What a shif; yet for the workers and stakeholders of the Sabang-Daguitan Surf Camp of Dulag, Leyte, it was a necessary shift, to be able to survive the lockdown imposed due to the CO-VID-19 pandemic. TACLOBAN CITY – The regional office of the Depart-ment of Health (DOH-8) has recorded nine deaths and a total of 4,221 dengue cases in Eastern Visayas from January 1 to July 18, 2020.

The nine deaths were recorded from Leyte – one each from the municipalities of Abuyog, La Paz, Ormoc City, Baybay, and Tacloban City; Eastern Samar – one each from the municipalities of Giporlos, Arteche, and General MacArthur; and one from Tagapul-an, Samar.

DOH-8 Regional Director Mi-nerva Molon said Leyte also has the highest number of cases among the six provinces with 2,160 or 51.17 percent. Of which, 279 are from Tacloban City, 228 are from Baybay City, and 158 are from Ormoc City.

This is followed by Southern Leyte with 571 cases or 13.53 percent with 113 cases recorded in Maasin City. They have also identified Brgy. Asuncion of the said city to having a clustering of dengue cases.

DOH-8 calls on LGUs to strictly implement health protocols for “Hatid Tulong” program

Digital tools to help revive PH tourism in new normal

TACLOBAN CITY – With coronavirus cases in East-ern Visayas breaching the 700-mark, the Department of Health (DOH-8) urged local government units (LGUs) to strictly imple-ment health protocols for the “Hatid Tulong” pro-gram of the government.

With more returnees expected to arrive in the coming weeks, DOH-8 Re-gional Director Minerva Molon warned not to be complacent of the govern-ment’s measures against the coronavirus disease (COVID-19) pandemic.

“Pinaaalalahanan ko po pa rin ang lahat na dapat patuloy parin ang

ating pag-iingat. Patuloy rin nating i-practice ang infection prevention and control measures para ma- limitahan ang pagkalat ng virus. Ang pagsunod ng safety prevention protocols ang pinaka- effective pa rin na depensa natin laban sa COVID-19,” Molon urged.

She said that part of the preparations being done is the availability of 15,068 beds in Community Iso-lation Units (CIUs) and Temporary Treatment and Monitoring Facilities (TT-MFs) in the region.

Molon shared that a total of 52 Level 1 to Level 3 hos-pitals have already submitted their surge capacity plans.

She said additional trainings were also conduct-ed to 707 teams of contact tracers in the region.

“With the LGUs ‘en-abled’ by the national gov-ernment to lead the fight against COVID-19 and with the collective efforts of ev-eryone, our region now has a high number of recoveries at 88.83 percent and with only 78 active cases,” Molon said based on the 725 total COVID cases recorded.

She noted that the im-mediate isolation of con-firmed COVID-19 cases and the intensified contact trac-ing of people who may have been exposed to the virus are among the effective ways

that the government has done to minimize the trans-mission of the infection.

She said that another best practice is the implemen-tation of a COVID-19 scan system or using QR Code for contact tracing in business establishments and borders in Ormoc City, Tacloban City, and Barugo, Leyte.

“This helps not only the government but also the es-tablishments in identifying people who are potentially exposed to COVID-19. It is like a diary of the places we visited and helps in tracking down and alert contacts of people who got infected by the virus,” she explained. By Marie Tonette Marticio

TACLOBAN CITY – A 19-year-old astrology en-thusiast from an interior town in Leyte has shared his weeklong experience before he was finally able to capture Comet NEO-WISE using his telescope and cellphone.

John Michael Tila-on, a first-year accountancy stu-dent, started his hobby days before the lockdown imposed due to coronavirus disease (COVID-19) in March.

Tila-on admits that his only hobby is surfing online where he is able to appreci-ate the beauty of nature, especially the moon and stars because his hometown in Burauen, Leyte does not have a beach.

“Kapag pag hinahatid ko ang girlfriend ko, doon ko mas naaappreciate yung pag-akyat ng moon from the horizon. Isang beses pauwi na ako, napansin ko na napakalaki ng buwan, as in napakaganda niya,” he shared.

John Michael recalled staring at the moon when he was traveling home after sending her girlfriend home. At that time, he only had a cheap smartphone that had a camera that is not good enough for astrophotography.

His fondness for as-trology and astrophotog-raphy grew. He also joined groups on Facebook but shared that he always failed in taking photos.

“Ilang beses din ako nagtry at wala. Parang ilaw lang nakukunan ko at hindi itsura ng moon kahit sa moon ako nakatutok. Yung tipong tinutok mo camera mo sa streetlight. Ganun lang. so-brang na down ako that time kasi interesado ako pero wala akong gamit para sa hobby ko,” he lamented.

He said he has been eyeing a telescope that went on sale online but still did not have enough money to buy it. He then asked his parents to buy him a telescope as an advance birthday gift.

“Walang tirang pera that time kasi nag-iipon sila mama at papa para kung sakaling lumala yung COVID may pera kami kaya nalungkot talaga ako. Naintindihan ko sila pero kasi opportunity na yun kaya kinausap ko si mama kaya sinangla talaga ni mama yung alahas niya

para lang mapunan yung gusto ko na sobrang naap-preciate ko,” he shared.

Through online tutori-als, he was able to capture Jupiter, Saturn, and Venus. He was also able to learn how to use his cellphone for astrophotography where he was able to capture the Milky Way Galaxy, penum-bral lunar eclipse, super-moon, and even the solar eclipse. His photos have also been featured in vari-ous news sites.

When he learned about Comet NEOWISE, a long-pe-riod comet with an orbital pe-riod of approximately 6,800 years, he asked his friends to join him witness the phe-nomenon passing some 103 million kilometers from the Earth. It was first discovered on March 27, 2020.

Every afternoon, John Michael and his friends would ride a tricylce and wait for two to three hourse for a week. They would sometime walk for four ki-lometers going home after several failed attempts.

“Dumadaan kami sa sementeryo pauwi, minsan hinahabol pa ng aso. Mas malala pa nung hinintuan kami ng police car habang nag-aantay dahil akala nila naaksidente kami. Nag-paliwanagi naman kami ng maayos na minsan lang itong event na ito, na kailangan talaga madilim yung site kasi iwas sa light pollution,” explained John Michael.

“Sabi ko nung time na yun, mag-aayos na kami mukhang wala tapos nung pag-alis nila, kumuha ako ng last shot baka swertehen tapos pasok na pasok nga nandun siya,” added John Michael.

He was filled with joy as he even saw the comet with his naked eye. He shared that the experience eased his wor-ries and stress brought about by the pandemic.

“Gusto ko lang po i-share sa inyo ang kwento ko kasi gusto ko po ma-encour-age yung mga kabataan tu-lad ko to explore more. May iba pa tayong magagawa kahit may pandemic. Wag natin hayaan na masayang ang mga araw natin. Let’s embrace the night skies,” he ended citing that there are many different ways to have fun without spending money. AFTER SEVERAL months of lockdown in various parts of the Philippines, efforts are underway to revive economic activity. This includes the tourism industry, which is a top job generator for the country.

