads of the European Union member states expressed concern about the violence between security forces and demonstrators in Kiev. “The rushed adoption of laws in Ukraine certainly won’t help to improve the current situation but are likely to cause an even larger conflict in Ukrainian society,” he stressed.

Paet added that, in the current situation, the sides have to exhibit restraint and the Ukrainian authorities must respect and defend not only the right of peaceful demonstrators to assemble but also the freedoms of speech and of the press.

The European Union foreign policy heads called on all sides to find a democratic solution to the political crisis which corresponds to the expectations of the Ukrainian people, and ensure that the legal changes are brought into accordance with Ukraine’s international obligations.

Israeli embassy urges Ukraine government to prevent attacks on Jews in Kyiv

The Israeli embassy in Ukraine is deeply concerned about recent attacks on members of the Jewish community in Kyiv.

"We urge the Ukrainian government to thoroughly investigate the incidents, find the assailants and bring them to justice," the Israeli embassy said on Monday.

Israel highly appraises the Ukrainian government`s fight against anti-Semitism and hopes that it will strongly condemn and prevent such attacks, it said.

The Jewish Kyiv portal reported earlier that a Yeshiva student was seriously wounded near the synagogue in the neighborhood of Podol in Kyiv on Friday evening. He was attacked and savagely beaten when he was returning home from synagogue. A Yeshiva teacher of the same synagogue was beaten up by three masked assailants on January 10.

Foreign Affairs Council Meeting

The Council adopted the following conclusions: 

1. Recalling the statement of HR Ashton of 17 January 2014, the Council expresses deep concern about the legislation passed by the Verkhovna Rada on 16 January under doubtful procedural circumstances. These legislative acts would significantly restrict the Ukrainian citizens` fundamental rights of association, media and the press, and seriously curtail the activities of civil society organisations. The EU calls on the Ukrainian authorities to ensure that these developments are reversed and that its legislation is brought in line with Ukraine`s European and international commitments. 

2. The EU is very concerned about recent developments in Ukraine and urges all actors to seek through an inclusive dialogue a democratic solution to the current political crisis that would meet the aspirations of the Ukrainian people. It calls on all actors to exercise restraint and on the authorities to fully respect and protect the peaceful demonstrators` right to assembly and speech, and the freedom of the press. All acts of violence must be duly investigated and those responsible brought to justice.

3. Recalling the Council`s Conclusions of 10 December 2012, the EU remains committed to Ukraine`s political association and economic integration, based on the respect for common values, and to signing the Association Agreement with its Deep and Comprehensive Free Trade Area, as soon as Ukraine is ready.

EU Foreign Affairs Council to discuss situation in Ukraine – Ashton

The EU Foreign Affairs Council will discuss the situation in Ukraine at a meeting on Monday, EU High Representative for Foreign Affairs and Security Policy Catherine Ashton has said.

"I`ve been following very closely the events in Ukraine in the last few days. I see that President [Viktor] Yanukovych is going to be talking today with opposition leaders. I hope that that is a positive move forward," she told reporters in Brussels on Monday.

As reported, Ukrainian President Viktor Yanukovych instructed National Security and Defense Council Secretary Andriy Kliuyev to set up a working group involving Cabinet of Ministers and Presidential Administration representatives to consider the issues on settling the political crisis in the country.

UDAR Party leader Vitali Klitschko said that Yanukovych would meet with opposition leaders on Monday, January 20.

German Foreign Minister Frank-Walter Steinmeier has said that the Ukrainian issue will be discussed at the Munich Security Conference, which will take place from January 31 to February 2.

"This is a question that we will discuss as part of the Munich Security Conference with many partners from Ukraine," he said in Brussels on Monday before a meeting of the EU Foreign Affairs Council, which will consider the situation in Ukraine following the escalation of the conflict.

He said that in the current situation in Ukraine it is necessary to be "grateful that [President Viktor] Yanukovych and [UDAR Party leader Vitali] Klitschko will meet in these days to find opportunities to reduce the escalation of the current tense situation."

UK foreign Secretary hails proposals for talks in Kyiv to settle crisis

British Foreign Secretary William Hague has welcomed the Ukrainian government`s readiness to hold talks in Kyiv to settle the political crisis and said he deplored the violence that took place in Kyiv on Sunday.

"There are, of course, now talks about to take place between the parties. We welcome that, but we deplore the violence that took place last night," he said ahead of a meeting of the EU Foreign Affairs Council, which will be held in Brussels on Monday.

