Dear Mr. Rodriguez:

This law firm represents Glass House Productions LLC and the property owner in relation to the referenced application for a supper club approval on the property. The purpose of this letter is to confirm that the proposed supper club will serve prepare and serve food. This question was specifically asked and answered at the planning and zoning appeals board on September 23, 2013. Although the original operation plan submitted with the application indicated that food was not to be served, the Record was corrected prior to the Planning zoning appeals board hearing with the Planning Department as well as at the public hearing.

The deadline to file the complete application with supporting documents is the last five working days of each month from 8:00 am until 3;00 pm, except on the fifth day, until 12:00 pm. The application submittal date is the date stamped by Hearing Boards' staff on this page. The responses to this application must be typed and signed in black ink. All pertinent and accurate information/documentation; i.e., the plans, reports, exhibits, shall be presented at the time of filing, in addition to the paid receipt. The applicant is responsible for the accuracy of the information contained in the application and all supporting materials. Should you wish, you could bring the materials to our office for review prior to submittal to ensure completeness.

You will be responsible, if needed, to bring an interpreter for the English language to any presentation before city boards, committees and the city commission. A valid power of attorney will be required if neither applicant or legal counsel representing the applicant execute the application or desire to_make a presentation before city boards, committees and the city commission. -All documents, reports, studies, exhibits (S'Y:2x11 ") or other materials submitted during this process will be kept as part of the record. Any documents offered to the Planning, Zoning and Appeals Board and the City Commission, which have not been provided fifteen (15) days before the meeting as part of the agenda materials will be entered into the record at the discretion of the aforementioned Board and Commission.

ORDINANCE NO. 11469, CODIFIED IN CHAPTER 2, ARTICLE VI OF THE CITY CODE STATES THAT ANY PERSON WHO RECEIVES COMPENSATION, REMUNERATION OR EXPENSES FOR CONDUCTING LOBBYING ACTIVITIES TO REGISTER AS A LOBBYIST WITH THE CITY CLERK, PRIOR TO ENGAGING IN LOBBYING ACTIVITIES BEFORE CITY STAFF, BOARDS, COMMITTEES AND THE CITY COMMISSION. A COpy OF SAID ORDINANCE IS AVAILABLE IN THE OFFICE OF THE CITY CLERK (MIAMI CITY HALL), LOCATED AT 3500 PAN AMERICAN DRIVE, MIAMI, FLORIDA, 33133.

Ordinance No. 12918 states that each person or entity requesting approval, relief or other action from the City Commission or any of its boards, authorities, agencies, councils or committees regarding any issue, shall disclose at the commencement (or continuance) of the public hearing(s) on the issue, any consideration provided or committed, directly or on its behalf, for an agreement to support or withhold objection to the requested approval, relief or action. The Disclosure of Consideration Provided or Committed for Agreement to Support or Withhold Objection Affidavit included in this package must be submitted with the application. The applicant must, at the commencement of any public hearing on the issue, if there is any disclosure to report, read the disclosure into the record. Also, the applicant must supplement the affidavit if there is any new information or additional information to disclose.

This law firm Represents Glass House Productions and A. A. Holdings, LLC in relation to the captioned matter. Below are our responses to Section 305 of Zoning Ordinance No. 11000.

An operationaljbusiness plan that addresses hours of operation, number of employees, menu items, goals of business, and other operational characteristics pertinent to the application.

HOUSE is not just another nightclub or event space. It is truly a home, with kitchens as bar, showers as VIP and art that physically responds to people. The entire space is surrounded by 360 degrees of panoramic projections, 3D Architectural mapping, and holographic and fogscreen technology. HOUSE has technology that has never been used before in a nightclub environment. It is a revolutionary space, where everyone is welcome.

HOUSE will operate between the hours of 11:00 PM and 5:00 AM daily.

With many successful venues under our belt, including most recently, Living Room in Fort Lauderdale, we have a large and loyal clientele. There is already a tremendous amount of anticipation for HOUSE's opening. There will be a strict dress code, but our prices will be reasonable.

The intent is to expose people and bring business to this area. The target patron is aware and appreciates the arts. Planned art shows in the afternoons will give local artists the opportunity to showcase their work in a unique setting.

Lastly, we are working with our neighbors to improve and beautify the area by painting walls, pressure cleaning sidewalks, and adding landscaping.

