As I explain at the start of every show, I have been working with the guys at Aussie Speeding Fines for a number of years now, promoting the excellent work that they do informing and educating the motoring public about their rights. And, in conjunction with a number of different groups, we have now formed the new Know Your Rights group and we are committed to finding new ways to wake people up to the truth in regards to what is really going on in the world. We would especially like to thank John, who runs RAT FM for this great opportunity to do these broadcasts over his digital radio network.
This is now our 43rd broadcast and, as I mentioned on last week's broadcast, we have now been broadcasting for just over a year, which is very exciting. So, we would like to welcome any new listeners to the show and extend a very warm welcome back all our regular listeners as well.

So there's lots of great information up on-line now for all listeners – new and old alike - to refer to in case you have missed anything or want a refresh on a topic we have previously covered.

As always, the point of these broadcasts is to inform and educate people about the truth and about their rights. It still amazes and concerns me how many people are still brainwashed by the government propaganda about things like speeding fines - "Speed Kills" and "Every K over is a killer", people who still
don't see that 9/11 or 7/7 were inside jobs or those that still don’t realise the fraud that is perpetrated by the banking elite every day.
And, once people do get their head around some of those basic truths, we want to give people strategies and techniques for taking action against these injustices and helping to set things right again.

So, before the break, I read out an e-mail asking us to cover a bit more information on the Strawman concept. For anyone who is completely new to this, I strongly suggest that you have a look at the very short "Meet Your Strawman" video link that we have near the top of our Strawman page, as that really explains the concept in its most basic form.
Now, the way I like to explain it to people is this - think of your Strawman as a business because, the reality is, that's how the governments and those in charge look at them. Any of you who are out there listening to this who own their own business will understand the concept that you are not your business but you "have" a business - its the same with your Strawman, your Strwman is not you but you do "have" a Strawman.
So, going back to the business example, your business or company is just a piece of paper that is registered with ASIC but that business entity is separate to you. You may own the business, you may work in the business but you are separate to the business. As I explained on our last live show, your business may make some sales and then have some expenses and may end up making a profit, or an increase as a result - that's because the business, or the piece of paper, didn't actually do anything to make that increase so it hasn't swapped time for money, for example - if you want to understand this concept better, please be sure to listen in to last week's podcast.
And so it is with your Strawman, it is just a piece of paper that was created by Births, Deaths and Marriages and that is how the governments "do business" with you. The important point to note is that you are separate to that Strawman - sure, the government will try and link your Strawman to you but you need to understand the important distinction between the two.
So, again, as an example, you may be the owner of a business or the director of a company or the trustee of a trust - you simply fulfil a role or a position within those entities but you are not actually those entities. It is exactly the same with your Strawman. Now, for our more advanced listeners, the reality is that your Strawman is actually a trust and the government will constantly try and appoint you as the trustee of that trust.
And, just as with any other organisation or structure, no-one can force you to accept or assume a particular role or position. Most people choose to be the Director of their company or some other role within their business but you always have a right to refuse any roles or responsibilities if you wish and it is exactly the same with your Strawman's trust.
You do not want to take on the role of trustee of that trust because you then take on the liabilities associated with that as well. Again, to give you an example, many people would be aware of the concept of buying a property in a trust. Now, the people who ultimately benefit from that trust are the beneficiaries but the trustee must run and control the trust and take responsibility for it.
Again, most people would make a conscious choice to do that for their family - which is the most common form of trust - but you do not want to do that when it comes to your Strawman because you didn't set up that trust and you, in all likelihood, don't understand how that particular trust works, so you certainly don't want to take responsibility for something that you don't understand.
Instead, you want to simply be a beneficiary of that trust - ie. someone who gets all the benefits but accepts none of the responsibilities or liabilities. lternatively, once you fully understand how this all works, you can accept the more powerful role of executor/administrator, which allows you to appoint the trustee. And, in the case of a court case, many people have taken on the role of executor/administrator and appointed the court, or, more specifically, the Magistrate or Judge, as the trustee and made them take control of the trust for the benefit of the beneficiaries.
Now, this is all fairly advanced, complex stuff so let's come back a notch and get back to the important point, which is separating yourself from your Strawman and the trust. So, again, as another example, if you are say the owner of ABC business or Director of ABC Pty Ltd and you correspond with someone on behalf of that entity, then you would make it clear that you are writing in your capacity as the owner or Director, not as the business or company itself. The same applies to a trust, where you would generally be writing as the trustee of the trust.
Regular listeners of this show, as well as those who have attended one of our Know Your Rights seminars, would recall me using the example of purchasing a car in a trust and then registering that car in the name of the trust. So, you might buy a car and register it in the name of John Smith as trustee for the Smith family trust. Now, if anyone was to look it up on the relevant database in your State, it would just come up under the trustee's name, John Smith, but a detailed printout would show that you are simply the trustee of the trust so, the car belongs to the trust, and, ultimately, the beneficiaries of the trust, it does not belong to you, you are simply looking after it on behalf of the trust. The beauty of this is that you can then complete a simple deed of variation and change the trustee over and that, effectively, changes the ownership on the relevant database, without actually changing the beneficial ownership - which is why no stamp duty or transfer fees are payable and why there is no need to get a roadworthy certificate.