Hague also described as a "serious mistake" the laws adopted by the Ukrainian parliament on January 16, "with restrictions on the activities of the opposition."

Journalists in Ukraine Face New Dangers

Freedom House is deeply concerned by Ukrainian authorities’ targeted violence against journalists during public protests in Kyiv – demonstrations spurred by President Viktor Yanukovych’s signing into law measures that tightly limit public protests, among other rollbacks on freedom. On January 19, as many as 200,000 people demonstrated against the new laws in Kyiv. Large crowds also gathered on January 20.

According to the Institute of Mass Information, which promotes the training of journalists in Ukraine, 26 journalists were injured by police as violence escalated during the protests. Two of the injured journalists were detained by the police. According to another group, “Stop Censorship.” several journalists asserted that police specifically targeted reporters, including firing at them with rubber bullets.

Freedom House calls on the Ukrainian government to ensure protection of journalists and press freedom and hold accountable police officers for violence.

Estonia condemns laws restricting freedoms of Ukrainians, says foreign minister

Estonia has condemned the adopted amendments to the Criminal Code of Ukraine, including the laws introducing criminal liability for extremism, mass riots and the like.

Estonia condemns the laws adopted in haste in Ukraine, which are aimed at restricting fundamental rights and freedoms of citizens, and which do not contribute to improving the current situation and create more conflicts in the Ukrainian society, the Estonia Foreign Ministry`s press service quoted Foreign Minister Urmas Paet as saying.

According to him, Estonia is following what is happening in Ukraine with an ever-increasing concern. The approval of these amendments jeopardizes the democratic solution to the crisis and is contrary to the country`s international obligations, Paet said.

The Estonian minister said that the solution of the situation lies in the dialogue, and not in ignoring the wishes of the other side and not in ignoring the fundamental rights and freedom.

OSCE free speech officer says Ukraine must give world clear explanation on brutal laws

The free speech representative of the Organization for Security and Cooperation in Europe said the draconian laws that parliament rubber stamped on Jan. 16 were "brutal" while expressing deep concern for "the huge step taken backwards." 

Referring to a package of laws that criminalize libel, obstruct the work of journalists, and which carry one to six-year prison sentences, Dunja Mijatovic noted that something is "deeply wrong in society."

"I  have been a witness (in the past) that when the media is targeted it is the first sign that something is wrong in society, if it is attacked, then this not a step in the right direction," she told the  Kyiv Post. 

Mijatovic was aghast that Ukraine took the regressive step toward limiting civil liberties just 16 days after vacating the chairmanship of the OSCE which it held throughout 2013. 

"It is a huge disappointment for a country whose chairmanship was devoted to media freedom as one if its chief priorities," she added. "I noticed Ukraine started rolling back in a negative direction in December around the time of the Ministerial Council (meeting of OSCE member states) in Kyiv."

Although she voiced caution over how the laws will be implemented, she said, "I have my doubts, including why they were approved with no consultations or dialogue...what I see, I do not like."

More troubling, Mijatovic noted, was the overall trend of freedoms being hampered in other countries that are "more or less democratic," including Romania where parliament attempted to criminalize libel. 

"I see countries that are not complying with their commitments (to observing civil liberties)...you cannot be a member of the OSCE and not honor the values that you agree to uphold," she stated.

She still hopes President Viktor Yanukovych will veto the law, despite media reports to the contrary, and still praised Ukraine for decriminalzing libel in 2001, on moving forward, albeit slowly, with the Georgiy Gongadze murder investigation, on passing a public service broadcasting bill last year and measures for accessing public information. 

But "if you look at the issues (entailed with the adopted laws) then of course the Ukrainian authorities need to have a clear and honest answer to the world why this was done," Mijatovic said. 

Asked whether Ukraine has dropped all pretense of even pretending to behave like a democracy, Mijatovic said: "Yes, I would agree with this assessment."

Fule `shocked, disappointed` at Ukraine`s turn from European path

European Commissioner for Enlargement and European Neighborhood Policy Stefan Fule has said he is shocked at Ukraine`s turn from the European path and warned that it will have consequences for partnership between Kyiv and Brussels.

