Message from the EVP
After celebrating the new year I took a few moments to refl ect upon 2010. It was a tough year in a lot of ways, but being an eternal optimist, I chose to look at the good things of the past year. The thing I’m most proud of is what took place after the Cuyahoga County corruption scandal. When voters decided to adopt a new form of county government, our association became involved – hosting the fi rst forum in which the county executive contenders stood on the same stage. We also took the extraordinary step of raising money for, and supporting a candidate. The candidate we supported won, and now we can rest assured our collective voice will be heard when issues come up that affect our members’ businesses.
On the challenging side, Ohio is facing a big defi cit, and John Kasich is just one of a handful of newly elected GOP governors who has signed on to a “no new taxes” pledge. Good news? Maybe. But some would say the problem these days is fees.
Consider newly elected Pennsylvania Gov. Tom Corbett’s pledge to rule out fee increases —such as those paid for car registration—to go along with his pledge against tax hikes. Now that is something I could get behind.
Fees are what NOAA spent big money fi ghting last year in litigation against the Northeast Ohio Regional Sewer District (NEORSD). NEORSD had intended to begin imposing fees on July 1, 2010, in the tens of millions of dollars annually, for stormwater, a function that is not properly within its scope of operation. Our attorneys—Berns, Ockner & Greenberger, LLC—have laid out a case asserting that these stormwater fees are nothing more than a cash-grab - taxation masquerading as FEES. In this issue of Suites you’ll fi nd a detailed update on the NEORSD lawsuit.
It appears that the best, if not only, way to challenge the PIPP program is through an appeal from the PUCO to the Ohio Supreme Court. We are advised by Berns Ockner that the PIPP program violates various Ohio laws and provisions of the Ohio Constitution. Again, this is addressed in our law fi rm’s report in this issue of Suites.
Almost everyone I’ve spoken to recently believes the worst is behind us economically. I agree. So it is with cautious optimism that our members press on into 2011. As you’re doing so, don’t forget that your association is fi ghting on your behalf.

To us, QR (Quick Response) codes are illegible black squares, randomly arranged to form much larger, equally meaningless blocks. To your phone, however, they could be links to email or web sites, connect you to wireless networks or give you new contact information.
Apartment newsletters, announcements or fl yers could easily include a QR barcode that links to a website with more details, full articles or even upcoming events. Rather than relying on your recipient to correctly type in a long web address, they could simply scan it in with their phone.
QR codes offer a physical link to the digital world. Think of them as two-dimensional barcodes. Information is retrieved from these codes by smart phones. Almost every smart phone equipped with a good camera and a barcode scanning application is capable of scanning these codes.
While traditionally used in business to scan parts and track order information, these codes are making their way into everyday use. They can be found in a wide range of print and interactive media. Museums, advertisements, business cards, magazines and posters - the applications are countless.
The Barcode, or QR code, scanning app is available on iPhone, Android, Blackberry and Windows Phone 7. Just search the appropriate market of your device, download the app and you are ready to start scanning.
These codes are also easy to customize. A quick Google search for “qr code generator” results in dozens of websites. One of the top results is: http://zxing.appspot.com/generator/. Just select the type of code you would like to generate, input your content, and your custom code is created!

