The pictures this month are mainly from the annual BIALL conference held in Belfast. Several delegates and exhibitors remarked on the enjoyable time they had in Belfast. Particularly good and worth mentioning were the opening dinner at the Titanic Visitors Centre, sponsored by Thomson Reuters and the closing dinner at the Europa Hotel, sponsored by LexisNexis.

Congratulations to Emily Allbon, this year’s winner of the Wildy-BIALL Law Librarian of the Year Award. Wildy & Sons began this award several years ago as a way of celebrating our 175 anniversary and acknowledging excellence in the profession of law librarianship. The award consists of an engraved glass book along with a cheque.

We would also like to congratulate 7 Side, this year’s winner of the BIALL Supplier of the year award.

While we are in the congratulatory mode, we must point out that Anita, the spouse of Jason Crimp of Wildy’s, has been awarded a MBE for her contribution to special education in the Queen’s Birthday Honours List.

We are pleased to announce that you may now purchase LexisNexis webinars through us, either using the link on our website or by emailing or calling our shop.

The other event this month was the launch of Sweet & Maxwell’s book Tax Avoidance at the Great Hall in Lincoln’s Inn. As we were so close by, several of our staff attended to lend a hand. (see picture p 5)

The original version of this work, entitled Pro-tecting the Assets of Older People was published in November 2000 and revised in April 2002. Both editions focused upon the issue of protecting the existing capital of older people in the context of the increasing cost of long-term care. Hutchinson, Allan C., Laugh-ing at the Gods: Great Judges and How They Made the Common Law, Cam-bridge University Press, Paperback, £19.99, ISBN: 9781107662766Wildy’s Book of the MonthAny effort to understand how law works has to take seriously its main players - judges. Like any perfor-

mance, judging should be evaluated by reference to those who are its best expo-nents. Not surprisingly, the debate about what makes a ‘great judge’ is as heated and inconclusive as the debate about the purpose and nature of law itself. History shows that those who are generally considered to be candidates for a judicial hall of fame are game changers who oblige us to rethink what it is to be a good judge. So the best of judges must tread a thin line between modesty and hubris; they must be neither mere umpires nor demigods. The eight judges showcased in this book demonstrate that, if the test of good judging is not about getting it right, but do-ing it well, then the measure of great judging is about set-ting new standards for what counts as judging well.

This book attempts to explain and ex-plore in an accessible fash-ion: What powers the court has to intervene and redis-tribute these rights? What are the procedural mecha-nisms which the court will follow in carrying out this intervention and redistribu-tion? In what circumstances will the court consider it ap-propriate to intervene and redistribute these rights or make some other compensa-tory provision? What actu-arial issues may arise from such considerations? Labour Law 6th editionBy Simon Deakin and Gil-lian S. MorrisHart Publishing, Paperback, ISBN 9781849463416, due August 2012, £37.50Labour law is a highly dy-namic and complex field which can be properly un-derstood only in its broader international and historical context. Deakin and Mor-ris: Labour Law, a work increasingly cited as au-thoritative in the higher ap-pellate courts, provides a comprehensive analysis of current British labour law which explains the role of different legal sources, as well as social and economic policy, in its development. It thus enables readers to obtain a deeper insight into likely future, as well as past, changes in the law. The new edition, while following the broad pattern of previous editions, highlights impor-tant new developments in the areas of the contract of employment, discipline and dismissal, equality law, EU law, employee representa-tion, human rights, ‘work-life balance’ policies, trade

union law and industrial ac-tion law. The book examines in detail the law governing individual employment re-lations, with chapters cov-ering the definition of the employment relationship; the sources and regulation of terms and conditions of employment; discipline and termination of employ-ment; and equality of treat-ment. This is followed by an analysis of the elements of collective labour law - the forms of collective organisa-tion, freedom of association, employee representation, internal trade union govern-ment, and the law relating to industrial action. The sixth edition of Deakin and Mor-ris: Labour Law is an essen-tial text for students of law and of disciplines related to management and industrial relations, for barristers and solicitors working in the field of labour law, and for all those with a serious inter-est in the subject.

The Law of Yachts and YachtingBy Filippo Lorenzon and Richard ColesInforma Publish-ing, Hardback, ISBN 9781843118886, due Au-gust 2012, £260.00The past 20 years has seen steady growth in the num-

bers and size of pleasure yachts and other leisure craft coupled with an explo-sion in the numbers of pro-fessionally crewed supery-achts and megayachts, many of which are operated on a commercial basis for char-ter by the wealthy. Many of these vessels rely upon cutting edge technology, innovative design and state of the art communications systems. Built by a growing number of specialist yacht builders, managed, crewed and operated by superyacht professionals, the supery-acht industry has in recent years evolved as a distinct and separate industry along-side mainstream shipping, but with subtle differences of approach and traps for the non-specialist. Against this background, this book offers a comprehensive analysis of the many aspects of yacht-ing law. Written by a team of leading yachting practi-tioners and researchers, this book covers the legal issues arising during the life of a yacht from conception to the scrapyard. It is a practition-ers’ book, to be used by law-yers and other profession-als involved in all aspects of yachting, from design, construction, registration, financing and operation and many related issues.

