አዋጅ ቁጥር-------/2011 ዓ.ም

የደቡብ ብሄሮች ብሄረሰቦችና ህዝቦች

ክልልመንግስት ጠቅላይ ዓቃቤን ሕግ ለማቋቋም የወጣ ረቂቅ አዋጅ

ሕገ መንግስቱን እና ሕገ መንግስታዊ ሥርዓቱን

እንዲሁም የሕግ የበላይነትን የሚያስከብር፤ ወጥነት

ያለው ውጤታማና ቀልጣፋ አገልግሎት የሚሰጥ፤

የሕዝብንና የመንግስትን ጥቅም በተሟላ ሁኔታ

የሚያስጠብቅ አንድ ጠንካራ ሕግ አስከባሪ የዓቃቤ

ሕግ ተቋም ማቋቋም አስፈላጊ ሆኖ በመገኘቱ፤

የሕዝብ ተአማኒነት ያለው፣ በተሟላ ተቋማዊና

ሙያዊ ነፃነት የሚያገለግል እንዲሁም ለሙያዊ፣

ተቋማዊና ሕዝባዊ ተጠያቂነት የሚገዛ፣ በግልጽነትና

በአሳታፊነት የሚሰራ የዓቃቤ ሕግ ተቋም ማቋቋም

በማስፈለጉ፤

በተለያዩ ተቋማት ተበታትኖ የሚሰራው የዓቃቢያነ ህግ

ስራ በአንድ ተቋም ስር ተደራጅቶ መሰራት እንዳለበት

A DRAFT PROCLAMATION TO PROVIDE FOR

THE ESTABLISHMENT OF THE ATTORNEY

GENERAL OF THE THE SOUTH NATIONS,

NATIONALITIESAND PEOPLES’ REGION STATE

WHEREAS, it has been found necessary to

establish one strong law enforcement public

prosecution institution which can comprehensively

protect public and government interest and deliver

uniform, effective and efficient service as well as

enforcing the constitution and constitutional

systems and the supremacy of law;

WHEREAS, it has been found necessary to re-

organize institution which enforces rule of law and

ensures that laws are properly organized and

government works are conducted in accordance

with the law;

WHEREAS, it has been believed that the public

prosecution activity to be performed at various

organizations shall be performed by organizing

under sole institution;

በመታመኑ;

በ1994 ዓ ም በተሻሻለው የደቡብ ብሔሮች፣

ብሔረሰቦችና ሕዝቦች ክልል ሕገ-መንግስት አንቀፅ

51 ንዑስ አንቀፅ 3 (ሀ) መሰረት የሚከተለው

ታውጇል፡፡

ክፍል አንድ

ጠቅላላ

1. አጭር ርዕስ

ይህ አዋጅ “የደቡብ ብሄሮች ብሄረሰቦችና ህዝቦች ክልል መንግስት ጠቅላይ ዓቃቤ ሕግ መስሪያ ቤት ማቋቋሚያ አዋጅ ቁጥር --------/2011” ተብሎ ሊጠቀስ ይችላል፡፡

2. ትርጓሜ

በዚህ አዋጅ ውስጥ የቃሉ አገባብ የተለየ ትርጉም

የሚያሰጥ ካልሆነ በስተቀር፤

1. “ክልል” ማለት “የደቡብ ብሄሮች ብሄረሰቦችና

ህዝቦች ክልል ነው፤

2. “ምክር ቤት” ማለት በደቡብ

ብሔሮች፣ብሔረሰቦችና ሕዝቦች ክልል

መንግሥት በየእርከኑ የሚገኙ የህግ አዉጭ

አካል ነው፡፡

3. “መስተዳድር ምክር ቤት” ማለት በተሻሻለው

የደቡብ ብሔሮች፣ ብሔረሰቦችና ሕዝቦች ክልል

ሕገ-መንግሥት አንቀጽ 65 መሠረት

የተገለጸው ሆኖ የክልሉ ከፍተኛ የአስፈፃሚ

አካል ወይም ካቢኔ ነው፡፡

4. “አስተዳደር ምክር ቤት” ማለት በደቡብ

ብሔሮች፣ ብሔረሰቦችና ሕዝቦች ክልል

መንግሥት በየእርከኑ የሚገኙ አስፈፃሚ

መስሪያ ቤት ሀላፊዎች በአባልነት የሚገኙበት

NOW, THEREFORE, in accordance with the sub

article 3 (a) of Article 55 (1) of the 2002 revised

Constitution of the Southern Nations,Nationalities

and Peoples’ Region State, it is hereby Proclaimed

as follow;

PART ONE

GENERAL

1. Short Title

This Proclamation may be cited as the “South

Nations, Nationalities and Peoples’ Region

State Attorney General Establishment

Proclamation No. ---- ------- /2018”.

2. Definition

In this Proclamation unless the context

otherwise requires:

1. “region” means the Southern Nations,

Nationalities and Peoples’ Region;

2. “council” means a legislative organ in

each administration of the South Nations,

Nationalities and Peoples’ Region;

3. “executive council” means a Supreme

Executive Organ or cabinet us defined

under urticle 65 of the revised

Constitution of the South Nations,

Nationalities and Peoples’Region;

4. “administration council” means an

executive organ, which heads of each

level executive organization are

members, in the Southern Nations,

አስፈፃሚ አካል ነዉ፡፡

5. “የክልል መንግስት መስሪያ ቤቶች” ማለት

ሕጋዊ ሰውነት ያላቸው ሙሉ በሙሉ ወይም

በከፊል በክልሉ መንግስት በጀት የሚተዳደሩ

አካላት ሆነው የክልሉ መንግስት የልማት

ድርጅቶችንም ይጨምራል፡፡

6. ““ሕግ” ማለት በፌደራል መንግስቱ ህግ

አውጪ ወጥተው በክልሉ ውስጥ ተፈጻሚነት

ያላቸው የሕግ ማእቀፎችን፣ በክልሉ ሕግ

አውጪ አካላት የወጡ አዋጆችን፣ ደንቦችን

እና ስልጣን በተሰጣቸው የክልሉ መንግስት

አካላት የወጡ መመሪያዎችን ያጠቃልላል፡፡

7. “ሕገ-መንግስት” ማለት የኢትዮጵያ ፌዴራላዊ

ዴሞክራሲያዊ ሪፑብሊክ እና የተሻሻለው

የደቡብ ብሄሮች ብሄረሰቦችና ህዝቦች ክልል

ሕገ-መንግስትን ያጠቃልላል፡፡

8. “የወንጀል ሕግ” ማለት በኢትዮጵያ ፌዴራላዊ

ዴሞክራሲያዊ ሪፑብሊክ ህዝብ ተወካዮች

ምክር ቤት የተደነገገ የወንጀል ሕግ ነው፡፡

9. “ጠቅላይ ዓቃቤ ሕግ” ማለት “የደቡብ ብሄሮች

ብሄረሰቦችና ህዝቦች ክልል መንግስት ጠቅላይ

ዓቃቤ ሕግ መስሪያ ቤት ነው፤

10. “ዋና ጠቅላይ ዓቃቤ ሕግ” ማለት “በደቡብ

ብሄሮች ብሄረሰቦችና ህዝቦች ክልል መንግስት

በርዕሰ መስተዳድር አቅራቢነት በክልል ምክር

ቤት የተሾመ የክልል ጠቅላይ ዓቃቤ ሕግ

መስሪያ ቤት የበላይ ኃላፊ ነው፤

11. “ምክትል ጠቅላይ ዓቃቤ ሕግ” ማለት

Nationalities and Peoples’ Region;

5. “offices of the regional state” means

organs with legal personality relay

wholly or partly on the Regional State

budget to be administered, encluding the

developmental organizations of the

Regional State;

6. “law” means legal packages that are

applicable in the Region, issued by the

Federal Government’s legislative organ;

Proclamations and Regulations issued by

the Regional Legislative organ and

encludes Directives issued by the

empowered Regional State’ organs;

7. “constitution” means the Constitution of

the Federal Democratic Republic of

Ethiopia and encludes the revised

Constitution of the Southern Nations,

Nationalities and Peoples’ Region;

8. “criminal law” means the criminal law

provided by the House of Peoples’

Representatives of the Federal

Democratic Republic of Ethiopia;

9. “Attorney General” means Attorney

General office of the Southern Nations,

Nationalities and Peoples’ Regional

State;

10. “chief Attorney General” means a chief

head of the Regional Attorney General

office submitted by excutive council and

appointed by the South Nations,

Nationalities and Peoples’ Regional

Council;

