W e are in uncertain times marked by anxiety and discord, fear and confusion. It is a time when community matters more than ever. And one thing we know for certain, there is no better place to be right now than West Hollywood.
Like many, we were drawn to the city for the core values it represents: inclusiveness, creativity, compassion, empathy and a healthy curiosity for progressive thought. We have always been very proud of our city and we have always felt very lucky to be active in this community. But never more so than now.
As the events of the past few months have unfolded, the responses from our residents, our businesses and our city council have been nothing short of extraordinary. Throughout the community, there has been an outpouring of support and activism. Our city council has reaffirmed West Hollywood as a sanctuary city. They have committed to allocate resources to respond to policies and programs that threaten members of our community and to protect those very core values that have drawn us all here over the years. The message is clear. West Hollywood stands strong in these turbulent times and we will not just survive, we will thrive.
This is our moment. And we are fully confident that our business community will lead the charge. The economic development and quality of life here are driven by you, our members. The role you play in providing support for our citizens is undeniable. Your commitment to excellence and standards of hospitality and engagement define West Hollywood. Your progressive values, social conscience and innovative thinking sets our business community apart from any other city. Construction has begun on new improvements at West Hollywood Park. The phase of work will implement and complete the vision of the West Hollywood Park Master Plan. The park will remain open throughout construction, and every existing park facility will remain open until after each new improvement is completed and available. Upon completion of Phase II, West Hollywood Park will feature —• An Aquatic and Recreation Center• Two off-leash dog parks, one each for small and large dogs• Expanded green spaces with landscaping, picnic areas, and public art• Updated children’s playgrounds• An AIDS Monument The new four-level, 75,000-square-foot Aquatic and Recreation Center will feature two rooftop swimming pools, including a competition pool and a recreational pool, and a multi-sport court with bleacher seating and scoreboards that will accommodate a variety of sports. The building will also feature five community meeting rooms and one conference room, City of West Hollywood Parks and Recreation staff offices, a Tiny Tot program classroom, a public access television studio, lockers, and additional parking. The entire park will be upgraded with more open space, a “Robertson Gardens” area with public art, new picnic areas, an outdoor exercise circuit for adults throughout the park, and updated playgrounds for children. The off-leash dog parks will feature expanses of open space with shade trees, small mounds and turf terraces for romping, and water stations.
Exciting Phase II Improvements Began in January 2017
The AIDS Monument, a collaboration between the Foundation for a National AIDS Monument (FAM), artist Dan Tobin and the City of West Hollywood, will be located within the park’s expanded green spaces along San Vicente Boulevard. It will be a visually distinct and tranquil area to be experienced in many different ways. Phase II construction is anticipated to last for approximately 33 months — the City and its partners in the project are working diligently to minimize impacts on park users, on local residents, and on surrounding businesses. During construction, fences will ensure safety in and around construction areas and large expanses of the park will remain open for use. El Tovar Place and the adjacent surface public parking lot will be closed; however, the five-story public parking structure and Library parking structure will remain open and accessible from the San Vicente Boulevard entrance. The surface public parking lot off of Melrose Avenue, and the adjacent alley, may also be impacted by constructiontraffic. The City Council directed staff to address the structural seismic safety issues of the City’s existing building stock and develop a framework for a seismic retrofit program. Degenkolb Engineers, a top structural engineering company specializing in seismic strengthening solutions, was selected to conduct a survey of the City’s entire existing building stock and assist with the development of a seismic retrofit plan and ordinance. 1. California Law Prohibits On-Duty (including “On Call”) Rest Periods.On December 22, 2016, the California Supreme Court ruled that California law strictly prohibits on-duty rest periods. This means that employers must relinquish any control over how non-exempt (hourly) employees spend their time during rest periods, and relieve their employees of all duties during those rest periods, including any obligation that an employee remain on call.
