SEBI has clari�ied that -• An investor may authenticate and complete the process of performing KYC by way of

electronic/digital signature including Aadhaar e-Sign, except for the documents mentioned inthe First Schedule of the Information Technology Act 2000.

• In case of non-individual clients, intermediaries may take caution and satisfy themselvesregarding the genuineness of the authorization and identity of the authorized signatories.

• With regard to requirement of geo-tagging in India, it is reiterated that while completing theinvestor’s KYC through KYC app of the intermediary, the SEBI Registered Intermediary shallcontinue to ensure the requirement of geo-tagging with the investor’s physical location in India.

Investors opening new demat account(s) on or after October 01, 2021, shall have the choice ofproviding nomination or opting out nomination. Further, all existing demat account holders shallprovide choice of nomination on or before March 31, 2022, failing which the trading accounts shallbe frozen for trading and demat account shall be frozen for debits.

• In this regard, a new value of ‘No Nomination’ is introduced i.e. ‘O’ - Opt out of Nomination.

• Earlier, the �ield 'No Nomination' had values 'Y' denoting that nomination is not opted and thevalue 'N' denoting that nomination is opted.

• Now, all new accounts which are being opened can have only two values in the �ield 'No

Nomination' i.e. 'N' denoting that nomination is opted or 'O' denoting that the client has optedout of nomination.

3. Operational guidelines w.r.t. nomination for demat accounts • Participant shall generate the demat request on the basis of Letter of Con�irmation andforward the same to the Issuer Company/RTA for processing the demat request.

• In case the investor does not submit the demat request within the aforesaid period, RTA /Issuer Company shall credit the securities to the Suspense Escrow Demat Account of theCompany.

4. Issuance of Securities in dematerialized form in case of Investor Service Requests

SEBI has directed that listed companies shall henceforth issue the securities in dematerializedform only while processing the following service requests submitted by investors –

i. Issue of duplicate securities certi�icateii. Claim from Unclaimed Suspense Accountiii. Renewal / Exchange of securities certi�icateiv. Endorsementv. Sub-division / Splitting of securities certi�icatevi. Consolidation of securities certi�icates/foliosvii. Transmissionviii. Transposition

• The securities holder/claimant shall submit duly �illed up request form for any of theabove-mentioned purposes in prescribed format (Form ISR – 4 – which can be found on thewebsite of the Issuer Companies and the RTAs).

• The RTA / Issuer Companies shall verify and process the service requests and thereafter issuea ‘Letter of con�irmation’ in lieu of physical securities certi�icate(s).

• The ‘Letter of Con�irmation’ shall be valid for a period of 120 days from the date of its issuance,within which investor should submit a request to Depository Participant for dematerializingthe said securities.

NSDL has introduced an online facility for Clients to nominate in their demat account or opt-out ofnomination. Participants of such Clients will be able to verify the declaration form with demataccount and submit their con�irmation/rejection. After con�irmation by the Participant, the demat

account of the Client will be updated in the NSDL Depository System.

Participants can subscribe for DPM Plus (include online nomination) by sending a request to

NSDL at NSDLDepository-Products@nsdl.co.in for more information on activation, charges etc.

5. DPM Plus enhanced – Online Facility for Clients to nominate or opt-out of nomination

Participants are requested to note that the last date for submission of networth certi�icate/ audited�inancial statements for the �inancial year 2020-21 is extended to February 15, 2022. Accordingly,Participants are requested to ensure that they submit the audited �inancial statements andnetworth certi�icate in the prescribed format, on or before February 15, 2022.

6. Extension of time for submission of networth certi�icate and audited �inancial statements

Participants are advised to encourage their clients to lodge their complaints through onlinemechanisms more speci�ically through SCORES portal and SCORES mobile application for effectiveredressal of grievances. The clients can also lodge complaints directly with depository / depositoryparticipant through link / option available on their website.

SEBI has approved the framework for Gold Exchange and SEBI (Vault Managers) Regulations, 2021.Government of India has declared “electronic gold receipts” as ‘securities’ paving the way foroperationalizing of Gold Exchange. The stock exchange/s desirous of trading in electronic goldreceipts (EGRs) may apply to SEBI for approval of trading of EGRs in new segment.

8. Framework for operationalizing the Gold Exchange in India

NSDL Business Rule 23 has been amended with respect to transfer of depository business.Participants are requested to make note of the same.

9. Amendments to Business Rules

Participants are requested to display prescribed advisory on their website to create awarenessabout the update of certain KYC attributes namely Name, address, PAN, mobile number, email IDand Income Range.

Participants are advised to take all possible measures so that the client accounts are compliantbefore March 31, 2022.

10. Mandatory update of certain attributes of KYC of clients

NSDL’s Mobile Application Speede has been enhanced to facilitate Users to redeem mutual fundunits held in their demat account.