11. “deputy Attorney General” means a

“በደቡብ ብሄሮች ብሄረሰቦችና ህዝቦች ክልል

መንግስት ርዕሰ መስተዳድር የተሾመ የክልል

ጠቅላይ ዓቃቤ ሕግ መስሪያ ቤት ምክትል

ኃላፊ ነው፤

12. “ዓቃቤ ሕግ” ማለት በመስተዳድር ምክር ቤት

በሚወጣ ደንብ መሰረት የሚቀጠር ወይም

የሚመደብ እና የሚተዳደር የሕግ ባለሙያ

ሲሆን በዚህ አዋጅ አንቀጽ 7 መሠረት

የተሾሙ ዋና ጠቅላይ ዓቃቤ ሕጉን፣ ምክትል

ጠቅላይ ዓቃቤያነ ሕግን እና በየእርከኑ ያሉት

የዓቃቤ ህግ መስሪያ ቤት ኃላፊዎችንም

ይጨምራል፤

13. “ፖሊስ” ማለት ስልጣን ያለው የክልል ወይም

የፌደራል ፖሊስ ነው፡፡

14. “ሰው” ማለት የተፈጥሮ ሰው ወይም በሕግ

የሰውነት መብት የተሰጠው አካል ነው፤

15. የፆታ አገላለፅ፤ በዚህ አዋጅ ውስጥ በወንድ

ፆታ የተገለፀው ሴትንም ይጨምራል፡፡

ክፍል ሁለት

መቋቋም፣ተጠሪነት፣ሥልጣን እና ተግባር

3. መቋቋም

“የደቡብ ብሄሮች ብሄረሰቦችና ህዝቦች ክልል

መንግስት ጠቅላይ ዓቃቤ ሕግ መስሪያ ቤት ከዚህ

በኋላ “ጠቅላይ ዓቃቤ ሕግ” እየተባለ የሚጠራ

ራሱን የቻለ የሕግ ሰውነት ያለው የመንግስት

መስሪያ ቤት ሆኖ በዚህ አዋጅ ተቋቁሟል፡፡

4. ዋና መስሪያ ቤት

የጠቅላይ ዓቃቤ ሕግ ዋና መስሪያ ቤት በሀዋሳ

deputy head of the Regional Attorney

General office appointed by the Chief

Executive of the South Nations,

Nationalities and Peoples’ Region State;

12. “public prosecutor” means a lawyer

employed or assigned and administered

under Regulation that is issued by the

Executive Council and includes the Chief

Attorney General, the deputy Attorney

General and heads of Attorney General

office in each level which are appointed

in accordance with Article 7 of this

Proclamation;

13. “police” means federal or regional police

with legal Power;

14. “person” means a natural person or a

body with legal personality;

15. Gender expression; for the purpose of

this Proclamation, expression in the

masculine gender includes the feminine.

PART TWO

Establishment, Accountability,

Powers And Duties

3. Establishment

The South Nations, Nationalities and Peoples’

Region State Attorney General (hereafter

called the “Attorney General”) is hereby

established as an autonomous government

office, which has its own legal personality.

ከተማ ሆኖ እንደአስፈላጊነቱ በክልሉ በተለያዩ

ቦታዎች ቅርንጫፍ ጽሕፈት ቤቶች ወይም

ምድብ ጽህፈት ቤቶች ሊኖሩት ይችላል፡፡

5. ተጠሪነት

1. ጠቅላይ ዓቃቤ ሕግ ተጠሪነቱ ለርዕሰ

መስተዳድሩ እና ለመስተዳድር ምክር ቤት

ይሆናል፡፡

2. በዞን እና በሀዋሳ ከተማ አስተዳደር ያሉ የዓቃቤ

ህግ መምሪያ እና በልዩ ወረዳ ያሉ የዓቃቤ ህግ

ፅ/ቤቶች ተጠሪነታቸው ለጠቅላይ ዓቃቤ ህግ እና

በየአስተዳደር እርከኑ ለሚገኙ ዋና አስተዳዳሪ

ወይም ካንቲባ እና አስተዳደር ምክር ቤት

ይሆናል፡፡

3. በወረዳ፣በከተማ አስተዳደር እና በሀዋሳ ከተማ

ክፍለ ከተማ ያሉ የዓቃቤ ህግ ፅ/ቤቶች

ተጠሪነታቸው ለዞን፣ለልዩ ወረዳ ወይም

ለሀዋሳ ከተማ አስተዳደር ዓቃቤ ህግ መምሪያ

ሀላፊ እና በየአስተዳደር እርከኑ ለሚገኙ ዋና

አስተዳዳሪ ወይም ካንቲባ ወይም ስራ አስፈፃሚ

እና አስተዳደር ምክር ቤት ይሆናል፡፡

4. በክልሉ በየትኛውም ደረጃ ለሚገኝ ዓቃቤያነ ሕግ

የበላይ ኃላፊ ጠቅላይ ዓቃቤ-ህግ ነው፡፡

5. በዚሁ አንቀፅ ንኡስ አንቀፅ 4 የተጠቀሰው

እንደተጠበቀ ሆኖ በየትኛውም ደረጃ ያለ ዓቃቤ

ህግ ለበላይ ኃላፊያቸውና ለተመደቡበት የስራ

ዘርፍ ኃላፊዎቻቸው ተጠሪ ይሆናሉ፡፡

6. ሥልጣንና ተግባራት

ጠቅላይ ዓቃቤ ሕግ የሚከተሉት ሥልጣንና

The head office of the Regional Attorney

General shall be in Hawassa and may have

branch or allocate offices in different area of

the region, as may be necessary.

5. Accountability

1. The Regional Attorney General shall be

accountable to the Chief Executive and

Executive Council;

2. The departments of public prosecutors in

zone and Hawassa City administration and

public prosecutor offices in especial woreda

shall be accountable to the Regional

Attorney General and to the chief

administrater or Mayor found at each

administration level;

3. The public prosecutor offices in woreda and

sub city of Hawasssa city shall be

accountable to the public prosecutor

departments of Zone, especial woreda or

Hawassa city administration and to the chief

administrater or Mayor or Executive found

at each administration level and

administration council;

4. Chief Attorney General shall be a head of

public prosecutors found at every level in

the Region;

5. Subject to Sub Article 4 of this Article,

public prosecutor at every level shall be

accountable to their principal heads and to

the division heads they are assigned;

ተግባራት ይኖሩታል፤

1. በሕግ ጉዳዮች የክልል መንግስት ዋና አማካሪ

እና ተወካይ ሆኖ ይሰራል፤

2. በፌደራል መንግስት ተዘጋጅቶ የጸደቀውን

የወንጀል ፍትህ ፖሊሲ በክልሉ ውስጥ

ተግባራዊ እንዲሆን ያስተባብራል፣

ይከታተላል፣ ያረጋግጣል፡፡

3. የወንጀል ፍትሕ መረጃዎችን መሰብሰብ፣

ማደራጀት፣ መተንተንና ማሰራጨት

የሚያስችል ሥርዓት ይዘረጋል፣ ያስፈፅማል፡፡

4. በፌዴራልና በክልሉ ሕገ-መንግስታት እና

በሌሎች ሕጎች የተደነገጉ የግልና የቡድን

መሰረታዊ መብቶች እና ነፃነቶች

መከበራቸውን ያረጋግጣል፣

5. የወንጀል ጉዳይን በተመለከተ፤

ሀ) በክልሉ ፍርድ ቤት ስልጣን ስር በሚወድቁ

በማናቸዉም የፀረ-ሙስና እና የታክስ ህጎችን

በመጣስ በሚፈፀሙ የወንጀል ጉዳዮች

እንዲሁም ከባድና ውስብስብ በሆኑ ሌሎች

የወንጀል ድርጊቶች የወንጀል ምርመራ

ከፖሊስ ጋር አብሮ ያጣራል፣ምርመራውን

በበላይነት ይመራል፡፡

ለ) በሕዝብ ጥቅም መነሻ ወይም በወንጀል

የማያስጠይቅ ሁኔታ መኖሩ በግልፅ ሲታወቅ

የወንጀል ምርመራ እንዲቋረጥ ወይም

የተቋረጠው የወንጀል ምርመራ እንዲቀጥል

ያደርጋል፤ ማናቸውም የወንጀል

ምርመራዎች በሕግ መሰረት መከናወናቸውን

ያረጋግጣል፤ አስፈላጊውን ህጋዊ ትእዛዝ

ለሚመለከተዉ አካል ይሰጣል፤

The Regional Attorney General shall have the

following power and duties:

1. works as principal advisor and

representative of the Regional government

regarding law;

2. coordinates, follows up and ensures the

implementation of the criminal justice

policy, prepared and ratified by Federal

government, in the Region;

3. Develop the system enables to collect,

organize, analyze and distribute the

informations of criminal justice; execute the

same;

4. Ensure if basic right and liberties of the

individual and group stated in federal and

Regional Conistitutions and in other

laws,are respected;

5. regarding criminal matters:

a) Investigates tough and complex criminal

cases as well as every criminal cases

committed by violating the anti-

corruption and tax laws, with police,

which are falling under the jurisdiction

of Regional courts,direct investigation

principally.