2. New Mandatory Federal I-9, Right to Work Form Federal law imposes on all employers the obligation to confirm each person being hired has the legal right to work in the United States. Effective January 22, 2017, all employers must begin using a substantially revised Form I-9, Employment Eligibility Verification form. The new “smart” form (attached to this email) uses Adobe Reader, but handwritten signatures are still required for employers that do not use a digital I-9 software program. There are many questions as to how the Trump presidency will alter immigration law. In the meantime, it is vital that all employers use the new I-9 form. On Top of it all -- New State Law ObligationsEffective January 1, 2017, state law makes it unlawful for an employer, in the process of an employee completing the I-9 process, to request more or different documents than are required under federal law to verify the right to work; refuse to honor driver’s licenses and other documents given by employees that appear reasonably genuine on their face; refuse to honor such documents or work authorization based upon the status or term of status that accompanies the authorization to work; and attempt to reinvestigate or reverify an incumbent employee’s authorization to work. Job applicants and employees who prove violations of the new law may be awarded reinstatement, lost wages, and a penalty of up to $10,000.
3. State & Minimum Wage JumpAs of January 1, 2017, the minimum wage California employers with 26 or more employees must pay non-exempt (hourly) employees increased from $10 to $10.50 per hour. The increase also affects how much such “larger” employers must pay salaried or exempt employees, as employers
must pay exempt employees a minimum salary that is tied to the state minimum wage. As a result, the minimum salary such larger employers must pay exempt employees increased from $41,600 to $43,680 per year. Employers must continue to pay close attention to whether they are subject to local requirements mandating even higher minimum wages. West Hollywood employers should be aware that, after months of debate, the City of West Hollywood has decided not to enact a local minimum wage ordinance, instead deferring to California’s minimum wage law.
4. Employers Must Pay Employees of Different Races and Ethnicities Performing Similar Work Equally.As of January 1, 2017, California law requires employers to pay employees of different races and ethnicities who perform substantially similar work equally. For example, paying a Caucasian employee more than a Latina employee, when the two perform substantially similar work, will be a presumed violation of the law. The new provisions are expansions of the Fair Pay Act, which currently mandates equal pay only for men and women performing substantially similar work. The law strictly limits the circumstances in which employers may pay employees of a different sex, race or ethnicity differently, and the burden is on the employer to justify any difference in pay. Prior salary will not, by itself, justify any disparity in compensation. The law bars employers from reducing the pay of any employee in order to meet the requirements of the Fair Pay Act. In fact, reducing the pay of any employee for this purpose is a crime under the law. Where an employee or former employee wins a claim under the Fair Pay Act, he or she may be awarded twice his or her lost wages, interest, and attorney’s fees and costs. Willful violation of Fair Pay Act is a misdemeanor punishable by a fine of up to $10,000, imprisonment for not more than six months, or both.
5. All Single-User Restrooms must be Identified as All-Gender Restrooms.Effective March 1, 2017, all single-user toilet facilities in any business establishment must be identified by signage as all-gender facilities. In other words, if a business has had, for example, two single-user

7. For Employers in Los Angeles, Inquiring into Applicants’ Criminal Convictions is now Illegal.Employers with 10 or more employees working in the City of Los Angeles are, effective January 22, 2017, prohibited from looking into whether job applicants have criminal convictions! Employers may only ask or investigate whether applicants have convictions if employers first make an offer of employment that is expressly conditioned on the employer conducting a criminal background check. Even where such a conditional offer is made, Los Angeles employers may not refuse to hire an applicant with a criminal history without conducting a “written assessment that effectively links the specific aspects” of the applicant’s criminal history “with risks inherent in the duties” of the job. The law also requires employers to allow applicants to present information weighing in favor of hiring them, notwithstanding their criminal histories. The ordinance imposes extensive additional obligations on employers. The law provides for administrative enforcement by the City Department of Public Works and gives applicants the right to sue employers in court for violations. The City will not enforce the ordinance, other than by issuing warnings, until July 1, 2017.