For this purpose, a two-hour web forum titled “#TravelSmart: Safe and Sustainable Tourism in the New Normal” was held on July 16, 2020 with DOT Sec-retary Bernadette Romulo-Puyat as keynote speaker in the webinar.

The web forum was organized by PLDT wireless subsidiary Smart Commu-nications, Inc. in partner-ship with the DOT together with key partners such as Grassroots Travel, a non-government organization that helps communities protect their natural and cultural heritage through sustainable tourism.

Joining DOT Secretary Puyat as speakers were Al S. Panlilio, Smart Commu-nications Inc. President and CEO, Joselito “Boboi” Cos-tas, founder of Grassroots Travel, Mon Isberto, Public Affairs Group Head for PLDT and Smart, Carlo S. Ople, PLDT Vice President, Marvin Santos, PayMaya Philippines Inc. Enterprise Head for Public Sector, Max Limpag, InnoPub Media Co-founder, and Jomelyn Manigos-De los Reyes, Bojo Aloguinsan Ecotourism As-sociation Vice President.

The webinar aims to shed light on the current challenges being faced by the tourism industry, to share best tourism practices of various institutions, and to present digital tools and mo-bile applications that local tourism players can tap and use to improve the tourism experience post-COVID.

Target participants for the webinar included represen-tatives of local government units, tourism officers, cul-ture and heritage groups and members of the news media.

“Reviving domestic tourism under current con-ditions requires that we combine seemingly op-posed qualities: discipline with creativity, caution with confidence. We hope that this webinar will provide insights on how the differ-ent stakeholders can work together to achieve this.

For Smart, we are keen to explore how digital tech-nologies can help,” says Mon Isberto, Public Affairs head for PLDT and Smart.

“To resuscitate the tour-ism industry, we have to work top to bottom and bot-tom to top, and empower the industry stakeholders especially the local com-

Sabang Daguitan Surf Camp’s triumphant “lockdown” storyT A C L O B A N C I T Y – Amidst fear and uncer-tainties brought about by the coronavirus disease (COVID-19) pandemic, ag-ri-tourism sites in Eastern Visayas manage to survive and remain hopeful for better days to come.

Only the noises coming from the sea, hammer, and midrib brooms are heard one sunny afternoon at Sa-bang Daguitan Surf Camp located in Dulag, Leyte that used to cater to up to 500 tourists a day.

Volunteer workers who used to greet tourists com-ing in three months ago are busy clearing the camp and doing some minor repairs on the roofings of their restaurant.

“Our workers are still hesitant to open especially that there are confirmed cases in our town, but every day, there is a group com-posed of 12 women and 9 men who volunteer to clean the area. They also look af-ter our piggery, fish pond, and poultry,” he shared.

Dumaguit recalled how the 68 workers of Sabang-Daguitan Surf Camp were

in awe when they found out that there will be a lockdown because it is their main source of their daily needs. The camp used to earn Php 60,000 per day during the peak season.

“Although we were given the option by our mayor, the majority of our members favored closing on March 18,” he said.

The camp that started with 30 persons who volun-teered for six months while they were starting their op-erations in February 2015 through the assistance of the ABS-CBN Foundation and the late of Environment Sec-retary Gina Lopez, it is not only supporting 68 workers and their families but also their community now.

Self-esteem and self-importance

Build or rent?

Hell: Home of the Devil

IN THE BIBLE, Adam and Eve were caught eating the forbidden fruit and the latter blamed it on the Devil because Eve was tempted by the Devil. It therefore presupposed that before Creation, Hell was already there. In other words, before Creation, Hell was already there. Hence, Hell cannot be a part of nature. There is no night and day. You cannot count the hours nor the days. Here on earth, when a man is given a sentence of a capital of-fense, he becomes eligible for parole after serving 40 years in jail. Since there is no sense in making count, you are in Hell for all time. Forever is the word.

The next thing that comes to mind is who are the possible residents. Let this corner make a guess or several guesses:

Emperor Nero. He is the one who burned down Rome because he loved to play with fire and he blamed it on the poor Christians. He also went down in flames.

King Herod, who ordered the behead-ing of St. John the Baptist. Herodias, his wife, even asked that the head be placed on a platter because she disliked what St. John said that her marriage is immoral because she was already a married woman.

All the Rulers, who made it a spectacle of seeing people being eaten alive by lions in the amphitheater made for the purpose. They enjoyed watching people mangled and eaten before their eyes.

There was a group that made a study of Dictators and then, picking out 20. In that list, Hitler was No. 1 and our own Marcos was No. 13. Of course, there are more than 30 all over the world.

Those who violate the Ten Command-ments of God that God gave to Moses in Mount Sinai. To make it easier, God planted these Commandments in our hearts so that we cannot claim that we did not know nor say that we forgot. Everytime we do something evil, there is our conscience that bothers us. If we persist to go ahead, God respects it but think of the consequences.

The most common sin of Dictators is the 5th Commandment: Thou shalt not kill. If you kill one or more than one, it is still a sin.

Lee Kuam Yew of Singapore was a good Dictator but this corner cannot believe that he did not kill anybody. All Dictators have to kill because they are afraid to be dislodged.

How many people die everyday? How many of them go to Heaven and how many go to Hell?

Let us endeavor to go to Confession to cleanse us of mortal sin. This coming Lenten season, let us all confess our sins.

IF YOU’RE NEARING retirement and stay-ing in one of the housing units at VSU, it’s likely that you would want to build your dream house. A red flag for those consider-ing getting a new house is the big amount of money involved but you do not have enough cash. If you must rely on your 5-year lump-sum from GSIS for the source of funds, then you could be in deep trouble.

If you opt for the lump-sum, it is safer if you or your spouse have another source(s) of income since your pension is now zero for the next 5 years. Besides, you have to factor in the many expenses of home ownership.

Homeowners lose track of how much they spend on home maintenance because it’s not a fixed monthly outlay. Experts advise budgeting 1% to 2% of your home’s value for annual maintenance costs, and adjusting it for inflation.

Home projects and chores like garden and lawn maintenance, minor repairs, out-door tiles cleaning, etc. may also become difficult down the line. Hiring workers for those chores will add to your ownership expense. Homeowner’s insurance can be-come a rising cost because it should cover fire, earthquake, flood and other natural calamities plus theft.

Retirement sometimes calls for flex-ibility, whether that’s the ability to transfer to be closer to the kids and grandkids, or chase better weather and/or a lower cost of living in another location. And these moves become harder if they necessitate selling your house.

If your retirement plan includes mak-ing a move, renting might be a better finan-cial and lifestyle fit. While homeownership is the dominant housing choice, more seniors in the States are renting today.

An analysis of U.S. government data by RENTcafe reports that the percentage of renters at least 60 years old increased more than 40% in the 10 years through 2017. That exceeded the 31% growth rate for homeowners of the same age. And some big cities saw more than double the average renter gain; renters ages 60+ rose more than 80% over the decade.