How To Safely Dispose Of Old Computers
With the New Year upon us, many of you may have upgraded your old PCs for shiny new ones. So what should you do about that old PC left over?
Whatever you do, don’t just throw it into a dumpster! Not only is it an environmental hazard you could be fi ned for, but you also don’t want complete strangers getting access to your old fi les, passwords, fi nancial information, and e-mails.
First, keep your old PC around for a few months until you are absolutely certain that you transferred all of the fi les and programs you needed to your new PC.
Next, you need to make sure the hard drive is wiped clean of any data you had stored on it — and simply deleting the fi les is not enough. We recommend you seek professional help in clearing the hard drive from any old PCs you are disposing of.
Finally, you may consider donating your old PCs to a charity such as Youth for Technology (youthfortechnology.org) or Computers With Causes (www.computerswithcauses.org). Many of these organizations will clean your hard drive to prevent identity theft, and you can write off the donation on your taxes!
The Top 5 Worst High Tech Habits to break in 2011
Admit it; you have some bad habits when it comes to maintaining the security and “health” of the high-tech tools you dearly depend on. Since it’s a fresh, new year, we thought it would be appropriate to point out the top 5 bad habits you should work on fi xing in 2011.
1) Not backing up your data. Funny how most people start their confession of not backing up their data with the words, “I know it’s bad, but…” If you know, then why are you still doing it? There’s absolutely no good reason to let this one continue.
2) Relying on tape drives to backup your data. This is almost as bad as bad habit #1. Why? Because tape drives have an average failure rate of 100% – and that’s not a typo. It’s not a matter of “if” but “when” is your tape drive going to fail. Trash ’em and get a better system in place!
3) Using weak passwords. If you’ve ever used the word “password” as your password, we’re talking to you! A good password should contain a combination of numbers and upper and lower case letters.
4) Not installing the latest security patches and software updates. Once a new patch is released by a software vendor, it acts like a green light for hackers who instantly implement viruses and scams to take advantage of those individuals who don’t regularly update (patch) their system.’
5) Printing and storing paper documents for everything. The cost of installing
a document imaging (also called document management) solution has come down dramatically, and it is now easier than ever to implement. Plus you get the added benefi ts of saved storage space, saved time in searching for documents, instant access to any paper fi le via the Internet, fewer lost fi les, less chance of losing critical documents to fi re, water, or wear and tear, AND a cost saving on paper and ink.

Lake County: Succession of a NOAA Chapter.
Back in March 1998, Painesville City Manager Rita McMahon revealed the possibility of requiring new apartment inspection fees in a small weekly paper.
It wasn’t announced in any big, flashy way, so many apartment owners could have easily missed it. But not Bob Schnittger.
Schnittger, a member of the Northeast Ohio Apartment Association for several years, thought NOAA might be able to step in. He called the association’s Executive Vice President Ralph McGreevy.
“I knew that we needed to get more than a couple of angry apartment owners,” Schnittger said.
They talked for a while about this impending action. McGreevy agreed to help, and Schnittger convened a meeting of upset apartment owners at Nucciarone’s Wine Press, located near the center of Painesville under the family’s bowling alley. (The Wine Press has long since been demolished and is now home to a major drug chain.)

The initial apartment owners who met that day were Richard Tibbits, Marty and Jim Nucciarone, owners of the establishment, Schnittger, Jim Manges, Charlie McDonald, Marvin Silver and John Cutlett. They had lunch and waited for the NOAA guy to show up.
In the meantime, McGreevy had decided to visit McMahon, whom he had spoken with when she was the outgoing city manager in Sandusky. He walked into Painesville City Hall and right into McMahon, who was leaving her office.
After a brief discussion, she assured McGreevy that the issue of inspections fees was dead for the moment. She had heard the rumblings of apartment owners in town gathering to fight the fee and decided that this wasn’t the right time to pick that fight.
Satisfied, McGreevy joined the men at the Wine Press. Their discussion was interrupted by the sound of strikes and spares from the bowling alley above. McGreevy told the men of his chance meeting with McMahon right from the start. But, to a man, they said they didn’t feel safe while the legislature was in session.
That issue prompted the birth of NOAA’s Painesville Chapter, originally comprised of seven members, according to the chapter’s first directory.
The formation of the Painesville Chapter brought all the benefits of NOAA to a local level: education, political influence and the credibility that comes with an established association, all focused locally to the needs of Painesville apartment owners.
Surrounding cities have recognized the hard work of Painesville members like Randi Turner, Richard Tibbits and Schnittger. The chapter has since

