Zoning Board Meeting Held Virtually March 8, 2021 The regular meeting of the Zoning Board of Appeals was called to order by Chairman Hoose at 7:05 p.m. Members present: Chairman Brian Hoose, Mark Donahoe, Karen Parkinson, Adam Keller, Bob Rose, Laura Voss, Scott Wild. Also Present: CEO David Ford, Village Attorney Matt Lenahan, Melissa Luft Zoning Board Clerk, Rich Tiede Marathon Engineers, Jake Harrington BYOH, Jp Schepp, David and Erica Jacobs applicants, Peter Lehning, Greg Jacobs and Cole Papasergi. Resolution: Motion by Mark Donahoe, seconded by Adam Keller to approve February 3, 2021 meeting minutes with correction. Motion Carried. Chairman Hoose reminded the Board and Residents that the Public hearing and public chat were now closed. Also, after this meeting we will be switching to using Zoom instead of Big Blue Button. Zoning Board Meeting Held Virtually March 8, 2021

The regular meeting of the Zoning Board of Appeals was called to order by Chairman Hoose at 7:05 p.m. Members present: Chairman Brian Hoose, Mark Donahoe, Karen Parkinson, Adam Keller,

Resolution: Motion by Mark Donahoe, seconded by Adam Keller to approve February

Resolution: Motion by Chairman Hoose, seconded by Bob Rose to approve SEQRA Part II and Part III Negative declaration for the Wolfsberger Park subdivision Plan on NYS Route 65 in the Village of Honeoye Falls. A RESOLUTION OF THE VILLAGE OF HONEOYE FALLS ZONING BOARD OF APPEALS

A Resolution Approving the SEQRA Part II and Part III Negative Declaration for the Wolfsberger Park Subdivision Plan on NYS Route 65 in the Village of Honeoye Falls

March 8, 2021

WHEREAS, the Village of Honeoye Falls (“Village”) is a municipal corporation located in the County of Monroe, State of New York; and WHEREAS, the Honeoye Falls Zoning Board of Appeals (“ZBA”) is a duly-appointed body of the Village established pursuant to Village Code § 190-138; and WHEREAS, the ZBA is charged with review of, inter alia, applications for subdivisions within the Village; WHEREAS, an application for a Proposed Action was received last year proposing to subdivide approximately 72 acres of land on the east side of North Main Street within the Village, off of NYS Route 65, a parcel with tax identification number 222.17-1-4, preliminary named and referred to by the applicant as the “Wolfsberger Park” project (“Proposed Action”); and WHEREAS, a public hearing was held on the Proposed Action, beginning at the regularly-scheduled meeting of the ZBA on November 2,2020, and continuing through the regularly scheduled ZBA meetings dated December 7, 2020, January 4, 2021, and February 3, 2021; and WHEREAS, as part of the application for the Proposed Action, the applicant submitted a completed Part I section of the Full Environmental Assessment Form (“FEAS”), under the State Environmental Quality Review Act (“SEQRA”); WHEREAS, at the regularly-scheduled meeting of the ZBA on February 3, 2021, the ZBA passed a resolution declaring the ZBA the lead agency for purposes of review under SEQRA; and WHEREAS, letters on behalf of the ZBA were duly forwarded to all involved or interested agencies, or potentially involved or interested agencies, along with Part I of the FEAS as well as the application package for the Proposed Action, advising those agencies of the ZBA’s intention to act as the lead agency for purposes of SEQRA; and WHEREAS, the ZBA determined that the Proposed Action qualified for a “Type I” level review under SEQRA; and

WHEREAS, the ZBA has either received the consent of each of the other involved agencies that the ZBA act as lead agency for this SEQRA review, or at least 30 days have passed since notification was provided and no objections to ZBA serving as lead agency have been received; and WHEREAS, pursuant to 6 NYCRR part 617, the ZBA has reviewed Part 2 of the FEAS to determine whether the Proposed Action will have any significant effect on the environment; and WHEREAS, pursuant to 6 NYCRR Part 617, the ZBA has determined that the Proposed Action will not have a significant effect on the environment, and will not cause a significant adverse impact on the environment, and therefore, the preparation of an Environmental Impact Statement is not required. NOW, THEREFORE, be it resolved by the ZBA as follows:

1. Based upon the examination of the FEAS, the criteria set forth in 6 NYCRR Part 617, the documents and information provided by the applicant, and the documents and information provided by various interested and consulting parties and agencies, the ZBA makes the following findings:

a. The Proposed Action constitutes a Type I action pursuant to 6 NYCRR

Part 617 and the ZBA has previously determined that a coordinated review is appropriate.

b. The ZBA has either received the concurrence from the other

involved/interested agencies the ZBA acts as Lead Agency for the Proposed Action or more than 30 days has elapsed since notification of lead agency status was provided to such agencies.

c. All aspects and sections of the FEAS have been discussed at length by the

ZBA at open and public meetings of the ZBA. d. The ZBA has determined that the Proposed Action will not have a

significant effect on the environment, and will not cause a significant adverse impact on the environment, and therefore, the preparation of an Environmental Impact Statement is not required.

e. The ZBA instructs its clerk to arrange for the issuance, filing, and service

of a Negative Declaration pursuant to 6 NYCRR 617.12.

BE IT FURTHER RESOLVED, that this Resolution shall take effect immediately. A motion to adopt the foregoing Resolution was made by ZBA Member ___________

approval for the Wolfsberger subdivision pending EPOD permit approval from the Conservation Board. All Board members in favor. Motion Carried.

Rich Tiede thanked the Board for all their efforts. David Jacobs thanked the Board of behalf of his family for accepting the project. Resolution: Motion by Mark Donahoe, seconded by Adam Keller to adjourn the meeting at