If the cost of renting is lower than your annual housing costs, that’s obviously a financial win. Renting also allows you to test-drive your retirement life. Many put a lot of time and effort into saving for retire-ment, but haven’t really planned what the day-to-day of living in retirement will look and feel like. Renting gives you time to get acquainted with your retirement self.

My advice is that you don’t want to have this huge commitment to your own house unless you’ve decided it really suits your needs. That can be especially true for single homeowners who don’t have a partner to share the work it takes to main-tain a home. Married couples should also give careful thought to how the surviving spouse will fare as a solo homeowner. Likewise, with the economic uncertainty because of Covid-19, it might be unwise to invest on a house now.

WHILE IT IS good to have a high self-esteem, it is not when we get fat in self-importance. A high self-esteem is the objective awareness of who we really are. An obese self-importance is an exagger-ated sense of our value and importance.

It is not good to have a low self-esteem that misses our real dignity as persons and as children of God, meant to be God’s im-age and likeness and to share in his divine life. We should try our best to build up and keep a high self-esteem that is always compatible with humility.

When we have a high self-esteem, our capacity to work, to help and serve others, and most importantly, to thank God and to be always with him, increases. We would be willing to do anything, even to play the role of being the servant of all servants. That would be no problem to us. In fact, it would reinforce our self-esteem.

Definitely, to have a high self-esteem would involve a constant reference to God. It would make one strive to always have presence of God, to know his will and ways and to do his best to follow them. It would make us feel that we are always accompa-nied, and that whatever situation we may find ourselves in, whether good or bad, we would still feel safe and secure.

Having a high self-esteem will lead others to see, feel and love God through us, while we hide and disappear. It does not steal the limelight from God. If we truly have a high self-esteem, we would feel good that we be ignored while doing a lot of good for others out of love for God.

When we have a high self-esteem, we would know how to distinguish between making full use of all our talents and pow-ers for the good of all, and simply strutting our stuff, eager to show off, hungry for people’s admiration. Of course, we would do the former while avoiding the latter.

But we should try our best also to avoid any trace of self-importance because we would just be deceiving and fooling ourselves. A fat self-importance is always awash with pride, vanity, an exaggerated self-awareness and overvaluing of our own assets, talents, resources, etc. All these blind us or, at least, distort the objective reality of who we are. It is an over-estimation that actually degrades us.

A bloated self-importance stems from one’s very subjective assessment of his own self, deprived of any reference to God. It is simply built up on one’s own consid-eration of his human and natural powers and fortunes. It stands on no solid ground, but rather on shifting sands. It’s actually not stable, and is highly prone to mental disorders like the bipolar cases that, sad to say, are rising these days.

When we have an intense sense of self-importance, we always want to be acknowledged, thanked, appreciated, ad-mired, spoken highly by others. We would

ORDER In a motion filed for

the purpose, petitioners through their counsel seeks the approval of this Court to allow them to have the order of the Court dated 27 Febru-ary 2020 and the peti-tion to be published in a newspaper of general circulation in the Prov-ince of Leyte or the entire Region VIII instead of a national newspaper of general circulation as embodied in the Order. Movants are that the bio-logical father of the child sought to be adopted, al-though the whereabouts is unknown, is a nature of Eastern Samar, hence the motion.

The Court GRANTS the motion – Section 12 of the Rule of Adoption (Domestic Adoption) mandates that the Court order setting the date and place of hearing shall be published before the date of hearing at least three (3) days once a week for three consecutive weeks in a newspaper of gen-eral circulation in the province or city where the Court is situated. Thus, publication in a national newspaper of general circulation is not necessary.

WHEREFORE, this Court allows the peti-tioners to have the order setting the hearing and the petition to be pub-lished in a newspaper of general circulation in the province or region where this Court is located. This Order amends the previ-ous order in so far as to the place where publica-tions of the Court order setting the date of hear-ing and petition should be made.

5. P e t i t i o n e r Frances is the grand aun-tie by consanguinity of the minor sought to be adopted being the auntie of Ma. Victoria, biological mother of the minor, thus she is a relative within the 4th civil degree.

6. Shortly after the birth of minor, Rovic, his biological father, Roli-to, left Ma. Victoria. Since then, Rolito’s where-abouts are unknown, despite diligent efforts to locate him.

7. Ma. Victoria and Rolito, Rovic’s par-ents, were never married to each other.

8. S o m e t i m e in April 2016, Rovic’s biological mother, Ma. Victoria, unable to sup-port Rovic, and honestly believing that it would be for his best interest, voluntarily entrusted him to the case and cus-tody of her aunt, herein petitioner Frances. Since then, petitioners have

been providing for the needs of Rovic, includ-ing but not limited to feeding him, providing him clothes and shelter, sending him to school and giving him materials needed for his schooling and all other needs and taking care of him, as is their natural born child.

9. Ma. Victo-ria, did not abandoned Rovic, on the contrary, she has full knowledge of petitioners’ intention and has expressly given her consent to the adoption, a copy of her Affidavit of Consent is hereto at-tached and marked as Annex “C” and made an integral part hereof.

10. Petitioners are of good moral character and have not been con-victed of any crime in-volving moral turpitude.

11. Petitioners are physically, financially, emotionally and psy-chologically capable of caring and raising Rovic. Both are at least sixteen (16) years older than Rovic, and has in fact, been maintaining, caring for, educating and sup-porting Rovic since 2016.

12. Thus, petition-ers have all the qualifica-tions and none of the dis-qualifications under the law to adopt Rovic, who is a relative within the 4th degree of consanguinity of petitioner Frances.

13. Rovic, likewise is not disqualified to be adopted under the law and maintaining the cur-rent set-up wherein he will be legally part of the family of petitioner who has been raising him for the past three (3) years, will be for the best inter-est and well-being fo the minor child sought to be adopted.

it is most respectfully prayed of this Honor-able Court that after due notice, publication, hearing and judgment be entered issuing a DE-CREE OF ADOPTION declaring that the minor child ROVIC BERINGA VALDENOR be freed from all legal obligations of obedience and mainte-nance with respect to his natural parents, and be considered as the legiti-mate child of petitioners, and that his surname be changed to that of the petitioners.

productive journey amidst the General Community Quarantine by not just staying at home, but also transforming themselves as Youth in Agriculture.

Due to the lack of access to resources and poor economic opportunities, food security and sufficiency have become key issues amidst this COVID-19 pandemic. To address this, the SK Federation of Baybay City has spearheaded the #YouthInAgriculture campaign in order to engage with local youths in providing healthy and sustainable supply of food.

With the foregoing, the Sangguniang Kabataan of Baybay City continuously supports its SK Councils across the 92 Barangays by collaborating with potential partners such as the East West Seeds Com-pany, Inc. and the Baybay City Agriculture Office by means of providing each SK Council with assorted vegetable seeds in the production of their respective vegetable gardens in the barangay.

Anent to this, as a way of empower-ing more young people to engage and be part of the campaign dubbed as “Youth In Agriculture”, the said SK launched the “Vegetable Garden Contest” highlighting the importance of engaging in agriculture amid the COVID-19 Pandemic that was published through a video documentary, in order to showcase and encourage agricul-tural production among the youth.