A parking plan which fully describes where and how the parking is to be provided and utilized, e.g., valet, self-park, shared parking, after-hour metered spaces, and the manner in which the parking is to be managed. By Class II permit (in addition to the Class II permit required for the subject establishment), 100 percent of the required parking may be located offsite within a distance of 600 feet from the subject establishment if the proposed parking is to be II self-park,," and a distance of 1000 feet from the subject establishment if the proposed parking is to be by "valet".

The proposed parking plan is as follows:

1. Applicant will utilize the paved lot behind the building as valet which contains twenty-nine (29) spaces which are shown on the plan.

2. In addition they will also lease the paved lot directly across from building which has forty-three (43) spaces.

3. Finally, the Applicant intends to lease the three (3) acre lot on the west side of NW 1 st Avenue, which will provide approximately 300 additional parking spaces.

For establishments proposing capacities over 300 persons, an indoor/outdoor crowd control plan that addresses how large groups of people waiting to gain entry into the establishment, or already on the premises, will be controlled.

Our philosophy as a business has always been to get customers inside the venue in a quick and orderly fashion. We are in a warehouse district with no comforts or air conditioning for the patrons. It is not acceptable to leave patrons sitting outside in the sweltering heat ",.raiting endlessly to come- - - - - - - - - -inside. There will be sufficient security to property ID patrons and get them in promptly. Once inside, there will be sufficient amount of security to properly control the crowd and make sure that our patrons have a safe and positive experience. Our requirements at the door will be strictly enforced with dress code, etc.

A security plan for the establishment and any parking facility.

There will be two security guards checking ID at the front door. There will be additional security guard checking ID for VIP bottle service as well as security at the entrance/ exit doors. Because of the location on the boarder of Overtown and Wynwood, there will be security on all four of the block's

corners, as well as in the parking areas. Additionally, there will be at least one police detail patrolling the area in a golf cart. Inside the club itself, the security will be as follows:

• One guard at the base of the VIP section in the Steam Room • One guard at the bar and DJ Booth of the Steam Room • One guard at the entrance to the Main Room • One guard at the entrance to the restrooms • Guards on both sides of the Main Room VIP • One guard at the Media Room VIP • One guard at the Living Room VIP • One guard at the Patio entrance • One guard at the back exit • One guard at the patio exit • A mobile head of security will be roaming from room to room

There will be a minimum of 15-20 licensed and insured security guards on site, depending on the night and/ or event.

For establishments proposing capacities over 300 personst a traffic circulation analysis and plan that details the impact of projected traffic on the immediate neighborhood and how this impact is to be mitigated.

The club's maximum occupancy is 1,200 persons. The traffic circulation analysis is attached.

A sanitation plant which addresses on-site facilities as well as off-premises issues resulting from the operation of the establishment.

There will not be any service of foods, therefore the garbage produced will consist mostly of CUpSt napkins, and basic items. There will be one large dumpster in the back that will be changed weekly. AdditionallYt staff will clean any potential garbage from our patrons on the streets, etc.

Proximity of proposed establishment to residential uses.

The nearest residential use is at 1760 NW 1st Avenue, which is considerably more than two hundred feet (200') from the property.

HOUSE NIGHTCLUB PHILOSOPHY AND BUSINESS PLAN

HOUSE is a concept that has been a six year dream and vision. First and foremost, I am an artist and designer. I

have designed 13 nightclubs and lounges world-wide, most recently Living Room in Ft. Lauderdale. A'fter four

years of success it was time to move forward with HOUSE.

HOUSE is not just a nightclub or event space. It is truly a home, with kitchens as bars, VIP as showers, and art

that physically responds to you. The entire space is surrounded by 360 degree panoramic projections, 3D

before been used in a nightclub environment. This is a truly revolutionary space, where EVERYONE is

welcome.

After an exhaustive two-year search, and hundreds of spaces from Broward to Miami Beach, we are proud to

have chosen theSoWyn area of Miami. I believe so much in the future of this area and what it represents. We

will be the first true nightclub in the area. Many have called this a tremendous risk, or questioned the logic of

this decision. I truly believe wecan bring people to this area that may not be inclined to come here. I want to see

people in the streets outside ofthe ArtBasel and Art Walle events. I want a real neighborhood, and life here.

I am proud to say that our own little block has started painting, covering graffiti, and beautifying our corner. It's

exciting to see what a little bit of paint and hard work can do.

