Thieves give sleep - less nights to Sanat Nagar residents Srinagar, Jun 27: In another dreadful road accident, four per- sons were killed and seven others injured when a cab fell into gorge in Uri area of Baramulla district. According to the details received by Kashmir News Service, a cab bearing number JKO5B-8962 was carrying the passengers towards Uri area during which the vehicle went out of control and fell into a deep gorge after which all the passengers in the vehicle were injured. The injured were later taken to the sub district hospital where four persons were declared brought dead. The killed were identified as Mohammad Hanief , Noor Husain residents of Thajal Uri, Imtiyaz Ahmad Kakroo resi- dent of Gharkot Uri and Manzoor Ahmad Chopaan hailing from res- ident of Ramban. The injured admitted in the dis- trict hospitals of Uri and Baram- ulla were identified as Iftikhar Awaan, Mohammad Ashraf, Gul Mohammad, Mohammad Hussain , Haneef paswal, Sareer Ahmad and Naseer Khokhar. The Inspector General of Police (IG) Traffic Muneer Khan told KNS over phone that the govern- ment is ascertaining the reason of the accident and that he has already sent the senior officials of his department to verify the facts. “It was the tempo traveler that met with this accident. Over loading cannot be the reason. A police official told GNS that Saima (16) daughter of Abdul Gani Mir, a 9th class student along with her grandmother Rehmati (70-years-old) while irrigating their rice field when the duo slipped into the river Larie near Waghed in Tral. Soon after the incident, scores of locals jumped into the river and they tried to save the duo from drowning, the official said, adding that the flash water swept them about 200-300 meters downward. High Powered Committee on operationalisation of the New Administrative Units met to-day under the Chairmanship of Chief Secretary Mr. Mo-hammad Iqbal Khandey.

The meeting was at-tended by Principal Secretary Planning and Development, Mr. B. R. Sharma, Principal Secretary Finance, Mr. B. B. Viyas, Commissioner Sec-retary Revenue, Mr. Vinod Koul, Secretary, Rural Devel-opment, Sheikh Mushtaq Ahmed, Secretary GAD, Mr. M. A. Bukhari and other se-nior officers. The Committee examined and deliberated

upon the proposals of dif-ferent departments regard-ing the creation of posts and necessary infrastructure for making these units op-erational at the earliest.Once finalized the recommenda-tions of the High Powered Committee will be placed before the Cabinet for its con-sideration and approval.The High Powered Committee for examining and clearing

the proposals of different de-partments was constituted by the government follow-ing the Cabinet decision to create New Administrative Units in the State.The Com-mittee has been working out the modalities in terms of to-tal manpower, infrastructure and financial requirements and recommend the propos-als for the consideration and approval of the Cabinet.

HANDWARA, JUNE 27: The Min-ister for Consumer Affairs & Public Distribution (CA&PD) and Trans-port, Ch. Mohammad Ramzan today announced that Rehbar-e-Khuraq scheme will be launched soon in J&K on the pattern of Rehbar-e-Taleem to provide job opportunities to edu-cated youth.

This announcement was made by the Minister at a day-long Educa-tional Conference held today at En-vironmental Hall, Handwara which was organised by ReT Teacher Forum Kupwara.

The Minister said that with the launching of Rehbar-e-Khuraq scheme 16,000 educated youth would be benefitted under the pro-gramme across the State, adding that their engagement would help open ration depots at uncovered and far-flung areas of the State. He further added that addressing employment issues of educated youth of the State is the propriety agenda of Omer led

coalition government. In this regard the government during last five years has launched numerous youth friendly schemes across the State besides steps have also been taken to create other job avenues in pub-lic and private sectors, the Minister added.

State for Animal, Sheep Husbandry, Agriculture and Horticulture Mr. Nazir Ahmad Gurezi said that there is a need to conduct more and more awareness camps in order to spread awareness among the farmers re-garding the newer and latest hor-ticulture techniques and about the policies and programmes of the Gov-ernment so as to provide them maxi-mum benefit.

The Minister was speaking at a Daylong Seminar on “Management of Apple Scab and other Physiological Disorders”, organized by the Direc-torate of Horticulture, Kashmir here today.

The Minister said that there should be emphasis on introduction of latest technology and techniques

in agriculture and allied sectors to enhance production. He further said that increase in production and pro-ductivity will not only help the econ-omy of the State but will also improve the socio-economic conditions of the farming community. Horticulture is a key source to ensure prosperity of the State in general and farmers in particular, the Minister added.

