In a written reply to the P2 NL CORRESPONDENT SRINAGAR, JULY 18 Tensions further escalated along Line of Control (LoC) as an army soldier was killed in fresh ceasefire violations by Pakistan in Nowgam sector of Kashmir's Kupwara district on Tuesday. Sources said the soldier belonging to 17 Infantry Brigade was killed when a sniper fired by Pakistani troops hit him at Sangam post in Nowgam sector along the LoC. "Heavy firing and shelling were going on in the area as Indian troops were retaliating with heavy weapons on Pakistani posts," they said. This was the second incident of a soldier's death in cross- border firing in as many days. On Monday, a trooper and a 9-year-old girl were killed in Pakistani shelling at forward posts and civilian areas in Rajouri district. Last week, two army men were killed after they were hit by sniper fire from Pakistan side near Furkian Gali in Keran sector of Kupwara district. Earlier in the day, Pakistani army resorted to indiscriminate shelling and firing along the LoC in Poonch district and Rajouri's Nowshera sector. An army personnel was injured in shelling from across the border in Mendhar area of Poonch. An official said that Lance Naik Navjot Singh of 581 Artillery regiment was hit by splinters in his eye at Sabra Gali in Mendhar sector. In a major rescue operation launched by the District Administration and Police 217 students and around 15 teachers were rescued from three schools in the wake of heavy mortar shelling along LoC in Nowshera sub- division of district Rajouri. The students of three schools were trapped for more than 6 hours amid heavy shelling in the area. In Middle School Kaladi 12 trapped students were evacuated. After hectic efforts in a prolonged rescue operation 150 students held up at Govt High School Bhawani were shifted to Nowshera. Likewise 55 students and teachers of Govt High School Sair were rescued amid heavy shelling. Sair school was badly damaged due to shelling. Following heavy shelling in the area, all schools in Nowshera and Manjakote sector have been closed till further orders. Sources said the JKCA office bearers were scheduled to hold a meeting on Tuesday about electing new cricketing body as the incumbent office bearers completed their term on July 18 . Javaid Ahmad, Vice Chairman of the JKCA for Kashmir province, said the new body will be elected once the amendments are made into the cricketing body rules as per the Supreme Court guidelines. "Imran Raza Ansari will continue to be its president while Iqbal Ahmad Shah as its General Secretary till new body is elected," he said. In June 2015, Farooq Abdullah was replaced by Imran Raza Ansari as the president of Jammu and Kashmir Cricket Association. It ended the dominance of National Conference patron on the state's cricketing body, who was the head of JKCA since 1980. After two years, there is now infighting within the ruling PDP leaders, who are eying on JKCA's president's post and appoint their confidantes as its office bearers. PDP leader, Mehboob Iqbal, who is JKCA chairman is keen to wrest full control on the cricketing body from minister for Youth Services and Sports Imran Raza Ansari citing the Supreme Court ruling. It has been learnt that a group of people is supporting Mehboob while another group is with Ansari. Sources said the Major posted in Kamalote area suffered fatal wound when a jawan fired from AK-47 rifle from behind around midnight. It is learnt that the major scolded the jawan over use of mobile phone. "The jawan was found by officer using the phone during the duty. The officer warned him and tried to confiscate the phone. During the process, the mobile screen broke over which an argument took place." Srinagar-based defence spokesman Col Rajesh Kalia termed the incident as unfortunate. "In an unfortunate incident that occurred at one of the forward posts in Uri sector along LoC, an Army officer was killed in the firing by one of the Army jawans. The officer succumbed to his injuries on the spot. Further investigations by the Army and the police are underway," the spokesman said. Rekha Devi (19), a class 12 student, and Mohammad Sarif (35) were swept away at Pachond nallah in Latti tehsil of the district when they were crossing the nallah this morning, police officials said. Despite efforts by police and locals, both are still untraced and a search was on till last reports came in, he said. (AGENCIES) NL CORRESPONDENT SRINAGAR, JULY 18 Opposition National Conference on Tuesday expressed serious concern over the decision of the Central Government to not file a written response to the Public Interest Litigation (PIL) filed in the Supreme Court challenging Article 35-A of the Constitution of India. Article 35A of the Constitution of India empowers the Legislature of Jammu and Kashmir to define 'Permanent Residents' of the State and subsequently empowers the Legislature to provide special rights and privileges to those permanent residents. In a statement, senior NC leaders Ali Muhammad Sagar, Abdul Rahim Rather, Muhammad Shafi Uri, Nasir Aslam Wani and Devender Singh Rana have said the Central government's decision to remain ambiguous on the very sensitive issue indicated a political intention to support and patronise those forces that want to use the judicial route to launch an assault on Article 35-A and Article 370 of the Constitution of India. "It is the responsibility of the Central government and the Attorney General to respond to such PIL in a transparent, unambiguous and unequivocal manner and that has clearly not happened," the NC leaders said. "The decision of the Attorney General to not file a written counter-response to the PIL before it was referred to the three-judge bench of the Supreme Court has raised many red flags and yet again points towards the fact that the powers that be in New Delhi are patronising and supporting such moves to question Jammu and Kashmir's special status and State Subject Law. Two suspected militants were killed in the operation, while two to three others are believed to be trapped. The encounter is still under way, reports said. Three weapons have also been recovered. An official said that a group of six militants at around11:30 pm tried to sneak into this side of LoC. Surinder Singh, Passenger Tax & Electricity P2 Transfer & postings in Judiciary NL CORRESPONDENT NEW DELHI, JULY 18 A proposal to procure 1.86 lakh bullet proof jackets for the armed forces is in progress, the government told Rajya Sabha on Tuesday, amid rising incidents of cross-border attacks on security forces along the Line of Control in Jammu and Kashmir. Minister of State for defence Subhash Bhamre, replying to a question, said that 50,000 such jackets have already been delivered to the Army. “A proposal for procuring 1,86,138 bullet proof jackets (BPJ) is in progress,” he said, adding that the Defence Research and Development Organisation (DRDO) is engaged in the project. “In addition, 12 Indian companies have been issued industrial licenses for the manufacture of BPJs,” he said. The Army has been pressing the government to procure the bullet proof jackets as soon as possible. The minister, to a separate question, said 297 army personnel were killed and 336 were injured while on duty between 2014 to 2016. Thirty personnel from Indian Air Force have also laid down their lives during the period. A proposal to procure 1.86 lakhbullet proof jackets for the armedforces is in progress, the governmenttold Rajya Sabha on Tuesday, amidrising incidents of cross-borderattacks on security forces along theLine of Control in Jammu andKashmir.Minister of State for defenceSubhash Bhamre, replying to aquestion, said that 50,000 suchjackets have already been deliveredto the Army. “A proposal forprocuring 1,86,138 bullet proofjackets (BPJ) is in progress,” he said,adding that the Defence Researchand Development Organisation

