    3. SENATOR ROCK:

4 Thank vou, Mr. Fresident, Ladies and Gentlemen of the Senate.

5 The motion, I think, is self-explanatory. We had, by rule of

6 this Body, adopted the date of May 25th as the last day to send

Senate Bills to the House. It seems only logical that a motion7.

like this should be made so that we can, in fact, clear our8.

Calendar. There's no since in printing these number of pages9.

ea e and every day if, in fact, e ey're not going to be considered.l0.

And any motion to suspend the rule to afford those bills that1l.

    20 SENATOR COFFEY:

Well, Mr. President and members of the Senate. I think2l.

Senator Hickey was speaking awhile ago that there's some22.

bills that didn't get a fair chanee on the Calendar last week.23.

sorry. Senator Netsch. I'm sorry, Senator Netsch. I think24.

Senator Hickey has already left us, but I wanted to remind you2b.

about someone that left us last Thursday evening when we had26.

a quorum call and there wasn't enough Senators here to carry

on the business and think she was one that was off the Ploor28.

6 PRESTDING OFFICER: (SENATOR SAVICIG S)

    Senator Netsch.

    SENATOR NETSCH:9.

Senator Hickey will speak to the motion made by Senator9.

Netsch. The committee report, the committee met this morning,l0.

which was the first opportunity we really had had to meetl1.

since the hearing on *he Executive Order some time ago. And12.

several things have happened since then. The principle thingl3.

is that House Bill 1400, which was intended to be the billl4.

implementing and also making some modifications in the Governor'sl5.

Executive Order No. 3 was not called for a vote on Friday nightl6.

in the House. And so is, I guess, in the same status as the

bills which we just recommitted to committee here in the Senate.l8.

That came as something of a surprise to a11 of us because manyl9.

people thought that that had reflected a number of the agreements20.

and accommodations that had been made with respect to the2l.

Executive Order. The committee meeting this morning was fairly22.

brief, but there.- the motion that Executive Order No. 3 not23.

be approved or be' disapproved, prevailed by a vote of 6 to 5.24. )

I was not on the p'revailing side of that vote and so someone2b.

else should make the case for supporting the motion. which26.

point I would be willing to make a very brief case aqainst the27.

    motion.28.

    PRESIDING OFFICER: (SENATOR SAVICKAS)29.

    there further discussion? Senator Buzbee.30.

    SENATOR BUZBEE:3l.

Thank you: Mr. President. Senator Netsch indicated she32.

was the...in opposition to the final action of the committee.

  • 1. It was my mokion that put us in this posture of saying thak

1 we do not approve of this Executive Order.' The position3 welre in today is, if we take no action by the end of today,

4 the Governor's Executive Order No. 3 of 1979 becomes effective

s with the new.- new department being- .being promulgated and

started as of October: I understand. So we are in a position...6.

PRESIDING OFFICER: (SENATOR SAVICKAS)7.Excuse me Senator. For what purpose does Senator Graham8

    .

    arise?9.

    SENATOR GRAHAM:lô. .

Would it be expecting too much for us to try to get all.little order.

    l2.PRESIDING OFFICER: (SENATOR SAVICKAS)l3

    .

Senator Graham, your point is well taken. Could wel4.

have a little order. This is a very important discussion.15.

Deals with the reorganization of State government and Senatorl6.

Buzbee deserves your attention. Senator Buzbee.

    SENATOR BUZBEE:l8.

Thank you, I don't know if I deserve your attention orl9.

not, but Senator Graham Ehink if youbll look around, most2 () .

of the talkers are the Governor's people that are on the Floor2l.

lobbying for khe Executive Order. So thatds...that's where

part of our problem is coming. It was the feeling of at least23.

six of us this morning in the committee that we ought to take24.

the position of saying No to the Governor's Executive Order.25.

At the moment there is no pending implementing legislation.26.

Discussions with Representative Kane in the House who heads

the Executive CommiEtee, the Executive Reorganization Committee28. .

there, indicated that he might make an...he would make an29.

effort, rather to try to get a committee bill out dealing3û.

with this- .this particular question of reorganization. But31.

our feeling was that until they get such a bill and we can,32.

as the Chair stated earlier today, with 30 votes you can do33.

  • 1I .

    1. just about anything you want in this Chamber. So we could put

    2. a bill out of our own if we wanted. But there were six of us this...

    3. this morning that felt that we oughk to go ahead and kill the

    4. Governor's Executive Order as of today and then start working

    5. on a package of reorganization of this Department of Business

    6. and Economic Development and take it from there. So we would ask that

    7. you would support our position of...killing the Governor's

    e. Executive Order as of today.

    9 PRESIDING OFFTCER; (SENATOR SAVICKAS)

lc Is there further discussion? Senator Graham.

    yl SENATOR GRAHAM:

Mr. President and members of the Senate. I...wil1 you guysl2.

get with the program for.-maybe I can have some effect. I havel3.

my feelings about Executive Orders, contrary to the Chairmanl4.

of our Committee on Reorganization. The Governor's peoplel5.

and we. those of us, who are interested in doing something tol6.

preserve some of the monies, taxpayerts monies of the Statel7.

