MANDATORY REQUIREMENTS

Mandatory Requirements

The following are the mandatory requirements of a formal bid and failure to meet one or more shall result in the bid being disqualified: .1 the Bid document shall be signed; .2 all unit prices shall be included in unit price contracts; .3 the Bid package shall be on Metropolitan Regional Housing Authority documents; .4 any Bid based on modifying, qualifying or re-writing any of the terms or conditions of the

Tender, the General Conditions and the Supplementary Conditions documents shall be disqualified;

.5 the Bid Submission shall contain all pages of the Bid and Agreement Form

Pre-Close Meeting and Site Tours

1. Pre-Close Meeting .1 A pre-close meeting will take place on Wednesday September 11, 2019 by

10:00am at Suite 3, 3770 Kempt Road, Halifax. .2 This will include a presentation explaining the scoring process. There will

not be a question and answer time during this presentation. All questions regarding scoring or the scope of work will need to be submitted in writing and the proper procurement protocols will be followed when responding through addendums.

2. Site Tours .1 site tours are strongly encouraged. Any Bidder requesting a site tour must

contact the appropriate maintenance supervisor at least (3) three days prior to the closing date.

INSTRUCTIONS TO BIDDERS

DESCRIPTION OF WORK The contract is for the provision of Winter Grounds Maintenance, at selected Metropolitan Regional Housing Authority properties from 8am on Monday, November 11, 2019 until midnight on Friday, May 15, 2020 and 8am on Monday, November 16, 2020 until midnight Friday, May 14, 2021. MRHA may exercise the option to renew for one (1) additional year after Friday May14, 2021.

1 BID CLOSING

The Bid Closing Address is Suite 3, 3 7 7 0 K e m p t R o a d, Halifax, Nova Scotia. Bids delivered to the Bid Closing Address must be in a sealed envelope marked “Bid” and bear the name of the bidder and the Service “WINTER GROUNDS MAINTENANCE”. Bids are to be placed in the Metropolitan Regional Housing Authority Tender Submission Drop Box, located at Suite 3 , 3770 Kempt road, Halifax (door located to the left of Subway). Bids will be received up to 2:00 PM local time and opened at 2:00 PM local time Wednesday, September 18, 2019.

2 BID FORM

One copy of the Bid shall be submitted on the Bid and Agreement Form provided by the Metropolitan Regional Housing Authority. All spaces on the form must be filled in completely and correctly. Signatures are to be those of authorized signing officers and are to be witnessed. The Bid submitted shall not contain any form of qualification unless the Bid documents otherwise provide, for any unsolicited alternative to the Bid. The completed form shall be without interlineation, alterations, or erasures.

3 EVALUATION OF TENDERS

.1 METROPOLITAN REGIONAL HOUSING AUTHORITY intends only to contract with responsible and competent bidders who are in the business of providing the goods and or bid upon and can provide proof that they can furnish satisfactory performance based on past work experience with the METROPOLITAN REGIONAL HOUSING AUTHORITY, other companies, or government agencies and have the financial, managerial and resource for the size of the product bid upon. Satisfactory performance of the various federal, provincial, for completion of work and making payments to sub-contractors on in a timely basis. The evaluation process may include, but is not limited to, reference checks, third party credit checks, site visits and/or criminal record checks if company information is not available or adequate. Bidders found unacceptable during the evaluation process will not be given further consideration.

.2 MRHA reserves the right, at its sole discretion, at its sole discretion to limit the number of snow and ice control areas awarded to any one bidder.

4 SCORING

.1 Evaluation Criteria – Stage 1

.1 If a proposal meets the Mandatory Criteria, it will be evaluated using the

Evaluation Criteria set out in the table below. Scores will be recorded for each criterion and a total score will be determined.

.2 Cost of Proposal – Stage 2

.1 If the proposal’s score meets or exceeds the minimum qualifying score at

subtotal A, the Pricing Response will then be evaluated using the formula below. Score = weight x (low / bid)

5 RIGHT TO REJECT

The right to reject any or all bids or to accept any bid deemed most satisfactory is reserved by the Metropolitan Regional Housing Authority. The Metropolitan Regional Housing Authority reserves the right to waive any informality in any or all bids. The Metropolitan Regional Housing Authority reserves the right to consider the following in the evaluation of the tender:

1. Metropolitan Regional Housing Authority past experience with the bidder and/or its management, including, but not limited to the following:

.1 compliance with the Terms and Conditions of past contracts between the Housing Authority or the Government of Nova Scotia and the bidder; and,

.2 performance of past tenders awarded to the bidder.

