He was obviously drunk and yelling something about “worthless dope,” but Curtis didn’t know what he was talking about. He had never seen Orville Wright before, nor had he ever sold dope to Wright or to anyone else. When he came at Curtis with a tire iron, Curtis dodged and Orville Wright slid in the gravel, falling to the ground. He must have hurt the side of his knee because he got up rubbing it, but he came at Curtis again. By this time, though, Curtis had gotten to his car and retrieved the gun he keeps in the glove compartment. He fired once, and Orville fell back against the car. Curtis then fled because he was scared. He gave the gun to a friend of his, who still has it. Further information: A. The Medical Examiner’s report shows: 1. Case Facts

Orville Wright was shot once fatally in the chest in the parking lot of a tavern known as

December 8 of last year. The only occurrence witness the State will call says she saw our client

shoot her husband during the course of a verbal argument.

Curtis Mayfield tells you that when he left the bar, some guy was waiting for him in the

parking lot. He was obviously drunk and yelling something about “worthless dope,” but Curtis

didn’t know what he was talking about. He had never seen Orville Wright before, nor had he

ever sold dope to Wright or to anyone else. When he came at Curtis with a tire iron, Curtis

dodged and Orville Wright slid in the gravel, falling to the ground. He must have hurt the side

of his knee because he got up rubbing it, but he came at Curtis again. By this time, though,

Curtis had gotten to his car and retrieved the gun he keeps in the glove compartment. He fired

INFORMATION

Now comes the People of the State of Illinois by the State’s Attorney and informs

this Court that on or about December 8, the defendant committed the offense of

Count I

FIRST DEGREE MURDER, in that said defendant, without lawful justification

and with the intent to kill or do great bodily harm to Orville Wright, shot Orville Wright

with a handgun, causing the death of Orville Wright.

Count II

FIRST DEGREE MURDER, in that said defendant, shot Orville Wright with a

handgun, knowing such act created a strong probability of great bodily harm to Orville

Wright thereby causing the death of Orville Wright.

Count III

FIRST DEGREE MURDER, in that said defendant, without lawful justification,

shot Orville Wright with a handgun, knowing such act created a strong probability of death

or great bodily harm to Orville Wright, thereby causing the death of Orville Wright.

Part I

Here you are to cross-examine Detective F. Kerwin in a motion to quash the arrest and suppress evidence. The detective claims Mayfield accompanied them voluntarily to the police station to answer questions. Initially denying he knew anything about the incident, Mayfield eventually admitted the shooting, though he claimed self-defense. Only after this oral statement, according to Det. Kerwin, was he arrested.

Impeach Det. Kerwin with his reports (attached).

Part II Cross of Amelia Cotton Wright. Amelia has testified that she heard Curtis say that he was going to kill Orville and she saw Curtis punch Orville, knocking him to the ground, before Curtis shot Orville.

Impeach her with the police report (attached).

Part III Cross-examine Det. Kerwin on Mayfield’s oral statement. Mayfield will testify. The defense theory is self-defense. Additional fact: Det. Kerwin’s partner for the last five years has been Joseph Cotton. He was “kept out” of this case because Amelia Cotton is his sister. You will hear his direct testimony in court.

Part IV

Cross-examine Amelia. She has filed a wrongful death case against Curtis. The year before this incident occurred, he received a substantial settlement from the police department. He’d been wounded by the police following a traffic stop. The officer panicked when Curtis was producing his driver’s license and shot Curtis. You accuse Amelia of embellishing her testimony of the struggle outside the bar to bolster her claim that Curtis was the aggressor. If Curtis’ self-defense is successful, Amelia’s dreams of a big payday could disappear.

Witness: Wright, Amelia Cotton (married to victim for one week), 3846 W. Kittyhawk, F, B, DOB 6/14/83 (34), 848-9217.

Witness Amelia Cotton Wright related in summary but not verbatim as follows: she and victim came out, he said a person he wanted to talk to(known to him as "Snake") was in there and would be out soon because the bar was closing.

Victim exited the vehicle when offender came out. Witness could not hear what was said but she could tell they were arguing because theywere standing in front of the car speaking in loud voices. Offender pulled a revolver from his jacket pocket and fired, hitting victim in the chestVictim fell back against the car. Offender then fled wib on Wallingford in his own car.

