-------------------------------------------------------------------------------------CORAM : B. P. PATIL, ACTING CHAIRMANDATE : 19.11.2019ORAL ORDER :
Heard Shri K.B. Jadhav, learned Advocate for the
applicant and Shri M.S. Mahajan, learned Chief
Presenting Officer for the respondents.
2. The applicant has challenged the order dated
06.11.2019 relieving him from the establishment of
Police Training Centre, Jalna on 20.11.2019.
3. Learned Advocate for the applicant has
submitted that the applicant has been transferred on
the establishment of Police Training Centre, Jalna in
the year 2014 and he has been appointed by the
respondent No. 7. He has submitted that without any
reason, the respondent No. 6 issued the order dated
06.11.2019 and directed to relieve him on 20.11.2019.
He has submitted that the impugned order is not legal
one and therefore, he has prayed to grant interim relief
in favour of the applicant.
4. Learned C.P.O. has submitted that the applicant
has been deputed on the establishment of Police
Training Centre, Jalna in the year 2014 and after
completion of his deputation period, he has been
directed to relieve. He has submitted that there is no
//2// O.A. No. 1015/2019
illegality in the impugned order and therefore, he
supported the same.
5. On perusal of the record, it reveals that the
applicant has been appointed by the respondent No. 7
on his establishment by the appointment order dated
11.10.2007 and accordingly he joined the
establishment of respondent No. 7. By the order dated
12.11.2014 and as per the approval given by the
Special Inspector General of Police, State Reserve
Police Force, Nagpur, the applicant has been deputed
on the establishment of respondent No. 6. Prima-facie,
it seems that the respondent No. 6 is intending to
relieve the applicant on completion of his deputation
period and accordingly, he has issued the impugned
order dated 06.11.2019. Prima-facie, it seems that
there is no illegality in the impugned order and
therefore, in my view, it is not a fit case to grant
interim relief in favour of the applicant. Hence, the
interim relief as prayed for by the applicant is hereby
rejected.
6. Issue notices to the respondents, returnable on
17.12.2019.
7. Tribunal may take the case for final disposal at
once and separate notice for final disposal shall not be
issued.
8. Applicant is authorized and directed to serve on
respondent/s intimation/notice of date of hearing duly
//3// O.A. No. 1015/2019

3. Learned Advocate for the applicant has
submitted that the applicant has been transferred on