2. information received in response to inquiries of credit, customer and industry references; and,

3. the experience and qualifications of the bidders senior management and project management.

6 BIDDING OPTIONS

.1 Bids may be may be submitted on one or more locations as detailed in Schedules

“A” to “Q”.

.2 The Metropolitan Regional Housing Authority reserves the right to limit the number of awarded schedules to any one bidder.

7 INTERPRETATION OF APPROXIMATE ESTIMATE OF QUANTITIES

The estimate of the quantities of Work to be performed and materials to be furnished as shown on Schedules “A-Q” of the Bid and Agreement is approximate and is given only as a basis of calculation upon which the award of the contract is to be made. Metropolitan Regional Housing Authority shall not assume any responsibility that the estimated quantities called for in the Bid shall be the same as the actual quantities required in the Work. Metropolitan Regional Housing Authority reserves the right to increase, decrease or omit all or any of the quantities of Work shown in the Bid and Agreement Form. Metropolitan Regional Housing Authority reserves the right to make mathematical corrections to the extensions with may change the Estimated Bid Price.

8 MODIFICATIONS TO BIDS

Modifications may be made to bids by facsimile (fax) message to 902.420.7586 or by email to [email protected], provided the following requirements are met: .3 modifications must be received at the address indicated in Paragraph 1 of

Instructions to Bidder, prior to Bid Closing Time; .4 modifications made by fax or email shall immediately be followed up by the original

document being delivered to the Metropolitan Regional Housing Authority and signed as outlined in Paragraph 2 of Instructions to Bidder; and,

.5 Modifications should not include the total original or revised bid amount. Note: Messages received by telephone shall not be considered.

9 EXISTING CONDITIONS The Bidder shall familiarize himself/herself with all locations where the work is to be carried out and will be deemed to have informed himself/herself of all existing conditions and limitations.

Metropolitan Regional Housing Authority shall require of any Bidder proof of financial and technical capability to undertake the Work for which its Bid is submitted.

DESCRIPTION OF SERVICES

THE PROPOSED AGREEMENT IS FOR THE PROVISION OF WINTER GROUNDS MAINTENANCE AT THE DISCRETION OF METROPOLITAN REGIONAL HOUSING AUTHORITY FROM 8am on Monday, November 11, 2019 until midnight on Friday, May 15, 2020 and 8am on Monday, November 16, 2020 until midnight Friday, May 14, 2021 AND EQUIPMENT REQUIRED TO PERFORM THE SERVICES REQUIRED UNDER THIS CONTRACT. MRHA MAY EXERCISE THE OPTION TO RENEW FOR ONE (1) ADDITIONAL YEAR AFTER FRIDAY MAY14, 2021.

2. GENERAL AGREEMENT

.1 This agreement shall be in 8am on Monday, November 11, 2019 until midnight on

Friday, May 15, 2020 and 8am on Monday, November 16, 2020 until midnight Friday, May 14, 2021. MRHA may exercise the option to renew for one (1) additional year after Friday May14, 2021.

.2 This Bid and Agreement, Instructions to Bidders, Specifications and the General

Conditions included herewith shall be and are the complete Bid and this offer is made subject to the provisions contained therein.

.3 This Bid supersedes and/or cancels all communications, negotiations, and

agreements relating to the work other than that contained in the complete Contract.

.5 The acceptance letter shall be issued by:

.1 forwarding by Registered Mail a letter to the Contractor at the address set out in the Bid document, in which case acceptance shall be deemed to be on the day this letter is deposited in the mail, or;

.2 delivering a letter by hand to the Contractor at either: the address set out in the Bid document, the Head Office of the Contractor, or to any officer of the Contractor, in which case acceptance shall be deemed to be the day the letter is delivered.

.6 The complete Bid together with, and subject to, all the provisions contained therein

shall, when accepted and executed on behalf of the Metropolitan Regional Housing Authority, constitute a binding Contract between the Contractor and the Metropolitan Regional Housing Authority.

.7 This Bid is made without connections with any other person or persons submitting Bids to perform the work(s) described herein.

3. TOTAL ESTIMATED BID PRICE

Bids may be submitted on one or more locations as detailed in schedules “A” to “Q”. The Metropolitan Regional Housing Authority reserves the right to award one or more contracts to a bidder.

The Contractor agrees that the following is the Total Estimated Bid Price referred to in Clause 1 of this Bid and Agreement and EXCLUDES all Taxes and is based on the detailed unit price(s) set out in Schedules "A" to “Q” attached to and forming a part of this Agreement.