(DRDO) is engaged in the project.“In addition, 12 Indian companieshave been issued industrial licensesfor the manufacture of BPJs,” hesaid. More than 50 students of two schools,who were trapped due to heavy mortarshelling by the Pakistan army in theNaushera sector in Jammu's Rajouridistrict, were rescued on Tuesday, anofficial said.Authorities rescued 12 children from aprimary school in the afternoon, whilemore than 40 students of a governmenthigh school were evacuated in theevening.The Pakistan army resorted to shellingin four sectors of Rajouri and Poonchdistricts this morning.

Earlier, Deputy Commissioner said theschool is located at a height which hadmade the task of evacuation difficult.However, police and other authoritiesevacuated 12 students from a primaryschool at Kadali in Naushera.The children were ferried from theschool in bullet-proof vehicles duringthe intermittent shelling by Pakistan,DC said.Three bullet-proof vehicles were sentto evacuate the students from highschool at Sehar.A population of 4,500-5,000 in thevillages of Panjgrain, Rajdhani andNaika in the Rajouri-Poonch belt wasaffected due to the shelling by

The standoff between the Chinese and Indian troops atDoklam Plateau in Bhutan has started causing anxietyamong many countrymen. Different voices are being

raised, some sane, some insane and some belligerent. The issuehas been discussed widely in the media both print and electronic.The Government of India so far has remained calm and balancedand refused to be cowed down by unusually hostile governmentcontrolled Chinese media and also remained unprovoked by theadvice and hysterical rhetoric of many self-styled Chinawatchers and strategic experts. The government is trying todiffuse the tension diplomatically and has also taken theopposition parties into confidence. But why is it that China isrefusing to come to the negotiating table and not cooperating indefusing the tension? A lot has been written about the nature and cause of conflict, theterrain and its strategic importance for both the nations as wellas the comparative tactical military advantage which Indiaenjoys in the current standoff. Hence I would avoid repetition.An important issue in this case is that the disputed territorybelongs to Bhutan but the standoff is between the armies of Indiaand China. For this, it is important for the readers to understandthe special relationship that exists between the two South Asianneighbours namely India and Bhutan. Traditionally the Kingdomof Bhutan and India have enjoyed very friendly and cordialrelations. India's contribution towards building of moderninfrastructure in Bhutan has been tremendous. Both the countrieshave signed treaties for cooperation and defence as early as 1949and the latest being the Indo-Bhutan Treaty of Friendship 2007.Article 2 of the Treaty states, "In keeping with the abiding ties ofclose friendship and cooperation between Bhutan and India, theGovernment of the Kingdom of Bhutan and the Government ofthe Republic of India shall cooperate closely with each other onissues relating to their national interests. Neither Governmentshall allow the use of its territory for activities harmful to thenational security and interest of the other". To honour the saidtreaty Indian troops had to enter Bhutan where China wasconstructing a road from Senchen La, located at the southern tipof Chumbi Valley, uptoZompleri, sole Bhutanese border out postin Western Bhutan guarding the Doklam plateau.China claimsDoklam plateau, an 89 sq km pasture that falls close to Chumbivalley at the corner of India-Bhutan-China tri-junction and is not