So, getting back to the Strawman, when a government department or corporation sends correspondence to your Strawman - which is usually signified by the fact that it is addressed to the ALL CAPS entity - then you would respond as an officer or agent for that entity rather than "as" that actual entity, which is what most people do. Now, the way it is done with respect to your Strawman, is that you respond as "the person's personal representative of person xxxx, in private capacity in being."
So an agency might write to the ALL CAPS entity JOHN SMITH or, alternatively, it is often addressed to Mr Smith - they both signify the person or the Strawman, not you, the living breathing, flesh and blood man or woman. So, you would then respond on behalf of the person, JOHN SMITH as the person's personal representative, of John Smith, in private capacity in being. Now, this specific phrase is used to clearly distinguish you from that person. Let's break it down.
Firstly, you are stating that you are the person's personal representative. Now, this is a specific legal role and it comes under probate law. It is actually a fiduciary role whereby the personal representative manages the finances of a person who is unable to do so. Probate law refers to the administration of the estate of a deceased person. Now, if you remember before, I explained that your person, or Strawman, is simply a piece of paper, it is not a living breathing entity. The reality is that the government basically killed you off at age 7 because you didn't show that you were A) alive and B) capable of administering your own affairs.
All of that comes under the Cestu Que Vie Act and that would be another whole show in and of itself but, again, anyone who has attended one of our seminars would have a basic understanding of that and I certainly urge anyone who is interested in finding out more about it to do further research into it. Additional proof that your person is deceased can be found in many different day-to-day ways - for example, you are "summoned" to court. Now, most people would have heard of that term - summoned - in regards to summoning ghosts or demons - you don't "summons" live people, you subpoena them.
You are addressed in ALL CAPITALS, which is, of course, how they write on your gravestone when you die. In fact, if you look at any government or major corporation document, card or ID that you have, you will see that it is almost always written in ALL CAPS. Now, the reality is that, as the government created the Strawman, or person, then they actually own all derivatives of that name but to keep it simple, that ALL CAPS one is the one most often referred to and the one most people can clearly see and distinguish themselves from, which, of course, is the key, as I said before.
Anyway, let's get back on point. So, you have established that you are acting in the legally valid role of personal representative, of the person - who we know is a fictitious, government created, dead entity - and the last part is "in private capacity, in being". Now, this is fairly self-explanatory but, again, it clearly notes that you are operating in the private, rather than in the public - something we have discussed on previous shows - and also signifies that you are a human "being" - ie. a living breathing man or woman, whom they have no lawful control over what-so-ever.
In fact, if you go to our Court Cases page, you will find the case of Rundle v Delaware - down near the bottom of the page - which clearly dictates that a corporation cannot sue or otherwise exercise any power of a living man or woman. Which brings us right back to the start, why the government created the Strawman in the first place - to do business with you.
Again, by way of example, if you went to court and someone called out your company name - ABC Pty Ltd - you may get up and say "yes, that's me" and the court would very quickly ask you who you were and why you didn't have a lawyer representing you. At that point, you could explain that you were the shareholder, secretary and director of the company and therefore have the right to be heard in court on behalf of the company, the court would make it very clear that you were not the company, however, and would try their utmost to stop you even speaking on behalf of the company - you can see my notes, again, on our Court Cases page - how you can get around that if you ever need to.
Conversely, if you go to court and they call out John Smith and you stand up and say "yes, that's me" then they take it that you have accepted responsibility for that entity , including any liabilities, which they will now try very hard to impose on you. Instead, you should stand up and say something like "Your Honour, I appear on behalf of that person in my private capacity, in being, as the person's personal representative of person, John Smith."
Now, at that point, they will try and force you into agreeing that you are that person, they may even say things like, "please let the record reflect that John Smith has failed to appear" - which, if they do that, is great because all you need to do is get a copy of the recording of that proceeding and then, if any Sheriffs officer, or similar, attempted to pursue you personally for any order or debt, you could give them a copy of the tape and say, "Well, clearly that order doesn't refer to me, because I was in court on that day, here is my voice and the fact that the Magistrate/Judge declared that the person didn't appear must mean it has nothing to do with me!"
So, hopefully this gives you at least a little bit more insight into the person or Strawman concept and how you would go about actually using it. Whether this is all brand new to you or you have researched this concept in depth, I want you to start thinking about the separation between you and the person or Strawman at every opportunity. When you pull out a credit card with the Strawman's name on it, understand that it is not "your" credit card, you are simply using the credit card as an authorised representative of that person - in exactly the same way as you might use a company card that simply has your name on it or has been issued to you.
The next time a police officer asks you to show them "your" driver's licence, you can explain to them that you don't have one, you simply use or accommodate, the person's licence and you would be happy to show that to them on the understanding that it is not yours - the reality is that the licence actually belongs to the State anyway, not even the person, so it's most definitely not "yours".
Next time a phone company sends an invoice to your address with your Strawman's name on it, just be aware that you are simply administering that account on behalf of the Strawman, it is not you.
Once you start doing this on a daily basis, you will very quickly cement that distinction between you and your Strawman in your mind and can then start looking into some really advanced techniques like claiming back any tax - for example, GST - that you have incorrectly been tricked into paying on behalf of the Strawman and, eventually, even accessing and administering the Strawman's trust account.
So, that's obviously a ton of information to get your head around so we're going to play a couple of songs to let that all sink in and we'll be back with any of your questions or comments, as well as your Facebook posts, very shortly.