' of Illinois, feel a good comprehensive reorganization thatl8.

is workable and livable, we could support. We have a feelingl9.

also, that it wasn't the fault of this Body that we don't have20.

House Bill 1400. This is purely the responsibility of the2l.

Speaker of the House who showed absolute intemperance with22.

regard to the feeling of the General Assembly when he kept23.

moving this bill down on the call the other day and didn't24.

call it. We have always, I have always felt that...that25.

an Executive Order without accompanying legislation was26.

undesirable. This order will become, in effect, really, October27.

the 1st and we have done this before,we've Passed these Executive28.

Orders and have followed up with a comprehensive statutory29.

l provision to.-implement the bill. That's the posture we are. 30.

in now, should be in now. The Governor's Office has given31.

us a commitment with regard to the amendment that was placed' 32..7ï 14oo over in the House last week, to the extent that if weon. 33.. 34

  • 1* find implementing legislation and the House could r if they

2 . et on the ball over there, could pass that bill anyw'ay because. g

    3. is exempt by their rules. We can provide the necessary

4* su tutory pra isions to implement the Governor's Executive

Order. I don't like Executive Orders, but I do like statutory

    6. provisions and I think we ought to be given the opportunity

    7. to do that. I think just arbitrarily ul1 the Governor's

    8. Executive Order might be a step in the wrong direction and I

    9. rise in opposition to the motion and the feelings explained

    l0. by Senator Buzbee.

    1l. PRESIDING OFFICER: (SENATOR SAVICKAS)

    12. Senator Shapiro.

    13 SENATOR SHAPIRO:

14 l4r. President and Ladies and Gentlemen of the Senate.

z5. I just wank to reiterate what Senator Graham has said. I think

l6. that this recommendation of the eommittee should be rejected,

17 then the force of the Executive Order will go into effect

la because of my understanding that this is the sixtieth day.

19 Now for those of you who are apprehensive about their not being

2() implementing legislation, let me say to you that every other

Executive Reorganization Order that has come before us was

implemented by this Body before the implementing legislation

23 in the form of a bill was passed. We have assurances from

the Governor's Office that they will support the implementing24.

legislation in another bill whatever that bill may be. So I2b.

am wholeheartedly and agree with what Senator Graham has said26. '

that the recommendation of the committee to disapprove the27.

Executive Order be rejected, whieh will require a No vote.28.

    PRESJDING OFFICEA: (SENATOR SAVICXAS)29.Senator Rock.30

    .

    SENATOR ROCK:3l.

Thank you, Mr. President, Ladies and Gentlemen of the32.

    35

  • Chief Executive delivers to this Body prior to April 1, an

    2. Executive Reorganization Message, 60 Calendar days later

it will become effective unless this Body, by a majority of4. those elected, votes to disapprove. I understand that's th e

way fhe motion will be placed pursuant to the committee recommen-

    6. dation. And those of us who wish to disapprove, will in fact,

    7. vote Aye. I would suggest to the membership that a commitment

flom the second floor is nice, except we don'E k now what he's8.commit G d to or what his staff is committed to. I understand

tha t House Bill 1400 whi & underwent some leng thly committeel0.

hearings was twice amended, at least twice amended on the F loorl1.

of the House and it never, in fa ct, was called for fi na1 passage. So,l2.

there seems to be some dis agreement as to what should be imbodiedl3.

in this reorganization. And h o, we can stand here and 'say we

will allow , there is a eommitmen) to do this or that, I1m justnot sure we're able to do that. We' certainly can't c unmitl6

    .

to what the House is about. It just s eems to me that as al7.

matter of legislative prerogative, if we are going to keep al8.

handle on this Executive Reorg aniza G on, we could very welll9.

disapprove this today and ask our commit G e of the Senate,20.

M nators Netsch and Graham, to work on and bring a bill out

of the Executive Reorganization Committee: which will adequately

reflect b0th what the Governor wants and what the Legislative23.

s u uctr ally sound and makes a good deal of sense. œ viouslyl2.

a number of m ople have objections to some part of it# andl3.

indeed House Bill 1400 did reflect a compromise of thosel4.

differing points of vie w. The bill which has subsequentlyl5.

failed to be called in the House. think the real difficultyl6.

is that if the Executive Order is not approved ,in effect, there

will be no real incentive to go ahead wi th this particularl8.

reorganization. thi hk we will just simply lose the m omentuml9.

and pr e ably flounder around and maybe something will happen20.

and maybe it wontt, but it's not too likely. On the other hand ,2l.

if the Executive Order becomes fact, because there are points22.

in it that need to be revised and reviewed, there will be a23.

very strong incentive for us to continue to work out the24.

implementing legislation. And for that reason and also because2b.

    I do think that reflects basically a s ound idea , think26.

that we would be in a better posture if we were to allow the27.

Executive Order M become effective at the end of today and28.

then take the opportunity either through a House Bill, excuse29.

me, and the House Rules do permit an exception to their deadline30.