b) Effects the discontinuation or restart of

discontinued investigation on the basis of

public interest or when it is clearly

known that there could be no criminal

liability, ensures that investigation is

conducted in accordance with the law,

gives the necessary instruction to the

ሐ) ምርመራቸው በፖሊስ በተጀመረባቸው

መካከለኛ፣ ቀላል እና በግል አቤቱታ

በሚቀርቡ የወንጀል ጉዳዮች ምርመራ

በአግባቡ ስለመከናወኑ በቅርበት ክትትል

ያደርጋል፤ በተጀመረ የወንጀል ምርመራ

አስመልክቶ ፖሊስ ለዓቃቤ ህግ ማሳወቁን

ያረጋግጣል፤

መ) በወንጀል መዝገብ ላይ የተሰጠ የዓቃቤ

ሕግና የፍርድ ቤት ውሳኔዎችን

ለሚመለከተው ፖሊስ ያሳውቃል፣ የወንጀል

ምርመራ መዝገቦችን አስመልክቶ በየደረጃው

ባሉ ዓቃቤያነ ሕግ በተሰጡ ውሳኔዎች ላይ

በፖሊስ የሚቀርቡ አቤቱታ ተቀብሎ ውሳኔ

ይሰጣል፤

ሠ) የተጠናቀቁ የምርመራ መዝገቦችን ከሕግና

ከማስረጃ አንፃር መርምሮ በሥነ-ሥርዓት

ሕግ መሰረት የተቀመጡ መመዘኛዎች

ሲሟሉ የ’አያስከስስም’ ወይም የ’ተዘግቷል’

ውሳኔ ይሰጣል፤

ረ) የጥፋተኝነት ድርድር ይወስናል፣ ድርድር

ያደርጋል፣ አማራጭ የመፍትሄ እርምጃ

እንዲወሰድ ይወስናል፣ ተግባራዊነቱን

ይከታተላል፤

ሰ) መንግስትን በመወከል የወንጀል ጉዳዩች ክስ

ይመሰረታል፣ ይከራከራል፣ ለህዝብ ጥቅም

አስፈላጊ ሆኖ ሲያገኘው ክስ ያነሳል፣

የተነሳ ክስ እንዲቀጥል ያደርጋል፡፡

ሸ) የወንጀል ድርጊት ጠቋሚዎችና ምስክሮች

በህግ መሰረት ጥበቃና ከለላ እንዲያገኙ

concern body;

c) effects immediate follow up if a

criminal investigation of medium, simple

and perivatly presented petition issues

which has been started by the police are

conducted appropriately; ensures if the

police notify regarding criminal

investigation to the public prosecutor.

d) informs the relevant police about

decisions given on criminal case files by

the public prosecutor and court; receives

and gives decision on appeals presented

by the police against decisions given at

different level of the public prosecution;

e) provides appropriate legal decision on

completed investigation files based on

evidence and law in accordance with

procedure law;

f) determines guilty plea, conducts plea

bargaining, decides alternative actions to

be taken, follows the implementation;

g) institutes criminal case charges by

representing the federal government,

litigates, withdraws charge when found

necessary in the interest of the public,

resumes withdrew charge.

ያደርጋል፡፡

ቀ) በማረፊያ ቤትና በማረሚያ ቤት ቁጥጥር

ሥር ያሉ ተጠሪጣሪዎችንና ታራሚዎችን

ይጎበኛል፣ አያያዛቸው እና ቆይታቸው በሕግ

መሰረት መፈጸሙን ያረጋግጣል፣ ሕገ ወጥ

ተግባር ተፈፅሞ እንደሆነ እንዲታረም

ያደርጋል፡፡ሕግን ተላልፈዋል በተባሉ ሰዎች

ላይ በሕግ መሰረት እርምጃ ይወስዳል ወይም

እንዲወሰድ ያደርጋል፤

በ) በዕርቅ ሊያልቁ የሚችሉ የወንጀል ድርጊቶች

በእርቅ የሚጠናቀቁበትን ሁኔታ ያመቻቻል፣

ተ) ፍርድ ቤቶች በወንጀል ጉዳይ የሚሰጡዋቸው

ውሳኔዎችና ትእዛዞች መፈፀማቸውንና

መከበራቸውን ይከታተላል፣ ሳይፈፀሙ ከቀሩ

ወይም አፈፃፀማማቸው ሕግን ያልተከተለ

ከሆነ በጉዳዩ ላይ ውሳኔ ለሰጠው ፍርድ ቤት

በማመልከት የእርምት እርምጃ እንዲወሰድ

ያደርጋል፤

ቸ) በፍርድ ቤት የሚወሰኑ የወንጀል ቅጣቶች

በአግባቡ እንዲፈፀሙ ለማድረግ የሚያስችሉ

ሥርዓቶችን ያደራጃል ወይም መደራጀታቸውን

ያረጋግጣል፤

ኀ) የሞት ቅጣት ውሳኔዎችን ለኢትዮጵያ

ፌዴራላዊ ዴሞክራሲያዊ ሪፐብሊክ

ፕሬዚዳንት በፌዴራል ጠቅላይ ዓቃቤ ህግ

በኩል እንዲቀርብ ያደርጋል፤ አፈፃፀሙን

ይከታተላል፡፡

6. የፍትሐ ብሔር ጉዳዮችን በተመለከተ፤

h) Enacts the criminal act informant and

evidences to have protection and secure

under law;

i) pays visit to suspected and inmates under

custody at police stations and prisons,

ensure their handling and reside is

carried out in accordance with the law,

cause unlawful act to be corrected; take

measures or cause measures to be taken

based on the law against people who are

found to have transgressed the law;

j) facilitates the condition in which

criminal acts that are completed with

settlement to be considered with

settlement;

k) follows the implementation and

enforcement of judgments and orders

given by courts under criminal case,

applies to the court that gave judgments

and orders and makes corrective action

to be taken where they have not been

implemented or their implementation is

contrary to law;

l) organizes or ensures the establishment of

systems for the proper execution of

criminal punishments imposed by the

court of law;

m) causes death penalty decisions to be

submitted to the President of the

Federal Democratic Republic of

Ethiopia through Federal Attorney

General; follow up the execution.

ሀ) በክልል የመንግስት መሥሪያ ቤቶች የሕዝብ

እና የክልል መንግስት መብትና ጥቅም ወኪል

ሆኖ ይከራከራል፣ ያስከብራል፣ እንዲከበሩ

ያደርጋል፣ የሚከበሩበትን ሂደት ይከታተላል፣

ይቆጣጠራል፤

ለ) ትላልቅ የመንግስት ፕሮጀክቶችን የውል

ዝግጅት እና ድርድር ከሚመለከታቸው አካላት

ጋር በመሆን ያደርጋል፣ የሕዝብና የክልል

መንግስት መስሪያ ቤቶች ጥቅም ይጎዳል ብሎ

ሲያምን በሌሎች ጉዳዮች ውል እና የመግባቢያ

ሰነዶች ዝግጅትና ድርድር ያደርጋል ወይም

የሚመለከታቸውን አካላት ያማክራል፤

ሐ) የክልል መንግስት መስሪያ ቤቶችን በመወከል

የፍትሐብሔር ክስ ይመሰርታል፤ በከሰሱበት

ወይም በተከሰሱበት የፍትሐብሔር ጉዳዮች

ላይ ክርክር ያደርጋል፤ በተጀመረ ክርክር

ተቋማትን ተክቶ በተናጠል ወይም በጋራ

ይከራከራል፣ ወይም በክርክር አመራር ላይ

ለመሥሪያ ቤቶች አቅጣጫ ይሰጣል፣ በሕግ

መሠረት ለተሰጡ ዉሳኔዎች ፍርድን

ያስፈፅማል፤

መ) በክልሉ መንግስት መስሪያ ቤቶች እና በግል

ድርጅቶች ወይም ግለሰቦች መካከል የሚከሰቱ

የፍትሐብሔር ክርክሮች በድርድር እንዲያልቁ

ጥረት ያደርጋል፤ድርድሩ ካልተሳካ ጉዳዩን

ስልጣኑ ለሚፈቅድለት ፍርድ ቤት አቅርቦ

ይከራከራል፣

ሠ) የክልል መንግስት መስሪያ ቤቶች እርስ

በርሳቸው ያልተግባቡባቸው የፍትሐብሔር

6. regarding civil matters:

a) litigates, enforces, causes enforcement,

follows and controls the process of

enforcement within the regional

government offices by acting as an agent

of rights and interest of the public and

regional government;

b) advises and participates with concerned

bodies in contract preparation and

negotiation of large government projects;

participates or advises concerned bodies

in other contract and consensuse

document preparation and negotiation

when it believes that public and

government interest could be affected;

c) institute civil suits on behalf of the federal

government office; represent them in civil

litigation where they sue or sued,

represent them in an ongoing civil

litigation by its own or together with

them; gives direction to government

offices on the management of the

litigation; cause execution of judgment on

decision imposed in accordance with law;