The aforementioned video entries were posted in the official Facebook page of the Sangguniang Kabataan of Baybay City to en-sure a wide reach of audience across all the SK Councils and the entire young people in general.

The Vegetable Garden Vegetable Garden Contest is in partnership with the Positive Youth Development Network (PYDN) through the HingyapPH, wherein cash prizes will be given to the outstanding SK Councils, including special awards and consolation prizes. (PR)

suffer when we are ignored, and more so when we are insulted and humiliated. We would always want to show off, if not to dominate others.

When we have this anomaly, we many times end up uneasy and tense, obsessed with perfectionism and the urge to control and to be on top of others. We always want to succeed and to win in any game. And when we lose, we usually become a sore loser, feeling quite devastated.

Another sign of this perverse sense of self-importance is to have an extreme feeling of entitlement. We would want to have as many privileges and benefits to such an extent that we would feel deprived if we would not have any of them. We also would become over-sensitive.

We should learn to clearly distinguish between a healthy high self-esteem and a bloated sense of self-importance. We should know where the basis of this distinction lies.

Pastor and Rosinda Mondido, Sps. Pablo and Luzviminda Condino and Jocelyn Dalot; and

2. Supplemen-tary Motion (RE: To De-clare Defendants in De-fault) filed by plaintiffs thru counsel praying that all of the defendants be declared in default considering that none of them filed an Answer.

The Court has scru-tinized the attached copy of the aforementioned EV Mail issues and found that the publication is non-compliant with the 12 March 2018-Order of this Court. In the said Order, the Court has spe-cifically directed for the publication in a newspa-per of general circulation the summons together with the complaint upon the defendants. It would appear that the com-plaint was not published as directed.

Wherefore, forego-ing premises considered, plaintiffs are directed to substantially com-ply with the 12 March 2018-Order of the Court. Pending compliance, the hearing on the plaintiffs Motion to Declare De-fendants in Default is deferred.

1. Plaintiff Sonia Canin-Tampus is of legal age, married and a resi-dent of Brgy. naghalin, Kananga, Leyte while all the heirs of Rogelio Canin namely: Rogelio Canin Jr. is of legal age, single and a resident of Brgy. Naungan, Or-moc City; Pereger Odilio

Canin is of legal age, married and a resident of Cebu City; Sherry Heidee Jakobs is of legal age, married and a resident of Chesapeake, Virginia USA and lastly Mahara-nee Busi is of legal age, married and a resident of Palm, Springs Caligornia USA. The heirs of Rog-elio Canin is represented in this case by their attor-ney-in-fact Gabriel Har-ris Busi which is likewise of legal age, single and a resident of Brgy. They can be served with summons and court pro-cesses at Brgy. Naghain, Kananga, Leyte;

4. That both par-ties have the capacity to sue and be sued;

5. Plaintiffs So-nia Canin -Tampus and the late Rogelio Canin

together with and de-fendants Elena Canin-M a d e j a , I l u m i n a d a Canin-Gementiza, Ber-nardina Canin-Campus, and Nicolas Canin are the legal and compulsory heirs of the late spouses Alejandro Canin and Alejandra Canin who died intestate on June 4, 1991 and July 15, 2006 re-spectively. Copy of their death certificates hereto attached as ANNEX “E”, and “F”;

6. Spouses Ale-jandro and Alejandra Canin have six (6) chil-dren namely: SONIA CANIN-TAMPUS, RE-GELIO CANIN, ELE-NA CANIN-MADEJA, ILUMINADA CANIN-GEMENIZA, BERNAR-DINA CANIN-CAMPUS and NICOLAS CANIN. Copy of the certificate of baptism of Sonia Canin-Tampus as ANNEX “”G”;

7. Plaintiffs Ma-haranee M. Canin-Busi, Sherry Heidee M. Canin-Jakobs, Peteger Odilio M. Canin and Rogelio Canin Jr. are the children of Rogelio Canin who predeceased his parents Alejandro and Alejan-dra Canin. Copy of their certificate of live birth as well as the death cer-tificate of Rogelio Canin hereto attached as AN-NEXES “H”, “I”, “J”, “K”, and “L” respec-tively;

8. At the time of the death of spo9uses Alejandro and Alelandro Canin, they left 14 parcels of land particularly de-scribed as follows:

The assessed value of all the subject lots ex-ceeds P20,000.00 as can be seen in the tax dec-larations. Copy of the tax declarations heretyo attached as ANNEXES “M”, “N”, “O”, “P”, “Q”, “R”, “S”, “T”, “U”, “V”, “W”, “X” “Y”, and “Z”,

9. Since, Spouses Alejandro and Alendra Canin have six children, therefore each of the child is entitled to one-sixth (1/6) share of their estate;

10. H o w e v e r , plaintiffs and defendants could not agree as to the physical division of the subject lot considering that defendants are occu-pying the better portion while plaintiffs are not amenable to the portion allocated to them by the defendants;

11. Considering that the parties are rela-tives, earnest effort to settle the matter amica-bly had been exerted but unfortunately failed. On August 17, 2016 plaintiffs through counsel sent a letter to the defendants in the hope of settling the matter amicably but it fails despite the earnest efforts exerted. Copy of the letters hereto at-tached as ANNEXES “AA”, “BB”, “CC” and “DD”;

12. Premises con-sidered, plaintiffs have no other option but to invoke the aid of the

court in order to physi-cally divide the estate of the late Alejandro and Alejandra Canin.

13. Plaintiffs and defendants are not resi-dents of the same City or Municipality and there-fore previous referral to the office of the baran-gay chairman or lupon tagapamayapa is not a pre-requisite in filing this case;

14. Defendants’ continued and unjustifi-able refusal to divide the subject lots in a fair manner is tantamount to bad faith on their part;

15. By reason of defendant’s unjustifi-able refusal to physically divide the subject lot caused the plaintiffs seri-ous anxiety and sleepless nights and therefore the former should be made to indemnify the latter for moral damages in the amount of P50,000.00;

16. Likewise, to deter other who have the inclination to do same act as defendants are doing, defendants should like-wise be ordered to pay P20,000.00 as exemplary damages;

17. Defendants’ unreasonable act has compelled the plaintiffs to litigate this mater which constrained them to hire the services of a counsel incurring an expenses of P40,000.00 as acceptance fee plus P2,000 in every court ap-pearance.

PRAYERW H E R E F O R E ,

plaintiff respectfully prays that judgment be

rendered: a) D e c l a r i n g

plaintiffs to be lawful heirs of the late Alejandro and Alejandra Canin;

b) Declaring the plaintiffs Sonia Canin-Tampus and the Heirs of the late Rogelio Canin to be entitled to one (1/6 share each of the subject lots or estate of the late Alejandro and Alejandra Canin;

c) Ordering the physical division of the subject estate late Alejan-dro and Alejandra Canin;

d) Ordering de-fendants to pay the at-torney’s fee in the sum of P40,000.00 plus cost of litigation;

e) Ordering de-fendants to indemnify the plaintiffs the sum of P50,000.00 as moral damages and P20,000.00 as exemplary damages.

