The Georgia Composite Medical Board (GCMB) held its regular meeting on June 13, 2019, at 2 Peachtree Street, Atlanta, GA 30303, to consider Medical Board matters.

CALL TO ORDER Dr. Retterbush called the meeting of the Georgia Composite Medical Board to order at 7:30 a.m. AGENDA AND MINUTES Dr. DeLoach submitted a motion, seconded by Dr. Harbin to approve the agenda of the June 13, 2019 meeting. The motion carried unanimously. Dr. Weil made a motion to approve the minutes of the May 2-3, 2019 meeting. Dr. Collins seconded the motion and it carried unanimously. WELCOME TO NEW BOARD MEMBER The Board members welcomed Dr. Norman to the Board. Dr. Norman gave a summary of his background. ELECTIONS The Nominating Committee nominated Gretchen Collins, MD, as Chair and Barby Simmons, DO, Vice chair. Dr. Retterbush asked if there were any nomination from the floor. Hearing none, Motion Dr. Weil, seconded Dr. Gross and motion carried to accept the nominations. Let the record show that no one opposed. EXECUTIVE DIRECTOR’S REPORT Ms. Hughes made the following report:

1. Letter from YWCA Sharmen Gowens and Helen Robinson with recommendations to the Rules/Website regarding physicians for sexual misconduct. The Board referred to the Rules Committee for consideration.

2. Michael Hyde – Corporate Practice of Medicine. There are no laws or rules on this matter.

3. Victoria Ceh, regarding a lawsuit regarding delegation of a surgical hair restoration procedure to unlicensed and unqualified techs. The Board accepted information.

4. Shelia Pierce, GA PDMP, regarding a grant and updates. The Board accepted as information.

5. Texas A&M Rural and Community Health Institute Assessments of Physicians or Physician Assistants. The Board accepted as information.

6. Brent Reece, is the prostate is considered genitalia as defined in Rule 360-3-02(12)? If so does a female physician must have a male chaperone present during the examination? The Board considers the prostate to be a part of the genitalia and requires a chaperone.

7. Seeking board approval for a new Lenis Device. The Board does not approve devices.

8. Department of Audit the Board accepted as information a letter that stated that the Board’s audit is being delayed.

9. Article “Physician Impairment and Rehabilitation: Reintegration into Medical Practice,: the Board accepted as information.

10. Assistant Physician Task Force from MAG – seeking the Board’s support of possible legislation for Assistant Physician licensure. The Board tabled for further consideration.

Dr. Antalis motioned to go into closed session Dr. Harbin seconded the motion and it carried unanimously PUBLIC OUTREACH COMMITTEE Mr. Law presented an update on some observations from other states on complaints, the website and other information. The Committee will continue to meet and come up with some suggestions. RULES HEARING Dr. Gross convened the Public Hearing concerning the following proposed Rules amendments:

Rule 360-3-.06 360 Pain Management Clinic-Minimum Clinical Examination Standard Dr. Gross asked if anyone was present to address the Board on the posted Rule with amendments. Dr. Gross made a motion to approve Rule 360-3-.06 360 Pain Management Clinic. That the Board find the formulation and adoption of these rules do not impose excessive regulatory cost on any licensee and any cost to comply with the rule cannot be reduced by a less expensive alternative that fully accomplishes the objectives of the applicable laws; that the Board finds that it is legal or feasible to meet the objectives of the applicable laws to adopt or implement differing actions for businesses as listed in O.C.G.A. 50-13-4(A) (3)(A),(B),(C), and (D). Dr. Weil seconded the motion and it carried unanimously. Rule 360-3-.02(3)(a) Unprofessional Conduct. Dr. Gross asked if anyone was present to address the Board on the posted Rule with amendments. Dr. Gross made a motion to approve Rule 360-3-.02(3)(a) Unprofessional Conduct. That the Board find the formulation and adoption of these rules do not impose excessive regulatory cost on any licensee and any cost to comply with the rule cannot be reduced by a less expensive alternative that fully accomplishes the objectives of the applicable laws; that the Board finds that it is legal or feasible to meet the objectives of the applicable laws to adopt or implement differing actions for businesses as listed in O.C.G.A. 50-13-4(A) (3)(A),(B),(C), and (D). Dr. Weil seconded the motion and motion carried with Dr. Antalis opposing. Rule 360-32-.05 “Additional Requirements Regarding Physician Delegation to an APRN” Dr. Gross asked if anyone was present to address the Board on the posted Rule with amendments. Dr. Gross made a motion to approve Rule 360-32-.05 “Additional Requirements Regarding Physician Delegation to an APRN” That the Board find the formulation and adoption of these rules do not impose excessive regulatory cost on any licensee and any cost to comply with the rule cannot be reduced by a less expensive alternative that fully accomplishes the objectives of the applicable laws; that the Board finds that it is legal or feasible to meet the objectives of the applicable laws to adopt or implement differing actions for businesses as listed in O.C.G.A. 50-13-4(A) (3)(A),(B),(C), and (D). Dr. Weil seconded the motion and it carried unanimously. Rule 360-36-.04 “Low THC Oil”

Dr. Gross asked if anyone was present to address the Board on the posted Rule with amendments. Dr. Gross made a motion to approve Rule 360-36-.04 “Low THC Oil” That the Board find the formulation and adoption of these rules do not impose excessive regulatory cost on any licensee and any cost to comply with the rule cannot be reduced by a less expensive alternative that fully accomplishes the objectives of the applicable laws; that the Board finds that it is not legal or feasible to meet the objectives of the applicable laws to adopt or implement differing actions for businesses as listed in O.C.G.A. 50-13-4(A) (3)(A),(B),(C), and (D). Dr. Weil seconded the motion and it carried unanimously. CLOSED SESSION Dr. DeLoach motioned seconded by Dr. Robinson to go into closed session to discuss investigations and disciplinary matters, and it carried unanimously. OPEN SESSION Dr. Retterbush declared open session. ATTORNEY GENERAL (AG) Max Changus, Assistant Attorney General presented the Attorney General Status Report; Dr. Harbin submitted a motion, seconded by Dr. Reisman to accept the report as information. The motion carried unanimously. RECESS Dr. Retterbush declared the meeting in recess for holding committee meetings RECONVENE Dr. Retterbush reconvened the meeting at 1:30 p.m. APPEARANCE BEFORE THE BOARD Joel Buring, M.D. requested an appearance before the Board for denial of his licensure application. Who can perform "laser" fat reduction (cryolipolysis and cavitation) and cosmetic procedures using radiofrequency, ultrasound, microwave, and other non-light based energy emitting devices? Under Georgia law, these procedures may be performed by a physician, a physician assistant with an approved additional duty request, or an APRN as part of an approved nurse protocol agreement. These procedures are considered the practice of medicine and cannot be delegated to unlicensed individuals such as medical assistants. The Cosmetic Laser License does not provide actual authority under the law to use these devices, and recommends that at the very minimum, a physician be physically present on site when these devices are being utilized by licensees. Injuries caused by use of these devices in these circumstances may constitute practice below minimum standards.