d) cause effort on the civil despute arising

among the regional government offices

and non-governmental organizations or

individuals to be completed in

negotiation; litigates presenting the issue

ጉዳዩች በፍርድ ቤት ወይም ከፍርድ ቤት

ውጭ ባለ አማራጭ የክርክር መፍቻ መንገድ

እንዲወሰን ውሳኔ ሀሳብ ይሰጣል፤ በውሳኔው

መሰረት መፈፀሙን ያረጋግጣል፤

ረ) የተመዘበረ የመንግስት ገንዘብ ስልጣን ባለዉ

ፍርድ ቤት ክስ በማቅረብ ያስመልሳል፡፡

የሙስና ወንጀል ዉጤት የሆኑት እና በፍርድ

ሂደት ላይ ያሉ ንብረቶችን ያስተዳድራል፤

እንዲወረስ ዉሳኔ የተሰጠባቸዉን ንብረቶች

ለሚመለከተዉ የመንግስት አካል

ያስተላልፋል፡፡

ሰ) የፍትሐብሔር ክስ ለመመሥረት የገንዘብ አቅም

የሌላቸውን ዜጎች በተለይም ሴቶችን፣

ሕፃናትን፣ አካል ጉዳተኞችን እና አረጋውያንን

ወክሎ ይከራከራል፤

ሸ) የገንዘብ አቅም የሌላቸው የወንጀል ተጎጂ የሆኑ

ተበዳዩች እንዲካሱ መልሰው እንዲቋቋሙ

እንዲሁም ከጉዳቱ የተያያዙ የፍትሐብሔር

ጥቅማቸውን ለማስጠበቅ እነሱን በመወከል

የፍትሐብሔር ክስ ያቀርባል ወይም

ይደራደራል፤

7. የሕግ ጥናት፣ ማርቀቅ እና ማስረፅ ሥራን

በተመለከተ፤

ሀ). በክልል መንግሥት የሚወጡ ሕጎች የሕግ

ረቂቅ ዝግጅት ስራ ይሰራል፤ የመንግስት

አካላት የሚያዘጋጁት ረቂቅ ህግ ከፌዴራልና

ከክልሉ ሕገ መንግስትና ከሌሎች ሕጎች ጋር

የተጣጣመ መሆኑን ያረጋግጣል፣

e) give decision for settlement of disputes

arising between regional government

offices through judicial means or out of

court alternative dispute settlement

mechanisms, and ensures the execution

of the decision;

f) administers properties that are on the

process of the court verdict and result

from corruption; pass the properties

concerned government body; causes the

corrupted government money to be

returned by presenting charge to the court

havig power;

g) conducts litigation by representing

citizens who do not have financial

capacity to institute civil action; specially

women, children, disabled and the elderly;

h) represent victims of crime who do not

have financial means in litigations or

negotiations for their compensation,

reinstitution and protection of their civil

interests emanated from the damage

sustained;

7. regarding legal study, drafting and

decimination activity;

a) perform preparation of draft laws to be

promulgated by the regional

ለሚመለከታቸው ክፍሎችም አስተያየት

ያቀርባል፤

ለ) በክልሉ በስራ ላይ ባሉ ህጎች ጥናት በማድረግ

ሕጎች እንዲሻሻሉ የውሳኔ ሀሳብ ያቀርባል፣

ሲደገፍም ለተባሉት ማሻሻያዎች ረቂቆችን

በማዘጋጀት ለሚመለከታቸው አካላት

ያቀርባል፣

ሐ) ሕጐችን የማሰባሰብ፣የማጠቃለልና የኮዲፊኬሽን

ሥራ ይሰራል፤ የክልሉን ህጎች በባለአደራነት

ይይዛል፣ ያሰራጫል፤

መ) ዓቃቤያነ ሕግ ስለ ስራቸው ያላቸውን

አመለካከት፣ እውቀትና ክህሎት በተከታታይ

እና በየደረጃው ለማሳደግ ትምህርት እና

ሥልጠና ይሰጣል፤እንዲሰጣቸው ያደርጋል፤

ሠ) የህብረተሰቡን ንቃተ ሕግ ለማዳበር ለክልሉ

ህብረተሰብ በተለያዩ ዜደዎች የንቃተ ህግ

ትምህርት ይሰጣል፤

8. የጠበቆች፣ የበጎ አድራጎት ድርጅቶች፣ ሲቪክ

ማህበራት እና የሰነድ ማረጋገጥን በተመለከተ፤

ሀ. በክልሉ ፍርድ ቤቶች ለሚከራከሩ ጠበቆች

ፈቃድ ይሰጣል፣ ያድሳል፣ ስራቸውን

ይቆጣጠራል፣ የጠበቆችን ዲሲፕሊን

ጉዳዮች አይቶ ይወስናል፤ በህግ መሰረት

ይሰርዛል፣

ለ) በክልሉ የሚንቀሳቀሱ የኢትዮጵያውያን የበጎ

አድራጎት ድርጅቶችንና ማህበራትን

ይመዘግባል፣ የሕጋዊ ሰውነት ማረጋገጫ

ምስክር ወረቀት ይሰጣል፣ ስራቸውን

consistent with the federal and regional

Constitutions and others laws; provide

legal opinion to concerned bodies;

b) conducts legal studies on the functional

laws in the region and present decision

idea to be reformed; submits to the

concerned bodies by preparing draft for

raised amendement when supported;

c) carry out codification, compilation and

consolidation of laws; hold and dispense

regional laws as atitle holder;

d) provide training or cause provision of

training and education at every level for

continuous development of the attitude,

knowledge and skill of public

prosecutors;

e) Provide legal awareness education in

different methods to the regional society

for the development of their legal

awareness.

8. regarding advocates, charity organizations,

civic societies and ;document certification;

a) supervise advocates practicing at

regional courts and services provided by

them; license, renew, revoke the license

in accordance with the law; determines

by overtaking disciplinary issues of

advocates;

b) recored the Ethiopian charity

ይሰርዛል፣

ሐ) አግባብ ባለው ሕግ መሠረት ሰነዶችን

ይመዘግባል፣ ያረጋግጣል፣ ይሽራል፣

ይሰርዛል፣

መ) ነፃ የሕግ ድጋፍ አሰጣጥ ስትራቴጂዎችን

ይቀርፃል፣ አፈፃፀሙን ይከታተላል፣ በመስኩ

የሚሰማሩ አካላትን ያስተባብራል፤

9. ብሄራዊ የሰብአዊ መብት ድርጊት መርሀግብር

መነሻ በማድረግ ክልላዊ ሰብአዊ መብት የድርጊት

መርሀ ግብርን ከሚመለከታቸው አካላት ጋር

በመሆን ያዘጋጃል፣ አፈፃፀሙን ይከታተላል፤

በክልል ደረጃ የሚመለከታቸውን አካላት

ያስተባብራል፣ ለሚመለከታቸው አካላት ሪፖርት

ያቀርባል፤

10. የዓቃቤ ሕግ የውሳኔ አሰጣጥ እና የፍቅደ ሥልጣን

አጠቃቀም ወጥነትን ለማረጋገጥ በጠቅላይ ዓቃቤ

ሕግ የፀደቀ መመሪያ ተግባራዊ መደረጉን

ያረጋግጣል፤

11. በዓቃቤያነ ሕግ የሚሰጡ ውሳኔዎች በሕግ

መሰረት መከናወናቸውን የሚያረጋግጥ

የኢንስፔክሽን ክፍል ያደራጃል፣ ጉድለቶችን በጥናት

አስደግፎ ይለያል፤ በግኝቱ መሠረትም እንዲታረሙ

ያደርጋል፣ አስፈላጊ ሲሆን እርምጃ ይወስዳል

ወይም እንዲወሰድ ያደርጋል፣ መልካም

ተሞክሮዎችን ይቀምራል፤ ያስፋፋል፤

12. የክልሉን ማረሚያ ቤቶች አስተዳደር ኮሚሽን

ሥራዎች በበላይነት ይመራል፣ ይከታተላል፣

organizations and companies working in

the Region; issue legal personality

assurance certificate; supervise their

work; ensure; revoke by law;

c) record, ensure, repeal, and revoke

document under pertinent law;

d) design strategy for provision of free legal

aid, follow up implementation of same,

coordinate bodies engaged in the sector;

9. prepare regional human right action plan

together with the concerned bodies based

on national human rights action plan,

follow up implementation of same,

coordinate the concerned bodies at national

level; submit report to the relevant bodies;

10. ensure that the directive issued by the

Attorney General with the view to ensure

consistent application of discretion and

provision of decision of the public

persecutors is enforced;

11. organize inspection department and

investigate that decisions passed by public

prosecutors are in accordance with the law,

identify defects based on studies and take

corrective measures on the bases of findings

to rectify the problems; when necessary, take

measure or cause measures to be taken;

compute, scale up good practices;

