SOLASContainerWeightVerifica8onRequirements

•  Effec&vefromJuly1,2016,theSafetyofLifeatSeaConven&on(SOLAS)requirestheshippernamedonoceancarrier’sbillofladinghastoprovideaverifiedgrossmass(VGM)forpackedcontainer.Thedeclara&onoftheverifiedgrossmassshouldbesignedanddatedbyapersondulyauthorizedbytheshipperandsubmittothecarrierviaeitherelectronicinterchangechannelsoraphysicalshippingdocument.Withoutaverifiedgrossmass,thepackedcontainershallnotbeloadedaboardship.

•  Therulesprescribetwomethodsbywhichtheshippermayobtaintheverifiedgrossmassofapackedcontainer:

•  Method1,upontheconclusionofpackingandsealingacontainer,theshippermayweigh,orhavearrangedthatathirdpartyweigh,thepackedcontainer.

•  Method2,theshipper(or,byarrangementoftheshipper,athirdparty)mayweighallpackagesandcargoitems,includingthemassofpallets,dunnageandotherpackingandsecuringmaterialtobepackedinthecontainer,andaddthetaremassofthecontainertothesumofthesinglemassesofthecontainer’scontents.(Es&ma&ngtheweightofacontainer’scontentsisnotpermiRed.)

•  Inrespectofbothmethod1and2,theweighingequipmentusedmustmeettheapplicableaccuracystandardsandrequirementsoftheStateinwhichtheequipmentisbeingused.

•  Group1:TerminalswillrejectcontaineratgateifnoVGMreceivedfromoceancarriersforsaidshipment–  MaherTerminalinNewYork–  WBCTTerminalinLosAngeles–  ITSandHuskyTerminalsinwestcoasts

•  Group2:Terminalswon’trejectcontaineratgatenomaRerVGMreceivedfromoceancarriersforsaidshipmentornot.Oceancarriershavetono&fyterminalstorollthecontainerbeforeloadingonvesselifVGMcouldn’tbereceivedbeforeloading.

•  BasedonthecommentsfromtheCoastGuardduringtheFeb/18mee&ngwithFMC,theysaidtheenforcementmechanismwillbeasfollows:

•  A)IfcontainersarriveattheterminalwithouttheVGMaberJuly/1,theywilldeclarethebox“manifestlyunsafe”.Thecontainerwillbeputonholdun&lthegrossweightcanbeknownanddocumented.

•  B)IfthecontainerisweighedattheterminalandtheVGMdoesnotmatch,thecontainerwillneedtobereweighedandanewVGMissued.–  Vancouver,Canadaterminals–  PortofGeorgia

•  Group3:TerminalwillweighthecontaineratgateanduseitasVGMforShipperandforOceancarriers–  SouthCarolinaPorts

The Tare Weight is located on the back right door of containers. The weight would need to be taken before container is backed into the dock for loading to be added to the weight of the contents for the VGM.

weightfromRailBillingisVGM,therefore,shippershouldprovideVGMbeforetruckerssendRailBilling.

•  ForterminalswhoacceptcontainernomaRerVGMreceivedornot(Group2),andfortheTerminalswhoweighcontainerforShipper(Group3)–  ShipperisresponsibleforprovidingVGMtoMTAbeforeBookingCutOffdate,

otherwisethebookingwillberolledtonextvessel.–  Shipperwillberesponsibleforallthecostsforbookingrolloveratport.

cer&fica&onprogram,MidwestTransatlan&cLines,Inc.isreques&ngthefollowingprocedurestobemetbyallofourvaluedcustomerstobeincompliancewiththisnewInterna&onalregula&on.

•  SinceMTALinesistheac&ngoceancarrierinallLCLshipmentsforinterna&onalexport,wearerequiredtosubmitVGMcer&fica&onforallcargotobeloadedintocontainersforoceanexportpriortoarrivalatthepiersforloadingofthecontainersontothevessels.

•  Belowaretheproceduresthatneedtobefollowedsothatyourshipmentsarenotheldup.•  -Shipperswillbeaskedtoini&allysupplyMTAwithaformofScaleCalibra&onCer&ficateissuedbytheauthorityintheir

localareaconformingtotheguidelinesforcalibra&onofscalessetforthbythelocalauthority.Thiswillonlybenecessaryuponini&alsetupandwhennewcalibra&onisperformedtore-cer&fyperlocalauthorityguidelines.

•  -Thisweightistoincludeproduct,thepackagingandthemeansthattheproductsareloadedintooronforhandling.Theseinclude:totes,bins,crates,woodenboxes,drums,pallets,etc.

•  -ShouldshippernotbeabletoweightheircargopriortoleavingtheirfacilityMTAwillprovidethisserviceattheexportterminalforafeetobeadvisedpermarketprice.

•  Since,MTALinesisac&ngasyouragentforinterna&onalexportcontainershipments,wearerequiredtosubmitVGMcer&fica&onforallcargoloadedintocontainersforoceanexport.TheVGMistobesubmiRedtocarrierpriortoarrivalatthepiersforloadingofthecontainersontothevessels.WithouttheVGMcontainerswillnotbeloadedontothevessel.

•  Belowaretheproceduresthatneedtobefollowedsothatyourshipmentsarenotheldup.•  -Shipperswillbeaskedtoini&allysupplyMTAwithaformofScaleCalibra&onCer&ficateissuedbytheauthorityintheir

localareaconformingtotheguidelinesforcalibra&onofscalessetforthbythelocalauthority.Thiswillonlybenecessaryuponini&alsetupandwhennewcalibra&onisperformedtore-cer&fyperlocalauthorityguidelines.

•  -Thisweightneedstoincludeproduct,thepackagingandthemeansthattheproductsareloadedintooronforhandlingalongwithanydunnageusedforblockingandbracing.Theseinclude:totes,bins,crates,woodenboxes,drums,pallets,2x4wood,loosepallets,airbags,etc.Thistotalweightisthenaddedtothecontainertareweightlocatedonthebackofthecontainerdoorstogivethetotalweight/VGM.

•  Cer&fica&oncanbeawriRenstatementfromshippersignedbyapersondulyauthorizedbytheshipper,eitherontheinlandbilloflading,dockreceiptorpackinglisttocer&fytheVGMweight.ThisdocumentmustbesentelectronicallyviaemailorfaxtoMTAimmediatelybeforeoruponloadingofcontainer(s).

•  -Shouldshippernotbeabletoweightheircargopriortoleavingtheirfacility,MTAcanprovidethisservice,providedthetruckerwillbeabletostopataweighsta&onforafeetobeadvisedpermarketprice.

•  -Anyfinesorpenal&esaccessedduetoshipper’ssuppliedweightbeingfoundinaccuratewillbefortheaccountoftheshipper.