Mr. Gurezi said that need is to set up a separate Enforcement Wing for Horticulture department so that the quality of pesticides used is prop-erly monitored. He asked the Direc-tor Horticulture Kashmir to submit a proposal to the Government in this regard for accord of necessary sanc-tion.

He also asked the concerned to spread awareness among horticul-turists through wider publicity cam-paign about use of quality and appro-priate pesticides through print and electronic media including FM Radio.

scored the need for up gradation of Laboratory at Lal Mandi.

The Minister asked the Hor-ticulture department and SKAUST to work in unison for better results in the sector. He emphasised on field visits by the officers concerned and feedback about the problems faced by the orchardists with regard to the uses of pesticides and techniques, so that these are appropriately ad-dressed.

The Minister said that the horticulture is among the priorities of Government and urged for evinc-ing keen interest in this sector. He ap-pealed the orchardists to follow the expert guidance of the horticulture department and use standard pesti-cides.

SRINAGAR, JUNE 27: According to a Circular issued by Chairman, State Transport Authority, Mr. Saurab Bhagat the RTOs/ARTOs have been asked to organize special drives within their respective territorial jurisdiction immediately against the illegal sale of used vehicles/automobiles and initi-ate action against the persons who are selling these without getting proper registration from the designed competent Au-thority without acquiring the requisite trade certificate.

The circular further stated that the practice has re-sulted in an un-healthy indulgence amongst the shopkeepers and business without adhering to any control. As per the cir-cular only authorized and bonafide trade certificate holders are authorized by law to conduct business of sale of vehicles in terms of Rule 34 of Central Motor Vehicles Rules, 1989. It is observed that there has been mushrooming of sale outlets of such used vehicles across the State which is in violation of law and is required to be stopped forthwith, it further added.

Accordingly, the State Transport Authority has therefore, made it imperative for the Traders to acquire a Trade Certifi-cate to regulate the business within the framework of law. It has also been informed that any vehicle not approved by the Empowered Standing Committee constituted by the Govern-ment, if sold inadvertently will invite a fine of Rs. 1 lakh per violation.

RAMBAN, JUNE 27- Minister of State for Technical Education(IC), Information, Parliamen-tary Affairs, Social Welfare, CAPD and Rural Develop-ment Vikar Rasool Wani today laid the foundation of additional accommoda-tion for Govt High School Buzla Khari Banihal. The project is coming up at an estimated cost of Rs.49.17 Lakh under Rashtriya Mad-hyamik Siksha Abhiyan (RMSA).

Addressing on the occasion, the Minister said that the education and health are priority sectors for the present govern-ment and during its regime all efforts have been made for development of new and upgradation of exist-ing infrastructure in both the sectors in the area.

stitutions have been estab-lished and upgraded and an equal number of ReTs have also been engaged

in areas like Khari, Shagan, Trigam, Chapnari, Amkote, Chachihaal, Chamalwas, Checknarwah, Senabati and Maligam.

Under the Health Sector, Mr. Vikar said that an additional complex at Sub District Hospital Bani-hal is being developed at

an estimated cost of Rs. 22 Crores which is expected to be completed soon for delivery of health services

to the people of the area. He said that large number of dispensaries have been established in the area to provide better health care to the people at their door-steps, adding that the work on the recently announced Nursing College at Banihal shall commence soon.

SRINAGAR, JUNE 27: Minister for Haj, Auqaf and Floriculture Peerzada Mohammad Sayeed, who was on 2- day tour of Pul-wama and Anantnag districts, has said that the government has launched massive drive for the development of far-off and re-mote areas of the state and vari-ous developmental projects are underway in this regard.

Addressing series of public meetings at Litter in Pulwama and Chakura, Dessu and Dandipora in Breng Constituency of Anantnag districts, the Minister maintained that the Government is commit-ted for equitable development of three regions of the State. He said that work on various new and existing developmental proj-ects have been taken into hand. He said roads, PHE, health and education sectors has been pri-oritized aiming to improve basic amenities to the people which will ensure upliftment of socio-economic status of the people liv-ing in the district.

At Litter, the Minister said that the area being rich in production

of high quality fruits, efforts are on to provide marketing facilities to the growers at their doorstep for getting best price of their pro-duction.