ያስተባብራል፤የህግ ታራሚዎች ይቅርታ

የሚያገኙበትን ስርዓት ይዘረጋል፡፡

13. የደቡብ ብሄሮች ብሄረሰቦችና ህዝቦች ክልል

መንግስት የአስፈጻሚ አካላትን ሥልጣንና ተግባር

በሚወስነው አዋጅ የመስተዳድር ምክር ቤት አባል

ለሆኑ አስፈፃሚ አካል መስሪያ ቤቶች የተሠጡ

የወል ሥልጣንና ተግባርን ሥራ ላይ ያውላል፤

14. የንብረት ባለቤትና የይዞታ ባለመብት ይሆናል፣

ውል ይዋዋላል፣ በራሱ ስም ይከሳል፣ ይከሰሳል፤

15. በሕግ የተሰጡትን ሥልጣንና ተግባራት ወይም

ዓላማውን ለማስፈፀም የሚረዱ ሌሎች ተግባራትን

ያከናውናል፡፡

7. ሹመት

1. ዋና ጠቅላይ ዓቃቤ ህጉ በርዕሰ መስተዳድሩ

አቅራቢነት በክልል ምክር ቤት ይሾማል፡፡

2. ምክትል ጠቅላይ ዓቃቤ ህግ በክልሉ ርዕሰ

መስተዳድር ይሾማል፡፡

3. በዞን፣በልዩ ወረዳ እና በሀዋሳ ከተማ

አስተዳደር ያሉ የዓቃቤ ህግ መምሪያ ኃላፊዎች

በየአስተደደር እርከኑ ዋና አስተዳዳሪ/ካንቲባ

አቅራቢነት በየእርከኑ ባሉ ምክር ቤቶች

ይሾማሉ፡፡

4. በወረዳ፣ በከተማ አስተዳደር እና በክፍለ ከተማ

በየእርከኑ ያሉ ጽ/ቤት ኃላፊዎች በየአስተደደር

እርከኑ ዋና አስተዳዳሪ/ካንቲባ/ ወይም ስራ

አስፈፃሚ አቅራቢነት በየእርከኑ ባሉ ምክር

ቤቶች ይሾማሉ፡፡

12. lead, follow up, coordinate principally the

activities of Regional prisonss administration

commission, develop the system in which

legal inmates acquire pardon;

13. exercise the common powers and duties

provided for, the offices of executive organ

and member of the Executive Council, under

the Definition of Powers and Duties of the

Executive Organs of the Southern Nations,

Nationalities and Peoples’ Regional State

Proclamation;

14. own and possess property, enter into

contracts, sue or be sued in its own name;

15. perform other activities that help to achieve its

objectives or carry out its power and duties

given by law.

7. Position

1. A chief Attorney General shall be appointed

by Council of the region up on the

recommendation of the Executive Council.

2. A Deputy Attorney General shall be

appointed by the Executive Council.

3. The heads of public prosecutor offices in

Zone, especial woreda and Hawassa City

administration shall be appointed at Council

of their level by approval of their

administrative level administrater/mayor.

4. The heads of public prosecutor offices in

woreda, urban center administration and sub

city levels shall be appointed at council of

their level by approval of their administrative

5. በየትኛውም ደረጃ የሚሾም የዓቃቤ ህግ

መስሪያ ቤት ሀላፊ በህግ ትምህርት እውቅና

ካለው ተቋም የተመረቀ መሆን አለበት፡፡

8. የጠቅላይ ዓቃቤ ሕግ አቋም

ጠቅላይ ዓቃቤ ሕግ፣

1. አንድ ዋና ጠቅላይ ዓቃቤ ሕግ እና ምክትል

ጠቅላይ ዓቃቤያነ ሕግ፤

2. የሥራ ዘርፎች፤

3. የማኔጅመንት ኮሚቴ፤

4. የክልል ዓቃቤያነ ሕግ አስተዳደር ዋና ጉባኤ፤

5. በዓቃቤ ሕግ መተዳደሪያ ደንብ መሰረት

የተቀጠሩ/የተመደቡ ዓቃቢያነ ሕግ፤ እና አስፈላጊ

ሰራተኞች ይኖሩታል፡፡

9. የዋና ጠቅላይ ዓቃቤ ሕግ ሥልጣንና ተግባር

1. ዋና ጠቅላይ ዓቃቤ ሕጉ የጠቅላይ ዓቃቤ

ሕግ የበላይ ኃላፊና የካቢኔ አባል በመሆን

በሙያውና በሕግ መሠረት ጠቅላይ ዓቃቤ

ሕግን ይመራል፣ ያስተዳድራል፡፡

2. በዚህ አንቀጽ ንዑስ አንቀጽ (1) የተመለከተው እንደተጠበቀ ሆኖ ዋና ጠቅላይ ዓቃቤ ሕጉ የሚከተሉት ሥልጣንና ተግባራት ይኖሩታል፤

ሀ) በዚህ አዋጅ አንቀጽ 6 የተመለከቱትን

ሥልጣንና ተግባራት በሥራ ላይ

ያውላል፤

ለ) በክልል የሥነ-ምግባርና የፀረ-ሙስና

ኮሚሽን ማቋቋሚያ አዋጅ 142/2004፣

እንዲሁም በተሻሻለው የገቢዎች

5. The head of public prosecutor to be

appointed at every level shall be a graduate in

legal education from recognized institution.

8. Organization of the Attorney General

The Attorney General shall have:

1. a chief Attorney General and Deputy

Attorney Generals;

2. line divisions;

3. Management Committee;

4. Regional Public Prosecutors

Administration head Council;

5. Public prosecutors employed/assigned in

accordance with the public prosecutor

administrative Regulation; and necessary

staffs.

9. Powers and Duties of the ChiefAttorney

General

1. The Chief Attorney General shall be the

head of the Attorney General and a

member of cabinet; and lead and

administer the Attorney General

professionally and in accordance with the

law.

2. Without prejudice to sub-article of this

Article, the Chief Attorney General shall

have the powers and duties to:

a) exercise the powers and duties

stipulated under Article 6 of this

Proclamation;

b) exercise the prosecution powers and

duties given to the organizations in the

ባለስልጣን ማቋቋሚያ አዋጅ ቁጥር

143/2004 ለተቋማት ተሰጥተው የነበሩ

የዓቃቤ ህግነትን የተመለከቱ ሥልጣንና

ተግባራትን ሥራ ላይ ያውላል፤

ሐ) በምክትል ጠቅላይ ዓቃቤያነ ሕግ

እንዲሁም በየእርከኑ ባሉ የዓቃቤ ህግ

መስሪያ ቤት ኃላፊዎች የዓቃቤ ህግ ስራ

አስመልክቶ የተሰጡ ውሳኔዎችን

ያፀድቃል፣ያሻሽላል፣ይለውጣል፣ይሽራል

ወይም ጉዳዩ እንዲጣራ ወይም እንደገና

እንዲታይ ያደርጋል፤

መ) ዓቃቢያነ ህግን በኣቃቢያነ ህግ መተዳደሪያ

ደንብ መሰረት እንዲሁም ድጋፍ ሰጪ

ሠራተኞችን በክልሉ ሲቪል ሰርቪስ

ህጎች መሰረት ይቀጥራል፣ ያስተዳድራል፣

በህግ መሰረት ያሰናብታል፤

ሠ) የጠቅላይ ዓቃቤ ሕግን ስትራቴጂክ

ዕቅድና በጀት ያዘጋጃል፣ ሲፈቀድም በስራ

ላይ ያውላል፤

ረ) ለጠቅላይ ዓቃቤ ሕግ በተፈቀደለት በጀት

እና የሥራ ፕሮግራም መሰረት ገንዘብ

ወጪ ያደርጋል፤

ሰ) ከሶስተኛ ወገኖች ጋር በሚደርጉት

ግንኙነቶች ጠቅላይ ዓቃቤ ሕግን

ይወክላል፤

ሸ) የጠቅላይ ዓቃቤ ሕግን የሥራ አፈጻጸም

እና የሂሳብ ሪፖርት አዘጋጅቶ

ለመንግስት ያቀርባል፤

ቀ) ለሥራ ቅልጥፍናና ውጤታማነት

c) revoke, change, modify, suspend,

approve the decision given by deputy

Attorney Generals and heads of public

prosecutors office concerning public

prosecutor activity, or refer the case

for re-examination or revision by the

one that has given the decision;

d) hire, administer public prosecutors in

the by laws of public prosecutors and

the supporting staff of the Attorney

General in accordance with the

Regional civil service laws; and

dismiss in accordance with law;

e) prepare strategic plan and budget of

the Attorney General, and implements

same upon approval;

f) effect payment in accordance with the

budget approved and work program of

the Attorney General;

g) represent the Attorney General in

its dealings with third parties;

h) prepare and submit the performance

and financial report of the Attorney

General to the Government;