Other reliefs just and equitable under the circumstances are like-wise prayed for.

Dumaguit shared that in 2019, they earned a total net income of Php 900,000 that they divided for their savings, optional fund, training fund, and com-munity development fund that they use to support their elementary school and a newly-organized asso-ciation in their municipality through “Ipasa ang Pag-asa” program by providing them with 10 piglets and feeds worth Php 70,000.

Although their income from tourists was lost, Du-maguit said they were able to survive because of their alternative sources of in-come.

“We were taught by the ABS-CBN Foundation of other means to earn be-cause NASAKASECO is composed of 3 associations – farmers, fisherfolk, surf-ers. Since we only have 8 working hours here, I went back to fishing,” he added.

Before the lockdown, the workers planted many vegetables such as lettuce in their “Balay Utanan”. They used to sell or cook them for their guests.

“If we only rely on our income here, it will not suffice for all the needs of our family that is why we diverted our attention to our other sources of income such as our vegetable, herb, and ornamental garden,” he said.

Dumaguit said they sell herbs and ornamental plants that they use to buy feeds for their animals and pay their utilities.

“We have a lot of buy-ers but we only do meet-ups because our barangay does not allow non-residents to come here. We also sell our products online,” he added.

Aside from that, the as-sociation has also donated vegetables to frontliners in Dulag, adding, “Just like what we have learned from Ma’am Gina (Lopez) to not only rely on dole-outs, we were also taught how to share our blessings so we gave vegetables to our frontliners.”

In Tunga, Leyte, Beengo Farm, an Agricultural Train-ing Institute (ATI)-certified learning site, which pro-vides training on basic bee-

keeping, has also managed to survive the pandemic after being damaged by Typhoon Ursula during Christmas last year.

Gary Ayuste, the owner of Beengo Farm shared that they were still rebuilding the farm when they learned about the lockdown.

“It was a 360-degree change for us because we did not allow visitors to come in unless they will pick up their orders. For three months we did not sell food. It was really hard,” he recalled.

The 400-meter farm located in the smallest mu-nicipality in Leyte used to cater to no less than 30 persons a day with an av-erage of Php 250 spending per person, excluding their income from selling herbs.

However, Ayuste la-mented that during the lock-down, even the members of the Empowered Farmers Association of San Vicen-te composed of at least 20 housewives that he formed were not allowed to gather as part of the health protocols.

“Luckily, we were able

to create a communal garden a few days before the lock-down, so during the time when there were no relief goods being given by the local government unit, we were able to harvest sweet potatoes, peanuts, and corn that added to their food sup-ply,” Ayuste shared.

With no tourists al-lowed, the farm focused on selling plants, which has become a trend nowadays. According to him, the de-mand for ornamental plants has drastically increased. Ayuste also earns from his speaking engagements through webinars.

“These herbs are amaz-ingly sustainable. There’s money if you really work hard because it requires time and smart farming,” he noted.

For starters, Ayuste sug-gested planting mints because they are more sustainable and are expensive. “They are easy to grow and guarantee better revenue,” he said.

They have also shifted to becoming a family enterprise. Since his niece and nephews have no class, they are now helping him on the farm.

Ayuste also expressed optimism that their plans to expand the farm will push through as soon as the quarantine is over.

“We have a honey wine bar opening soon. We will start discovering local talents that will perform here every last weekend of the month. We will also add freedom soap from beeswax with goat’s milk and honey in our list of products,” he shared.

He added that part of the proceeds of the free-dom soap will be allotted to provide soap to persons deprived of liberty, while their other programs such as

“Project Basa (Batang Aan-gat sa Alaedmiko at Agri-kultura)” for the children in the community will resume.

Beengo Farm also aims to be the pioneer school for beekeeping in Visayas in partnership with the Techni-cal Education Schools Devel-opment Authority (TESDA), with him being tagged as the national validator for the beekeeping course.

“COVID-19 has prac-ticed my mind to focus here on the farm because I have been traveling a lot for my other engagements be-fore,” he stressed. By Marie Tonette Marticio

RESOLUTION NO. 99, S - 2020AMENDING MUNICIPAL ORDINANCE NO. 111, SERIES OF 2020

WHEREAS, Title I, Chapter 2, Section 20 of RA 7160 states that “(a) a city or municipality may, through an ordinance passed by the Sanggunian after conducting public hearings for the purpose, authorize the reclassification of agricultural lands and provide for the manner of their utilization or disposition in the following cases: (1) when the land ceases to be economically feasible and sound for agricultural purposes as determined by the Department of Agriculture or (2) where the land shall have substantially greater economic value for residential, commercial or industrial purposes, as determined by the sanggunian concerned;

WHEREAS, the Implementing Rules and Regulations of the Local Government Code provides that a municipality shall continue to prepare their respective comprehensive land use plans (CLUP), enacted through zoning ordinances, subject to applicable laws and regulations;

WHEREAS, the said IRR also prescribes that such plans shall serve as the primary and dominant bases for future use of land resources and reclassification;

WHEREAS, the municipality does not have an existing comprehensive land use plan nor enacted zoning ordinance, hence, the Sangguniang Bayan exercised its power to reclassify lands so that such reclassification will be incorporated in the making of CLUP;

WHEREAS, Section 65 of RA 6657, otherwise known as the Comprehensive Agrar-ian Reform Law of 1998, likewise empowers DAR to authorize, under certain conditions, the reclassification or conversion of lands awarded to agrarian reform beneficiaries;

WHEREAS, based on the submitted documents for application, the Sangguniang Bayan finds no Certificate of Land Ownership Award (CLOA), hence, it is of presumption that it is not covered by the certain conditions for DAR to be authorize to reclassify such lands;

WHEREAS, it is a well settled rule in statutory construction that a mere Executive Order cannot supersede a national law, such as the Local Government Code of 1991, which grants the power of the local sanggunian to reclassify lands within its jurisdiction;

WHEREAS, the housing projects for the victims of the super typhoon Yolanda was an overdue project wherein the president of the Republic of the Philippines Rodrigo Roa Duterte directed the Presidential Assistant for the Visayas, Michael Diño, to expedite the completion of the projects in the Eastern Visayas before the year end;

WHEREAS, based on SP Resolution No. 2020-498, otherwise known as “A Resolu-tion Returning to the Sanggunian of origin, Municipal Ordinance No. 111, Series of 2020 of the Sangguniang Bayan of Villaba, Leyte to clarify grounds for reclassification and to provide legal basis”, the SP asked the SB of origin to clarify the ground for reclassification and that there is a need to spell-out their legal basis, hence, this amendment;

economic value for residential purposes; and2.3 the said reclassified land, does not exceed the limitation on the percentage of

the total agricultural land area at the time of the passage of this ordinance. 2.4 the municipality does not have an existing comprehensive land use plan

nor enacted zoning ordinance, hence, the Sangguniang Bayan exercised its power to reclassify lands so that such reclassification will be incorporated in the making of CLUP;

2.5 based on the submitted documents for application, the Sangguniang Bayan finds no Certificate of Land Ownership Award (CLOA), hence, it is of presumption that it is not covered by the certain conditions for DAR to reclassify such lands;

2.6 Section 534 (e) of Local Government Code of 1991 states that all general and special laws, acts, city charters, decrees, executive orders, proclamations and administrative regulations or part or parts thereof which are inconsistent with any of the provisions of this Code are hereby repealed or modified accordingly. Hence, RA 6657 specifically Section 65, being one of those laws cited above and enacted prior to the enactment of the LGC, the Sangguniang Bayan is of the position that said law is already repealed and it has the power to reclassify lands within its jurisdiction

Section 3. This Ordinance shall take effect fifteen (15) days from publication of a local news paper or in a three (3) conspicuous places in the Municipality.