We have a large and loyal clientele, and there is a tremendous amount of anticipation for our opening. The

design will be beautiful and upscale. We will have a strict dress code, but believe in keeping prices reasonable

(it's a tough economy for every-one). The true intent is to expose people and bring business to this area. We

want a clientele who is aware and appreciates the arts. Not all upscale nightlife establishments need to be.on the

other side of the causeway.

We intend to incorporate art shows during the afternoons to give our local artists the opportunity to showcase

their work in a unique setting. We are doing everything we can to make the block more visually acceptable and

safe. We are painting the walls, pressure cleaning the sidewalks and adding grass and trees. We are working

with our neighbors (old and new) to beautify and improve the area. We wantto build a neighborhood.

More than anything please know that this is a passion project for us. We are not millionaires. We are struggling

like everyone else with a dream and vision. We have taken absolutely everything we have and put it into this

project. Even the smallest seed eventually produc€s a flower.

HOUSE NIGHTCLUB SECURITY/CROWD CONTROL PLAN

C. INDOOR OUTDOOR CROWD CONTROL: Based on our previous experience with other clubs we've

built and operated we propose the following-

Many nightlife establishments look to build and create lines to increase interest or give the illusion of being

busy. First and forerriost, we have no open businesses or residential neighbors in the vicinity. Our

philosophy as a business has always been to get customers inside the venue in a quick and orderly fashion.

We are in a warehouse district with no creature comforts or AC outside for our patrons. It isn't acceptable to

leave them sitting outside in the sweltering heat waiting endlessly to come in. We are very hopeful that we

can bring new life and clientele to an area that is currently deserted at night ( with the exception ofthe

homeless population). That being said, we will have sufficient security to properly ID guests and get them in

promptly.' Once inside, we again have the sufficient amount of security to properly control the crowd,

making sure our guests have a safe and positive experience. We want to try and bring a sophisticated

clientele to this area. Our requirements at the door will be strictly enforced with dress code etc. It's not about

whether people spend,5 dollars or 5,000 simply, that people took the time to get dressed to come out. We

have signed a 20 year lease, so our intention is to be here for the long haul. We will never be the club that

opens for the sake of opening just for short term gain. Those are the people who come to an area with no - .

regard whatsoever for the safety and quality of their business or guests.

D. SECURITY PLAN: Our security plan will be as follows. We will have two security checking ID at the

front door. We will have an additional security guard checking ID for VIP bottle service as well as security

at the entrance/exitdoor. Because of our location on the border of OvertownlWynwood we will have

security on all four block corners, as well as in the parking areas themselves. If we were to have one incident

of vandalism, assault, or theft it could absolutely destroy us as a venue. We recognize that the area is still up

and coming, and that safety and security is paramount. Additionally, we will have at least one police detail

in a golf cart. In the club itself the security will be divided as follows. 1. Guard at base of VIP in Steam

Room 2. Guard at bar and dj booth of Steam Room. 3. Guard at entrance to Main Room 4. Guard at entrance

of restrooms 5. Guards on both sides of Main Room VIP 6. Guard at Media Room VIP 7. Guard at Living

Room VIP 8. Guard at patio entrance 9. Guard at back exit 10. Guard at patio exit 11. Head of security

mobile( roaming from room to room). We will have a minimum of 15-20 licensed and insured security

F. Sanitation plan: We are onl~ opening two nights a week for a minimum of the first month. We do not

serve food so our garbage is cups, napkins, and basic items. We will have one large dumpster in the back

that will be changed weekly. Additionally, our porters and staff will clean any potential garbage from our

patrons on the street etc. As we progress into more nights and/or events we will increase proportionately.

Executive Summary

This report is being prepared to evaluate the traffic generation for the subject project. The

subject site is located at 1915 NW Miami Court in the City of Miami, Florida. This site currently

has a Warehouse (General Heavy Industrial) with 7,669 Square Feet (SF) and is planned to be

converted into a Nightclub (Drinking Place) with 9,245 SF including an outdoor patio.

The trip generation characteristics were obtained from ITE's Trip Generation Manual, 9th

Edition. Since ITE does not have data for Nightclub, Land Use (LU) 925: Drinking Place was

utilized to estimate the trip generation for the proposed use. Please note that LU 925 most

closely resembles the characteristics for the subject project.

The Trip Generation calculations were performed for the AM and PM peak hour. The AM peak

hour calculations resulted in negative net vehicle trips since the existing use is currently

generating more vehicle trips than the proposed use. The PM peak hour yielded 9 net vehicle

trips of which 7 vehicles are entering and 2 vehicles will exit the site. Please note the PM peak

hour gross vehicle trips were distributed to the project's driveways consistent with the

resulting distribution percentages of TAZ 494. The corresponding traffic distribution

percentages were determined by interpolating between the 2005 TAZ and 2035 TAZ data for the

design year of 2014.

