Dear Friends: Our State Use Program and its affiliated organizations are working diligently to make sure that every individual with a severe disability has the opportunity to experience economic independence.
The State Use Program offers training and job opportunities for the severely disabled. The program is made up of an eight member State Use Board, 65 Community Rehabilitation Programs, and staff attached to the Department of Administration.
This unique program has been effective in lowering the high rates of unemployment among persons with disabilities. At the same time, the program’s participants have achieved a greater degree of self-sufficiency and self-reliance.
I enthusiastically endorse the program and encourage all state agencies and political subdivisions across Wisconsin to use the services and products provided by the State Use Program.

INTRODUCTION Wisconsin’s State Use Program, created by the 1989 enactment of the State Use Law, promotes a desirable socioeconomic goal by using the vast purchasing power of state government as a catalyst in employing people with disabilities who cannot engage in competitive employment. The law provides long-term employment opportunities for people working in not-for-profit community rehabilitation facilities by encouraging all state agencies to purchase products and services produced and provided by workers who are severely disabled. The State Use Law assists and encourages individuals with severe disabilities to achieve maximum personal independence through useful, productive and gainful employment by expanding markets for the products and services produced by certified work centers. Such meaningful employment enhances their dignity and capacity for self-support and minimizes their dependence on public services. The State Use Law established the State Use Board to help match the needs of State procurement with the products and services produced by State certified work centers. The State Use Board provides the framework for a structured approach to generating significant growth in employment opportunities for people with severe disabilities. Under the State Use Program, people with disabilities, state agencies and Wisconsin citizens all win. State agencies obtain high quality services and products that meet standards for suitability, performance and price. Wisconsin residents with disabilities are employed at work centers located throughout the State in large and small communities, thereby stimulating the economic growth of local communities in Wisconsin. The State's economy grows as a result.

STATE USE BOARD RESPONSIBILITIES The Board is responsible for coordinating and monitoring the implementation of the State Use Program, also known as the Work Center Program. The Board’s primary goals are:
• Maximizing State agency contracting with Wisconsin work centers; • Insuring the procurement of quality products and services at fair market prices;
and • Providing a positive impact on the employment of individuals with severe
disabilities. S.16.752(2)(e), Wis. Stat., requires the State Use Board to submit to the Secretary of the Department of Administration an annual report of its activities including:
• The names of work centers certified to participate in the State Use Program (See Appendix A);
• A summary of materials, supplies, equipment, and contractual services available
for purchase by State agencies from work centers (Appendix C); and • The impact of the State Use Program on production, work stabilization, and
program development by participating work centers, and the number of persons with severe disabilities served (pages 8 & 9).

WORK CENTER RESPONSIBILITIES
A work center is a non-profit organization, or a unit of a county government, with a program of rehabilitation for persons with severe disabilities that produces goods or services and employs persons with severe disabilities for at least 75% of its direct labor. Workers with disabilities employed in a Wisconsin work center setting receive a variety of tangible benefits. The tangible benefits include the value of work and pay earned for that work, the same benefits received by all employees in workplace settings everywhere. Tangible benefits for these workers also include on-site continual supervision and aide assistance for those who need help with personal hygiene and meals, on-site counseling for behavioral problems, and on-site training in social skills, daily living skills, problem solving skills, time management and work ethics. To obtain a State contract, a work center must:
• Provide a product or service that the State needs, i.e., according to State specifications;
• Price the product or service at a fair market value;
• Employ persons with severe disabilities for at least 75% of the direct labor hours
needed to produce the product or service; and
• Add an appreciable contribution (value) to the raw materials needed to make the product (for products only).
When a work center satisfies these requirements, then:
• A State agency need not solicit bids or proposals to enter into a contract with a work center. However, an agency may solicit bids or proposals as a means to establish the fair market value when other means do not exist.
• A State agency is obligated to buy the work center’s product or service.
• A State agency may approve a price increase provided that such increase is
predicated on an increase in the work center’s material or compensation costs and is consistent with market conditions.
• The State contract continues as long as the work center performs satisfactorily to
meet State agency needs.