NEW BOOKS FROM WILDY, SIMMONDS & HILL

DISSENTING JUDGMENTS IN ThE law

Neal Geach and Chris Monaghan

Price: £69.00 ISBN: 9780854900848 Extent: 432 pp Size: 229x152mm Binding: Hardback

In Dissenting Judgments in the Law a team of expert contributors reassess nineteen land-mark cases from different areas of the law, each of which had the potential for the law to have developed in a markedly different direction. The cases have been selected on account of their continued relevance to the law today or the controversial nature of the majority’s decision. A key feature of each case was a dissenting opinion from a judge who thought that the law should develop in a different direction.

The aim of the contributors is to re-evaluate important cases, such as YL v Birmingham City Council [2007] UKHL 27, Scruttons Ltd v Midland Silicones Ltd [1962] AC 446 and R v Hinks [2000] UKHL 53 by assessing the merits of the judgements given, before deciding whether the law would, in fact, have been better served by following the dis-senting opinion rather than that of the majority of judges in the case. The judicial reason-ing in each case is explored in depth and is contrasted with differing approaches in other jurisdictions. Where relevant, a comparative analysis is employed in order to show how the law, by not following the dissenting opinion, has developed out of step with other common law jurisdictions. Each contributor then sets out what impact the dissenting judgment might have had on the law if it had decided the case and assess where the law in that particular field would be today.

Neal Geach is a senior lecturer at the University of Hertfordshire specialising in Tort and Property law. He also has research interests in electronic and mobile commerce. Chris-topher Monaghan is a lecturer at BPP University College. He also has extensive research interest in criminal law and legal-history.

ExPaNDING ThE hORIzONS: On active Service in law and Education

His Honour John Toulmin CMG QC

Price: £25.00 ISBN: 9780854901081 Extent: 384 pp Size: 229 x 152mm Binding: Hardback

With a Foreword by The Right Honourable Kenneth Clarke, MP, Lord Chancellor and Secretary of State for Justice

In Expanding the Horizons: On Active Service in Law and Education John Toulmin reflects on his varied contributions both nationally and internationally in stimulating the development of the seven organisations in which he has been involved. He tells the story through speeches and articles by him and in his honour and looks at future developments. The book begins with Valedictory speeches on his retirement as a Judge, and with a tribute by the Director of the European Law Academy (ERA), of which he was Chairman of Trustees from 1997-2010. It continues with developments in civil procedure, access to justice, dispute resolution and the author’s proposals for reform. Expanding the Horizons contains the last liability judgment in “Factortame”, one of the most famous European and UK cases, and it deals with one other case illustrative of construction litigation and of the changes proposed earlier in the work. The story con-tinues with the author’s 1993 Presidency of the CCBE (European Bar Council) starting with “Our Worldwide Legal Profession”, a keynote lecture at the University of Michigan in 1993, and a 2001 lecture describing his negotiation of the GATT/Uruguay Round, on behalf of the legal profession, and leading role in the Lawyers’ Establishment Directive, both of which expanded legal horizons. This section includes an article in Fordham International Law Journal 1992 arguing for a worldwide code of professional ethics, and a chapter entitled “Professional Rules and Ethical Ideologies”, based on a 1997 seminar tracing the transformation of legal practice over 30 years, and arguing against multi-disciplinary practices. The book goes on to set out the development of the European Court of Justice and the Court of First Instance (now the general court), particularly relevant to the current scrutiny of the European Court of Justice, indicating possible areas of reform and that the current debate should take place in an atmosphere “more of light than heat”. The remarkable story of ERA is set out, with suggestions for the future. There is a history of the Institute of Psychiatry (IOP) from 1979 - 2003 when the author was closely involved, latterly as Chairman of its Advisory Committee, and an article about interdisciplinary col-laboration at King’s College London, particularly law and medicine. The author’s 2008 “Reading” in the Middle Temple which proposed further international links is included and, after membership from 1990-2010 of the Temple Church committee (as Chairman in 2003), he addresses its develop-ment as the Mother Church of the Common Law, the Inns of Court being the cradles. Finally, Sir Konrad Schiemann’s end piece encompasses European law, ERA and the modest vineyard of the Toulmin family in Burgundy.