Witness to her knowledge has nat seen Offender prior to this date but will try to identify him when an arrest is made.

information developed that the wanted offender in the 08 Dec shooting death of Orville Wright might be Curtis Mayfield. Witness Amelia CottonWright was shown an array of five photos on 14 Dec andsaid Curtis Ma~eld looked like the offender but would have to see him in person to besure.

On 15 Dec subject was visited at his home and voluntarily agreed to acompany R/Os to Area 6 to answer questions concerning the incidentunder investigation. He initially denied any participation at ail and RtOs left him alone to give him time to collect his thoughts. At noon he askedto talk to us further and we took him from the lockup to an interview room, again advised him of his rights, and asked him if he now recalledwhat happened. Subject admitted shooting the victim but claimed the victim was waiting for him in the parking lot when he came out of thetavern and came at him with a tire iron. Subject says he was able to get his gun from the glove compartment of his car and shoot the victimounce in the chest.

This start' is not corroborated by occurrence witness Amelia Cotton and there was no tire iron found at the scene.

Line up: At 1400 hours subject was placed in a line-up which was viewed by witness Amelia Cotton through one-way glass. She identified CurtisMayfield as the shooter of Orville Wright.

Q: Please state your name? A: Amelia Cotton Wright. Q: Where do you live? A: 3846 W. Kittyhawk. Q: Are you employed? A: Not right now. Q: Calling attention to approximately 2:00 AM of last December 8th, where were

you? A: I was with my husband, Orville Wright. Q: Where was that? A; We were in the parking lot of Sam’s Tavern. Q: Why were you there? A: We were going to pick up some wine for a party we were going to. Q; What if anything unusual happened while you were there? A: My husband went into the bar for the wine and when he got back to the car he

was waiting for someone who was still in the bar. Q: Did someone come out of the bar? A: Yes. Q: Do you see that person in the courtroom today?

A: Yes, he’s right over there (pointing to Curtis Mayfield). Q: What happened when that person left the bar? A: My husband got out of the car and the two of them began arguing. Q: Did you hear what they said? A: Not much. They were yelling at each other but I did hear that man say that he

was going to kill Orville. Q: What happened after he said that? A: That man hit Orville and Orville fell to the ground. Then the man ran to his car,

came back with a gun, and shot Orville. Q: What happened then? A: Orville fell back against our car and the man drove off.

Part III Detective Kerwin Cross - Mayfield Statement

. . . Q: And what did you do when you arrived at Area 6? A: We went to an interview room where we again advised him of his rights. Q: What did he tell you at that time? A: Well, at first he said he didn’t know anything about the incident, but he couldn’t

remember where he was when it happened, either. Q: What happened next? A: We took him to a room where he could lie down, maybe get some sleep if he wanted to,

have a chance to get his thoughts together. Q: Did you have occasion to speak to him again later? A: Yes. At about 11:30, one of the other officers – Officer Rudolph, I think it was – called

me to say that Mr. Mayfield wanted to talk to me. Q: And what did you do? A: I brought him back to the interview room and asked him if he remembered any better

now. Q: What did he say? A: He said he did. And he said that he was in fact the person who had shot Orville Wright

in the parking lot of Sam’s tavern on the night of the 8th, the morning of the 8th. Q: Did the defendant say he knew Orville Wright? A: Yes, he did. He said he’d had some previous dealings with him but he didn’t go into any

detail.

Q: Where did he say he first saw Orville Wright on the morning of December 8? A: He said he was in the bar having a drink when Orville came in to get a carry-out. Orville

wanted to speak with him and he, Curtis Mayfield, told him to wait in the parking lot, that he’d be right out.

Q: Did the defendant say what happened next? A: Yes. He said he finished his drink and went out to the parking lot. He went directly to

his car and got his gun. Q: What happened then? A: According to the defendant, Orville Wright walked over to him and defendant raised his

revolver and shot him once right in the chest. Q: Did the defendant say Orville Wright had anything in his hand? A: I think he said he was holding a tire iron. Q: Did he say what he did after he shot Orville Wright? A: Yes. He said he jumped in his car and drove off.