6. A New Hurdle is Thrown into Settling PAGA Cases. Another roadblock to settling costly Private Attorneys General Act (PAGA) cases became effective January 1, 2017. PAGA permits a single employee or former employee to seek penalties on behalf of all similar employees for Labor Code violations without satisfying the procedural requirements to which class actions are subject. Under the amendment to PAGA effective January 1, “any settlement of any civil action” under PAGA must be approved by the superior court. Previously, the superior court had to approve only “any penalties sought as part of a proposed settlement agreement.” (Labor Code Section 2699 (l), emphasis added.)

Between November 2015 and September 2016, GPA, the City’s consulting firm, surveyed 763 commercial and non-residential properties in the City of West Hollywood constructed through 1975 at the reconnaissance level. Of these 763 properties, a total of 89 properties warranted an intensive level evaluation based upon their potential to convey significance. Of the 89 properties evaluated, 58 appear to be eligible for designation under national, state, and local landmark programs. They represent a broad range of periods and themes in West Hollywood history as well as a variety of architectural styles and building types. These properties and their assigned status codes are listed in Table II on page 90 (Potential Individual Historic Resources) and DRP 523 A and B forms attached in Appendix IV of the final Commercial Historic Resources Survey. Properties Identified as Having Potential for DesignationThe final survey provides information needed to 1) make informed planning decisions, 2) prioritize preservation planning goals and objectives, 3) develop and implement land use policies, 4) perform environmental reviews pursuant to the California Environmental Quality Act, and 5) educate the public about the built environment as a tangible reminder of the community’s history. It will not, however, result in the designation of any properties. Designation of cultural resources is a separate process outlined in Chapter 19.58 of the West Hollywood Municipal Code. Staff will contact all owners of properties identified as having potential for designation to inform them of the designation process and its benefits. Those who express interest in having their property designated will be compiled in a group. Staff will then return to City Council with a contract for a qualified preservation consulting firm to process the group of properties as individual local cultural resources.
Historic Resources Commercial Survey Results Are InIf your property has been identified as a potential cultural resource, please contact the Chamber to understand what this means for your property. Properties identified as having potential for future designation are subject to a certificate of appropriateness (GOA) pursuant to the provisions in the Chapter 19.58 (Cultural Heritage Preservation) in the WHMC. A GOA is intended to protect structures from any alterations, demolition, or removal which would have an adverse effect on its significant architectural or cultural significance and integrity.
Historic Preservation WebsiteIn addition to the Commercial Historic Resources Survey, a new user-friendly auxiliary website has been completed and available at www.wehopreservation.org. The mobile friendly website is a comprehensive source for all historic preservation information in West Hollywood, including a searchable database of all surveyed properties and designated cultural resources using RuskinARC, a cloud-based system, making the information about the designated and surveyed properties available to the public. Additionally, the new website provides easy access to the Cultural Heritage Preservation Ordinance, Historic Preservation Chapter of the General Plan, Historic Context Statements, relevant applications and forms for cultural resources, and answers to frequently asked questions about the City’s historic preservation process and programs. Later this Spring, the new website will feature historic walking tours.

City Council Looks at Small Business and Chamber Forms Taskforce
Ever since the minimum wage debate, the City Council has been seeking new ways to helps small business. With the help of the West Hollywood Chamber’s task force, the City hopes to evaluate policies and programs supporting small businesses leading to cost savings and preserving our unique, boutique business community. As part of the internal review, the City’s Economic Development Department first looked at what is currently being evaluated by various departments that intersect with businesses. The items outlined below are part of current work plans and often involve work across multiple departments. These are consistent with and reflect feedback from business requests for technical assistance: Extended Hours of Operations - Staff is exploring the feasibility of updating the process so that it would result in cost savings for small businesses and facilitate the administrative oversight for the City by changing the process from a major conditional use permit to a business license. Fee Reductions -The revisions recommended will make it more affordable for new businesses to update their space and for existing businesses to expand by reducing the overall costs associated with tenant improvements for business, signage and special event permits. Parking - Parking is an ongoing concern for businesses in West Hollywood. Staff will explore current best practices to address parking requirements for small businesses including but not limited to: Access to transit; potential for shared parking; Implementation of programs to reduce demand for parking; and study data to support requests to reduce parking. Special Event Permitting Process – Staff will evaluate whether the lowest impact activations (for example sidewalk sales, grand openings, in-store promotions, etc.) should be removed from C classification and other issues to help streamline the process.