GENERAL CONDITIONS

1 DEFINITION OF TERMS In this Contract: .1 "Project Manager" means the person designated to represent the Metropolitan

Regional Housing Authority under the Contract. .2 "Work" includes the whole of the work, materials, matters and things required to be

done, furnished and performed by the Contractor under the Contract.

2 AUTHORIZATION AND PURCHASE/WORK ORDERS .1 A portion of the work covered by this Contract may be of an emergent nature. In

such cases the Contractor will be notified by phone, by the Project Manager, of the nature of the call. The Contractor is expected to respond within 60 minutes. A purchase/work order number will be provided verbally at this time and the written document subsequently.

.2 In non-emergent situations, the Contractor will be provided with a written purchase/work order and the work shall be completed within a reasonable period of time which will not exceed two days.

.3 The Contractor, shall on request of the Metropolitan Regional Housing Authority, provide a written quotation detailing the cost of labour and materials prior to the issuance of a purchase order.

3 SUB-CONTRACTING

The Contractor shall NOT substitute or hire any replacement subcontractors. Should the contractor become unable to fulfil its responsibilities, MRHA should be consulted immediately.

4 INDEMNIFICATION

The Contractor shall indemnify and save harmless the Metropolitan Regional Housing Authority from and against all claims, losses, costs, damages, suits, proceedings, or actions arising out of or related to improper acts in executing the work. The Contractor shall pay for and maintain liability insurance during the term of the Agreement in an amount of not less than Two Million Dollars ($2,000,000) in respect to any one accident or occurrence against claims for personal injury, death, or property damage or loss arising from any act, fault or omission of the Contractor. Certificates of Insurance showing Housing Nova Scotia and Metropolitan Regional Housing Authority as an additional named insured shall be filed with the Metropolitan Regional Housing Authority.

5 WORKERS COMPENSATION

The Contractor shall carry Workers Compensation coverage on all employees engaged under this Contract. At the time of bid submission, the Contractor shall supply the Metropolitan Regional Housing Authority with a Letter of Good Standing from the

6 SAFETY CERTIFICATION

1. At time of bid submission, the bidder must provide a Certificate of Recognition or Letter of Good Standing issued by an occupational health and safety organization approved by the Workers’ Compensation Board of Nova Scotia. Letters “in progress” will not be accepted.

7 QUALI FICATIONS AND CONDUCT OF WORKERS

.1 All employees engaged in the performance of the work shall, in the opinion of the Metropolitan Regional Housing Authority, be qualified in the work carried out.

.2 The Contractor shall submit to the Metropolitan Regional Housing Authority a roster of employees (including copies of documents confirming their qualifications) engaged in providing service under this Agreement. Other persons shall be permitted to perform services only with the written approval of the Metropolitan Regional Housing Authority.

.3 Workmanship shall be of the highest standards and quality performed by workers that are experienced and skilled in the respective duties for which they are employed. The Metropolitan Regional Housing Authority reserves the right to require the dismissal from the work site of workers deemed incompetent, careless, insubordinate, objectionable, or unskilled in the respective duties for which they are employed.

.4 The Contractor and workers are expected to conduct themselves in a polite and professional manner at all times. Discussions with residents regarding the work shall be limited to only aspects of the work that bears directly on the residents.

.5 Qualified Operators: The Contractor shall provide qualified winter maintenance operators that are competent to operate the equipment supplied. A qualified operator shall have a valid Nova Scotia driver’s license, at the appropriate vehicle class, to operate the equipment specified and demonstrated abilities of having operated a similar piece of equipment for winter maintenance purposes. The qualified operator shall also understand and be able to operate the equipment including all apparatus and controls in a safe, efficient and effective manner while completing work.

8 PERMITS, LICENSES, FEES, TAXES & BYLAWS

.1 The Contractor shall comply with all Federal, Provincial or Municipal laws and regulations, relating to the work, and shall pay for all permits, licenses, fees and certificates required for the execution of the work.

.2 The Contractor shall include in the Bid all Federal, Provincial and Municipal taxes

which are applicable to this Contract and the Contractor shall pay these taxes. No return of, or credit for taxes paid will be made to the Contractor.

.3 The Contractor shall comply with all laws, regulations, and by-laws in providing the service and shall be responsible for correcting any infraction and for paying any resulting fines, penalties, or damages.