very far from the Sikkim sector. China, citing the 1890 China-Britain treaty, calls Doklam (referred by China as Donglang ) itsown while Bhutan has disputed the fact saying the conventionapplies to the India-Bhutan border, not Bhutan and China. Byrevoking 1890 treaty China has added a new strategy to theborder dispute called "lawfare." Lawfare is defined as a 'strategyof using-or misusing-law as a substitute for traditional militarymeans to achieve an operational objective.' India also needs todevelop a resource-pool for exploitation of 'lawfare' to countergrowing Chinese assertiveness and resolve other issues with itsneighbours to its advantage using legal provisions. Indian officials have said that the road construction by the PLAis aimed at getting closer to Doka La, the last Indian militarypost on its border with Bhutan.On its part, China has repeatedlyasserted its claim over Donglang (Doklam) and accused Indiantroops of trespassing."In order to cover up the illegal entry byIndian troops into the Chinese territory, Indian side wants toinfringe upon Bhutan's sovereignty and they try to confuse rightfrom wrong. This is futile. We have no objection to normalbilateral relations between India and Bhutan but are firmlyopposed to the Indian side infringing on Chinese territory usingBhutan as an excuse," said GengShuang, Chinese spokesperson. China has launched a disinformation campaign to mislead theinternational opinion. The fact is that for several decades, Chinahas accused India of forcing Bhutan not to allow opening of itsdiplomatic mission in Thimphu. At present, only India andBangladesh have embassies in Bhutan, and Bhutan maintainscontacts with China through the Chinese Embassy in New Delhi.China is not happy with status quo and wants this to be alteredin its favour and hence trying to bully Bhutan.The current standoff is not only a border issue but a territorialissue as well. Forcible occupation of other nation's territory hasbeen part of the Chinese statecraft from the imperial days and isbeing faithfully followed by the present Communist regime.China is used to bullying its neighbours to submit to its demandsand diktats. That is why it solved its land border disputes withother neighbours when it was in a comparatively strongerposition viz a viz the adversary nation. With India, China had notbeen very keen for early resolution of the border disputesbecause it perceives India as a competitor towards gainingstrategic space in the emerging world order. It wants to keepIndia permanently anxious and unbalanced. "A frontier ofthousands of miles between two powerful nations holding each

other in mutual contempt seems to point at anything but peace."India-China relations have been growing steadily except thesecurity relations. The security relations between the twocountries cannot improve till there is a disputed border.Demarcated border is not the only dispute but also China's claimto a large chunk of Indian Territory including the entire state ofArunachal Pradesh. That is why it is no longer talking about "as-is-where-is" settlement.A brief peep into the Chinese mind set will help the readersunderstanding the China's intent more clearly. According to asenior general of PLA, "When a nation grows strong enough, itpractices hegemony. The sole purpose of power is to pursue evengreater power--------Geography is destiny-------When a countrybegins to rise, it shall first set itself in an invincible position".The dragon is riled due to India's constant refusal to acceptChinese hegemony but pursue her independent path based onher national interests. China is annoyed due to many recentmoves of the Modi Government and hence manipulated thecurrent standoff in exasperation. Coercion forms an importantingredient of Chinese war fighting doctrine. One of theimportant phases of Chinese military strategy is, "Achievementof Political Objectives through Coercion". China is an ardentadvocate and practitioner of coercive security strategy "Shi" tosecure advantage. To quote Sun Tzu, "To win one hundredvictory in one hundred battles is not the acme of skill. To subduethe enemy without fighting is the acme of skill". China fears thatpost 2020 scenario may not be conducive for coercion becauseof a resurgent and assertive India.China on its part is going ahead with containment of India witha view to keep India confined to the back waters of IndianOcean. Its policy of string of pearls and the Belt Road Initiative(BRI) is aimed to contain India. The first ever Chinese militarybase abroad at Djibouti in Horn of Africa is also meant to allowPLA Navy (PLAN) to challenge Indian Navy in Indian Ocean.China Pakistan Economic Corridor (CPEC) and development ofGwader port will provide enough strategic leverage to challengeIndia's might in the region. The presence of Chinese troops inPOJK and their reported presence in terror training camps hasadded a new dimension to the prevailing security scenario inJ&K. Mehbooba is not talking off the cough and she needs to betaken seriously when she refers to "external forces meddling inKashmir affairs". China has deliberately propped up Pakistan asan adversary of India and is providing financial, military, nuclear

