Yellow Door Restaurant6pm-midnight. On the road that runs alongside Bangkok Hospital heading towards Rang Hill.

A small restaurant with a yellow door. Seating is simple and mostly in the open , with chairs and tables probably a bit tiny for the western bum. Basic rice and noodle dishes start at just 35 baht, Thai Spicy salads around 70 baht. This place is cool and increasingly popular as the word spreads about the food .

We all know one of those places… they never advertise but they’re busy. Why? ‘Word of mouth’. People tell their friends, “You must try..” and the word spreads. In this monthly column, we spread the word further about the great-value nooks and crannies that we know about on Phuket.

Simple place with a few plastic chairs, no air conditioner but packed every day. Off ers a great variety of fresh ice cream options. Prices start at 28 baht for four scoops of your choice of topping, ranging up to 40 baht. 'Special'. Highly recommended is the deep-fried ice cream.

A tasty red duck curry or fi sh with tamarind sauce are the best. The vegetarian selection includes mushroom curry with tof u and mixed vegetables − a good choice for the veggie-peeps. Full breakfast costs 190-220 baht. Soft drinks also fair priced at 40 baht.

Bamboo House7.30am-3.30pm. Baan Rawai - Baan Nai Harn Rd., 100m. from the junction.

One of the best breakfasts in this area, a favourite amongst locals looking for heart y and value for money English grub. Eggs cooked any style , bacon , sausage , beans and toast; sausage and egg baguett es, sandwiches and more make great morning fare . Popular Thai dishes also available throughout the day.

Roti Chaofa6am-noon. Chao-Fa Rd. East, next to SCB Bank, 300m from Jee Teng Intersection.

Rot i Chaof a has been open for more than 30 years, serving the Rot i Namkang (Muslim pan-fried bread with a small bowl of curry made with your choice of chicken , beef or lamb) + a fried egg. Cost around 50 baht. Rot is Mataba, which have many ingredients folded into the middle are something should not miss too.

Desmond HughesThis month WINDOW on Phuket catches up with an international professional who has been part of the Phuket scene for 10 years.

PHUKET-BASED HUGHES KRUPICA

It's been a while since we last spoke. What are you doing now? I've entered into a partnership with Robert Krupica and Khun Pongsak Daengkaew; we've formed HughesKrupica, an international legal services provider, specialising in legal services for the real estate, hospitality and leisure industries.

Bring us up to date on your last few years. In 2003, I assisted with setting the Phuket offi ce of my former law fi rm. I went onto own and manage several offi ces, increasing my investment as I expanded the business into Vietnam and Indonesia and added further offi ces in Thailand. I trained a diverse mix of associates, some of whom went on to try their hand at being partners in businesses or managing their own offi ces. Passing on my knowledge and experience to others, whilst continuing to improve my own skills, has been rewarding and satisfying. However, the mission of improvement continues.

Why do you remain committed to Phuket? I believe, and have witnessed, that Phuket has an amazing diverse mix of business people: successful people, all enjoying the fruits of their success. It's a melting pot of Thai people mixed with foreign interests with a strong base of tourism and related businesses. Every year new hotels, businesses, leisure activities and developments spring up, keeping Phuket a fresh and amazing part of Thailand. Long may that continue.

Do you intend to expand HughesKrupica? I have no hesitation or fear in expanding our business to other parts of Thailand and jurisdictions, having done this before. But I believe in expansion through balanced and cautious investment, sustainability and smart structuring. That my partners share this vision helps me sleep well at night. We will have representation in Bangkok in due course, but will be clever about the way we service and allow clients to receive services in other jurisdictions, with an emphasis on ensuring quality is not aff ected through overstretching resources.

What is your work philosophy? I believe in being happy at work, and passing on this good feeling to clients, colleagues and others.

Where do you live now, and why? I've lived in most places on the island – even in Patong whilst I got my bearings! But I soon decided that didn't suit me. The fi rst offi ce I worked in was on the very dangerous Patong Hill. I lived for a few years in Chalong and also near Phuket Town, but fi nally settled on buying a place in Kathu.