9 SAFETY MEASURES

1. The Contractor shall take precautions to prevent accidents and injury to persons or property, about and adjacent to the premises where the work is performed. The Contractor will be held responsible for the enforcement of all applicable provisions of the Nova Scotia Occupational Health and Safety Act and its regulations and all other safety measures as required by authorities having jurisdiction. 2. Vehicular and pedestrian traffic shall be protected by the use of barriers supplied by the Contractor.

3. Safety and Training: All the Contractor’s personnel engaged in winter snow and ice control activities shall be informed of their specific duties and shall be properly trained in snow and ice control and knowledgeable of the prescribed Performance Standards.

Safety Requirements

1. The Contractor shall comply with all the regulations set out in the Occupational Health and Safety Act for the Province of Nova Scotia and ensure that each and every employee is properly trained, equipped and considered competent to perform designated work tasks.

2. The Contractor shall comply with the regulations set out in the most current

edition of the Nova Scotia Traffic Control Manual for all on-street and shoulder works.

3. Proper PPE includes the wearing of safety vests, safety boots, safety

boots, safety glasses and gloves (suitable for the weather). A hardhat is required during ice removal overhead.

4. The Contractor shall perform work in a manner that does not provide any

unsafe or dangerous situations to pedestrians, motoring public, adjacent properties, etc.

5. Materials and/or equipment are to be stored and maintained in a safe and

orderly manner satisfactory to the MRHA during the progress of work. Materials and/or equipment shall be removed from the site if and when ordered to do so to correct an unsafe condition.

6. No provisions in this technical specification shall relieve the Contractor of

responsibility for negligence of faulty materials or workmanship to the extent and period provided by law.

7. The Contractor must take care not to damage all existing infrastructure (e.g

all existing pipes, ducts, sewers, service mains, overhead and underground cables, fencing, trees/shrubs, asphalt/concrete walkways, lawn areas etc.) during the execution of the works. The price quoted shall include provision for correction of all damage caused during the course of the works.

8. MRHA representatives may inspect all work performed by the Contractor.

9. Any infractions of the Temporary Workplace Traffic Control Manual,

Provincial Occupational Health and Safety Regulations, or the MRHA Occupational Health and Safety - Policy & Procedures Manual (also deemed to include the PPE code of practice); shall be immediately investigated, results reported to the MRHA, and if necessary, reported to the Department of Labour. The Contractor shall inspect equipment to ensure proper working order. Any breakdowns shall be reported and if possible repaired immediately and replaced with replacement equipment in order to continue to reach the required turnaround times and minimum performance standards.

10. The Contractor shall report all vehicle accidents or property damage to

MRHA within 12 hours of the incident.

11. The Contractor shall not engage in any confrontation with tenants or general public. Refer such matters to proper MRHA Representatives.

12. All vehicles and equipment are to be operated in a safe manner, respecting

legal speed limits and to be respectful and aware at all times of pedestrian and vehicle traffic.

4. Contractor Safety Management Policy

The Contractor shall:

.1 Comply with all health and safety and environmental legislation and MRHA policies and procedures in the performance of this contract and to practice the principles of proactive due diligence.

.2 Maintain a safe and healthy work environment during the performance of this contract.

.3 Permit MRHA to audit or inspect contractor health and safety and environmental records during the term of the contract and upon its conclusion and to co-operate fully with any such audit or inspection.

GENERAL CONDITIONS

10 Contacts and Representatives The primary project manager may from time to time designate other representatives of Metropolitan Regional Housing Authority. Should the Contractor be absent, he/she shall appoint a competent foreperson or manager, satisfactory to the MRHA, who shall have supervision over the work.

11 EQUIPMENT

All equipment used to carry out this Contract shall be in accordance with the following conditions:

1. Equipment shall be of industrial contractor quality and be suitable for the

application of this Contract. MRHA, in its sole discretion, will determine the suitability of equipment.

2. All equipment used by the Contractor shall be made available for inspection

by MRHA by November 15th of each year of the contract and at any other time if so requested by MRHA. All equipment must be in full working order and able to perform all work outlined within the terms of this contract at the time of inspection.

3. Each unit shall be equipped and operated in accordance with the

requirements of the Motor Vehicle Act and the Regulations.

4. All necessary equipment will be available and dispatched as required to perform the various components of the work as defined in this contract

5. All equipment working under this Contract must display identification signs to

readily identify the vehicular equipment that it is under Contract to MRHA. These signs shall be supplied by the Contractor and installed on each unit in a highly visible location.

6. MRHA shall be notified as soon as possible of any equipment failure. Any

replacement equipment that is proposed for use by the Contractor during the term of the Contract shall first be reviewed and approved in advance by MRHA. This replacement equipment must be equivalent to the original equipment listed by the contractor.