Giving an overview of devel-opmental activities in Anantnag District, the Minister said that besides establishment of two Degree Colleges, a number of

educational institutions have also been upgraded in the area during the regime of present Government. He said over 30 health institutions of the area have been provided better in-frastructure with installation of latest diagnostic equipments and provision of blood bank fa-cility with central heating facil-

ity at Sub-District Hospital for the convenience of the people. He said Kokernag being tourist place, has been provided with the Tourist Reception Centre (TRC) and 5-star hotel facility.

Referring to road and power sector, Peerzada said that various un-connected hamlets have been connected under PMGSY, LT/HT

transmission lines augmented under APDRP in the area.

The Minister also inaugurated Water Supply Scheme (WSS) Cherpanzi completed at a cost of Rs. 1.42 crore which would ben-efit over 2414 souls of the area.

While making a mention of Art 370, the Minister said that it is a guarantee provided to the State by the Constitution of India and its safeguarding is in the best interest of the people of the State and the country.

Responding to the demands projected by the locals, the Min-ister said that their genuine de-mands would be looked into and addressed on priority. He said that local gardens and parks would be developed on modern lines so that the locals have better recre-ational facilities in the area.

Legislator, Bashir Ahmad Magray also addressed the gath-ering.

Frequent road accidents-a matter

of concern

The traffic accidents con-sumes more precious lives than the militan-cy related incidents, is a shocking revela-

tion which is indicative of the pathetic condition of our roads and the prevalent traffic man-agement system. Undoubtedly the already deficient road con-nectivity in the state is in a very bad condition and the frequent accidents are the result of these depleted roads. Leave aside the roads leading to small towns and villages, the National High-way from Baramulla to Srinagar and From Srinagar to Anant-nag, highways are nothing but death traps. The widening and upgrading of this highway has resulted in frequent accidents and unending traffic jams have become unbearable and intoler-able for commuters. Nobody in the govt. is bothered to see what ailing this project and why it has been delayed so long. Per-haps for R&B Minister the only road in the valley lies between Gupkar and Civil Secretariat, which seems to be the first pri-ority of the R&B dept. which has become a den for corruption and where reportedly lakhs of rupees change hands for the posting and transfer of junior engineers to chief engineers. This dept. is as if it is the property of its po-litical and administrative heads. The roads in the rest of the val-ley as compared to Jammu are in such a bad condition that the accidents cannot be avoided. Similarly the traffic manage-ment in the state is so poor that anybody can acquire driving li-cense against payment without qualifying the necessary test and ply any vehicle of his choice. The corruption at every level in traffic dept. and regional transport office is a known fact but no efforts have ever been made to check this bad practice to save the lives of hun-dreds of passengers who become victims of road accidents. The over-loading has become a nor-mal thing. People sitting on bus tops and on sumos often fall down and loose their lives or become handicap for whole of their life. There is an urgent need to prior-itise the R&B sector and give it under an able and honest min-ister and dedicated officers so that the money is spent in a jus-tified manner. The traffic man-agement should be modernized in view of the rush of vehicles. The inherent weaknesses and shortcomings of this dept. need to be removed in order to save the lives of the passengers from frequent road accidents.

Why does this happen once

and againUnfortunate to note that every now and then, here and there the security forces indulge in an act which white washes all the efforts made towards res-toration of peace and normal-cy in the valley. It has been seen during the whole mili-tancy particularly during last few years that security forces sometimes do not exhibit re-quired patience while dealing with mobs particularly the stone throwing people. Thoughthere seniors and the political leadership has been repeated-ly stressing the need to exer-cise restraint while on law and order duty but some impatient personnel do an act which plunges the whole valley into fresh wave of violence fol-lowed by strikes, shut downs and curfew. This process ef-fects the normal life very badly and derails the state from the path of development. It also causes enormous problems for general people who have to suffer on many counts varying from lack of medical facilities to the ailing people, denial of education to our children and shortage of essentials besides their sky rocketing prices. They provide a tool to those people who are waiting to get a pretension for disturbing the whole normal life in the valley because it is always in their in-terest to keep the pot boiling. One fails to understand as to why these things happen re-peatedly. The recent happen-ing a Naidkhai which resulted in the protests marches and hartal in the whole valley is never and will never be in the best interest of the state and the country. If Jammu & Kash-mir police and other security forces exercise a bit more pa-tience and restraint, there will never happen incidents like Naidkhai and the young peo-ple will not lose their precious lives. Anybody in the securi-ty forces doing such things is not in any way a well wisher of the country and the state. In fact security forces are meant to establish peace and normal-cy in the state and that can be done only when they have thecredibility in the people and when people think that they are their saviors and not kill-ers. A best force is known be-cause of its reputation in the people and not by its repres-sive actions which annoy the people who then serve the pur-pose those elements who are alien to the interests of the state and the country.