Aside from HughesKrupica, do you have any other business interests? I love the freedom of being in a new business environment with partners who have an aligned way of thinking. This has helped develop a few business ideas. I'm putting together, slowly, a structure for Private Equity Investments in hand-picked projects around the region − but I'm so busy with the legal services business, that I'm making sure I'm not distracted by other opportunities. The investment business is being developed with a view to ensure that no member has to commit too much time, but can contribute their network to the business. This will not be a business centered around any one person – but a group of well connected business people pooling their resources and experience, for the benefi t of investments in real projects and opportunities.

As you are not eligible to be a Thai lawyer, how do you maintain your own academic abilities and development? Thai law is defi nitely the domain of Thai lawyers − unless and until Thailand ever opens up this profession to foreigners. This could be a possibility under the Asian Economic Community, but that remains to be seen. International lawyers must have an ability to thread together local laws, international practices and client needs

− and develop business models while working with Thai lawyers, and lawyers of other nationalities, to deliver a rounded, quality-driven service to clients. There are lots consultants and foreigners in Thailand, many of whom have good professional backgrounds, who can assist with training and development of less senior Thai staff and professionals, to allow the labour market and skills in that market to benefi t Thailand. I think working with clients every day also helps refi ne legal skills and abilities, regardless of nationality. I certainly have a non-xenophobic, all-embracing approach to success in business.

Anything Else? I recently undertook the Overseas Lawyers Qualifi cation Examination in Hong Kong, and thankfully passed those, which for me was a combination of proving that I'm still able to take and pass examinations whilst running a well-staff ed business.

What do you do to relax in Phuket? Well, Phuket residents often see the beach and the beautiful sea, but don’t get much time to enjoy it. Some of my favourite times are when my family visit, and I get to visit them, go to lovely restaurants most nights, and spend time in the swimming pool catching up on family news. I really enjoy the fi ne dining in Phuket and across Asia. Whenever I travel, I look for the best truly local cuisine, and the recommended fi ne dining establishments, to get a fl avour of the food scene. This is enhanced through my experiences in the Châine Des Rôtisseurs, which is a global club exemplifying all that is passionate about gastronomy. I'm also building up a fairly extensive whisky collection, which is best shared with friends on special occasions.

What do you like and dislike about living in Phuket? I love the cultural mix, its international feel with the twists of being an island. I dislike intensely the disregard for human life and safety on the roads, and some of the unnecessary violence. I think better policing and some more focused infrastructure investment over time may improve things, but I certainly don’t qualify to give public opinions on Thai politics. The dinner table, with friends and others, is where I share my personal views.

Could you tell us about your private life? I try to be a little more private as I get older, but I'm now married, plan to have a family soon and simply enjoy spending time with my family and close friends.

PHUKET’S GENTLE GIANT

Big ideas for Phuket are usually concocted and carried out by starry-eyed entrepreneurs. But the biggest idea for the island yet comes from a surprising source: the sacred beliefs of a peaceful religion born more than 2,500 years ago.

Rising from the hills of Chalong, forming a gleaming presence that can be seen from clear across Phuket’s south, sits the Big Buddha. A decade ago, the huge statue was commissioned for a temple in Kata, but at some point someone looked up to the top of the verdant hill rising behind the temple and thought, “Why not?” Thus, an ambitious plan was born.

The Big Buddha project is helmed by Suporn Wanichakul, Chairman and Founder of the Phra Phuttha Ming Mongkol Eaknakakeeree Foundation, who says that not only is the project an homage to the Buddha, it aims to promote cultural tourism in Phuket and introduce visitors to a side of the island away from Patong’s party zone. “Now, when people think of Phuket they will not only think of beer or ago-go bars with girls dancing around a pole,” he says.

Before reaching the steps to the Buddha, visitors pass through a large hall with amulets and other religious artefacts for sale, and donation boxes aplenty. The sparkling white marble that adorns the Buddha statue’s exterior, from the spiral hair pieces to the ears and fi ngernails, was paid for, piece by piece, by visitors and locals keen to add their names as benefactors to the project.