AN ORDINANCE SUPPORTING PROPER DENTAL HEALTH PRACTICE AND PENAL-IZING ILLEGAL DENTAL HEALTH PRACTITIONERS IN THE CITY OF BORONGAN.

TITLE, STATEMENT OF POLICY, OBJECTIVES, AND SCOPE OF PRACTICESection 1. Title. This Ordinance shall be known as “The City of Borongan Dental

Health Practice Ordinance of 2020”. Section 2. Statement of Policy. The State recognizes the importance of dentists, dental

hygienists and dental technologists in nation-building. Hence, it shall develop and nurture competent, productive, morally-upright, and well-rounded dentists, dental hygienists and dental technologists whose standards of professional practice and service shall be excellent, qualitative, world-class and internationally recognized, globally competitive through regula-tory measures, programs and activities that foster their continuing professional development.

Section 3. Objectives. This Ordinance provides for:(a) The regulation, control, and supervision of the practice of dentistry, dental

hygiene and dental technology in the City of Borongan;(b) The local registration and regulation of dentists, dental hygienists and dental

technologists in the City of Borongan,(c) The accreditation of the various specialties of dentistry;(d) The promotion and development of continuing dental education and research in the city;(e) The enforcement of the Code of Ethics and Code of Dental Practice in the

Philippines; and (f) The stipulation of penalties for infractions or violations of the Act, any other

laws, rules and regulations authorized under the provisions of the Act and this ordinance.Section 4. Definition and Scope of Practice.The following are Dental Practitioners;(a) Dentist – refers to a person who is a holder of a valid certificate of registration

and professional identification card in Dentistry who renders dental service within the meaning and intent of this Law and who, for a fee, salary, compensation or reward, paid to him/her or through another, or even without such compensation or reward, performs any operation or part of an operation, upon the human oral cavity, jaws, teeth, and surrounding tissues: prescribes drugs or medicines for the treatment of oral diseases or lesions, or prevents and or corrects malpositions of the teeth or implantation of artificial subtitutes for lost teeth; and teaches subjects in the licensure examination; or engages in dental research:

Provided, however, that this provision shall not apply to:1. Dental technologies engaged in the mechanical construction of artificial den-

tures or fixtures or other oral devices, as long as none of such procedures is done inside the mouth of the patient;

2. Students of dentistry undergoing practical training in a legally constituted dental school or college under the direction or supervision of a member of the faculty who is duly licensed to practice dentistry in the Philippines;

3. Registered dental hygienists who may be allowed to perform preventive oral hygiene procedures and other procedures or to dentistry graduates working as dental as-sistants to licensed and registered dentist authorized to practice dentistry in the Philippines who are engaged in private practice. Provided, further, that these dentistry graduates work under their direct supervision.

(b) Dental Hygienist – refers to a person who is a holder of a valid certificate of registra-tion and professional identification card and has undergone a two year course in dental hygiene from a government recognized school under a college of dentistry and passing the prescribed board examination for dental hygienist, renders oral health promotion and preventive measures, performs scaling and polishing, oral examination, taking brief clinical history, taking radiograph, and giving oral health education to patients under the supervision of a licensed dentist.

(c) Dental Technologies – refers to a person who is a holder of a valid certificate of registration and professional identification card and who renders and who renders technical services such as mechani-cal construction of artificial denture and other oral devices under the supervision of a licensed dentist, and has finished a two year certificate course in dental technology from any government recognized school.

ARTICLE II PRACTICE OF DENTISTRY, DENTAL HYGIENE AND DENTAL TECHNOLOGY

Section 5. Code of Ethics and Code of Dental Practice for Dentists. The existing Code of Ethics and Code of Dental Practice of dentists, dental hygienists and dental technologists prescribed and issued by the accredited professional organization of dentists shall be strictly implemented in the City of Borongan.

Section 6. Registration without Examination for Dental Hygienists and Dental Tech-nologists. The provisions of RA 9484 with regards to the registration without examination for dental hygienists and dental technologists shall be strictly implemented as provided for in Section 27 of the Act as follows:

a. Had been given a certificate in dental hygiene or dental technology by a duly recognized college, school or institution and had at least three years actual experience as dental hygienist or dental technologists in an accredited or licensed dental clinic or laboratory; or

b. Had been practicing as a dental hygienist or dental technologist for at least five (5) years in a licensed dental laboratory or clinic under the supervision of a dentist and had attended a training course given by an accredited school or institution accredited and certified by TESDA.

Section 7. Display of Name and Certificate of Registration Every registered practicing dentist, dental hygienist and dental technologist shall display in a conspicuous place in the building or office where he/she practices, his/her name or his/her certificate of registration in plain sight of patients who enter the dental office, or dental clinic or dental laboratory. In the case where the dentist has more than one clinic, the original certificate should be displayed in his/her main office or clinic, and he/she shall display a copy of his/her certified original certificate of registration in the other branch or branches of his/her practice. Any owner or proprietor of a dental office or establishment shall display the certificates of registration of each and every one of such persons in the same manner as hereinafter provided.

Section 8. Continuing Professional Education. The PRC Board in collaboration with the accredited professional organization (APO), shall implement the continuing professional educa-tion among practicing dentists, dental hygienists and dental technologists in consonance with the guidelines of the Continuing Professional Education (CPE) council of the Commission. Exemption from the CPE program may be applied for upon reaching the age of sixty-five (65).

ARTICLE IIIPDA- EASTERN SAMAR CHAPTER AND CITY HEALTH OFFICE

Section 9. Registration of Dental Health Practitioners. The PDA- Eastern Samar chapter shall be responsible with the Registration of all dental practitioners in the City of Borongan. It shall appoint an officer for the regulation of the dental practice in Borongan City. All dental health practitioners who intend to practice in the City of Borongan shall have to be a registered PDA member in Eastern Samar. The PDA shall issue the corresponding certificate which shall provide for the privilege of practicing activities related to dental health. No dental health practitioner shall be allowed to practice within the City of Borongan without the proper registration with the PDA- Eastern Samar Chapter and the proper certification.