The commissioner said in exclusive comments to Interfax-Ukraine on Friday by phone from Sarajevo: "I`m shocked. It is deeply disappointing to see such a turn from the European path of Ukraine. It is worrying to see this happening with such an important EU partner. The decisions adopted by the Verkhovna Rada represent disrespect for basic democratic principles and they not only raise concerns about the state of democracy and the future of Ukraine, but will also have consequences for the partnership between the EU and Ukraine."

Fule said that one of the laws adopted by the Ukrainian parliament on Thursday was aimed at limiting partnership with the civil society.

"We have made it clear to the Ukrainian authorities that the cooperation which we build is not cooperation between us and the Ukrainian government but cooperation between the citizens of the EU and Ukraine," he said, explaining the threat to the bilateral partnership in this aspect of the adopted legislation.

Fule said he was sure that Kyiv and Brussels built this relationship and initialed the Association Agreement "for the benefit of the Ukrainian people."

"And we firmly stand behind this offer. It is sad to see how the authorities turn down a chance for the Ukrainian people in such a way. I am particularly worried about the impact on the citizens of Ukraine who risk with this legislation to have their basic freedoms curtailed," he said.

On January 16, the Verkhovna Rada adopted Ukraine`s state budget for 2014 and a number of laws without discussion. Most of the documents were passed without discussion, by a show of hands. The texts of certain laws became available only after MPs voted for them.

The Party of Regions faction noted that the opposition prevented normal voting, in particular, members of opposition factions took away voting cards from their colleagues in parliament. The opposition said that the laws had been adopted in violation of the parliament`s rules of procedure and described their essence as "a coup."

The laws passed by parliament include the so-called Oliynyk-Kolesnichenko law, which, in particular, determines the procedure for the registration and functioning of NGOs - "foreign agents," the law criminalizing libel and extremist activities, as well as intervention in the information resources of the authorities, the law tightening criminal responsibility for riots, the blocking and seizure of buildings, etc.

The adoption of these laws caused a negative reaction from Western politicians and officials, as well as international human rights organizations.

Schulz condemns passage anti-freedom laws in Ukraine

European Parliament President Martin Schulz made the following statement in reaction to recent decisions of the Ukrainian parliament:

"I am deeply worried by the Ukrainian Parliament`s adoption of draft laws that could limit the basic freedoms of citizens, impede on freedom of assembly and speech and curtail the activities of NGOs. If they become law, they would push Ukraine back towards its authoritarian, Soviet past. Haste, a lack of transparency and violation of parliamentary procedures are not the way to make sound laws.

I call on President Yanukovych not to sign the draft laws and ensure that any legal changes are compatible with Ukraine`s international commitments.

The door to Ukraine`s integration with the European Union remains open. Yet we need to see a clear commitment from the Ukrainian authorities that they are serious and sincere about Ukraine`s European integration. These latest developments not only disrespect the will of people protesting on the Maidan Square, but also could move Ukraine away from its European path and, indeed, away from the civilised world."

German foreign minister: Limitation of civil rights to distance Ukraine from Europe

The laws adopted by the Verkhovna Rada on January 16 restrict civil rights and lead Ukraine further away from Europe, German Federal Foreign Minister Frank-Walter Steinmeier has said.

"The path chosen yesterday by President [Viktor] Yanukovych leads to a dead end. The limitation of civil rights will lead Ukraine only further away from Europe. I am sure that most people in Ukraine want an open future for their country, which will make possible a choice in the direction of Europe," he said in a statement on the package of adopted laws, which was released by the German Embassy in Ukraine on Friday.

He said that Germany expects from the political leadership in Kyiv that "there will be no administrative obstacles and prosecutions for a political debate after the adopted decisions against rapprochement with the EU."

"Repression cannot be a response to a politically controversial debate," Steinmeier said.

The Party of Regions faction noted that the opposition prevented normal voting, in particular, members of opposition factions took away voting cards from their colleagues in parliament. The opposition said that the laws had been adopted in violation of the parliament`s rules of procedure and described their essence as "a coup."

The laws passed by parliament include the so-called Oliynyk-Kolesnichenko law, which, in particular, determines the procedure for the registration and functioning of NGOs - "foreign agents," the law criminalizing libel and extremist activities, as well as intervention in the information resources of the authorities, the law tightening criminal responsibility for riots, the blocking and seizure of buildings, etc.

The adoption of these laws caused a negative reaction from Western politicians and officials, as well as international human rights organizations.