Indeed, the entire project has been fi nanced by donations, a remarkable feat that shows Phuket’s solid economic standing and international appeal. Visitors are invited to donate a set amount for one square marble tile, on which they may write a message. Tiles on display show a variety of languages, hopes and well-wishes.

But is it too much of a good thing? Has the overfl owing car park and packs of tour groups tromping around cluelessly undermined its sanctity and meaning? On a frenetic island where money is sacred, is the sacred now at risk of turning into a money machine?

Phuket’s a place where everything happens at a fast-forward pace. For hundreds of years since the tin-mining days of yore, dreams of riches have been at the centre of the island’s energy.

The struggle of the Big Buddha’s direction could be seen as a microcosm of Phuket’s larger struggle to balance money, power, culture and community. It’s the burning question on the mind of many for Phuket: “What next?”

On the Big Buddha hilltop, however, there are encouraging signs to be found. In the large meditation hall on one afternoon, a small group of Thais and foreign tourists are seen receiving blessings from two monks, a peaceful scene familiar to anyone living in Thailand, but for visitors it reveals the contemplative, tender side of Thai culture not always evident in the brash tourist areas.

And one need only look to the monument itself for more answers and inspiration. Fittingly for Phuket, an island with hedonistic pleasures aplenty, the Big Buddha silently sends a message of calm and spiritual strength through its seated subduing Mara pose.

In Buddhist lore, Mara was a demon who was something of an ancient Soi Bangla sex-show tout. During the young prince Siddhartha’s journey towards enlightenment, he was met by this devil of desire. Mara inundated him with a host of naughty temptations, even off ering up his own young daughters, in an attempt to lure him away from his spiritual path.

To fend off the overwhelming feelings of lust, longing and hunger, Siddhartha sat in meditation and pointed the fi ngers of his right hand down towards the ground, summoning the earth goddess Toranee. A statue of Toranee is housed in a shrine by the steps to the Big Buddha.

Wringing her long hair, Toranee released a fl ood of water that washed Mara away, helping clear the way for Siddhartha to become the Buddha, the Enlightened One.

Ingredients

Khao Soy Pla Salmon:200 ml Chiang Mai curry sauce30 gm Salmon10 gm Spring onion5 gm Pickled cabbage5 gm Saw tooth parsley5 gm Chili powder in oil45 gm Egg noodle45 gm Rice noodle1.5 whole lemon

MethodChiang Mai Curry Sauce:

Gently warm the wok and add virgin olive oil. Heat until nice and hot, then add shallots and fry for about 5 minutes, stirring all the time, until the aroma is really good. Add Chiang Mai curry paste and fry stirring all the time until cooked. Add fi sh sauce, palm sauce to taste plus tamarind juice and fi nally coconut cream. Before removing from the heat add some spring onions and saw tooth parsley, stirring well for a few minutes. Use a colander to separate the mixture allowing the curry sauce to fl ow through and discard the rest.

Crispy Egg Noodles:Deep fry egg noodles in oil until golden brown, remove from oil, drain and serve.

Khoa Soy Pla Salmon:Steam the salmon wrapped with rice noodles for about 10 minutes and warm the Chiang Mai curry sauce. When the salmon is ready, place the salmon on a serving plate, pour the Chiang Mai Curry sauce over the salmon and top with fried egg noodle. Serve with side dishes of spring onion, pickled cabbage, chili powder in oil and lime fruit.

The construction of Laguna Shores is scheduled to begin in mid 2013, with completion of the development expected in mid 2015.

Laguna Property is Phuket’s largest developer of high quality resort residences set in the heart of Laguna Phuket, complete with a range of the popular resort’s renowned lifestyle benefi ts, and with prices starting at THB 4.XX.

Laguna Property commissioned Helicam to obtain aerial views of the location, which they used to combine with a 3D computer CGI of the Laguna Shores creating a vision of the built project.

On location in Laguna the Helicam crew fl ew into action using the remote piloted helicopter camera platform equipped with a 24 mega pixel camera. The pilot/photographer positions the camera platform and positions the camera using ground monitor to compose the imagery.

Using this system Helicam are able to obtain the desired imagery. The imagery is system-worked back at the Helicam offi ce before being handed over to the client. To date, more than half the units in this project have been sold since the project was landed in December 2012.