Section 10. Submission of Roster of all Dental Practitioners. The PDA-Eastern Samar Chapter shall submit a roster of all dental practitioners in Borongan City indicating therein the status of their current registration on or before fifteen days after the effectivity of this Ordinance to the chairman of committee on health of the Sangguniang Panlungsod and all City Health Offices. The roster shall be regularly updated whenever new members are registered by the PDA-Eastern Samar Dental Chapter.

Section 11. Warning against illegal Dental Practitioners. The PDA-Eastern Samar Chapter shall file complaint to the City Health Office against illegal dental practitioners must immediately issue a written warning to all slating therein mandatory compliance to this ordinance within 10 days from receipt of the letter. Such written warning must be personally delivered by a representative, an official or employee, of the City Health Office to the illegal dental practitioner. The following must accompany during the personal delivery of the written warning.

a. Any 2 elected Barangay officials on the location of the dental practice of the illegal dental practitioner, provided that the attendance of the Punong Barangay and the Barangay Kagawad who is the chairman of the committee on health shall be preferred.

b. A member of PNP Borongan City or any respectable member of the community who is not a dental practitioner ; and

c. A member of the PDA-Eastern Samar Chapter.Receipt by any person present in the location of the dental practice of the illegal dental

practitioner shall be considered as receipt of the written warning by the illegal dental practitioner provided that the PDA shall explain in details to the recipient the violation, the legal consequences and the mandatory answer explanation by the illegal dental practitioner. In case no one wants to receive the written warning, it shall be considered delivered with the barangay officials, the PNP member and the PDA member indicating in the receiving copy of the written warning that it was not received, that they have left the copy of the written warning in an area within the vicinity of the illegal dental practitioner’s house or place where he conducts the illegal dental practice, and then affixing their respective signatures in the said copy to certify what they have done.

Section 12. Post Delivery of Written Warning. A written warning not received may be sent through post-delivery or through snail mail. In case this is done, the persons accompany-ing the representative of the City Health Office shall issue an affidavit stating the following.

a. Their presence during the personal delivery of the written warning.b. The date, day and time of the personal deliveryc. The fact that the PDA explained to the illegal dental practitioner the legal

consequences of his/her actions.d. Other circumstance during the personal delivery.Section 13. Recommendation to the Legal Office. After 10 days from the delivery of the written

warning, the City Health Officer shall recommend legal action to the City Legal Officer attaching therein the written warning stamped received by the recipient and/or the affidavit of the accompanying persons.

Section 14. Responsibility of the City Legal Officer. The City Legal Officer must act upon the recommendation of the City Health Office within 15 days from receipt thereof.

Section 15. Penalty for Non-implementation. The City Health Office shall personally explain to the Sanggunian Panlungsod the reasons for their non-implementation of the said ordinance and may at the discretion of the Sanggunian be accountable to face administrative sanctions.

ARTICLE IVPENAL PROVISION AND ENFORCEMENT OF THE ACT

Section 16. Penal Provision. The following, shall be punished by a fine of not less than Two Thousand Pesos (P2,000.00) but not less than one (1) month but not more than (1) year, or both, upon the discretion of the court.

a. Any person who shall practice dentistry, dental hygiene or dental technology in the City of Borongan as defined in this ordinance, without a certificate of registration and professional identification card and special permit issued in accordance with the provisions of RA 9484 otherwise known as the Philippine Dental Act of 2007, or has been exempt,

b. Any person who practices the profession to whom the definition of the practice of dentistry, dental hygiene or dental technology does not apply.

c. Any licensed dentist who shall abet the illegal practice of dentistry,d. Any person presenting or using as his/her own the certificate of registration

and professional identification card and special permit of another.e. Any person who shall give any false or forged evidence to the Board in obtaining

a certificate of registration,f. Any person who shall impersonate any registrant of like or different name.g. Any person who shall use a revoked or suspended certificate of registration

and professional identification card,h. Any person who shall assume, use or advertise as a bachelor of dental sur-

gery, doctor of dental surgery, master of dental surgery, licentiate of dental surgery, doctor of dental surgeon, or append to his name the letters D.D. S., B. D. S., L. D. S. or D. M. D. without having been conferred such title or degree in a legally constituted school, college or university, duly recognized and authorized to confer the same or other degrees, and

i. Any person who advertises any title or description tending to convey the impres-sion that he/she is a dentist, without holding valid certificate of registration and professional identification card and special permit from the Board.

ARTICLE VMISCELLANEOUS PROVISIONS

Section 17. Separability Clause. – If any section or provisions of this Ordinance shall be declared invalid or unconstitutional, such shall not invalidate any other section or provision of this Ordinance.

Section 18. Repealing Clause. – All other ordinances and issuances in conflict with the provisions of this Ordinance as pertain to the practice of dentistry shall be, and are hereby repealed.

Section 19. Effectivity. – This Ordinance shall take effect following its posting and publication in any newspaper of general circulation.

AN ORDINANCE ESTABLISHING STRICT SAFETY MEASURES IN ORDER TO MINI-MIZE THE POSSIBILITY OF LOCAL TRANSMISSION OF COVID-19.

WHEREAS, Section 5, Article II of the 1987 Constitution of the Philippines provides that, the maintenance of peace and order, the protection of the life, liberty and property, and the promotion of general welfare are essential for the enjoyment by all the people of the blessings of democracy;

WHEREAS, Section 16 of the Local Government and Section 5 of Republic Act 9394, otherwise known as the Charter of the City of Borongan, states that the local government unit has the duty to exercise the powers expressly granted, those necessarily implied therefrom, as well as powers necessary, appropri-ate or incidental for its efficient and effective governance, and those which are essential to the promotion of the general welfare for various purposes especially with regards to the promotion of the health and safety of the people and preserve the comfort convenience of the Boronganons;

WHREAS, on March 23, 2020 Republic Act No. 11469, otherwise known as the “Bayanihan Heal as One Act of 2020” or “An Act Declaring the Existence of a National Emergency arising from the Coronavirus Disease 2019 (COVID-19) situation and national policy in connection therewith and authorizing the President of the Republic of the Philippines for a limited Period and subject to restrictions to Exercise Power necessary and proper to carry out the declared national policy and for others purposes”;

WHEREAS, under Section 5.1.1 of DILG Memorandum Circular Bo. 2020-062 entitled as “Suppletory LGU Guidelines on the Implementation of Enhanced Community Quarantine in Luzon and State of Public Health Emergency in other parts of the country due to COVID-19 Threat” all LGUs are charged with the promotion of health and safety within their jurisdiction, and as such, the City Government of Borongan is expected to take the lead in the prevention and control of the spread of COVID-19 at the local level;

WHEREAS, as per declaration of His Excellency President Rodrigo Roa Duterte last 22 May 2020 and the issuance of an executive order by the City Mayor last 31 May 2020 the City of Borongan has been placed in a state of Modified General Community Quarantine (MGCQ) effective 01 June 2020;

WHEREAS, the threat of COVID-19 continues and so the necessary protocols should still be strictly implemented to avoid the local transmission of the virus;

Be it enacted by the Sangguniang Panlungsod of the City of Borongan in session assembled:Section 1. Short Title. This ordinance shall be known as “Borongan City New Normal

Health Procotols Ordinance of 2020”. Section 2. Statement of Policy. Public health and safety is of supreme importance

over that of personal rights especially in times when the immediate threat to life and health has been acknowledged and considered to be a national emergency. At present, the threat of COVID-19 is projected to go beyond months and even years as no immediate medicine, vaccine or any other form of treatment is available. Hence there is a need to implement public safety measures that must be enforced after the lifting of any level of quarantine. These measures therefore are intended to be implemented beyond any declaration of quarantine as long as there is a constant threat of local transmission of the COVID-19.