STATE USE BOARD REPRESENTATION AND DUTIES The State Use Board is attached to the Department of Administration, is provided staff, and has the following duties and responsibilities as defined in s.16.752, Wis. Stat.:
• Coordinate and monitor the State Use Program;
• Aid in the identification of materials, supplies, equipment, and contractual services for procurement by State agencies from work centers;
• Establish eligibility criteria for work centers participating in the State Use Program;
• Establish and review fair market prices for materials, supplies, equipment, and
contractual services that state agencies purchase from work centers;
• Prepare an annual activity report for the Secretary of the Department of Administration;
• Conduct reviews of prices paid by state agencies for materials, supplies,
equipment, and contractual services provided by work centers and make any adjustments necessary to establish fair market prices;
• Promulgate rules regarding specifications, time of delivery and designation of
materials, supplies, equipment, and contractual services to be supplied by work centers. The Board must maintain a list of each material, supply, piece of equipment, or contractual service to be supplied by work centers and must assign a number to each item on the list. Specifications of the Board must be consistent with specifications prescribed by State agencies for which procurements are made;
• Review each order and contract for the impact of the State Use Program on each
supplier and contractor to the State and assure that the program requirements do not affect more than fifteen percent (15%) of a supplier’s or contractor’s current yearly sales or production;
• Prescribe an annual fee to be paid by State agencies for program support, payable
to the Department of Administration, according to procedures specified by the Board; and
• Investigate any alleged State Use Program violation by a work center or state
agency.

STATE USE BOARD STAFF State Use Board staff assists the Board in the discharge of its functions by working closely with the procuring agencies and work centers across the state to identify and develop new products and services for purchase by state agencies. State Use Board staff provides oversight, expertise, and support in developing new contracting opportunities between work centers and state agencies. The contracts between state agencies and work centers provide training, meaningful employment and fair wages for Wisconsin citizens with disabilities. Some key activities State Use Board staff undertakes in fulfilling their responsibilities to the Board are:
• Leading, managing and coordinating the day-to-day operation of the State Use Program, including administration of contracts with work centers;
• Providing out-reach through on-site visits and training sessions to assist work
centers and State agencies in complying with State Use Program provisions;
• Obtaining certification and submitting to the Board a listing of work centers wishing to participate in the State Use Program that are qualified and legally eligible to do so;
• Monitoring work centers to evaluate their qualifications and capabilities and ensure
they will be able to produce the commodity or provide the service satisfactorily;
• Providing the Board with data necessary to determine the fair market price which should be paid by the State for a commodity or service under consideration for award;
• Providing technical assistance, either directly or indirectly, to work centers and
state agencies in the form of pricing, procurement, contract administration and negotiation;
• Acting as a troubleshooter when assistance with a State Use commodity or service
is needed by a procuring agency; and
• Overseeing the coordination, development and implementation of programs and special initiatives within the State Use Program that impact contracting opportunities.

IMPACT OF STATE USE PROGRAM The State Use Law strives to maximize State agency contracting with Wisconsin qualified work centers, insuring the procurement of quality products and services while providing a positive impact on the employment of Wisconsinites with severe disabilities. If a work center employing persons with severe disabilities demonstrates they can offer quality products and services at competitive prices, the State will purchase the product or service for as long as it is needed and the work center's performance and production meet applicable standards. Annually, the State Use Board asks work centers to report on their contracting with state agencies to help determine the impact of the State Use Program. This annual report includes a summary of financial and employment analysis of the program's growth. In Fiscal Year 2007, work centers reported annual sales to State agencies totaling $13,430,689. This represents an increase of 17% from the previous year. The increase is a result of continued product development and expansion of current product lines. Of the 65 work centers certified to do business under the State Use Program in Fiscal Year 2007, 43 work centers (66%) did some business with the State. The State Use Program continually strives to increase the number of people with severe disabilities who work on state contracts. While special manufacturing or procedural techniques may be developed to adapt the production process to meet the needs of individuals with severe disabilities, there are no modifications made to the State's specifications or quality requirements. The results are high quality products and services for Wisconsin state agencies and greater independence for people with disabilities Wisconsin’s State Use Law links people to rehabilitation, rehabilitation to jobs, and jobs to productivity and independence.

Work Center Employment of Persons with Severe Disabilities
The State Use Program provides needed services and products to state agencies while providing good jobs, decent pay and honest self-determined futures to people with disabilities. While percentages of dollars spent are good measures of the program’s success, the ultimate objective of the State Use Program is more jobs and better jobs for people with severe disabilities. During Fiscal Year 2007, State Use Program contracts provided employment for 6,600 workers with disabilities (a 35% increase from the previous year) who worked 320,963 hours and earned $2,053,882 in wages. The dollars paid out in State Use wages advance the economic independence and self-reliance of Wisconsinites with disabilities. Moreover, 345 disabled workers were successful in moving to competitive jobs outside the program. FY 04 FY 05 FY 06 FY 07

This represents 64% of the total spent on all contracts in the State Use Program (see below). *The Department of Transportation (DOT) historically has contracted with work centers to clean and maintain the facilities and grounds for rest areas along the interstate highway system in Wisconsin and a few primary Wisconsin highways. Through the State’s rest area maintenance (RAM) program the DOT currently contracts with 24 certified work centers for rest areas located throughout the State.