i) delegate part of his powers and

በሚያስፈልግ መጠን ከሥልጣንና

ተግባሩ በከፊል ለምክትል ዋና ጠቅላይ

ዓቃቤ ሕግ፣ ዓቃቤያነ ሕግና ሠራተኞች

በውክልና ሊያስተላልፍ ይችላል፡፡

በ) በሕግ የሚሰጡትን ሌሎች ተግባራት

ያከናውናል፡፡

10. የምክትል ጠቅላይ ዓቃቤ ሕግ ሥልጣንና ተግባር

ምክትል ጠቅላይ ዓቃቤ ሕግ ተጠሪነቱ ለዋና

ጠቅላይ ዓቃቤ ህግ ሆኖ፣

1. ለዋና ጠቅላይ ዓቃቤ ሕጉ የተሰጡትን

ሥልጣንና ተግባራት በማቀድ፣ በማደራጀት፣

በመምራትና በማስተባበር ዋና ጠቅላይ ዓቃቤ

ሕጉን ያግዛል፤

2. የሚመደብባቸውን ዘርፎች ይመራል፣

ያስተዳድራል፤

3. በዋና ጠቅላይ ዓቃቤ ሕጉ ተለይተው

የሚሰጡትን ተግባራት ያከናውናል፤

4. ዋና ጠቅላይ ዓቃቤ ሕጉ በማይኖርበት ጊዜ

ውክልና ያልተሰጠ እንደሆነ በሹመት

ቅድሚያ ያለው ምክትል ጠቅላይ ዓቃቤ ሕግ

የዋና ጠቅላይ ዓቃቤ ሕግነት ሥራን ተክቶ

ይሰራል፤

11. ከሹመት ስለመነሳት

1. ዋና ጠቅላይ ዓቃቤ ሕጉ እና ምክትል

ጠቅላይ ዓቃቤ ሕግ እንደዚሁም በየእርከኑ

የሚገኙ የዐቃቤ ሕግ ሀላፊዎች

ከሹመታቸዉ ሊነሱ ይችላሉ፡፡

for effective and efficient

performance of the activities of the

Attorney General;

j) perform other activities given to him

by law.

10. Power and Duties of the Deputy Attorney

Generals

Deputy attorney general shall be accountable

to a chief attorney general, and;

1/ shall assist the Chief Attorney General

in planning, organizing, leading and

coordinating powers and duties given

to a chief Attorney General;

2/ shall lead and administer the line

divisions to which he is assigned;

3/ shall perform specific duties given to

them by the Chief Attorney General;

4/ in the absence of the Chief Attorney

General, without giving delegation, the

senior Deputy Attorney General shall

represent and perform the duties of the

Chtef Attorney General;

11. Removal from position

1. The Chief Attorney General and the

Deputy Attorney General as well as the

public prosecutors at various levels may

be removed from their position.

12. የዓቃቤያነ ሕግ አስተዳደር

የዓቃቤያነ ሕግ አስተደደር በመስተዳድር ምክር

ቤት በሚወጣ የዓቃቢያነ ህግ መተዳደሪያ ደንብ

ይወሰናል፡፡

13. የዓቃቤያነ ሕግ አስተዳደር ዋና ጉባኤ

1. የዓቃቤያነ ሕግ አስተዳደር ዋና ጉባኤ በዚህ

አዋጅ ተቋቁሟል፤ የጉባኤው ሰብሳቢ ዋና

ጠቅላይ ዓቃቤ ህጉ ይሆናል፡፡ የጉባኤውን

አባላት፣ የአሠራር ሥነ-ሥርዓትና ሌሎች

ዝርዝር ጉዳዮች የመስተዳድር ምክር ቤት

በሚያወጣው የዓቃቢያነ ህግ አስተዳደር ደንብ

ይወሰናል፡፡

2. የራሱ ጽህፈት ቤት፣ለስራዉ የሚያስፈልጉ

ዓቃቢያነ ህግ እና በዋና ጠቅላይ ዓቃቤ ህጉ

የሚሰየም የጽህፈት ቤት ኃላፊ ይኖረዋል፡፡

ክፍል ሶስት

ሙያዊ ነፃነትና ተጠያቂነት

14. የዓቃቤያነ ሕግ የሙያ ነፃነት

ዓቃቤ ሕግ ሥልጣኑንና ተግባሩን ሲያከናውን

ከማንኛውም ሰው ወይም አካል ጣልቃ ገብነት ነፃ

ሆኖ በሕግ መሠረት ብቻ ይፈፅማል፡፡

15. . ተጠያቂነት

በየትኛውም ደረጃ ያለ ዓቃቤ ሕግ በሥራ

አፈፃፀማቸውና በሥነ-ምግባራቸው ለሚታየው

ጉድለት የዲስፕሊን ተጠያቂነቱ በመስተዳድር ምክር

ቤት በሚወጣው የዓቃቢያነ ህግ መተዳደሪያ ደንብ

` 12. Administration of Public Prosecutors

The administration of public prosecutors

shall be determined by by-laws of public

prosecutors which is issued by the Executive

Council.

13. public prosecutors’ administration head

council

1. The Public Prosecutors Administration head

Council is hereby established with this

Proclamation; the chair person of the council

shall be a chief Attorney General. The

members, working procedures and the details

of which shall be determined by public

prosecutors administration regulation to be

issued by the Executive Council.

2. The assembly shall have its own office,

public prosecutors necessary for work, and

head of the office who is assigned by a Chief

Attorney General.

PART THREE

Proffetional Independence And

Accountablity

14. Public Prosecutors’ Professional

Independence

The Attorney General shall discharge its

powers and duties based on law independently

free from any person or body’s interference.

15. Accountability

Public prosecutors in every level shall be

accountable, in accordance with the public

prosecutors’ working Regulation issued by

Executive Council, for defects in their work

መሰረት ይሆናል፡፡

16. አቤቱታ የማቅረብ መብት

1. ዓቃቤ ሕግ በሚሰጠው ውሳኔ ላይ ቅሬታ

ያለው ማንኛውም ሰው በየደረጃው ለሚገኙ

የዓቃቤ ሕግ ኃላፊዎች አቤቱታ የማቅረብ

መብት ይኖረዋል፤ አቤቱታ የቀረበለት ኃላፊ

ጉዳዩን በአፋጣኝ አጣርቶ ውሳኔ መስጠት

አለበት፡፡

2. አቤቱታ የቀረበለት ኃላፊ ጉዳዩን ለማጣራት

አግባብ ያላቸውን ባለሙያዎች የሚያካትት

ኮሚቴ ሊያቋቁም ይችላል፡፡

3. አቤቱታውን የመረመረው ኃላፊ የሕግና

የማስረጃ ምክንያቱን በመጥቀስ በበታች ዓቃቤ

ሕግ የተሰጠውን ውሳኔ ለማጽደቅ፣

ለማሻሻል፣ለመለወጥ፣ለመሻር፣ለማገድ ወይም

ጉዳዩን አስቀድሞ አይቶ ወደ ወሰነው ክፍል

ለመመለስ ይችላል፡፡

4. ከላይ በአንቀፅ 3 መሰረት በተሰጠዉ ዉሳኔ

ቅሬታ ያለዉ አካል ቅሬታዉን ደረጃዉን

ጠብቆ እስከ ጠቅላይ ዓቃቤ ህግ ድረስ

በየእርከኑ ላሉት የበላይ ሀላፊዎች ማቅረብ

ይችላል፡፡ሆኖም የጠቅላይ ዓቃቤ ህግ ዉሳኔ

የመጨረሻ ይሆናል፡፡

17. ጥቆማ ወይም አስተያየት የማቅረብ መብት

1. ማንኛውም ሰው በጠቅላይ ዓቃቤ ሕግ

ሥልጣንና ተግባር ውስጥ የሚወድቅ

ማንኛውም መታረምና መስተካከል አለበት

የሚለውን ጉዳይ ወይም ተፈጽሟል የሚለውን

የሥነ-ምግባርና የሕግ ጥሰት በማናቸውም

መንገድ ለጠቅላይ ዓቃቤ ሕግ እንዲሁም

16. Right to Lodge Complaint

1. Any person who has grievance against the

decision of public prosecutor has the right

to lodge complaint to the public

prosecutor’s heads at different levels. A

head received complaint shall urgently

investigate and give decision.

2. A head received complaint may form a

committee containing relevant professionals

to investigate the case.

3. A superior considering the complaint may

suspend, change, modify, revoke or approve

the decision of the subordinate public

prosecutor or return the case to the section

that saw the case previously by stating his

legal and factual reasons.

