“Everyone’s A Winner” CampaignTerms and ConditionsProgramme Period
1. This Citibank Berhad ("Citibank") "Everyone’s A Winner" Campaign("Campaign") will run from 1 March 2007 until 31 May 2007 (both datesinclusive) ("Campaign Period").
Eligibility
2. Subject to Clause 3 below, all Principal Citibank Credit Cardmemberswho are residents of Malaysia, are eligible to participate in this Campaignexcept for Ready Cash Credit Cardmembers ("Eligible Cardmembers").
3. The following persons are NOT eligible to participate in this Campaign:(a) Representatives and/or agents (including advertising and promotion
agents) of Citibank and their immediate family members; (b) Holder(s) of Citibank credit card(s) not issued in Malaysia; and (c) Holder(s) of Citibank credit card(s) who is(are), in default of or cancelled
facilities granted by Citibank at any time during the CampaignPeriod, subject to Citibank’s discretion.
The Campaign
4. For the purpose of this Campaign, a Qualifying Retail Transaction shallbe taken to mean a retail transaction worth at least Ringgit MalaysiaFifty (RM50).
5. Eligible Cardmembers who:-(a) register their participation in the Campaign by sending a short
messaging service text ("SMS") to 36700 stating their credit cardnumber; and
(b) use any one of their Citibank credit card(s) to effect a minimum ofeight (8) Qualifying Retail Transactions over a period of one (1)calendar month during the Campaign Period (March, April andMay 2007 respectively);
shall be entitled to participate in this Campaign ("Participants").
6. (a) Platinum, Gold, Silver, Clear, Citibusiness, Choice and Celcom Credit Cards(i) Pursuant to the Campaign, Eligible Cardmembers other than
holders of Citibank Cash Back Credit Cards shall be entitled to receive Rewards Points in the following manner:
(b) Citibank Cash Back Credit Card(i) Pursuant to the Campaign, Eligible Cardmembers who are holders
of Citibank Cash Back Credit Cards shall be entitled to receivecash rebate ("Cash Back") in the following manner:
(ii) The Cash Back Rate applicable for the purpose of calculating the total amount of Cash Back received by an Eligible Cardmember is determined by (1) the monthly opening balance [which is previous statement balance less any credits or payments credited as of the billing period] of the relevant cardmember’s credit card account as stated in the credit card monthly statement for the months of March 2007, April 2007 and May 2007 respectively AND (2) the provisions of the Eligible Cardmember’s Cash Back Credit Card Agreement and/or the Citibank Online at www.citibank.com.my in relation to Cash Back Rates.
7. For the purpose of tabulating the total number of Rewards Points and/orCash Back to be awarded to Eligible Cardmembers under the Campaign:-(a) the Average Amount will be calculated in the following manner:
(i) the amount spent for each Qualifying Retail Transaction will beaggregated and then divided by the number of Qualifying RetailTransactions effected by the Eligible Cardmember in a particularmonth (March 2007, April 2007 and May 2007 respectively);
(b) as an example, if an Eligible Cardmember had effected eight (8) retail transactions worth Ringgit Malaysia Sixty (RM60) each for the month of March 2007, the Average Amount would be RinggitMalaysia Sixty (60). (i) a holder of a Platinum, Gold, Silver, Clear, Citibusiness, Choice or
Celcom Credit Card would be entitled to receive seven hundred and twenty (720) Rewards Points (ie. 60 x 12 = 720) in that month.
(ii) assuming a holder of a Cash Back Credit Card had an Opening Balance of Ringgit Malaysia Five Thousand (RM5,000) and the corresponding Cash Back Rate was 1%, the said cardmemberwould be entitled to receive Ringgit Malaysia Seven and TwentySen (RM7.20) Cash Back (ie. 12 x 1% x 60 = RM7.20) in that month.
8. Subject to Clause 13 below, the above mentioned Qualifying RetailTransactions must be accumulated and posted on one Citibank creditcard account only. Purchases made on Citibank’s Easy Payment Plan,Flexi Payment Plan or Autobilling/Recurring Transactions Plan,refunded, disputed, unauthorised or fraudulent retail transactions, cashwithdrawals, balance transfers, payment of annual card membershipfees, interest payments, late payment fees, charges for cashwithdrawals and any other form of service/miscellaneous fees shall
not be taken into account in the calculation of ‘Qualifying RetailTransactions’ for the purpose of this Campaign. Citibank shall also fromtime to time at its sole discretion without assigning any reasons thereofor notification to cardmembers include other categories of transactionsthat would not be entitled to earn Rewards Points and/or Cash Back.
9. Only up to a maximum of 1,000,000,000 Rewards Points will be givenaway in conjunction with the Campaign during the Campaign Period ona first come, first served basis based on the Eligible Cardmember’sregistration date.