Ukraine: Repressive legislation threatens freedon of expression, assembly and association

On 16 January, the Ukrainian parliament passed a law “On amendments to the Law on the Judicial System and Status of Judges and procedural laws on additional measures for protecting citizens’ safety”. The law was passed within two days of being submitted and in circumvention of the usual procedures; there was no prior discussion in parliamentary committees or the plenary, and it was passed by a simple show of hands without using the electronic voting system.

The law proposes wide-ranging changes to legislation that, if implemented, will have a devastating effect on freedom of expression, association, and assembly. It is directed against those who have taken part in peaceful demonstrations during the Euromaydan protests and if implemented will have a chilling effect on civil society and people expressing dissent. 

Freedom of Association

The law proposes changes to the Law on Public Organizations which would require all NGOs who receive foreign funding from foreign governments, organizations or individuals, and who engage in political activity to declare themselves foreign agents or risk closure. Political activity is defined as activities “which aim to influence government decision-making, to change government policy and to form public opinion according to these goals”. The proposed changes could lead to the closure of NGOs and the prosecution of civil society organizations for failure to comply with these new draconian requirements.

Any NGOs labelled as “foreign agents” would have to comply with additional and onerous administrative requirements. They would also be required to include in the official name of the organization the phrase “organization carrying out the function of foreign agent”. The government authorities would be empowered to appeal to a court for closure of any organization that fails to comply with these regulations. The proposed changes are a close copy of similar Russian legislation which was adopted in 2012 and has had a devastating effect on civil society there.

The proposed changes to the Criminal Code provide for heavy fines or imprisonment for up to three years for “extremist activities” which are vaguely defined and include “attacks on the territorial unity, the “untouchability” and the unity of the state ... or prevention of the lawful activities of the state and local government”. The Law on Freedom of Conscience and Religious Organizations is also changed to specifically ban “extremist activities” by religious organizations. This comes just after the Ukrainian Catholic Church was threatened with closure for allowing its priests to conduct prayers in unauthorized prayer tents during the Euromaydan protests.

Freedom of Expression

Many aspects of The Law threaten freedom of expression. For the first time in 12 years defamation becomes a criminal office in Ukraine. The maximum penalty for publishing defamatory information on the internet and via mass media is one year’s corrective labour. 

Under international human rights standards criminal defamation laws are not a justifiable restriction on freedom of assembly and should be abolished.

Other forthcoming legislative changes threaten access to information on the internet – all news required to register within three months, and internet service providers would be required to cut off internet access to groups and individuals on the government’s direct request.

Among the changes proposed are increased penalties for revealing information about officials. This would limit the ability of journalists and civil society activists to publish critical information regarding officials including the police. Such information could be classified as being “offensive”.

Freedom of Assembly

Ukraine currently has no national legislation governing public assemblies except for the Constitution which guarantees freedom of assembly and requires only that people must notify the state in advance of a public assembly. The law is a step backwards in terms of compliance with international human rights standards on freedom of assembly. The proposed changes to the Administrative Code introduce the requirement to seek permission from the authorities for many aspects of public assemblies and tighten up penalties for those taking part.

According to the changes proposed, the use of masks, helmets or uniforms would require permission and there are fines or administrative detention of up to 15 days for failing to seek permission. Express permission would be required from the police to use amplifiers, stages and any form of temporary shelter such as tents. The driving of more than five vehicles in procession without permission could lead to being denied the right to drive for up to two years.

According to international human rights standards, the exercise of the right to freedom of assembly should not be subject to previous authorization, but at the most should be subject to a prior notification procedure. The Special Rapporteur on the rights to freedom of peaceful assembly and association has stated that even in cases where demonstrators fail to notify the authorities the organizers of peaceful events should not be subject to criminal or administrative sanctions.

The proposed legislative changes are in direct contradiction with Ukraine’s international human rights obligations and must not be enacted.

The members of AEGEE-Europe / European Students’ Forum are deeply concerned with the recent adoption by the Ukrainian Parliament (Verhovna Rada) of a new draft law that would severe multiple basic freedoms in the country. The law was passed on Jun 16th in a very irregular Parliamentary session, and is now waiting to be signed by President Viktor Yanukovych.

AEGEE, as a non-governmental, politically independent, and non-profit organisation, has proclaimed in its statement of principles that freedom and human rights are essential elements of a European society. Through respecting these values, we strive and stand for an inclusive society where citizens enjoy equal opportunities and rights. In this context, we oppose and deeply condemn any law which in any sense could limit the fundamental rights of the Ukrainian citizens, impede their freedom of assembly and speech, and put under the state control the activities of rightful civil society actors such as independent NGOs and think tanks.