Now, before I get into the Facebook questions and posts, I want to quickly remind everyone what we spoke about on our last week's show regarding taxation and private foundations.
This week marks the start of the new financial year and I know a lot of people have "tax time" on their mind so please be sure to review all of the information on our Tax page so that you fully understand that the ATO is not a legal entity, the fact that personal tax is voluntary and the ATO can't define the word
"income" - so how can you possibly be expected to fill out an Income Tax Assessment form anyway!
Now, as our regular listeners would be aware, we keep hearing more and more concerning information about a particular group who are charging people $2,500 to set up a private foundation and then recently contacted their client list and asked them to pay an additional $750 to "fix" their incorrect paperwork.
Now, we mentioned on last week's show that the group that that was charging that insane amount of money was now being investigated by the ATO and they have now openly admitted this fact to their clients as well so please, if you have had a private foundation set up by someone other than the Operate in the Private group then please be very careful and make sure you protect yourself against any impending action.
We would like to remind everyone that in light of this information, the guys at Operate in the Private are extending an offer to anyone who is interested to have them complete a fully compliant private foundation for the discounted price of just $750 - instead of the $1,500 or $2,500 that these other groups are charging - but you only have until midnight, next Tuesday, the 7th of July, to get in touch with the guys to secure that price. We have spoken to the guys and they are concerned at the number of uninformed, uneducated people e-mailing them asking all kinds of questions, most of which are already answered on their extremely comprehensive FAQ documentation. Have a read through those, have a read through the information on our Financial Protection page and have a read through the information on their actual website too www.operateintheprivate.com and THEN e-mail if you still have any questions.
One of the reasons that they can provide this service at a significantly reduced cost is because they provide these foundations to people who already know about them, they are not in the business of educating people about them - if you want to do that, then please attend one of our upcoming seminars.
We have also been told that some people are e-mailing them with concerns that because of the reduced price they are charging that they must, somehow, be providing less information or documentation that other groups - the fact is that nothing could be further from the truth!
Other groups are charging too much, plain and simple. There is just no need - except for pure greed - to be charging the kinds of prices that some other groups out there are charging. They provide every bit of documentation that any other group other provides, and more: they include letterheads, invoices, receipts and even a detailed screenshot-by-screenshot explanation of how to set up a Paypal account in the name of the foundation, something other groups say can't even be done! So, you can rest assured that the Operate in the Private guys are not giving you any less just because they are charging considerably less - in fact, they provide more information and documentation that ANY other group that I know of - and I know about most of them - and they are more than fair, reasonable and honest with their pricing structure and we challenge ANY of the other groups out there providing private foundations to justify their significantly higher costs.