8. The Contractor shall ensure that sufficient equipment is available to have the

Contract completed. Should the work not be proceeding according to the Contract, MRHA shall request the Contractor supply additional equipment to have the work completed. MRHA shall be the sole judge as to the satisfactory completion of the work. No extras shall be claimed by or paid to the Contractor in order to complete the work if extra equipment is required.

12 INSPECTIONS 1. MRHA representatives shall have access to the work at all times. If the work is

found not to be in accordance with the contract, it shall be corrected at the Contractor's expense.

2. MRHA representatives shall have full authority to reject defective equipment, materials, safety devices, quality of workmanship and to suspend the carrying out of any work that is being improperly done. The Contractor, however, remains fully responsible for the quality and accuracy whether an MRHA representative is present on-site or not.

13 WARRANTY

The Contractor shall make good any defects due to poor workmanship.

14 PROTECTION OF WORK AND PROPERTY .1 The Contractor shall provide and/or maintain at his/her own expense adequate

protection to any work in progress. .2 The Contractor shall protect from damage all infrastructure, real property, goods,

household effects and personal property of residents, adjacent property owners or the Metropolitan Regional Housing Authority in the course of performing the work or as a direct result of it.

.3 WINTER DAMAGE TO MRHA PROPERTY

1. The Contractor is responsible to repair all damages caused to MRHA and private property as a result the Contractor’s snow and ice control activities. Repairs are to be completed by the end of the contract (failing which MRHA may make such repairs at Contractor’s expense and/or terminate the contract). Any urgent or safety related damage/repair requiring immediate attention will be completed with 24 hours.

2. The Contractor is responsible to report to MRHA representatives

regarding the status and completion of damage repairs through twice weekly updates (Monday and Thursday) during the spring repair season.

15 TERMS OF PAYMENT

The Metropolitan Regional Housing Authority agrees to make payment in accordance with the terms of the Bid and Agreement subject to the following:

1. The MRHA representatives shall verify, through various means, that all the work has been satisfactorily performed.

2. Invoices shall include a detailed description of the work performed by property and applicable taxes identified separately. The purchase order number must appear on each invoice.

3. Daily Reports and Hazardous Assessments, completed on the forms

provided, must be sent in daily to the Primary Project Manager. Billing to show start time and stop time and equipment used and description of services provided.

5. Holdback: .1 The contractor shall invoice at ninety percent (90%) of the c o

n t r a c t value, proportional to the amount of the Contract, of labour and materials incorporated in the work

.2 the ten percent (10%) of the value of the work, service and materials shall be retained by the Metropolitan Regional Housing Authority until all end-of-season clean-up and repairs and inspection have been completed to the satisfaction of the Project Manager. At that time, the Contractor shall submit an invoice for the release of Holdback.

.3 Failure to complete clean-up and repairs prior to May 31 of each year could lead to forfeit of holdback by the contractor.

6. Invoices will be paid on a net 30-day basis.

16 METROPOLITAN REGIONAL HOUSING AUTHORITY SUPPLIED MATERIALS

The Contractor shall install material supplied by the Metropolitan Regional Housing Authority when, in the opinion of the Metropolitan Regional Housing Authority, it is expedient to do so.

17 RUBBISH & WASTE REMOVAL

.1 Rubbish and waste material is to be kept to a minimum. At completion of the work the Contractor shall, at his/her expense, ensure the maximum cleanliness of any Metropolitan Regional Housing Authority or other property and shall remove and properly dispose of all rubbish or waste materials.

.2 The Contractor, upon written request of the Metropolitan Regional Housing Authority, shall deliver to the Metropolitan Regional Housing Authority any part, etc. that has been replaced.

18 TERMINATION OF CONTRACT

The Metropolitan Regional Housing Authority reserves the right, at any time during the term of the Contract, to terminate the Contract or any of the terms and conditions or specifications in whole or in part.

.1 Contractor Equipment Invoice Provisions with Respect to Efficiency Nova Scotia Rebate. The following provisions apply to products or services which may be eligible for rebates/incentives through various programs including those offered by Efficiency Nova Scotia. Eligible products and services may include, but are not limited to:

• Heating equipment (e.g. heat pumps); • Lighting equipment and technologies; • High efficiency circulator pumps; • Insulation (e.g. exterior rigid, attic etc.); • Windows and doors; • Heat Recovery Ventilation (HRV); • Energy Recovery Ventilator (ERV), and • Air-sealing.