Income Tax Ombudsman: Take his help to Redress Your Grievances

As a taxpayer, you may have some very legiti-mate grievances relating to your income-tax mat-ters of settlement of your

claims. You may, for example, feel that the Income Tax Department owes you a certain refund of tax but it is not doing enough to hear your grievance of complaint nor taking action to redress it. You may also be aggrieved about the rude behaviour of officials or their failure to follow instructions and circulars of the Board. In all such cases, you can approach your Income tax Ombuds-man. Before you do so, however, you have to ensure that certain condi-tions are fulfilled. The Ombudsman is governed by, and has to act with-in, the framework of the Income Tax Ombudsman Guidelines, 2006. The institution of Ombudsman is of Scandinavian origin. The Om-budsman enquires into grievances or complaints against the function-ing of a public authority. In our own country, the Income tax Ombuds-man is appointed by the Central Government. He is usually a person with vast experience in tax adminis-tration, but functions independent-ly of it. At present, the Government has appointed Ombudsman at New Delhi, Mumbai, Chennai, Kanpur, Chandigarh, Pune, Bhopal, Kochi, Kolkata, Hyderabad, Bangalore and Ahmedabad. What Grievances can you take to the Ombudsman

You can complain to the Om-budsman about your grievances re-lating to delays in disposal or settle-ment of claims connected with: a. Issue of refunds;b. Interest waiver petitions;c. Appeal effects;d. Rectification applications;e. Release of seized books of ac-counts and assets;f. Allotment of PANs/ issue of PAN Cards. You can also complain of such mat-ters as failure to:a. Give credit for taxes paid, including tax deducted at source;b. Maintain transparency in selec-tion of cases for scrutiny;c. Follow the guidelines, circu-lars and instructions of the Central Board of Direct Taxes;d. Observe proper working hours by Income-tax officials;e. Acknowledge letters and doc-uments forwarded by the assessee;f. Maintain or update records and registers leading to harassment. “A person can also complain about any unwarranted rude behavior of In-come Tax officials with assesses.” Etc., For further details, please re-fer to clause 9 of the Guidelines.

Procedure to be Followed

On receiving complaint, the Ombudsman will examine it to see if certain basic conditions laid down in the guidelines have been fulfilled or not. He cannot take notice of the complaint unless these conditions are fulfilled. These conditions are: i. The complaint should have been signed by the complainant as well as his authorized representa-tive, in case the complainant is rep-resented by such an authorized rep-resentative.ii. The complaint should clearly

indicate/provide:a) The name, address and PAN of the complainant;b) The name and designation of the official who is being complained against (this should invariably be the junior most officer who has giv-en rise to the grievance, not below the rank of an Income Tax Officer)’c) The facts giving rise to the com-plaint;d) Supporting documents; ande) The relief sought from the Om-budsman.iii. The Ombudsman will accept complaints filed through the elec-tronic media if they are otherwise in order, but the print out of such a complaint has to be signed by the complainant at the earliest. After he does so, the complaint would relate back to the date on which it was first received electronically. A complaint shall not lie to the Ombudsman unless in the first in-stance, the complainant had also made a written representation to the superior authority of the officer complained against. Also, a com-plainant can complain only if he has received no reply and more than one month has passed since he submit-ted his representation. Alternative-ly, he can also complain if he has re-ceived a reply but he is not satisfied with it, or if his representation has been rejected. No complaint can be made:i. 12 months after the re-ply was received from the superior

authority;ii. 13 months after the representation was submitted to the superior authority but no reply was received. Remember, the Ombudsman will not take cognizance of the complaint if it has been the subject matter of : a. an earlier settlement made by the OmbudsmanORb. an appeal, revision, reference or writ before any Income-tax authori-ty or a court of law. On receiving a complaint, the Om-budsman shall forward it to the of-ficer complained against and shall endeavour to settle it by an agree-ment through either conciliation or mediation. If the officer cannot set-tle the grievance by agreement with the complainant within a period of one month, or such further time as the Ombudsman may allow, the Ombudsman will mediate and try to bring about an agreement. If he still does not succeed, he can make an ‘award’.