Technical Assistance - The City of West Hollywood provides technical assistance to businesses that seek to start a business, troubleshoot operational issues, and expand their business.

AT 96 YEARS OLD WE PROUDLY CELEBRATE OUR LEGACY CHAMBER MEMBERSThe West Hollywood Chamber of Commerce was established in 1921 as the Sherman Chamber of Commerce. When the town of
Sherman changed its name to West Hollywood to compete with Hollywood so did its Chamber of Commerce. Sometime in the 1930’s (although we cannot find the accurate documentation), the Chamber changed its name to the West Metropolitan Chamber.
On June 4, 1947 the Board of Directors wisely changed it back to West Hollywood Chamber of Commerce. Thank you for your years of commitment in making West Hollywood a great place to live and do business!

West Hollywood Chamber of Commerce held its Annual Member Meeting & Board Installation (AMMBI) at the Andaz West Hollywood on Tuesday January 31st, Presented by US Bank. The AMMBI event was the West Hollywood Chamber’s annual meeting for its Members and the installing of the new 2017 Board of Directors. This was a stakeholders’ conference for Members to hear how their investment was being used. Andaz’ rooftop Panorama Room was filled with Chamber members and supporters, sponsors, dignitaries and City Officials. West Hollywood Mayor, Lauren Meister, welcomed the 180 guests while Lieutenant David Smith from the West Hollywood Sheriff’s Department officiated the installation. Genevieve Morrill, Chamber President and CEO presented highlights of the WHCC’s 2017 Program of Work which featured several new business programs. Our Chair, Keith Kaplan’s choice for the 2017 Ray Reynolds Award was Ruth Tittle for her amazing support of the business community and significant contributions to the West Hollywood Chamber of Commerce. The morning highlight was a presentation from Dr. Christopher Thornberg Ph.D. of Beacon Economics on “Trump and the Economy”. We look forward to seeing you at next year’s AMMBI in January 2018. The West Hollywood Chamber of Commerce’s 33rd annual West Hollywood Creative Business Awards 2016: Honoring Innovation in Business presented by Wells Fargo, was held on Wednesday, November 16, 2016 at theW Hollywood. It was a stunning evening reminiscent of old Hollywood glamour in the W Hotel’s Great Room with 350 guests in attendance. The excitement was palpable as the audience waited in anticipation to know who the Chamber Member businesses voted for as their faves. The top honor went to Craig Susser for the Thomas Crail Lifetime Achievement Award. It was apropos that Craig received this Awards as his restaurant is an institution, not only in West Hollywood, but in Hollywood’s A-List community. The gala was hosted by NBC’s America’s Got Talent finalist, the Standup Magician Derek Hughes and live entertainment produced by Chris Isaacson Presents and a 7-piece band featuring acclaimed guitarist Kay-Ta Matsuno and special guest Verve Records recording artist Brenna Whitaker wearing an original gown designed by Designer Lorena Sarbu. The Creative Business Awards (CBA) is the Chamber’s longest running and most important fundraiser. Each year the Chamber celebrates businesses that have shown innovation and creativity in their business model. The nominees are selected by their peers and the winners are voted by the membership and announced at the event. 2016 CBA’s went to: Creative Concept: The City of West Hollywood and Unitronics for the Automated Parkade; Creative Innovation: OWN: Oprah Winfrey Network; John Chase Art & Design: Vanity Girl Hollywood; Creative Communications: West Hollywood Lifestyle Magazine; WeHo Attraction: kitchen24; Creative Community Service: Covenant House California; and Innovative Sustainability: Levin Morris Architects for 1232-36 Kings Road. The event raised over $63,000 for the Chamber from supporters purchasing tickets and tables, sponsorship, and the tireless efforts of the event committee and Chamber Members who volunteered and contributed their time, products and services. The Chamber is fortunate to have so many great contributors and sponsors and grateful for their generous donations which allow the organization to host this event year after year.