Now, just to clarify, when we say our "introductory seminars", we have found that, after conducting those seminars in every major city in Australia since November last year, that most people have found them to be a very good balance between basic, introductory information as well as providing some more advanced, detailed strategies as well.
After nutting out the framework of our Advanced Seminars with Darryl, our more advanced members and listeners will be happy to hear that we will be expanding on things even further and we will be taking all of the information that we touch on in our initial seminars to a whole new level in our Advanced
seminars. And, most importantly, we will be adding in a whole lot of new, practical steps that you can take to actually use and implement the information that we give you.
Now, anyone who has attended one of our introductory seminars will know, even at that level, we provide a ton of practical, useable information so you can just imagine how incredibly powerful the Advanced Seminars are going to be. Darryl and I are still putting together the finishing touches on the agenda for the Advanced Seminars and then, of course, we have to do all the work that is required to put them into a similar logical, flowing format as our introductory seminars and complete all the PowerPoint presentations, workbooks etc. So, there's a lot to do between now and then but we hope to be able to report more during our next live broadcast, in two week's time.

Be sure to share posts that we put up there with other on your own page and through other groups that you may also be a part of.

As I have mentioned a few times before, we are always looking at new ways of generating some cash flow to ensure that we can continue running these weekly radio shows right throughout the year and organising some great guest speakers as well – such as Darryl and Owen Godfrey, who we had on a few weeks ago – as well as amazing people like Larry Hannigan as well. We also need to continue researching for our shows and so that we can also update our website with the latest, cutting edge information and strategies for learning about and standing up for your rights.

Also, we are slowly but surely building up a regular base of listeners for the Know Your Rights show and we will be doing more research and hopefully talking to some new people about all kinds of topics that concern our freedoms and Constitutional rights so be sure to block off your Tuesday nights between 8 and 10pm and, if you can't listen in live for some reason, be sure to check for our podcasts which will now be uploaded each week so you can listen in to all your favourite parts of the show.
As I have said many times before, these shows don't write themselves, it takes about 4 hours or more each week to prepare for each 2 hour show. We have to research the content and put it all together in a format that flows and makes sense. We do this in addition to trying it upload new information to our website each week or so and, as anyone who is involved in web design knows, there is a fair bit of work involved in setting up and constantly updating a website - writing the content, uploading that, constantly making little changes here and there etc. and this all costs time and money.

Anyone know if I can honestly get out of paying a fine for apparently failing to stop at stop line and going through a red arrow, I swear the lights for straight ahead also the arrow in which I had stopped for both had both turned green, Police pulled me over after I had driven approx 1km and made the next right hand turn, They told me I had done this and at the time I couldn't argue the point as my word against theirs and they told me I may get a fine in the mail which I did 3 days later, $369 and 3 points for something I can't prove I didn't do nor do I think that they can prove that I did. Where do I stand ? Anyone?

I got a parking fine for a 3 hours car slot in University of Canberra while I was there for my exam which is 3 hours long and the car park is situated right outside the examination hall. Also very important to mention that it’s a paid parking and we pay every fortnight and yes I did pay it regularly. People associated with UC would know that there is heaps of free parking too just at the other side of paid parking although that's mostly occupied but we neither get the guarantee to get an empty slot in paid parking too. most of the times its also filled up.so my point here is that first they convert these free parking to the paid parking wherever it was possible and than they also start charging students for parking there vehicles "overtime" yet they set up the exams of 3 hours and consecutive 4 hours classes to attend. Doesn't matter you pay for parking or not but they'll put fine if you park more than 3 hours.
Now the question!..Is there any regulatory authority keeping a check on this of UC's monopoly or anyone who could be contacted with these regards?or is being a silly sheep and bearing all this injustice the only best thing to do!

Here in Victoria we have citylink and eastlink both private companies that bill drivers for using the roads. If the bill is not paid they send out a reminder which has increased in price this happens two or three times before receiving a letter from a lawyer's company. Then you receive a fine from police and so on till it is a warrant. So a original bill of $12 or so has now turned into a $250 warrant and possible suspension of license and rego and all so possible jail time! How on earth can they pass this off as a fine and with threats of jail etc, what is besides just paying the toll can be done about it?