4. A body that has an appeal on decision set in

accordance with Article three may submit

its appeal to the heads of Attorney General

at each level; whereas the decision by

Attorney General shall be the end,

17. Right to Inform or Present Suggestion

1. Any person may inform or present

suggestion to the Attorney General or to

the public prosecutor’s heads at different

levels in any way on any matter which

falls under the power and duty of the

Attorney General which he believes

2. በዚህ አንቀፅ በንዑስ ቁጥር አንድ መሰረት

ጥቆማ ወይም አስተያየት የሚቀበሉ አካላት

ጥቆማ፣ አስተያየትና ቅሬታዎችን

የሚቀበሉበትን፣ የሚያጣራበትና የመፍትሄ

እርምጃ የሚወሰድበት እና ለሕብረተሰቡ

የሚገለጽበትን የአሠራር ሥርዓቶች ይዘረጋል፡፡

ክፍል አራት

ልዩ ልዩ ድንጋጌዎች

18. መብትና ግዴታን ስለማስተላለፍ

1. በደቡብ ብሄሮች ብሄረሰቦችና ህዝቦች ክልል

መንግስት አስፈፃሚ አካላት ሥልጣንና ተግባር

ለመወሰን በወጣው አዋጅ ቁጥር 161/2008

እና በሌሎች ሕጎች ለፍትሕ ቢሮ ተሰጥተው

የነበሩ ሥልጣንና ተግባራት በዚህ አዋጅ

መሠረት ለጠቅላይ ዓቃቤ ሕግ ተላልፈዋል፡፡

2. በደቡብ ብሄሮች ብሄረሰቦችና ህዝቦች ክልል

መንግስት የሥነ ምግባርና የፀረ-ሙስና

ኮሚሽን ማቋቋሚያ አዋጅ ቁጥር 142/2004

እና በሌሎች ሕጎች ለክልሉ ሥነ-ምግባርና ፀረ-

ሙስና ኮሚሽኑ ተሰጥቶ የነበረ የዓቃቤ

ሕግነት ሥልጣን ለጠቅላይ ዓቃቤ ሕግ

ተላልፏል፡፡

3. በደቡብ ብሄሮች ብሄረሰቦችና ህዝቦች ክልል

መንግስት ገቢዎች ባለሥልጣን ማቋቋሚያ አዋጅ

ቁጥር 143/2004 እና በሌሎች ሕጎች ለባለስልጣኑ

ተሰጥቶ የነበረው የዓቃቤ ሕግነት ሥልጣን ለጠቅላ

ይጠቅላይ ዓቃቤ ሕግ ተላልፏል፡፡

claim of ethical and legal violation which

has been committed.

2. In accordance with sub article 1 of this

Article, bodies that collect inform and

suggestion shall lay down working system

whereby suggestion and complaints are

received, investigated and corrective

measures are taken and notified to the

public.

PART FOUR

Miscelaneous Provisions

18. Transfer of Rights and Duties

1. The powers and duties given to the Bureau of

Justice under the Definition of Powers and

Duties of the Executive Organs of the

Southern Nations, Nationalities and

Peoples’Regional State Proclamation No.

161/2016 and other laws are hereby

transferred to Attorney General pursuant to

this Proclamation.

2. The public prosecution power given to the

Southern Nations, Nationalities and Peoples’

Regional State Ethical and Anti-corruption

Commission under its establishment

Proclamation No142/2012 and other laws are

hereby transferred to Attorney General.

3. The public prosecution power given to the

Southern Nations, Nationalities and Peoples’

Regional State Revenues Authority under its

establishment Proclamation No. 143/2012 and

other laws are hereby transferred to Attorney

General.

4. የደቡብ ብሔሮች፣ ብሔረሰቦችና ሕዝቦች ክልል

መንግሥት የአስፈፃሚ አካላትን ሥልጣንና ተግባር

እንደገና ለመወሰን በወጣው አዋጅ ቁጥር

161/2008 አንቀፅ 30 ንዑስ አንቀፅ 13 እና

በማረሚያ ቤቶች አስተዳደር ኮሚሽን ማቋቋሚያ

ደንብ ቁጥር 137/2008 አንቀፅ 6 ንፁስ አንቀጽ 1

መሰረት የክልሉን ማረሚያ ቤቶች ኮሚሽን

አስመልክቶ ለጸጥታና አስተዳደር ቢሮ የተሰጠዉ

ስልጣን በዚህ አዋጅ ተጠሪነቱ ለጠቅላይ ዓቃቤ ህግ

ተላልፉል፡፡

5. በንግድ ውድድር እና የሸማቾች ጥበቃ አዋጅ ቁጥር

813/2ዐዐ6 እንዲሁም በሌሎችሕጎች ለንግድ

ውድድርና ሸማቾች ጥበቃ ባለሥልጣን ተሰጥቶ

የነበረው የዓቃቤ ሕግነት ሥልጣን ለክልል

ጠቅላይ ዓቃቤ ሕግ ተላልፏ፡፡

6. በንግድ ውድድር እና የሸማቾች ጥበቃ አዋጅ

ቁጥር 813/2ዐዐ6 እንዲሁም በሌሎች ሕጎች

ለንግድ ውድድርና ሸማቾች ጥበቃ ባለሥልጣን

ተሰጥቶ የነበረው የወንጀል ምርመራ የማድረግ

ሥልጣን ለክልል ፖሊስ ኮሚሽን ተላልፏል፡፡

7. የደቡብ ብሄር፣ ብሄረሰቦችና ህዝቦች ክልል

የፍትህ አካላት ባለሙያዎች ስልጠና ማዕክል

ተጠሪነት በዚህ አዋጅ ለጠቅላይ ዓቃቤ-ህግ

ተላልፏል፡፡

19. የመተባበር እና የመፈጸም ግዴታ

1. የክልል ጠቅላይ ዓቃቤ ሕግና ዓቃቤያነ ሕግ በሕግ

የተሰጣቸውን ሥልጣንና ተግባር ለመወጣት

4. The power given to the security and

administration bureau, regarding the regional

prisons commission, according to Article 30,

sub Article 13 of the Proclamation

No.161/2016 which is issued to redetermine

the Powers and duties of the executive organs

of the Southern Nations, Nationalities and

Peoples’ Region State and the prisons

administration commission of the region is

accountable to the security and administration

bureau of the region in Article 6, sub Article 1

of Regulation No.137/2016 , is transferred to

Attorney General hereby this Proclamation.

5. The prosecution power given to the Trade

competition and consumers protection

Authority under the proclamation. No

813/2013 and other laws are hereby

transterred to the region state Attorney

General.

6. The crime investigation power to the Trade

competition and consumers’ protection

Authority under proclamation No.813/2013

and other laws are hereby transferred to the

region police commission.

7. The accountability of the Suthern Nations,

Nationalities and Peoples’ Reogion Justs

Organs profesionals traiming center

transferred to Attorney General hereby this

Proclamation.

19. Duty to Cooperate

1. Any person who is requested to cooperate

with the Regional Attorney General and

public prosecutors in the execution of their

ትብብር የተጠየቀ ማንኛውም ሰው ከአቅም በላይ

ያልሆነ እና ጉዳት የማያስከትልበት ከሆነ

የመተባበር ግዴታ አለበት፡፡

2. ይህ አዋጅ ከመውጣቱ በፊት በሥራ ላይ የነበሩ

የክልል ፍትህ ቢሮ እና የስር መዋቅር አመራር እና

ሠራተኞች፣የገቢዎች ባለሥልጣን አመራር እና

ሰራተኞች በዚህ አዋጅ መሠረት የሚደረገውን

ሽግግር የመተባበርና የመደገፍ ግዴታ አለባቸው፡፡

3. ማንኛውም የፖሊስ አባል የዓቃቤ ሕግን የመጨረሻ

እና ሕጋዊ ውሳኔ የማክበር እና የመፈጸም ግዴታ

አለበት፡፡

20. የወንጀል ተጠያቂነት

1. ጠቅላይ ዓቃቤ ሕግ እና ዓቃቤያነ ሕግ

ሥራቸውን በነፃነት እንዳያከናውኑ ጣልቃ

የሚገባ ወይም የሚሰጡትን ህጋዊ ውሳኔ

የማያከብርና የማያስፈጽም እንዲሁም

የመተባበር ግዴታውን የማይወጣ ማንኛውም

ሰው አግባብ ባለዉ የወንጀል ህግ ይጠየቃል፡፡

2. ማንኛውም የፖሊስ አባል የዓቃቤ ሕግን

የመጨረሻ እና ሕጋዊ ውሳኔ በመቃወም

ያልታዘዘ እንደሆነ አግባብ ባለው ሕግ

በወንጀል ይጠየቃል፡፡

21. የመሸጋገሪያ ድንጋጌዎች

1. በመስተዳድር ምክር ቤት የወጡ ደንቦች፣ በፍትሕ

ቢሮ፣ በክልሉ ገቢዎች ባለስልጣን እና በክልል

የሥነ-ምግባርና ፀረ-ሙስና ኮሚሽን የወጡ የጠቅላይ

ዓቃቤ ሕግ ሥልጣንና ተግባር ለማስፈፀም

አግባብነት ያላቸው መመሪዎች እና ማኑዋሎች

በሌሎች ደንቦች፣ መመሪያዎች ወይም ማኑዋሎች

powers and duties has a duty to cooperate if it

is not beyond his capacity and does not cause

danger.

2. Leaders and employees of the Regional

Justice Bureau and the subordinate structure,

leaders and employees of the revenue

authority who have been in charge before the

coming into force of this Proclamation have

duty to cooperate with and assist the transition

based on this Proclamation.

3. Any member of the police shall have duty to

respect and execute final and legal decision of

the public prosecutor.

20. Criminal Liability

1. Any person, who does not respect and

execute the authorized decision provided as

well as does not exercise; or interferes

against the Attorney General and public

prosecutors inorder not perform their work

independently, shall be liable by pertinent

criminal law.

2. Any member of the police who resists and

fails to execute the final and legal decision

of the public prosecutor shall be punished in

accordance with relevant law.

