located here or by clicking the Resident Login tab at www.mh3condos.com

If you are unable to email or come in the office, please call 303-841-8658. Give your name, address, phone number and explain your request as clearly as you can so the Work Order can be issued correctly. Please give the exact location of the issue or problem to eliminate any potential error. Please note that any request that is owner responsibility and will result in the charge being billed to your HOA account and that payment will be due immediately.

COVENANTS, CONDITIONS AND RESTRICTIONS INFO THESE RULES APPLY TO EVERYONE WITH NO EXCEPTIONS:

• The HOA is responsible for the exterior of each unit.• No alterations can be made to “anything” exterior without HOA approval.• Two pets (domestic, i.e. cat or dog)

maximum per household. Residentsare responsible for pets to be on aleash, to clean up after them, and toregulate potential noise issues.

• Parking lots are not to be used as playgrounds (for everyone’s safety!).• Patios and walkways cannot be used for storage.• Window covering – blinds, curtains in good repair only.

ARCHITECTURAL REVIEW PROCESS The exterior of the condominiums is maintained and regulated by the Association. Any change to the exterior components, including gates, lattice, doors and windows, must pass through the architectural review process prior to work being done. If any change or replacements have not been approved, they may be subject to removal and replacement to meet the association’s guidelines and policies at the owner’s expense.

Any work or construction to the exterior of units MUST be approved by the Architectural Review Committee.

Roles of the Board and Property Management Companies

Setting and Enforcing Community Policies If you own property in a condominium, townhome or newer single-family home community, your community is likely governed by a Homeowners Association, or HOA. Your HOA is governed by an elected Board of Directors, comprised of owners who have volunteered to serve your community.

Your HOA is responsible for your community’s operations and common areas, as well as for creating the CC&Rs (covenants, conditions and restrictions) – the comprehensive policies and rules you and your fellow homeowners must follow to maintain your community’s curb appeal, quality of life and property values.

Many HOAs hire a professional property management company to properly and effectively leverage their expertise to handle day-to-day operations, perform ongoing maintenance duties and communicate with residents. In addition, the property management company is responsible for executing on all Board decisions and ensuring that all homeowners comply with the CC&Rs and adhere to state condominium statutes.

Sometimes, however, homeowners confuse the roles and responsibilities of their HOA Board and their property management company, especially when it comes to community rule enforcement. Despite what many homeowners think, your property management company does not set any policies or rules pertaining to your community, nor does it determine the penalties for non-compliance. Rather, the management company’s responsibility is to enforce the community policies and regulations made by your Board of Directors on behalf of your HOA.

Property management companies’ partner with your board to optimize property values and ensure harmonious living environments for you and your neighbors. Working together, they can create a beautiful and thriving community you’ll be proud to call home.

Responsibilities of Owners and Residents Subject to the governing documents, each owner or resident typically has the responsibility to:

• Understand What They Own or Occupy. This includes condominiums and the difference between their unit andthe common property, and also planned communities and the HOA’s ownership of the common property.

• It is the Owners responsibility to know what you bought or are buying into, you must work with the seller and orrealtor to become informed. It is not the HOA’s “fault” that your seller or realtor does not provide all theinformation regarding the current state of your community.

• Pay Assessments and Other Proper Charges of the HOA. These obligations of the owner must be met on atimely basis for the HOA to operate effectively. Residents (that are not owners) are not responsible for thesecharges.

• Read and Comply with the Governing Documents of the Community.

o This includes the obligation to pay HOA assessments and proper charges of the HOA on time (seeabove). Owners should contact the HOA to discuss financial obligations and alternative paymentarrangements.

o Owners and residents must comply with restrictive and affirmative covenants in the declaration. This aids inmaintaining and enhancing property values, based on established standards.

o Owners and residents must also comply with the covenants, articles of incorporation, bylaws, rules,regulations, policies and procedures of the HOA.

o Owners and residents must ensure that those who reside on the owner’s property (e.g., tenants, relatives,and friends) adhere to applicable parts of the governing documents.

o Owners need to communicate and stay informed, by going to meetings, reading communications, visitingthe HOA website.

• Maintain Separate Liability Insurance and Casualty Insurance. Owners and residents must maintain (as to theirseparate property interests and ownership) their own liability insurance for accidents within theproperty. Owners should also maintain casualty (or hazard or property) insurance on property in or on theirLot/Unit which is not insured under a property insurance policy maintained by the HOA.

• Vote. Owners have the responsibility to vote in community elections and on other issues. Owners need tounderstand that once they elect a Board of Directors, the Board makes the decisions for the community, theOwners do no participate in day to day operations of the HOA.

• Property Maintenance. Owners and residents have the responsibility to understand who is required to maintaincomponents of the community, including their own property or the property they occupy.