Provision 1: Supplier to Contractor Invoice The Contractor shall provide a copy of supplier invoices for the following products:

• High-efficiency circulator pumps (i.e. pumps containing permanent magnet motors and VFD technologies), and

• Lighting equipment (i.e. bulbs and fixtures).

All eligible product(s) shall be identified on the invoice c/w description (model/make), quantity, and design designation label. The location in which the product will be installed shall be identified by the Contractor.

Provision 2: Quotations/Estimates At the request of the RHA and/or HNS, the Contractor shall provide quotations/estimates that show the installed price of all eligible product(s) and services prior to commencing any work. All eligible product(s) shall be identified in the quotation/estimate with the following information:

• Quantity of product(s); • Manufacturer; • Model number; • Material cost per unit; • Labour as a separate line item, and • Applicable taxes.

SCOPE OF WORK AND SPECIFICATIONS

GENERAL

The Winter Grounds Maintenance activities have a direct impact on the safety of MRHA staff and Residents. The Contractor is advised that the response time in mobilizing operations and being proactive to address the conditions is of primary importance. The Contractor shall ensure that its operation reflects that importance and complies with the prescribed Performance Standard. The Contractor shall maintain sufficient staff and equipment to execute the terms of the contract.

This contract is for the supply of material and labour for Winter Grounds Maintenance as per following specifications.

Contractors will provide an all- inclusive lump-sum price for winter grounds maintenance up to a 260 centimetre total accumulated precipitation of snow. Amounts over the 260 centimetre cap, will be paid per centimetre, using the bidder’s bid price. Any overage amounts will be invoiced after the last date of the contract and shall be based on the accumulation amounts reported as of the last date of the contract. It is the intent of this contract to set out a formula for calculating accumulation amounts that reflect known weather pattern variations, in particular, to reflect the effect of an individual schedule’s proximity to the coast and topographical elevation level. The accumulation amount for each schedule shall be calculated in accordance with the formula set out in each schedule and is based on data reported by Environment Canada Weather Station 8202251 operated by NavCanada at the Halifax International Airport.

Overage will be calculated per year as follows:

SCOPE OF WORK AND SPECIFICATIONS

This contract shall be in effect from 8am on Monday, November 11, 2019 until midnight on Friday, May 15, 2020 and 8am on Monday, November 16, 2020 until midnight Friday, May 14, 2021. MRHA may exercise the option to renew for one (1) additional year after Friday May14, 2021.

1. SCOPE OF WORK – WINTER GROUNDS MAINTENANCE

.1 This service includes all labour, material, equipment and transportation to carry out Winter Grounds Maintenance, ice removal, salting or sanding, snow plowing, snow blowing and snow shovelling, at all d e si g n a t e d properties on schedule’s “A” through “Q”. This includes associated parking lots, driveways, walkways (including sidewalks in areas that are not cleared by Halifax Regional Municipality) All building exits and entrances: this includes all EMERGENCY FIRE AND STAIRWELL EXITS TO THE NEAREST AREA WHERE SNOW CLEARANCE HAS ALREADY BEEN COMPLETED. Fire exits that do not have a defined sidewalk, the width of the cleared area shall be a minimum of 36” inches wide. Sidewalks that have Winter maintenance provided by HRM shall be the responsibility of the Contractor to ensure that the abutting sidewalk or driveway is maintained free and clear and safe for pedestrian traffic. Sidewalks are to be COMPLETELY CLEARED (from edge to edge) of all snow and ice.

.2 The definition of a complete winter weather event response (snow, ice, freezing rain, etc.) is the initial opening, maintenance required during the weather occurrence, and a complete clean up following the weather occurrence, including all plowing, coordinated parking lot clearing with appropriate site supervisor or residents to complete snow clearance, shovelling, salting and sanding, etc. in accordance with MRHA directives

.3 Winter maintenance around all waste bins/carts fire hydrants, emergency generators, drainage, catch basins, storm drains, and other features in the applicable schedule and property maps shall be included as part of this tender and shall not be considered an extra cost.

.4 This service includes responding twenty-four (24) hours a day, seven (7) days a week, as required. Maintaining an acceptable level of performance in the area of response time shall be routinely monitored by MRHA. The Contractor’s performance will be a factor of consideration in the annual review process.

.5 The Contractor is responsible to ensure availability of an adequate supply of salt and sand to satisfy the requirements of the contract, including any necessary stockpile which would be required to offset any possible shortages due to transportation delays, salt mine/source shut downs, holidays, mine closures and the increased salt/sand usage rate of multiple subsequent winter weather events.