and moral support to Pakistan to continue to wage the proxy war.Terrorism and radicalisation are a means to an end. The endbeing "to contain India and weaken the Indian economy".Pakistan is like a monkey on our back.Having highlighted the Chinese intent, the readers need tounderstand the Chinese objectives in the current standoff. Thesecould be summarised as: test the resolve of Modi governmentagainst Chinese hegemony despite strong signals to the contrary;to coerce India to withdraw her troops from Bhutan so that it cangrab the strategic Doklam plateau thus threatening the SiliguriCorridor and deny a launch pad to Indian troops; force India topermit construction of the road so that it can then do the same inGilgit-Baltistan to complete its prestigious CPEC project;portray India as an undependable ally to the Royal Governmentof Bhutan and force it to have direct diplomatic ties with Chinaside lining India; pressurise India to join the BRI, the projectaimed at strengthening Chinese hegemony; reduce growingIndian influence among SAARC nations and wean themtowards China; keep India on tenterhooks as far as the Siliguricorridor, India's lifeline to North-East, is concerned and fuelinsurgent movements in NE; to brow beat India to submit toChinese dominance in Indo-Pacific region and stay away fromthe South China Sea region and snub India because of hergrowing strategic relations with USA, Japan and Israel.India's approach so far has been very mature and worthy of anation that is shedding the image of a "soft state". India's strategyrevolves around both side honouring the 2012 Agreement signedby the 'two sides' coupled with matching military responselocally. India should continue to strive to find a diplomaticsolution and not succumb to Chinese manipulations and threats.Any unilateral withdrawal by India will be suicidal. India'sNational Security Adviser AjitDoval is scheduled to visit Beijingon July 26 to attend the meeting of NSAs from BRICS - Brazil,Russia, India, China and South Africa. He is expected to raise theissue with his Chinese counterpart Yang Jiechi. Hopefully bythen Chinese would have been convinced of India's resolve tonot to give in to the coercive strategy of China.

As many as 696 daysafter the SupremeCourt had asked for

the Aadhaar matter to beheard in front of aConstitution Bench, on July18-19, the case is finallybeing presented in front of afive-member bench todecide all issues pertainingto Aadhaar, which includemandatory uniqueidentification for accessingbenefits and violation ofprivacy.The bench is also likely toaddress the constitutionalvalidity of the Aadhaar Act,2016 - which was passed asa money Bill.This decision wasannounced by a three-judgebenching hearing ShantaSinha vs Union of India,which questions makingAadhaar mandatory forgovernment schemes such asmidday meals andscholarships.Shyam Divan, the lawyer onbehalf of the petitioner,argued that the wholecountry was becoming a"concentration camp" aseven children below the ageof 18 years are being forcedto part with their biometricsto access governmentbenefits.Divan argued that the

government has been issuingnotices compelling people toget the biometric ID, eventhough the Supreme Courthad ruled through an interimorder that Aadhaar wouldnot be mandatory.Divan, while arguing againstthe mandatory linking ofAadhaar cards with PANnumbers for tax filing, hadargued that Aadhaarthreatens the right to bodilyintegrity, dignity andinformational self-determination under Article21 but the bench haddeclared that no argumentsrelated to privacy would beheard. So far, issues withregard to privacy have notbeen heard, and thisConstitution Bench isexpected to decide the futureof Aadhaar in India.So far,there is plenty of reason tobe scared of the unique ID,given it can be misused:1) Weak privacy laws: Indiadoes not have a right toprivacy, and in this day andage of digital data, and ourpersonal information beingsplashed around and beinghoused with the government,in the case of Aadhaar, it isof utmost importance. Thereis no protection for Indiansagainst their data beingused/misused by corporatesor the government2) Identity theft: In February,