We would like to express our strong support to all representatives of the Ukrainian civil society, and specially the members of our branches in the Ukrainian territory. We are convinced that the signature of this draft law, which contradicts the current Constitution of Ukraine and through a process that violates the existing national parliamentary procedures, is against the interest of the Ukrainian citizens.

At the same time, we fear that this anti-democratic law, which directly contradicts to the European commitments of Ukraine such as the European Convention of Human Rights, may lead to an aggravation of the stagnation of the EU-Ukraine relations. Even though the door to Ukraine’s integration with the European Union remains open (as most of the EU high ranked officials commented, see for instance the speech of Martin Schulz, president of the European Parliament), we consider that in case of adoption of this law the negotiations may remain closed for an uncertain period of time.

Moreover, AEGEE-Europe would like to denounce the spread of similar laws in other countries of Europe, even inside the EU, as the case of the Spanish ‘Citizens Safety Law’ proposal, which also was signaled by Nils Muiznieks, the Council of Europe commissioner for human rights. At a time when citizens are demanding more democracy, these laws against fundamental rights just go in the opposite direction.

Secretary General of the Council of Europe Thorbjorn Jagland has expressed his concern about the adoption of laws affecting the fundamental rights of citizens in Ukraine.

"The way in which such wide-ranging legislation affecting fundamental rights and the judiciary were rushed through parliament without a proper debate is unacceptable. Any laws adopted by Ukraine must correspond to the letter and to the spirit of its commitments taken towards the Council of Europe," the statement reads.

In this connection, Jagland called upon the Ukrainian authorities to reassess the legislation jointly with the Council of Europe to ensure Ukraine meets its commitments.

The secretary general also said that declaring NGOs which receive funding from abroad as "foreign agents" is alarming.

Germany warns Ukraine on anti-protest law

The German government on Friday (16 January) said controversial Ukrainian laws banning pro-EU protests would have "consequences" for its EU relations.

Chancellor Angela Merkel`s spokesman, Steffen Seibert, said the legislation, which bans protests and introduces the "concept of foreign agent" into criminal law, will make life difficult for opposition activists and NGOs.

"The German government expresses its great concern about this law, which marks a turn-around from European values," he noted.

He spoke of "disappointment for Ukrainian citizens and the EU" and warned that this "will have consequences on EU-Ukrainian relations."

Pressed to be more concrete, Seibert said he did not want to pre-empt EU foreign ministers` talks on on the subject on Monday.

Another German official told this website that Berlin is not EU envisaging sanctions.

But he said it might favour a freeze on all ongoing EU-Ukraine talks, for instance, on visa-free travel.

Germany wants is keen to send a message to Yanukovych that his actions will have repercussions, especially if opposition activists are thrown in jail following adoption of this law.

German diplomats hope that a tough stance might make him think twice before signing the bill into life.

But according to Ukrainian media, he already signed it in secret on Friday.

The law is aimed at deterring people from joining the anti-Yanukovych and pro-EU protests which erupted in Kiev last November when he declined an EU pact in favour of a Russian bailout.

Under the new rules, people can be sentenced to up to 10 years in jail for blocking access to government buildings or face harsh fines for smaller offences.

Germany`s message on Friday was echoed by Sweden`s foreign minister Carl Bildt, who said "there can be no business as usual with Kiev."

EU neighbourhood policy commissioner Stefan Fuele also told the Interfax news agency: "Decisions adopted by the Verkhovna Rada are a disrespect of basic democratic principles and ... will have consequences for the partnership between the EU and Ukraine."

OSCE representative calls on President Yanukovich to veto legislation criminalizing speech, endangering media freedom in Ukraine

VIENNA, 16 January 2014 - OSCE Representative on Freedom of the Media Dunja Mijatović today said she was concerned about the adoption of legislative amendments in Ukraine, including re-criminalization of libel, that endanger free speech.

“I am worried about today’s decision of Verkhovna Rada and call on the Ukrainian authorities to stop attempts to restrict free expression and free media,” Mijatović said.

Today the parliament, Verkhovna Rada, adopted amendments to the Criminal Code which introduce provisions recriminalizing defamation and provide additional protection for public officialsfrom critical speech. The amendments also introduce criminal responsibility for distributing extremist materials, which are broadly defined in the law, through the media and the Internet.