.6 The Contractor is responsible to prepare a Winter Grounds Maintenance Plan including installing marker flags, reflectors, or other markings to alert operators of

immovable infrastructure (including but not limited to, fire hydrants, curbs, bollards, support posts, traffic barriers etc.) prior to the first weather event, to prevent damage and make operators aware of locations.

.7 In the event there is a complaint or obstruction preventing snow plowing/clearing, the Contractor is responsible to document via electronic photos the obstacle, actions taken, and/or completion.

2. ADDITIONAL WORK

.1 In addition to the total contract price, MRHA may require additional supplemental unit prices that shall apply to occasional requests for additional work.

.2 Unit prices shall be firm/fixed for the duration of the contract and Contractor agrees to perform additional work at such prices when requested and approved by MRHA.

.3 MRHA reserves the right to award additional occasional work to any contractor regardless of the area that is covered by their awarded contract

3. WINTER/SPRING MAJOR CLEAN UP

.1 The Contractor is responsible for the removal of all residual ice control materials applied during the winter maintenance period on Housing Authority properties.

.2 Sweeping and removal, and any property damage repairs must be completed by the last day of the contract each year.

4. PERFORMANCE

The Contractor is responsible to become familiar with the Property Maps (provided with tender award) of the areas to be serviced and all listed properties to be serviced in the applicable schedule. The Contractor shall review these areas and become familiarized with the locations of all obstructions that may be a hazard to winter maintenance operations. In addition, the Contractor shall plan and organize the necessary resources and operational routes required to achieve the prescribed Performance Standards.

5. FIVE STAGE SNOW MAINTENANCE PLAN

.1 Prior to Snow and Ice Event: The contractor shall: (a) Patrol streets and monitor weather forecasts and reports to

ascertain expected weather conditions. When adverse weather conditions become apparent, determine the following:

i. Weather event severity, impact and duration and operational requirements

ii. Type of precipitation (i.e. wet snow, dry snow, sleet,

freezing rain, etc.) iii. Visibility (good, fair, poor, nil) iv. Existing temperatures and changes (falling or rising)

(b) Inspect and check equipment to ensure proper working order. (c) Organize and call-out operators according to conditions to

ensure that necessary operations are undertaken with minimal delay.

.2 During the Snow and Ice Event:

The contractor shall:

(d) Continue to patrol MRHA Properties and monitor weather

conditions. The contractor must maintain communications with operators in the field to assist in monitoring weather and road conditions. The contractor must remain vigilant to changing weather conditions.

(e) Ensure that salt, sand or mixture of sand and salt is being applied at the correct time and rate and that it is applied effectively. This includes around recycling/garbage/dumpster areas to prevent slips/falls.

(f) Ensure that plowing operations are continuous to maintain emergency vehicle access to each property. Fire exits and muster stations are to remain clear and accessible.

.3 After the Snow and Ice Event: First Twelve (12) Hours after Snow/Ice

Event

The contractor shall: (g) Complete priority clean up within Twelve (12) hours of the

end of the snow and/or ice event. • Priority shall be given to MRHA staff office & fleet

parking compounds on business days only. • Driveways shall be completely cleared full width. • All stairs, sidewalks, walkways, pathways, all building

entrances/exits and fire exit pathways shall be completely cleared full width making handrails functional including ice control where applicable.

• Walkways, stairs and driveway entrances that abut municipal sidewalks and municipal or provincial roadways shall be revisited during this period to ensure the juncture points remains clear.

• Garbage dumpsters shall be made truck accessible. (h) Ensure that salt and sand continues to be applied effectively, as

conditions warrant. This includes around recycling/garbage/dumpster areas to prevent slips/falls.

.4 Major Clean Up: Next Twelve (12) Hours

• Dumpsters and recyclables and garbage sorting areas shall be fully cleared and functional.

• Full coordinated parking lot clear-out to the fullest extent possible by proactively working with MRHA staff and established “snow buddy” program.

• Driveway and parking lot accumulations shall be lifted up and pushed back beyond curb to allow for future accumulation.

• Emergency generators and associated infrastructure, fire hose connections, fire hydrants, fuel supply access points, oil tanks, air in/out take, furnace exhaust, or any other utility related infrastructure requiring regular or emergency access, as applicable to each property shall be fully cleared and accessible.

• Snow removal and ice control on all drainage catch basins & storm drains.

.5 The Final Cleanup • Reducing snowbanks, better ice control of

sidewalks/pathways/ snowbanks. • Cleanup MRHA/ HRM sidewalk junctions where they

overlap or join.