10. An Eligible Cardmember’s Citibank credit card account(s) must be ingood standing during the Campaign Period in order to be entitled toearn Rewards Points and/or Cash Back. An Eligible Cardmember whocloses his account(s) before 31 July 2007 will not be entitled to RewardsPoints and/or Cash Back earned on such account(s), if at all, during theCampaign Period.
11. The number of Qualifying Retail Transactions accumulated and the totalamount of Rewards Points and/or Cash Back awarded to EligibleCardmembers will be calculated on a monthly basis on 31 March 2007,30 April 2007 and 31 May 2007 respectively during the CampaignPeriod. The total Rewards Points and/or Cash Back earned each monthwill be credited into the Eligible Cardmember’s account six (6) to eight(8) weeks after the end of each month (31 March 2007, 30 April 2007or 31 May 2007 as applicable) during the Campaign period.
12. Transactions made by a supplementary Citibank Cardmember will beaggregated with that of the Principal Citibank Cardmember for thepurpose of calculating Qualifying Retail Transactions. However only theprincipal Citibank Cardmember (and not the supplementary CitibankCardmember) will be entitled to the Rewards Points and/or Cash Back.
13. Holders of Platinum, Gold, Silver, Clear, Citibusiness, Choice and CelcomCitibank Credit Cards who upgrade or downgrade their respective creditcards in a particular calendar month during the Campaign Period willhave their Rewards Points for that month calculated based on thecombined number of Qualifying Retail Transactions effected under boththeir old Citibank credit card and their new Citibank credit card.
14. Rewards Points and/or Cash Back must be redeemed and used only bythe Principal Citibank Credit Cardmembers themselves. Redemption ofRewards Points and/or Cash Back is subject to the sole discretion ofCitibank. Furthermore, Citibank reserves the right to cancel RewardsPoints and/or Cash Back earned on credit card accounts wherepayment has been due for thirty (30) days or more, accounts believedby Citibank to be operated fraudulently or any accounts otherwiseclosed by Citibank.
15. Rewards Points earned are not exchangeable for cash, credit or kindand have no monetary value. Eligible Cardmembers are not allowed totransfer or sell their Rewards Points to any other person.
16. In the event that Rewards Points and/or Cash Back are awarded to andreceived by persons who:(a) are not Eligible Cardmembers in the Campaign; and/or,(b) have committed or are suspected of committing any fraudulent or
wrongful acts in relation to use of their Citibank credit card(s)and/or any transactions made thereof;
Citibank reserves the right to disqualify such persons from participatingin the Campaign and/or from redeeming or using the Rewards Pointsand/or Cash Back.
Miscellaneous
17. Citibank shall not be liable for any default in respect of the Campaign dueto any act of God, war, riot, strike, lockout, industrial action, fire, flood,drought, storm or any event beyond the reasonable control of Citibank.
18. Citibank’s decisions on all matters relating to the Campaign, includingthe determination of Eligible Cardmembers will be final and binding andno further correspondence or attempts to dispute such decisions will beentertained.
19. Citibank reserves the right to cancel, terminate or suspend the Campaignwithout any prior notice. For the avoidance of doubt, cancellation, terminationor suspension by Citibank of the Campaign shall not entitle the Participantto any claim or compensation against Citibank for any and all loss ordamages suffered or incurred by the Participant whether as a direct orindirect result of the act of cancellation, termination or suspension.
20. Citibank reserves the right at its absolute discretion to vary, delete oradd to any of these Terms and Conditions from time to time withoutprior notice
21. In the event where there is any inconsistency(ies), conflict(s),ambiguity(ies) or discrepancy(ies) between the English and BahasaMalaysia versions of these Terms and Conditions, the English version ofthese Terms and Conditions will prevail only in respect of suchinconsistency(ies), conflict(s), ambiguity(ies) or discrepancy(ies).
22. To the fullest extent permitted by law, in no event will Citibank or any ofits officers, servants, employees, representatives and/or agents(including without limitation, any third party service providers thatCitibank may engage for purposes of the Campaign) be liable for anyloss or damages (including without limitation, loss of income, profits orgoodwill or indirect, incidental, consequential, exemplary, punitive orspecial damages of any party including third parties) howsoever arisingwhether in contract, tort, negligence or otherwise in connection withthe Campaign, even if Citibank has been advised of the possibility ofsuch damages in advance, and all such damages are expressly excluded.
23. By participating in the Campaign, Participants agree to be bound bythese Terms and Conditions and any decisions of Citibank, and theParticipants hereby give their consent to and authorise Citibank todisclose their particulars to third party service providers engaged byCitibank for the purposes of this Campaign, if any. Citibank warrantsthat the disclosure of such particulars to any third party serviceproviders, if any, shall be limited to the Participant’s name, address andtelephone number and shall be used only in relation to and for thepurposes of this Campaign.