“In 2001 Ukraine was among the first OSCE participating States to decriminalize libel. This important reform was the starting point for Ukraine to have one of the most liberal legal environments for media in the region,” Mijatović said.

The Verkhovna Rada also introduced amendments to the law on the National Council on Television and Radio Broadcasting, allowing the President and Parliament the early and arbitrary dismissal of the members of National Council. Mijatovic pointed out that these amendments undermined the independence of the broadcasting regulator.

“I sincerely hope that President Yanukovich will veto the amendments, which might be arbitrarily interpreted and lead to disproportionate restrictions on media freedom, stifling debate and critical views,” Mijatović said.

Mijatović also noted that the amendments have not been publicly discussed with civil society and the media community.

The United States has expressed its deep concern about the adoption of legislative amendments that restrict the right to peaceful protest and the freedom of speech by the Ukrainian parliament on January 16, as well as the way in which they were passed.

The U.S. State Department`s spokesperson Jen Psaki said this in a statement, which was posted on their Web site on Thursday.

Ukraine Moves Closer to Outlawing Dissent

Freedom House strongly condemns the approval by Ukraine’s Rada (parliament) of legislation that criminalizes libel, imposes Russian-style “foreign agent” restrictions on civil society groups receiving foreign funding, and punishes civic participation in protests. Freedom House calls on the Speaker of the Rada, Volodymyr Rybak, and Ukrainian President Viktor Yanukovych to reject the legislation, which would violate Ukraine’s commitments to uphold universal human rights.

On January 16, in violation of legislative rules and procedures, the Rada narrowly approved the legislation designed to  limit dissent and opposition protests in the country and tightly regulate freedom of speech.  The bill also allows authorities to fine organizers for unauthorized public meetings and the use of equipment such as stages or tents. It also expands the definition of extremism, banning the distribution of print or online material that the government considered to be “threatening the constitutional order.”

“It is disheartening to watch the democratically elected government of Ukraine moving further away from the democratic aspirations of the people of Ukraine,” said David J. Kramer, president of Freedom House. “Not only was the law passed in violation of normal procedures, the Rada offered a glimpse of the dark times awaiting Ukraine if the bill is signed into the law.”

Testimony on Ukraine of Assistant Secretary of State for European and Eurasian Affairs Victoria Nuland to the U.S. Senate Committee on Foreign Relations

Thank you, Chairman Menendez, Ranking Member Corker, and distinguished members of the Senate Foreign Relations Committee.  It is my honor to appear before you today to discuss the situation in Ukraine and our response to it.  These are challenging times for the people of Ukraine and for people everywhere who care about democracy, economic prosperity, rule of law and a European future for that country.

First let me express our gratitude to this committee and to the US Senate for your leadership on Ukraine, and for the superb working relationship between the executive and legislative branches of government on this issue.   Senate Resolution (319), introduced in December and adopted on January 7, sent a strong, bipartisan message of concern and support to the Ukrainian people at a key moment. 

I also want to thank and commend Senators McCain and Murphy for bringing that bipartisan support directly to the people of Ukraine on a key weekend in December, and engaging with President Yanukovych, his government, the opposition, the business community and civil society in support of a peaceful, democratic way out of the crisis.   The people of Ukraine saw America stand up with them at a critical moment when they could have felt very alone.     The whole world has watched the peaceful protest of hundreds of thousands of Ukrainians on the Maidan in Kyiv and tens of thousands in other cities across Ukraine.   I am often asked why they come out week after week, young and old, and from every economic sector of Ukraine, despite the frigid weather.   I can only tell you what Ukrainians tell us. 

They say that what began as a protest against the government’s  decision to “pause” on the route to an Association Agreement and Deep and Comprehensive Free Trade Agreement with the European Union deepened and broadened into something much more in the ensuing weeks as events snowballed.  These included:  the violent attempt by security forces to clear the Maidan of protestors on November 30 and the lack of

government accountability that followed; the second attempt to use security forces to shut down the Maidan in the wee hours of December 11; and finally the Ukrainian government’s decision to accept $15 billion in Russian bail-out money.  

Ukrainians tell us that over those weeks the movement that started as a demand for a European future grew into a protest for basic human dignity and justice, clean and accountable government, and economic and political independence of Ukraine.   