expanded to 72 members and is now known as the Lake County Chapter. The chapter continues to grow and encompasses surrounding cities and adjoining counties, from Chardon to Fairport Harbor to Ashtabula.
Over the past 12 years, the Lake County Chapter has continued to thrive. It is currently the only NOAA chapter and is the last of six original chapters. The need for a strong NOAA presence in Lake County is indisputable.
“After the recession turns around, people are going to be looking for leadership in the housing market, and that is where NOAA comes in,” Tibbits predicted.
The Lake County Chapter’s current slate of offi cers includes: President Jim Morris, of Kentim Investments Ltd., Vice President Greg Tomsich, Treasurer Randie Turner and Secretary Ruthann Durrant. The Board consists of: Tibbits, Terry Castilyn, Mary Ann Moris, Gary Fisher and Christina Dubeansky.
These dedicated board members organize outstanding events and educational seminars throughout the year which, despite the chapter’s name, aren’t exclusive to Lake County members. Any NOAA member is welcome to attend; as is any Lake County member to attend any event held by NOAA.
Among the more notable events is the annual Holiday Party in December, which is traditionally held at the Mentor Harbor Yacht Club and features music from the one-man band Tom Todd, a Holiday Hat contest and an appetizing array of food.

Save the date for the evening of July 13th, 2011, when Lake County will host their Summer Picnic, an outing held at the Winery Debonne Vineyards in Madison, for the past fi ve years.
But like a good wine, membership pairs social gatherings with industry education.
For instance, the association’s recent seminar on tenant screening with associate member Sandy Simon, of Resolve Partners, drew more than 50 attendees at Capelli’s Restaurant.
Meetings are held quarterly in such popular and convenient Painesville locations as Chester’s Diner and at Capelli’s. Meetings, while entertaining and offer opportunities for valuable business networking, are designed to be effi cient and productive.
The 2011 calendar is full of ambitious plans for what continues to be NOAA’s most successful chapter.

NOAA ISSUE WATCH: Impervious Surfaces Update / PIPP
Litigation continues over whether the Northeast Ohio Regional Sewer District (“NEORSD”) can implement its Regional Stormwater Management Program, including the imposition of stormwater fees. NOAA is a party to this litigation. So are roughly 62 municipalities and townships, the Diocese of Cleveland and Catholic Cemeteries of the Diocese of Cleveland, the Cleveland Metropolitan School District, the NAACP, and a number of property owners and organizations whose members are property owners.
Currently, pretrial discovery is ongoing. NEORSD has recently fi led a motion for partial summary judgment concerning its authority over stormwater. Trial is scheduled to begin July 18. For the time being, NEORSD has agreed not to pursue stormwater fees until the court rules in the case, which may include one or more appeals to higher courts. On a related note, as many are probably aware, at its meeting on Dec. 2, NEORSD’s Board of Trustees approved a consent judgment with the Department of Justice and the State of Ohio to settle the DOJ’s claims against NEORSD for violating the Clean Water Act for continuing discharges of untreated sewage into Lake Erie from the combined sewer system in the City of Cleveland, which is owned and operated by NEORSD.
The Consent Judgment will require the construction of capital improvements in excess of $3 billion, which will cause sanitary sewer rates to more than double within the next fi ve years and more than triple within the next 25 years. Sewer rates for a typical homeowner
are expected to increase from the current $380 a year to over $1,000 a year within the next 25 years.
Pleas by two of NEORSD’s Trustees to delay the imposition of the consent judgment failed, and the consent judgment was approved by NEORSD’s Trustees by a 5-2 vote. One of NEORSD’s Trustees who sought to delay the imposition of the consent judgment, Middleburg Heights Mayor Gary Starr, appropriately referred to the increase in sanitary sewer rates as “an unvoted tax.”
Percentage of Income Payment Plan (PIPP)
Yet another tax is masquerading as a natural gas utility charge. This gem is called Ohio’s “Percentage of Income Payment Plan” (PIPP) program. It collects cash from our members, who receive no benefi t from the payment. Under the PIPP program, residential customers who are at or below 150 percent of the U.S. poverty level may pay the greater of $10 or 6 percent of their income on a monthly basis in lieu of the full amount of their gas bill. Whatever amounts PIPP participants fail to pay gets passed on to the utility’s non-PIPP customers through “riders” to their natural gas utility bills. The PIPP program’s charges may amount to as much as 14 percent or more of your gas utility bills, and is costing some of our members hundreds of thousands of dollars every year. There’s no doubt he PIPP program increases rents and devalues property.