PHUKET ACTIVITIES

The Art of the Water Warrior :

On this particular outing off Bangtao Beach, during the golden late-afternoon hours, our novice SUP group was given some brief instruction before carrying our large boards out to the calm sea, just deep enough to avoid the small waves breaking close to shore. Balancing the boards beside us, we hopped on, or rather fl opped on, and tried to crawl up onto our feet. Some of us promptly fell off with a splash.

We were told the key to keeping balance was to look ahead, not look down at the board, once we were relatively steady on our feet. This advice certainly helped, and after a few more attempts we found our balance. It also helped when we started to imagine ourselves as a Maori warrior, setting off for battle on some distant isle.

There’s no evidence that the Maori, the indigenous people of the Pacifi c islands now known as New Zealand, did anything resembling standup paddling in their history,

but standing atop the sturdy board, stabbing at the water with our paddles as we glided over the sea made us feel rather warrior-like. In any case, this warrior fantasy helped keep us high and dry in making our shaky start as SUP afi cionados.

It’s believed that the ancient people of another Pacifi c island group, Hawaii, did some form of standup paddling, and it’s on Hawaii where the modern version of the sport gained popularity in recent years. Some of Hawaii’s big wave surfers began doing it as a way to stay in shape and fi nd some on-the-water adventures when the ocean wasn’t kicking up giant waves. These hardy surfers, of course, found ways to take SUP to new daring heights.

Videos of famed big wave surfer Laird Hamilton, for example, with his movie-star good looks and warrior-ready ripped body, shooting across the sea on his SUP board as powerful waves break behind him have inspired many to

take up the sport, as well as showing that SUP boarding can every bit as challenging and adventurous as surfi ng.

Given its abundance of bays and beaches, it’s only natural that Phuket has caught the worldwide SUP wave, too, and now there are a number of places around the island off ering board rental and sales, and SUP lessons and excursions. In addition to Bangtao, we’ve seen SUP paddlers off Kata, Kamala, Layan and Ao Yon beaches, and it seems likely that more Phuket beaches will off er SUP board rental in the coming seasons.

It’s a highly versatile sport that can be done in all water conditions, and in Phuket, which sees little wave action from November through April, it’s a good water-sports alternative to surfi ng. Children and beginners can easily learn to paddle in a shallow, sheltered bay. And much like kayaking, SUP off ers a way to explore Phuket’s coastal areas and reach places that are inaccessible to boats.

SUP is also a fantastic way to keep fi t. Even on glassy-calm water, balancing on the board boosts agility and keeps the legs busy, while the paddling action builds strength in the arms and the body’s core. Certainly, as beginner SUP paddlers we were feeling most every part of our body from shoulder to calf by the end of our wobbly one-hour session!

For our fi rst SUP outing at Bangtao Beach, we arranged the lesson and board rental from Skyla’s Surf & SUP Club, who have set up a surfer’s shack beside Bliss Beach Club. Rental is 300 baht an hour, while a two-hour guided

lesson is 1,000 baht. Skyla’s also keeps boards in stock at its beachfront restaurant on the north end of Kamala Beach. For a true balance challenge, there are SUP yoga sessions available at both Kamala and Bangtao. A private session is 1,600 baht or a group session for four is 900 baht per person.

Our SUP instructor, Tim Campbell from Australia, has also set up a separate operation called Stand Up Projects, which takes more experienced paddlers out on a four-day adventure covering 150 kilometres around Phuket – a real test of skill that includes cliff jumping and camping on the beach.

Tim, an avid surfer who, like the Hawaiian big-wavers, discovered SUP as a way to keep fi t when the waves were small, describes one of his most memorable standup paddle moments: “One afternoon after work I paddled out into the middle of Kamala bay and sat in the middle of the ocean and watched the sunset. One side of the sky was an epic mix of oranges and purples while the other half of the sky had a fi erce electrical storm. I sat there mesmerised by this spectacle, feeling a great sense of peace and excitement.”