• Duties and Responsibilities of the HOA, Board Members and Manager. Owners and residents shouldunderstand, at least generally, and when needed, specifically, the duties and responsibilities of the HOA, boardmembers and the manager. Owners and residents have the responsibility to know what the HOA and itsboard/officers/managing agent can do for them and cannot do. Too often, an HOA and its leaders areexpected to solve all problems and cover all unexpected losses. These expectations are typically broader thanthe HOA’s authority or required actions under the governing documents.

• Serve on the Board. All owners have a responsibility to run for and serve on the board, as representatives to theowners. Residents may be qualified to serve on the board. Check the bylaws. Board members serve theinterests of the entire community, known as a duty to manage, that requires good faith and the care ofordinary prudent person in a similar position. As a representative of private governance of the community, theboard and those elected to it seek to further the best interests of the community.

• Treat HOA Leaders Honestly and Respectfully. Just as owners and residents are to be treated honestly, fairlyand with respect by the HOA and its leaders, owners and residents are responsible for treating the HOA and itsleaders fairly with honesty and respect.

• Offer Comments and Recommendations to the Board, the HOA and Management. Owners and residentshave the responsibility to offer comments and recommendations to HOA leaders and management in a calmand businesslike manner. Issues will arise, but should not be personalized. Comments should be made withoutprofanity, personal attacks or shouting.

o Consider the best interests of the community before and when offering comments to the board, the HOA,and management.

o Offer comments which are relevant to the purpose of the HOA and/or management.

• Provide Current Contact Information. To allow the HOA to be able to communicate with an owner oroccupant, send notices of member meetings, newsletters, etc. to owners, current contact information isREQUIRED by owners to be supplied. This helps ensure receipt of information from the community.

• Avoid Interference with Contractors Engaged by the HOA. Owners and residents are not the persons who havecontracted with vendors of the HOA. The HOA has entered into those contracts, through the Board of Directorswho were elected by the “Owners”. Owners and residents have the responsibility to avoid interferencewith these contractors while a contract is in progress. All communications and complaints about acontractor’s work should go through the HOA manager, an HOA representative, or be in accordance withpolicy.

• Avoid Harassing and Threatening Others. Owners and residents have the responsibility to avoid harassing orthreatening others through any means to control or instill fear in any other owner or resident, board member,the manager or any agent of the HOA.

• Use Professional and Businesslike Language and Decorum. Owners and residents have the responsibility to beprofessional and businesslike, and to act with appropriate decorum when interacting with the HOA, its leadersand management.

• Avoid Personal Attacks. Owners and residents have the responsibility to avoid personal attacks, other owners,residents, board members, managers and service providers. NOTE: Colorado law allows for personalprotective orders, to seek to preserve the peace, and to avoid physical harm or injury to another person.

TRASH PICK-UP

Dumpsters are for Common Household Trash only!

Construction debris and furniture are to be taken to the Denver Arapahoe Disposal Site at 3500 S Gun Club, Aurora, CO 80018.

You will be billed per HOA policy for misuse of the dumpsters. Placing items such as; Mattresses, bedframes, T.V.’s, couches, bicycles, and other furniture or construction debris, etc.

If you think the items are decent and something that somebody could use, please donate to one of the many local charity organizations.

VOLUNTEERS We are truly grateful to all of the volunteers in our community! If you would like to join the Meadow Hills III Volunteers to help out, please attend the monthly meetings.

The volunteers focus their energy on running the corporation, compliance, general grounds related improvements, picking up trash, and many more things that help out to improve our entire community.

ANIMAL RULES There are 2 pets per unit limit. Domestic Pets only - Chickens are not allowed.

The following is a brief summary of the city ordinances pertaining to animals. Report Violations to Animal Control first!

Pets are not allowed to roam loose in the community. All pets must be on a leash or inside the owner’s property at all times. DO NOT ALLOW YOUR PET TO GO TO THE BATHROOM ON THE BALCONIES. All dogs and cats over the age of 6 months must be licensed by the city. (https://www.auroragov.org/residents/animal_services/licenses)

Excessive or continuous barking by dogs is not allowed.

If a dog is barking excessively there might be a reason for it. -Have you considered that someone could be breaking in? -The owner may be in trouble, ill, or worse?

Please consider these things before making a complaint.

Pet owners MUST provide adequate food, water and immediate pet waste pick up.

Pet Waste Stations:

According to the EPA, dog waste is as toxic to the environment as chemical and oil spills. Dogs drop some 10.6 million tons of waste each year, enough to fill 2,500 football fields 10 feet deep.

You will find the pet waste stations situated in convenient locations around the community. These stations consist of pet waste trash cans and pet waste bags, in order for us to help our residents keep the Timbers free from mess and easier for you to bag and trash pet waste.

Please clean up after your pets, not just when you walk them, but on your patio too, DO NOT allow pets to go to the bathroom on the decks and balconies. Pet waste deposited by pets on common areas and fenced patios MUST be cleaned up immediately by the pet owner. Washing pet waste off patio and onto common areas is prohibited.

Please help keep the Meadow Hills III Community clean. Most importantly, please respect your

neighbors!!