Why does the United States have an interest in how this turns out?   Because these same principles and values are the cornerstone of all free democracies, and America supports them in every country on the planet. Countries that live freely and independently and respect the rule of law are more stable and make better partners for the United States.  

The Euromaidan protestors – students, workers, pensioners, priests, entrepreneurs, business moguls and popstars -- are all calling for the same basic rights we hold dear here in the United States.  They want to live in a country where their government truly represents the wishes of the people and where they can safely exercise their rights without the fear of oppression. 

Just this past weekend tens of thousands returned to the Maidan in Kyiv, hundreds joined them in other cities like Kharkiv, and some five hundred cars participated in a “protest drive” called AutoMaidan.  They returned to the squares and streets of Ukraine to make their demands, and to protest the latest assaults on human dignity, including the beatings of opposition leader and former Interior Minister Yuriy Lutsenko and journalist Tetyana Chornovol, as well as dozens of other acts of intimidation and criminality, and efforts to stifle the media and political activity across the country. 

Like the vast majority of Ukrainians, the United States and our partners in the European Union want to see the current stand-off resolved politically, democratically and above all, peacefully.  This last point applies to the government and protestors alike, and we condemn the actions of rioters outside a Kyiv court building on January 10.  However, the use of violence and acts of repression carried out by government security forces and their surrogates have compelled us to make clear publicly and privately to the government of Ukraine that we will consider a broad range of tools at our disposal if those in positions of authority in Ukraine employ or encourage violence against their own citizens.   

We have also pressed all key stakeholders – President Yanukovych, his government, the opposition, business representatives, religious leaders and civil society – to engage in a good-faith dialogue to get Ukraine back on the path to economic health, justice and a European future.   When I last met with President Yanukovych on December 11, he asserted that he still wanted all those things for his people.  If that assertion is still true, we call on him to make it credible through concrete actions to restore government accountability, rule of law and engagement with Europe and the IMF.    

In this connection, we commend the European Union for leaving the door open for Ukraine, and the International Monetary Fund for its willingness to work with Ukraine when the government is willing to roll up its sleeves and address the serious structural and macro-economic problems that have plagued the country for years.  The IMF is offering a proven, if arduous, long-term diet plan back to good economic health.  Like any tough health regime, it requires work and sacrifice but the rewards are great.  When Ukraine’s leaders are ready to invest in that kind of program, the United States and our EU partners will help them sustain the commitment.  We urge them to restart consultations now.

Looking forward, the United States will work hard to support a free and fair presidential election in 2015.  The re-run of parliamentary elections held on December 15th was not conducted according to international standards, especially with respect to alleged misconduct during the election campaign.  We call on the Government of Ukraine to thoroughly investigate all reported violations, and to prosecute those responsible for them.   We also call on all Ukrainians to help guard their democracy against encroachments on media freedom, political intimidation or efforts to rig, corrupt or undercut electoral structures and processes.  

U.S. pre-election assistance to Ukraine likely will include programs to support citizen oversight of the campaign environment and the conduct of the elections, independent media coverage and informed civic awareness and participation.  The United States will focus on supporting the integrity of the process, and not support any

specific candidates or parties.  Like the rest of our policy toward Ukraine, our assistance will be carefully coordinated with the EU. In addition to election-related programming, the State Department and USAID are reviewing how best to support Ukrainian civil society and media and to further strengthen the rule of law.  Given the threats currently facing many non-governmental organizations who participated in the EuroMaidan, we are looking at ways we can support those who feel they may be in danger.  We will also work with the EU to support their efforts to disseminate reliable information on what European integration really means to the Ukrainian public, especially in the East, and to counter false narratives and fear-mongering.   

As I have said repeatedly over the past few months, Ukraine’s European integration is not a zero-sum calculation.  We encourage Ukraine to continue to develop normal and strong, sovereign relations with all neighbors.  There is also, unfortunately a good deal of disinformation in Russia about the potential effect that the EU’s Eastern Partnership could have on its economy and arrangements with neighbors. 

We have encouraged the EU to redouble its efforts to counter false narratives in Russia and actively make its case that a more prosperous, European Ukraine will lift the whole neighborhood, both economically and in terms of democratic stability.  

Ukrainians have struggled for 20 years to protect and strengthen their sovereignty, their democracy and their economy.   The events of the last six months demonstrate that Ukrainians want and deserve better.   I am proud to work with this committee to support their aspirations.