SUMMARY OF STATE USE FY 2007 ACCOMPLISHMENTS Since its inception, the Board has demonstrated leadership in identifying opportunities for work centers to market their products and services to state agencies. In Fiscal Year 2007 the primary focus of the Board was on providing information to work centers to maintain the effectiveness of the State Use Program. The State Use Board has continued to grow the program with its objective of establishing viable systems that create opportunities for work centers to increase sales to state agencies. It is important to note that the State Use Program achievements are a team effort, only reached with assistance from the State Use Board, work centers, Board staff and numerous state agencies. The Board encourages comments and questions from the public at each of its meetings so that the Board becomes cognizant of developing issues and concerns. The Board meets quarterly on the second Thursday of January, April, July, and October. Working with staff and work centers, the Board accomplished the following during Fiscal Year 2007 (July 1, 2006 through June 30, 2007):
Joint Venture Contract Initiative The Board continued to encourage Wisconsin’s work centers to team with for-profit companies to establish the necessary technical foundation for providing products to contracting state agencies. The for-profit partner’s willingness to share expertise and knowledge has resulted in an increase in employment options for individuals with disabilities. During FY 2007, the joint venture initiative resulted in state contracts to provide correctional officer uniforms, inmate tennis shoes and indigent hygiene kits for prisoners. Every new product helps to diversify the portfolio of the work center and the job skills of the individual workers while demonstrating the potential of people with disabilities to excel in the jobs performed. The collaboration between for-profit companies and work centers provides opportunities for individuals to achieve greater self-worth, esteem, improved economic independence, and social inclusion while building a stronger foundation for Wisconsin's economy.

Education and Outreach
In the previous fiscal year the State Use Board conducted a survey of work centers asking how the State Use Program meets work center’s expectations. Feedback from the survey indicated the Board should conduct some of its Board meetings outside of Madison to accommodate work centers located around the state. Work Centers also requested the Board provide state use program training opportunities. During FY 2007, State Use Board meetings were held in West Allis and Balsam Lake in response to the work centers’ suggestions and for State Use Board meetings held in Madison, the Board now offers conference call participation to work centers. Additionally, the Board presented training on lean manufacturing provided by UW Stout’s Economic Development Center and State Use Program training at an employer roundtable in Tomah designed to educate the manufacturing sector and work centers on the State Use Program.
Annual Fair Market Review Procedure
One of the State Use Board’s fundamental governance duties identified in the State Use Law is to “at least annually, conduct a review of the prices paid by agencies for the materials, supplies, equipment and contractual services provided by work centers and make any adjustments necessary to establish fair market price.” During Fiscal Year 2007 the Board established methods to implement an annual fair market pricing review. The annual fair market review procedure is scheduled to begin April 2008.
Research and Development In Fiscal Year 2007, the State Use Program received requests from work centers for information on how the state buys certain products and services. Obtaining this information is the first step for the work center in analyzing its ability to contract with the State. Staff did extensive investigation and provided research results on annual State purchases, most recent contract specifications, terms and conditions, prices and samples in the following areas:
• Safety Cones/Barrels, vests, flags • Drug Testing Kits • Soap • Disposable Coverall • CD/DVD & Computer Data Destruction • Corrugated Boxes • Cafeteria Services
Work Centers that demonstrated persistence in bringing initiatives to the Board for research and development seem to be the most successful in finding new ways to contract with the State.

SUMMARY
For more than 18 years the State Use Program has provided job opportunities to Wisconsin’s residents with severe disabilities who would otherwise face countless obstacles to securing employment. The program benefits individuals who are blind, developmentally and mentally disabled. The State Use Board continued to make progress in Fiscal Year 2007 establishing policies and procedures to effectively and efficiently manage the program while addressing the needs and concerns of work centers and state agencies. The State Use Program was designed and passed into law by the Wisconsin State Legislature for the purpose of providing gainful employment for persons with disabilities. The Program opens doors to opportunity, providing people with disabilities job skills and training that enhance their lives. The value of work is deeply ingrained in Wisconsin culture and Wisconsin’s work centers provide opportunities for employment to individuals with disabilities who would likely be unemployed. Through the State Use Program certified Work Centers are guaranteed the opportunity to show they can offer quality products and services to the Wisconsin’s state agencies at competitive prices. The State benefits through the acquisition of quality goods and services, assurance of on-time delivery, and payment of fair market prices. The work centers provide long-term transferable work experience and marketable job skills for people with disabilities that increase their independence and self-sufficiency. The State Use Law Program is an example of State government operating at its best. Through the State Use Program people with disabilities are provided the opportunity to work in a supported environment, receive vocational training and earn a living by their own efforts. The State Use Program gives Wisconsinites with disabilities the same opportunity as everyone else to have a job, develop self esteem and fully participate in society.