Section 3. Definition of Terms. For purposes of this Ordinance, the following defini-tions will be adopted:

a. Authorized Activity shall refer to any activity that is allowed by the national, re-gional, provincial and city governments and their instrumentalities as provided or promulgated through a law, ordinance, executive order, administrative order, circular, memorandum, letter of instruction, and the like in accordance with set guidelines such as the limited attendance to the celebration of a religious activity, conducting outdoor exercises, etc.

b. Business Establishment shall refer to any area, building, center, or place where trade, commerce, industry or the selling, production, barter, or exchange of goods and services, and other related activities are conducted.

c. Face Mask shall refer to any form of mask that protects the nose and mouth from potential contaminants. These include surgical masks, medical masks, N95 masks, do-it-yourself masks, industrial masks, handkerchief or any device that creates a physical barrier between the nose and mouth of the wearer and airborne particles.

d. Public Place shall include all areas within the territorial jurisdiction of the City of Borongan that people frequently visit, including but not limited to parks, national roads, city streets, places of worship, terminals for public vehicles, wet markets, groceries, sari-sari stores, drugstores, banks, ports, money changers, pawnshops, dental clinics, medical clinics, public and private buildings, schools, commercial establishment, and others.

e. Reasonable Purpose shall refer to any intention, objective or goal that under sensible, practical and usual circumstances are allowed to be conducted, performed or accomplished as the prohibition of which may imperil or endanger life, health, safety, security and property of a person or a community such as responding to an emergency call or the delivery by a senior citizen or a minor of basic necessities to those in need when no other recourse is available. For this purpose, the apprehending officer/s may either assists, accompany or perform other necessary action in accordance with the intention, objective or goal.

Section 4. Safety Measure to be Implemented. The following safety measures shall be strictly implemented in the City of Borongan until such time that the Department of Health (DOH) declares the zero possibility of any threat of COVID-19 in the country.

a. Mandatory Use of Face Mask. Face mask shall be worn at all times when one is going to any place public place frequented by other people.

a.1. A face mask may only be removed when so ordered by duly constituted authori-ties for the purpose of:

may cause health problems such as during outdoor exercises provided that the physical distance required to ensure zero possibility of the transmission of coronavirus ad other communicable disease is maintained.

b. Strict implementation of Social or Physical Distancing Policy:b.1. Maintain at least one (1) meter distance from another person when in public places;b.2. Business owners must place posters or signage and markings on the floor to

promote physical distancing.b.3. Business establishments must provide acetate or any barrier on their counters;b.4. Avoid any gathering or activity where the one (1) meter apart policy cannot be

strictly enforced; andb.5. Limit the number of customers inside the establishments up to 50% of the

capacity of the establishment;c. Strictly implementation of hygiene and sanitation in public places. The following

measures must be strictly observed:c.1. Customers and clients of business establishments and offices must have access

to alcohol, hand sanitizers or other disinfectants all times. If unavailable, establishment or office must provide handwashing area;

c.2. Workers suffering from flu-like symptoms shall not be allowed to report to work and must be given alternative working arrangements by the superior or the owner;

c.3. Any person entering an enclosed, walled or contained establishment or office must be thermal scanned;

c.4. All work areas and frequently handled objects such as doorknobs and handles shall be cleaned and disinfectant regularly, at least once every two (2) hours; and

c.5. Alcohol or hand sanitizers shall be made available in corridors, conference areas, elevators, stairways and areas where people pass by.

d. All persons are encouraged to stay home especially seniors, minors, pregnant, those with co-morbidities except for the following purposes:

d.1. To go to work;d.2. To seek medical attention;d.3. To buy essential goods;d.4. To perform other authorized activities; and/or d.5. To go out for other reasonable purposes.Section 5. Exemptions to the Physical Distancing Rules. In cases of activities where

physical distancing shall be impossible to strictly impose such as the carrying of heavy objects when the use of an equipment is impossible, conducting haircuts, dental treatments, and such other activities that physical proximity cannot be avoided and physical distancing is somehow impossible, the issued guidelines from relevant government agencies and ac-credited professional organization shall be considered as suppletory to this Ordinance and may be incorporated in the formulation of the Implementing Rules and Regulations (IRR).

Section 6. Penalties for Violations of this Ordinance. The following shall be the prohibited acts with their corresponding penalties.

a. Failure of government officials and employees to implement or follow this Ordinance. Any government official or and employee who shall fail to implement or abide by the provisions of this Ordinance shall be criminally, civilly and administratively liable depending on the extent of harm or damage that may happen or be experienced by any citizen, or another government official or employee, due to the failure of enforcement of this ordinance or on his or her negligence which may put another at risk of infection in accordance with pertinent CSC Rules and other laws and issuances.

b. Failure to implement the safety measures within offices establishments and other public places:

First Offense: -P5,000.00 fine with warningSecond Offense: -P5,000.00 fine and the revocation of business permit, if business establishment, without any prejudice to other legal actions under national laws and issuances.c. For the individual violations:First Offense -P3,000.00 fine Second Offense -P4,000.00 fineThird Offense and -P5,000.00 fine with imprisonment for not more than 30 days or upon the discretion of the courtIn case of minor offenders, the parents or legal guardians shall be a liable for the

payment of penalty.Section 7. Implementing Offices. The Office of the City Mayor (CMO) shall be the main

implementing office of this ordinance with the assistance of the City Health Office (CHO) and the Borongan City Police Station (BCPS). However, the City Mayor may, through an executive order, create a Task Force and designate other offices to help in the implementation of this ordinance and through the same executive ordinance provide the duties and functions of the Task Force and detailed guidelines to ensure the full and strict enforcement of this ordinance.

Section 8. Flexibility Clause. In case of any issuance coming from national, regional and provincial authorities concerned regarding the imposition of stricter protocols these shall be implemented within the period indicated in such issuance without need for any legislative action unless provided for in the same issuance.

Section 9. Separability Clause. In case a parts of this ordinance is rendered ultra vires, the parts not affected shall continue to be effective.

Section 10. Repealing Clause. All existing ordinances and other local issuances that are inconsistent with this ordinance shall be amended or revised accordingly except where provided above.

Section 11. Effectivity Clause. Due to the urgency of the matter, this ordinance shall take effect immediately upon approval and shall continue to be in effect until such time that the national government issues an official declaration regarding the lifting of the national health emergency in relation to.