21. Transitory Provisions

1. The regulations issued by the Executive

Council, directives and manuals issued by the

Bureau of Justice, Regional Revenues

Authority, Regional Ethics and Anti-

corruption Commission which are relevant

for the enforcement of the powers and duties

of the public prosecution shall be applicable

እስካልተተኩ ድረስ ተፈፃሚነታቸው ይቀጥላል፡፡

2. አግባብነት ያላቸው የተሻሻለው የፌደራል የፀረ-

ሙስና ልዩ የሥነ-ሥርዓትና የማስረጃ አዋጅ

434/97 (በአዋጅ ቁጥር 882/2007

እንደተሻሻለ)፣የተሻሻለው የፌደራል ስነ ምግባርና

ፀረ ሙስና ኮሚሽን ማቋቋሚያ አዋጅ ቁጥር

433/2007 (በአዋጅ ቁጥር 883/2007

እንደተሻሻለ)፣የሙስና ወንጀሎችን ለመደንገግ የወጣ

አዋጅ ቁጥር 881/2007 በክልሉ በሚፈፀሙ

የሙስና ወንጀሎች እንደየአግባብነቱ ተፈፃሚ

ይሆናሉ፡፡

3. በክልሉ ፍትህ ቢሮ፣በገቢዎች ባለስልጣን እና

በክልል የሥነ-ምግባርና ፀረ-ሙስና ኮሚሽን

ተቀጥረው ወይም ተመድበዉ በሥራ ላይ የሚገኙና

በጠቅላይ ዓቃቤ ህግ የሚወጡ መሥፈርቶቹን

አሟልተው ወደ ክልል ጠቅላይ ዓቃቤ ሕግ መስሪያ

ቤት የሚዛወሩ ዓቃቤያነ ሕግ በዚህ አዋጅ መሠረት

በዓቃቤ ሕግነት ሥራቸውን ይቀጥላሉ፡፡፡

4. በክልሉ ፍትህ ቢሮ፣በገቢዎች ገቢዎች ባለስልጣን

እና በክልል የሥነ-ምግባርና ፀረ-ሙስና ኮሚሽን

ለዓቃቤ ሕግ የሥራ ክፍሎች በድጋፍ ሰጪነት

ሥራ ላይ የሚገኙና በክልል ጠቅላይ ዓቃቤ ሕግ

ውሳኔ ወደ ጠቅላይ ዓቃቤ ሕግ የሚዛወሩ

የመንግስት ሰራተኞች በዚህ አዋጅ መሠረት የክልል

ጠቅላይ ዓቃቤ ሕግ ሠራተኞች ሆነው ሥራቸውን

ይቀጥላሉ፡፡

5. በጠቅላይ ዓቃቤ ሕግ ሥልጣን ሥር የሚወድቁ

2. The Federal Ethics and Anti-corruption

Commission under its establishment

Proclamation No 433/2005 (as amended by

Proclamation No. 883/2015) and the Revised

Anti-corruption Special Procedure and

Evidence Proclamation No. 434/2005 (as

amended by Proclamation No. 882/2015 and

Proclamation No.881/2015 issued to

determine the Corruption crimes shall be

executed as may be necessary.

3. The Public prosecutors, who are employed or

assigned to worke for Regional Ethics and

Anti-corruption Commission, Revenues

Authority, and Justice Bureau, and

transferred to the Attorney General upon

satisfying the criteria issued by Attorney

General, shall continue their work as public

prosecutors pursuant to this Proclamation.

4. Public servants, working as supporting staff

for prosecution departments, in the Regional

Justice Bureau, Ethics and Anti-corruption

Commission, and Regional Revenues

Authority, and transferred to the Attorney

General by decision of the Regional Attorney

General, shall continue their work as

employees of the Regional Attorney General

pursuant to this Proclamation.

5. The criminal and civil cases, which are

pending under the power of the regional

Justice Bureau, Ethics and Anti-Corruption

Commission, and Revenues Authority but

የወንጀልና የፍትሐብሔር ጉዳዮች የክልሉ ጠቅላይ

ዓቃቤ ሕግ በአራት ወር ውስጥ እስኪረከባቸው

ድረስ በተጀመሩበት አኳኋን መታየት ይቀጥላሉ፣

እንዲሁም በነዚህ መስሪያ ቤቶች የሚሰሩ ዓቃብያነ-

ሕግ እና ድጋፍ ሰጪ ሰራተኞች አስተዳደር

በነበረበት ሁኔታ ይቀጥላል፡፡

6. በዲሲፕሊን ኮሚቴዎች ወይም በሌሎች የዓቃቤ

ሕግ አስተዳደር ጉባኤዎች በመታየት ላይ ያሉ

የዓቃቤ ሕግ የዲስፕሊን ክስ ጉዳዮች በዚህ አዋጅ

መሠረት ለተቋቋመው የዓቃቤያነ ሕግ አስተዳደር

ጉባኤ ተላልፈዋል፡፡

7. በክልል ፍትህ ቢሮ፣ የሥነ ምግባርና የፀረ-ሙስና

ኮሚሽን እና በክልል ገቢዎች ባለሥልጣን እጅ

የሚገኙ ጥቆማዎች፣ የምርመራ እና የዓቃቤ ሕግ

መዛግብትና ሰነዶች እንዲሁም

ኤግዚብቶች፣የተያዙና በክርክር ላይ ያሉ ንብረቶች

ወደ ጠቅላይ ዓቃቤ ሕግ ይዛወራሉ፡፡

8. በክልሉ ስነ ምገባርና ፀረ ሙስና ኮሚሽን እና

በክልሉ ገቢዎች ባለስልጣን መስሪያ ቤት የተጀመሩ

የወንጀል ምርመራዎች ለክልሉ ፖሊስ ኮሚሽን

ተላልፏል፡፡

22. በጀት

የክልል ጠቅላይ ዓቃቤ ሕግ ከመንግስት

በሚመደብለት በጀት ይተዳደራል፡፡

and Anti- corruption Commission, and

Regional Revenues Authority, and files and

documents of public prosecutors, as well as

showings, seized properties and properties on

dispute shall be transferred to Attorney

General.

8. Criminal investigations that are strated in the

Region Anti corruption Commision and

Revenue Authority are transmitted to the

Region Police Commission

22. Budget

The Regional Attorney General shall be

administered by budget allocated by the

Government.

23. የሂሳብ መዛግብት

1. ጠቅላይ ዓቃቤ ሕግ የተሟላና ትክክለኛ የሂሳብ

መዛግብት ይይዛል፡፡

2. የጠቅላይ ዓቃቤ ሕግ የሂሳብ መዛግብትና ገንዘብ ነክ

ሰነዶች በክልል ዋና ኦዲተር ወይም በዋና ኦዲተር

በሚሰየም ኦዲተር በየዓመቱ ይመረመራሉ፡፡

24. ደንብና መመሪያ የማውጣት ስልጣን

1. የመስተዳድር ምክር ቤት ይህን አዋጅ ለማስፈጸም

የሚያስፈልጉ ደንቦችን ሊያወጣ ይችላል፡፡

2. ጠቅላይ ዓቃቤ ሕግ ይህን አዋጅ እና በዚህ

አንቀጽ ንዑስ አንቀጽ (1) መሠረት የወጡ

ደንቦችን ለማስፈፀም የሚያስፈልጉ መመሪያዎችን

ሊያወጣ ይችላል፡፡

3. በህግ መሰረት ለህዝብ ይፋ እንዳይደረጉ

ከተከለከሉ ሚስጥራዊ ሰነዶች በስተቀር

የሚያወጣቸውን መመሪያዎች በማናቸውም

መንገድ እንዲታተሙ እና እንዲሰራጩ

ይደረጋል፡፡

25. ተፈፃሚነት የማይኖራቸው ሕጎች

ከዚህ አዋጅ ጋር የሚቃረኑ ማናቸውም ሕጎች

በዚህ አዋጅ ውስጥ በተሸፈኑ ጉዳዩች ላይ

ተፈፃሚት አይኖራቸውም፡፡

26. አዋጁ የሚፀናበት ጊዜ

ይህ አዋጅ በክልል ምክር ቤት ከፀደቀበት ቀን

ጀምሮ የፀና ይሆናል፡፡

23. Books of Accounts

1. The Attorney General shall keep complete

and accurate books of account.

2. The books of accounts and financial

documents of the Attorney General shall be

audited annually by the Regional Auditor

General or by an auditor designated by him.

24. Power to Issue Regulation and Directive

1. The Executive Council may issue

regulations necessary to enforce this

Proclamation.

2. The Attorney General may issue directives

necessary for the enforcement of this

Proclamation and regulations issued

pursuant to sub-article (1) of this Article.

3. Except the secret documents banned to

public by law, directives issued shall be

published and disseminated by any means.

25. Inapplicable Laws

No laws, in so far that they are inconsistent

with this Proclamation, shall be applicable

with respect to matters covered under this

Proclamation.

26. Effective Date

This Proclamation shall enter into force on the

date of its approval by regional council.
