WKU SILENT AUCTION MATERIAL/EQUIPMENT WAIVER & HOLD HARMLESS AGREEMENT
It is agreed and understood by signature below that the following statements apply to any items sold, transferred,
given away, or are in any other manner received by me from Western Kentucky University:
1. Any and all items are received “as is.” No testing items. No viewing items.
2. Without exception, Western Kentucky University does not warranty any item regardless of its condition, nature of application, usefulness or longevity, and some of the items may be unsafe if handled improperly.
3. I specifically waive, release, indemnify and hold Western Kentucky University harmless from claims of any
nature whatsoever involving liability, personal or bodily injury, as well any property damage that may occur while moving the items.
4. I specifically waive, release, indemnify, and hold Western Kentucky harmless from any harm that may arise out
of my use/misuse (or transportation of item to another person) that I purchased or received from Western Kentucky University.
5. Items purchased that require extra moving time will have until April 18th, 2014 at 1:00 pm CST to be removed
from campus. I will bring any tools, assistance, or supplies needed, at my own cost, to disassemble and take away. I understand that WKU Recycling and Surplus staff will not be there to help move the items, and anything left after
April 18th, 2014 will be left for WKU to dispose of as they see fit.
