1. Whereas, the Shiroda Sahakari Dudh Vya. Saunstha Maryadit Shiroda,.Ponda-Goa was registered on 16-3-1968 under Section 9 of the Maharashtra Co-op. Societies Act, 1960 as in force in the State of Goa (hereinafter referred to as the "said Act") and the Co-op. Societies Rules, 1962 (hereinafter referred to as the "said Rules") under Code Symbol No. PRD-(Cl-59/ /Goa and was classified as "Producers Society" and sub-classified as '~gricultural Producers Society" under sub-classification (C) Of., Clause 7 of Rule 9 of the said Rules to fulfil the objects as enshrined in Bye-laws No. 1.2 of the Bye-laws of the Society.

2. And whereas, as per Bye-law No. 5.1(a), the Management of the S~ciety is consist of 9 elected members of which 1/3niember will retire every year. The vacancies so caused are to be published on the notice board of the S'o~iety and be filled in by Election as required under Electioll Rules appended to the Bye-laws. .

3) And whereas, neither the names of retired Managing Committee Members nor the election prograrmne was declared by the Management of the Society as required under election rules of the society.

4. And whereas, the election held on 21-10-2001 for election of 3 members on the Managing Committee was declared improper by 'the Asstt. Registrar of Co-op. Societies (Dairy).vide order dated 12-2-2002 in the case No. ARCS/Dairy/ABN-24/2001.

5 .. And whereas, the Society declared six Managing Committee members elected in the Annual Generai Body Meeting 'held on 14-11-2002 without incorporating subject in the Agenda of the Notice of the Annual General Body Meeting and without following proper procedure for election as required under its Bye-laws and Election Rules and thus the election held for six Managing Committee members is illegal and without imy locusstandy.

6. And whereas, it is pertinent to be mentioned here that as on date there remain only 3 elected members on the MaIlaging Committee to manage the affairs of the Society and in absence of full fledge Committee, the affairs of the Society cannot be carried out and looked after by the duly elected managiIlg committee in terms of its Bye-laws and the Asstt. Registrar of Co-op. Societies (Dairy), Ponda has requested to tai<e further necessary action in the matter.

7. And whereas, the undersigned is of the opinion that a situation has arisen that the Management of the Society is likely to be rendered ineffective, undemocratic and illegal. Similarly, it's functioning is also likely to be affected subsequently thereby causing hardship to the producer members and it is expedient that immediate action is reqUired to be taken in terms of provisioQ.s of clause (e) of sub-section (1) of Section 77 A of the Maharashtra Co-op. Societies Act, 1960 as in force in this State and satisfied that it is not reasonably practical to publish a notice as contemplated in the first proviso to Section 77 A (1) of the aforesaid Act, I, P. K. Patidar, Registrar of Co-op. Societies, Goa, therefore, in exercise of the power vested under Section 77 A of the said Act pass the following Order:-