Hi all need your help again. I have been issued with two different red light camera fines and have viewed the pictures and have the pictures in my possession.I am thinking of having the matter dealt in court. In the first offence the camera states my vehicle enters the intersection 0.7 seconds after light turned red. My cars rear wheels are just over the thick white line.
And in the second offence I was photographed entering the intersection 1.5 seconds after the light turned red the fact is the sun was in my eyes, the red light looks orange and I had been at the intersection stopped waiting for the silver car to go what do you guys think

Hey guys I was on a payment plan with good old civic compliance and missed a payment .so I wrote them a letter on the paper work they supplied to do that requesting that they give me another payment plan and they wrote back saying I was denied . No reason why ,nothing. They also say in that letter that I have to pay the fines now or they will turn to warrants so I write back saying if I had the money to pay them now I wouldn't want a payment plan . Now I am getting Text messages on my phone saying they will not re register my car . Does anyone know if this is true can they do that. Just after some good advice. Regards Dave
Warren Did a little research the other day and found out that our Birth Certificate is a bond. Our mother's unknowingly and uninformed sign our birth certificates and that has the effect of actually pledging her new born child to the Government Corporation of the state you are born in. For example, if you are born in Queensland, you are owned by the QUEENSLAND GOVERNMENT, Australian Business Number 75 818 456 675. To the best of my understanding, we humans, via our birth certificate, are collateral for our state and country. In America, a country that went bankrupt in 1933, birth certificates are traded on the New York Stock Exchange and each birth certificate is worth literally millions if not Billions of dollars. Americans can claim all the money that their birth certificate is worth. I am finding it difficult to find out if the same applies to Australian birth certificates. The process of finding out the worth of your birth certificate, in America at least, is as simple as calling a broker, quoting your birth cert. number and social security number, and they should be able to tell you. I do not know the consequence of claiming the value of your birth certificate. All this has something to do with straw man. Do a little research and see who owns you!

Yes but this isn't about her...it's about you"I said" You need to respect your elders and I've done nothing wrong. Am I under arrest or free to go?"He took my name and wrote it in a notepad along with the registration plate number but let me go. Pays to know your STUFF.

If a qld police officer gives you a alcohol test are they required to tell you the reading before taking you to the station if you ask for it?Are they required to give you or offer you a blood test at police station? Hey guys got done for apparently doing 89 in a 60 zone on a radar gun + fog lights, which was totally wrong I'm going to take it to court anyone be able to tell me how I can access the footage on the police vehicle which the officer also pushed me, cheers guys.

Hello all. I have a few things I'd like to mention.Today I was in court dealing with a fine. Alleged 26km over the limit.I used a lot of the information provided in the booklet to have the charge lowered, however, the letters for the 3 step process do not work. 1) The prosecutor will state that the 3 letters are Internet based letters or templates and will not administer them into evidence.2) Even if sent via registered post, the receiver can state they did not receive them.3) The judge agreed that they cannot be used in evidence.
I would advise drastically editing the letters to be one of a kind. I formatted my letters as such and they were still not accepted.

The referendum is to force the Parliaments of Australia to govern under the laws of the Constitution Act 1900-1901 as proclaimed and gazetted. They are not doing so and have not done so since 1973 (example), Even though we had a referendum in 1988 re: to make Local Councils legal (which was defeated) they totally ignored the no vote of the sovereign people of this nation. This referendum is to put a stop to these kind of things ever happening again. We are sovereign under the Constitution Act 1900-1901 as proclaimed and gazetted. and the politicians are or servants. They have been abusing that Philosophy since 1973. it is time to reclaim our sovereignty from this foreign registered corporation posing as our government.The only way this is going to happen is with you all at this time coming on board to instigate this referendum. The 50,000 people is only to be able by law to implement the referendum. once we have the 50,000 signatures. Then we can proceed with the instigation of the referendum. The paper work is nearly ready.Councils among other things will be made accountable for acting as a law unto themselves as well as many other fraudulent laws etc. Now is the time folks. When the Paper work becomes available on line within the next 10 days all will be revealed as to What should be done. Once the actual referendum has been initiated we want all Australians to vote in the affirmative if you want to rid your selves of the slave system that has been placed upon us by this unscrupulous foreign registered defacto government.