As a healthy, clean sport that off ers a peaceful, eco-friendly way to explore the island’s stunning coastal environment, SUP seems an ideal addition to Phuket, which is sadly looking more city-like and less beachy, with each passing year. Will there be more standup water warriors paddling Phuket’s shores in the future? We hope so.

Lemongrass founder, Bobby Duchowny, studied aromatherapy – a healing art that promotes massage, when combined with specifi c herb and spice oils, as a method to reduce stress, boost energy and heal certain physical ailments – at the American Aromatherapy Association.

Some years ago while on holiday in Thailand, he visited an organic farm in Petchaboon province and became interested in the natural healing properties of Thai herbs and spices.

“I was particularly attracted to lemon grass as it was used in many popular Thai foods, as a medicine for stomach disorders and even as a repellent for mosquitoes,” he recalls.

Chilled out by the soothing background music, my mind was fi lled with a peaceful wellbeing as I enjoyed the warm traditional welcome (again from Sukko culture) of the ‘Flower Floating Ritual’ – similar to ‘Loy Kratong’, where the idea is to fl oat away past stresses and wish for luck and joy from that moment on.

A variety of 40 spa treatments – prepared by Sukko's certifi ed Thai Herbalist and based on ancient Thai medical theory – is off ered at Sukko, in packages lasting from 2 to 4 hours. Each package has a specifi c purpose and can be selected to suit your lifestyle or the way you feel on the day. These herbal recipes and procedures have been handed down through generations and are totally free of petrochemicals, synthetic perfumes or colouring. Some of the herbs and spices are grown in Sukko’s own herb garden and picked just for your treatment, ensuring they are as fresh as can be.

I was pampered with the “Be Balanced” package; a 3-hour experience that left me feeling relaxed and refreshed. How long have you been with SALA Phuket Resort & Spa? I've been working as Regional General Manager based in Phuket at SALA Phuket Resort & Spa since January, 2010. I oversee the operations at both SALA Samui Resort and Spa and Muang Kulaypan Samui (soon to be SALA Chaweng Resort and Spa)

What were you doing before? I was Resident Manager during the pre-opening of Anantara Phuket Resort and Spa in 2008, after the company relocated me from the Maldives where I was involved in three other Anantara property pre-openings as Group Director of Food and Beverage and Group Director of Technical Services for Minor International. Prior to my work experience in Thailand and the Maldives, I held various senior positions in rooms and food and beverage operations at both the Sofi tel Nha Trang Vietnam, Le Meridian Port Villa, Vanuatu and French Polynesian Islands including Noumea, Fiji and New Caledonia. I started my career in hotel management with the Intercontinental Hotel Corporation (IHG) in Australia and was relocated to various IHG properties throughout Australia and South Pacifi c during my 13 years with the group.

Trust Accounts, Deposits, Reservations, Purchase Monies and Sales ProceedsKeeping your monies safe - When does “Trust” really mean Trust?

The following issues exist, although this list is only a selection of many potential issues:

1. The company or fi rm in which the monies are placed may become insolvent. Many clients do not expect their law fi rms to be in fi nancial diffi culty, and therefore may not think about conducting due diligence on the fi nancial health of the advisers in whom they place trust in taking care of their monies.

2. Monies may be mingled with operational monies. This isn’t possible in certain jurisdictions – such as the UK, U.S, Hong Kong, Singapore – without very severe sanctions . For those that have been subject to a legal regime where this matter is supervised closely, the event is almost unthinkable.

3. If the company has one director, and that director dies, becomes mentally incapacitated or indisposed, then there may be limited methods of solving any fi nancial issues in the company or, worst-case scenario, an inability to access the bank account.

4. If the fi rm is a series of limited liability companies, then there may be several bank accounts and it might not be clear to a client where their monies are being held and on what terms and conditions.

5. If the company you have placed monies with comes under investigation for corruption, money laundering or other alleged criminal acts or other misdemeanors, then your monies could be ‘frozen’ pending the outcome of the investigation.

6. If the company is a real estate agent, then the agent may have a vested interest in the release of the monies, linked to a commission. The independence of any party seeking to provide assurance of their capability to be an intermediary must be inspected closely.