Powers The Ombudsman has the following powers:

i) He can receive complaints on matters indicated in clause 9 of the Guidelines.ii) He can consider these com-plaints and settle them either by agreement through conciliation and mediation or by passing an appro-priate award.iii) He can require the Income-tax authority concerned to provide any information or furnish certified cop-ies of relevant documents required by him.iv) In the event of the failure of an Income-tax authority, to furnish such information or documents (in-dicated in para iii above), he may

draw an adverse inference.v) He can suggest remedial mea-sures for redressal of grievances.vi) He can also report his findings to the Secretary, Department of Rev-enue and Chairman, C.B.D.T.

Duties The duties of the

Ombudsman are to:i) Exercise powers of superinten-dence and control over his office.ii) Maintain confidentiality of information coming into his pos-session and not divulge the same to third parties, except with the consent of the person who furnish-es such information. He may, how-ever, divulge such information to an opposing party to the dispute in order to reasonably comply with the principles of natural justice.iii) Protect the taxpayers’ rights and reduce their compliance bur-den.iv) Identify issues that increase the burden of compliance and bring the same to the notice of the CBDT and Ministry of Finance.v) Furnish a monthly report to the Chairman, CBDT and Secretary, Department of Revenue recom-mending appropriate action includ-ing that to be taken against erring officials.vi) Furnish an annual review of the tax administration to the Chairman, CBDT and Secretary,

Department of Revenue.vii) Compile a list of awards made by him during the financial year and report the same to the Chief Commissioners concerned and Chairman, CBDT so that the same can be taken into account while writing the Annual Confidential Reports of the officials concerned.

Nature of the Proceedings

The proceedings before the Om-budsman are quasi-judicial in na-ture. He is not bound by any legal rules of evidence. He is expected at all times to be fair and reasonable while performing his functions.

Nature of Awards As already indicated, he shall try to settle a complaint by agreement in the first instance. If such agreement is not forthcom-ing within a month or such further time as the Ombudsman may al-low, he may make an award. This shall be speaking order and shall clearly specify the directions to the authority concerned- including making of an apology. The award, however, cannot affect the quan-tum of total income or tax assessed or the penalty already imposed. The Ombudsman can award com-pensation upto Rs. 1000/- for the loss suffered by the complainant. Such compensation will be the first charge on the budget allotted to the authority complained against. The award shall be binding on the de-partment but it shall be binding on the assessee, only if he issues a letter of acceptance within 15 days of its receipt. If the complainant does not accept the award or fails to furnish a letter of acceptance within 15 days or further period of

15 days if the Ombudsman permits, it shall lapse and be of no effect. If it is accepted by the assessee, the authority complained against has to implement the award within one month of its having being made. Compliance of having done so has to be reported to the Ombudsman.

Check List A check list has been prepared to help you file a complaint. This is given below: 1. The complaint has not been signed by the complainant.2. It has not been signed by the authorized representative.3. It does not contain:-a. The name and address of the complainantb. Supporting documentsc. Details of the relief sought from the Ombudsman.4. It has been made electroni-cally but the hard copy (print out) does not have the complainant’s signature.5. The complainant does not seem to have reported to the imme-diate superior of the officer com-plained against.6. More than one month has not passed before the representation to the immediate superior was filed.7. The complainant does not ap-pear to be aggrieved with the reply received from the immediate supe-rior.8. (a) The complaint has been made after the expiry of one year

from the receipt of the reply of the immediate superior;OR (b) Where no reply has been received from the immediate supe-rior:The complaint has been filed after the lapse of 13 months from the date of filing of the representation before the immediate superior.9. The complaint is the Subject matter of an earlier proceeding with the Ombudsman.10. The ground(s) of the complaint is/are also the subject matter of a proceeding in appeal, revision, ref-erence or writ before an appellate authority or a revisionary authori-ty or a Court of Law.11. The ground is not covered by Guideline 9 of the Income Tax Om-budsman Guidelines, 2006.12. The complainant is represent-ed by an authorized representa-tive but no power of attorney to represent the complainant has been filed before the Ombuds-man. Remember, the answer to every statement in the check list should be negative. A positive response to statements are Sr. No. 1 to 7 and 12 would indicate that the complaint is defective and the Ombudsman cannot proceed further to redress your grievance till the defect is re-moved. A positive response to statements at Sr. No. 8 to 11, on the other hand, would indicate that not only is the complaint defective but it is also incurable. No purpose would be served by filing such a complaint. We all have a positive responsibil-ity in making this institution effec-tive. We can do so by ensuring that we eschew the defects indicated in the check list given above and avoid filing frivolous or vexatious com-plaints.