6. MRHA will be the sole judge of operational performance.

.1 The Contractor agrees:

That MRHA shall address contractor performance deficiencies in the following progressive steps:

i. The problem will be identified to the MRHA Contractor, Supervisor Staff

ii. The Contractor’s head office will be contacted about the problem, orally and followed up in writing.

iii. At the sole discretion of MRHA, the contract may be suspended or terminated and/or payment withheld.

iv. If required to do so by legislation, MRHA will immediately report the problem to the appropriate regulatory authority.

That depending upon the nature and/or seriousness of the deficiency MRHA reserves the right to bypass any or all of the steps described in subsection 5.1 above.

.2 Inspection of Work

The work shall be subject to the inspection of the MRHA (Manager, Supervisor or Designate) in order to monitor and evaluate performance, compliance, and/or quality assurance under this contract. All inspections and evaluations shall be performed in such a manner that will not unduly interfere

with the Contractor’s business or work hereunder. All instructions given by MRHA regarding the quality of the work, scheduling or performance shall be followed by the Contractor.

.3 Amounts Owing Upon Termination Regardless of the reason for termination of the contract, the Contractor will only be paid for work satisfactorily performed prior to termination, less any losses or damages incurred by MRHA (including but not limited to any excess costs incurred by the MRHA in re-procuring and completing the work). In no event shall the Contractor be entitled to lost profits.

7. WEATHER

.1 CONDITIONS AND MONITORING

The Contractor is responsible to refer to the services of professional weather forecasters in order to monitor weather conditions (24 hours a day) during the contract period. The forecast shall include detailed information pertaining to precipitation, wind speed and direction, surface and air temperature, dew point, and the probability of black ice. The forecast must be accessed by the Contractor a minimum of three (3) times daily.

8. COMMUNICATION REQUIREMENTS

.1 The Contractor is responsible to maintain 24-hour supervisory coverage within the contracted area. The Supervisor/Owner must be able to receive and respond to calls, texts, and emails, respond to emails from the MRHA representative, and other designated representatives from MRHA, the MRHA after hours’ service centre (902- 420-6000) and/or other designated representatives from MRHA.

.2 The Contractor is to provide one (1) email address and one (1) telephone number for

the primary contact to be used by a MRHA representative to contact the on-duty foreperson at all times.

1. The Contractor must supply cellular phones for each unit of equipment in

order that the operators of the equipment can be contacted, through the Contractor’s representative, during operation. Any communication costs shall be included in the price bid.

2. The Contractor is responsible to respond to, investigate, and resolve any inquiries or complaints from a Property Owner regarding service issues or damage to private property as a result of snow and ice control activities.

3. A secondary or alternative contact must be provided at the time of award.

9. CUSTOMER SERVICE REQUIREMENTS

It is the Contractor’s responsibility to ensure that a high quality of customer service is provided in the delivery of the snow and ice control services outlined in this contract. Calls and complaints will be recorded and forwarded to the Contractor.

10. REPORTING

Reporting Requirements .1 Daily Log: The daily log shall be completed daily and submitted electronically on the due date (bi-weekly as directed by the Project Manager). The Contractor shall document the following in the diary including, but not limited to:

• Report forms will be provided by the Housing Authority. • Failure to supply reports by the due date will result in payment delays.

Any incident that occurs should be reported to Donna Bonner, Project Manager, immediately and followed up with a written report.

Long winding driveway, plenty of empty space for snow dump on the left side of driveway for moving snow around if an opening is kept free. Dumpster and recycling area. Generator and Gate, Circular Access Front entrance with overhang. Oil Fill up by Front Door. CAUTION: Millwood Fence: Very delicate when snow is pushing up against it. Snow need to push into the right down over the hill, opposite way when snowbanks are getting higher. Driveway leading to Roadway: Snowbanks that build up at the stop sign at the end of the driveway (left side) must be keep at a height so driver coming out can see the traffic coming. Push snow back from corner. (See Picture) This driveway can get icy because of run off.

HIGH PRIORITY: Special Care Facility: This is a high priority, special care facility. Snow removal MUST be cared for before and after staff shift change at 7:00am and 7:00pm. Upper and lower parking lots are very hilly and ice up quickly. All fire exits and walkways in gated areas. Back parking lot, dumpster and recyclables area and back double doors to the receiving bay. Security/staff will be on-hand for accessibility to the secure area if driver does not already have a key. Call supervisor before season starts for a key.