7. If there is a dispute, then if there is no true escrow, the party holding the monies will most likely refuse to take any action whatsoever, until the dispute is resolved. This might mean an unfairly prejudiced party, who believed that by placing monies certain rights had been secured, is left to be forced to negotiate when in other circumstances it may have been able to insist upon release or payment of monies.

Solutions and SummaryThe Escrow Regime in Thailand is rarely used for private real estate transactions. This is because the nature of a transaction is time sensitive which is contrary to some of the requirements of the regime, such as inspection and approval of the Escrow Agreement.

The informal escrow regime of using an advisory fi rm or intermediary company, carries the risks set out above. These risks can be mitigated through proper due diligence of the possible custodian of the funds, its fi nancial health, the background and ethical standards of the persons in control of the monies, and safeguards to ensure that the monies can be inspected in the bank account at any time with full transparency of the status of the monies.

A formal escrow regime could be used in other jurisdictions, where escrow can be speedy but also regulated with vigour.

The use of the word ‘trust’ can be very misleading – because simply stating the word ‘trust’ can instill the feeling of trust in others. We recommend that trust is placed in parties in relation to custody of monies, only when the reasons for placing such trust have been properly investigated and established.

As many visiting holidaymakers know, Phuket is an island blessed with some big beaches. Though few undiscovered places remain in Phuket, there are plenty of smaller, more remote beaches off ering barefoot travellers some peaceful and picturesque escapes. Here are some of our favourites.

Ao Sane, Nai Harn:Ao Sane rates as the beach with the most bizarre access point in Phuket. With a scattering of broken coral, Ao Sane’s sand is not quite as fi ne as nearby Nai Harn’s but the scene is quaint and tranquil and the snorkelling’s good around the rocks just off shoreHow to get there: Get through the covered car park at Phuket Yacht Club resort in Nai Harn, then taking a well-paved but very narrow lane for a kilometre.

Banana Beach, Nai Thon: Also known as Haad Hin Gluai or Banana Rock Beach, has everything a beach lover would ever need: a small bay of soft sand, rocks off shore and water as clear as glass for snorkelling, a smattering of sun bedsHow to get there: Located on the north west coast between Bang Tao and Nai Thon Beaches, around 500 metres north of Trisara Villas.

Hua Beach, KamalaHua Beach, might well have been the last truly secret beach on Phuket. But since a small handmade sign was posted at its entrance a few months ago, the secret’s out. The 300-metre lane leading to the beach takes you through a lush landscape with thick trees arching over the road, ending at a small car park area next to a basic restaurant. Tall casuarina and palm trees line the beach, reaching out over Hua’s golden sand. How to get there: Drive along the Kamala beach road to the south end and turn right. Drive passed Rayee Beach and you will quickly come to a sign pointing downa track toward Hua Beach.

...and off the beach, wander around Old Phuket Town

Much of Phuket’s development has taken place in the last ten years and the building style is resolutely modern – some say, stridently so; but parts of Phuket City are little changed from a hundred years ago. At that time the island was a busy trading port and supported a thriving tin mining industry. The then captains of industry built their prestigious homes in the Sino-Portuguese style. Narrow housefronts ornately decorated with red and gold, the mystic signs representing sacred guardians of the access, yielded to storied accommodations with tall ceilings and interiors often incorporated delightful gardens. Nowadays the streets in the Chinese quarter have transformed themselves into busy thoroughfares featuring antique shops, speciality restaurants and more. Well worth a visit.

Cape Promthep

Nai Harn Beach

How to get there: Less than one kilometre north of Rawai Beach, Arriving to Laemka’s main beach at the end of Soi Laem Ka Yai.

Ya Nui, Nai Harn:Not exactly a hidden spot, it can get crowded through the sunny season with rows of rental chairs full of sunbathers. Even on its busiest days, however, the beach is a breathtaking sight with its silken sands and dramatic surrounding landscape including a rocky cape jutting out from its centre and a lush green hill topped by a wind turbine rising up steeply from one end. How to get there: From Nai Harn Beach head South to Promthep Cape, the beach is located about half way to Promthep Cape.