Based on the trip generation and trip distribution results, the subject project will have no traffic

impact during the AM peak hour and a "De Minimus" impact during PM peak hour. Therefore,

no further traffic analysis is recommended.

Introduction

The purpose of this study is to estimate the vehicle trips generated by the proposed project and

to compare them with the vehicle trips of the existing use. The subject site is located at 1915 NW

Miami Court in the City of Miami, Florida. This site currently has a Warehouse (General Heavy

Industrial) and is planned to be converted into a Nightclub (Drinking Place) with an outdoor

patio. In addition, this report has identified the Traffic Analysis Zone (TAZ) for the subject

project which was utilized to distribute the proposed project traffic and driveway assignments.

Lastly, this report follows the methodologies adopted by the Institute of Transportation

Engineer's (ITE) Trip Generation and has evaluated the following:

• AM Peak Hour Trip Generation

• PM Peak Hour Trip Generation

• Driveway Vehicle Trips

Project Description / Location

The subject site is located on the east side ofNW Miami Court just north ofNW 19th Street at the

address 1915 NW Miami Court in the City of Miami, Florida. As previously mentioned this site

currently has a Warehouse (General Heavy Industrial) and is planned to be converted into a

Nightclub (Drinking Place) with an outdoor patio. The following land uses, as identified by the

Institute of Transportation Engineers (ITE), most closely resemble the existing and proposed

uses. These land use (LU) are as follows:

Proposed Use

• Land Use 925: Drinking Place with 9,245 Square Feet

The subject project will maintain the two (2) existing driveways; one at North Miami Avenue

and one at NW 19th Street. Figure 1 below depicts the location map of the subject project.

Figure 2 is the site plan provided for illustrative purposes only.

Trip Generation

The trip generation characteristics were obtained from ITE's Trip Generation Manual, 9th

Edition. Since ITE does not have data for Nightclub, Land Use (LU) 925: Drinking Place was

utilized to estimate the trip generation for the proposed use. Please note that LU 925 most

closely resembles the characteristics for the subject project.

The Trip Generation calculations were performed for the AM and PM peak

hour. The AM peak hour calculations resulted in negative net vehicle trips

since the existing use is currently generating more vehicle trips than the

proposed use. The PM peak hour yielded 9 net vehicle trips of which 7

vehicles are entering and 2 vehicles will exit the site. Please note the

Nightclub is planned to open doors at 10 PM and therefore, no visitors are

expected within the AM or PM peak hour. However, we have developed a reasonable trip

generation rate to account for any staff that may arrive to the site within the PM Peak hour, as a

conservative approach. The trip generation rate was developed utilizing the ITE PM peak hour

of generator to peak hour ratio of 0.10 from LU 925. The ITE rates and percentages for the AM

and PM peak hour are included in Appendix A. Table 1 below summarizes the Trip Generation

results for the AM and PM peak hour.

Trip Distribution/Assignment

The Traffic Analysis Zone (TAZ) for the subject project is TAZ 494 as assigned by the

Metropolitan Planning Organization's (MPO) on the Miami-Dade Transportation Plan (to the

Year 2035) Directional Trips Distribution Report, October 2009. The corresponding traffic

distribution percentages were determined by interpolating between the 2005 TAZ and 2035

TAZ data for the design year of 2014. Please note the PM peak hour gross vehicle trips were

distributed to the project's driveways consistent with the resulting distribution percentages of

TAZ 494. Figure 3 below depicts the TAZ map.

The corresponding traffic distribution being assigned to the eight (8) cardinal directions are

outlined in Table 2 below. Again this TAZ distribution is based on interpolation of the 2005 and

2035 Directional Trip Distribution Report from the Miami-Dade 2035 Long Range

Transportation Plan for the design year of 2014. Appendix B includes a TAZ Map and the

corresponding Directional Distribution Summary for this zone.

Project Traffic Assignments . The PM peak hour gross vehicle trips have been further distributed into the four quadrants.

Table 3 includes the traffic distribution with the corresponding assignments while Figure 4 is

the ingress and egress traffic distribution with the corresponding assignments to the North,

South, East and West for the PM peak hour trips. Lastly, Figure 5 includes the gross site traffic

assigned to the project driveways for the PM peak hour.