Jio salesmen were arrestedfor the fraudulent use offingerprints acquiredthrough Aadhaar e-KYC, toactivate and sell sim cards.This sort of identity theft ispossible through Aadhaarsince the Central IdentitiesData Repository (CIDR) iscentralised and makes ourdata vulnerable. Identitytheft can be used to maketransactions such as bankingon behalf of an individualwithout their consent3) Data leaks: There havebeen multiple data leaks ofAadhaar numbers throughgovernment websites.Recently, there was analleged data leak of RelianceJio phone numbers (whichuses Aadhaar) with namesand addresses of users beingsold on the dark web. Giventhat Aadhaar numbers are acentral piece of identity inIndia and linked to all sortsof databases as well asbiometrics, having themfloat on the internet is notthe best idea.4) Authentication issue: Alarge number of people havesuffered authenticationissues, i.e. fingerprints havenot been confirmed as theirown. This can happen for amultitude of reasons such asmismatch of fingerprints tothe database, server issues,capturing of biometric, etc.

Repeated failure can meandenial of benefits andadministrative issues inaccessing governmentservices.5) No opt out: Once enrolledinto the Aadhaar database,the individual remains in thedatabase for life and isunable to opt out even ifunwilling to have theirbiometric data stored. The troubles with Aadhaarhave been compounding.There have been reportssuggesting data leak of 130million Aadhaar numbersfrom four governmentwebsites that deal withbenefits such as pensionsand the National RuralEmployment Guarantee Act(NREGA).There have been reports offake Aadhaar enrolmentsand the UIDAI hasblacklisted 34,000 centressince 2010, and news of fakeenrolments keeps poppingfrom around the country.The government maintainsthat biometric data is safebut privacy activists havebeen worried about both thesafety of the database andthe potential uses of Aadhaarfor mass surveillance.Some of these fears havefound basis in recentincidents such as a sub-inspector threatening aDelhi-based activist that an

initiative has been launchedto "surround and kill"(gheroaurmaaro) thosewithout Aadhaar or otheridentity proofs.The government has beenparticularly aggressive inmaking Aadhaar mandatoryfor access of governmentschemes and programmes,where the news has beendismal. Stories of rationdenied through the PDS,non-payment of NREGAwages, non-receipt ofpensions and scholarshipsdue to mismatch in linkingbank account with Aadhaarnumber, server issues,authentication failures andlack of awareness ofbeneficiaries have beenreported for long.The absence of a grievanceredressal system makesmatters worse as there islittle recourse for those whohave not received benefits.Emboldened by the centralgovernment's efforts, stategovernments have madeAadhaar mandatory forservices like usingambulances.The government of Indiamaintains that the gains ofusing Aadhaar are immense,and has quoted big saving inresponse to the petitionsagainst the biometric projectin court. However, it hasbeen difficult to unbundle

the numbers and understandsavings in a detailed manner.Discussions on how toreform Aadhaar have beenmade in Parliament, and theRajyaSabha has somesuggestions to reform theAct - the most importantbeing the right to "opt out" ifa user has already enrolledwith UIDAI but no longerwishes to be part of thesystem - thus, all dataincluding authenticationrecords, and biometricinformation would bedestroyed.This reform would give theindividual control over herbiometric data. TheRajyaSabha also suggestsproviding alternativeidentification for those whoare not enrolled with UIDAIor have chosen to opt-out.These suggestions havecurrently not been taken on-board by the government.Given all the chaos andconcerns around Aadhaar,the Constitution Benchhearing is of utmostimportance to provide legalperspective on the matterand give clarity on thepossibilities and limitationsof Aadhaar, a system that hasfast become the backbone ofIndia's welfare state and hasso far not proven itself touphold the interests of thoseit claims to serve.

Shakti is the life-force.There are five aspects of creation.Asti - Is-ness, Bhati -Knowledge and Expression, Preeti - Love, Nama - Name,Rupa - FormMatter has two aspects, Name and Form.Consciousness has three aspects, Asti - it is, Bhati - it knowsand expresses and Preeti - it is loving. Maya - ignorance ordelusion is not being aware of the three aspects of theconsciousness and getting caught up in the name and form.Different functional aspects of this divine energy, Shakti, havedifferent names and forms. The "i" (ee) in Shakti is energy.Without the "i", "Shiva" becomes "shava" which in Sanskritmeans lifeless.

Shakti is dynamism expressed. The Shiva tattva isinexpressible. You can see the wind blowing, trees swaying, butyou can't see stillness which is the reference point for allmovement. The dynamic expression is Shakti. The stillness andcalmness is Shiva. Both are necessary. When dynamicexpression is combined with stillness within, then there iscreativity, positivity, and Sattva is generated.Shakti is the moving force. Parvati is an ansha of Adi Shakti.With reference to Shiva, she is the ardhangi. She is thescintillating energy, the dynamic aspect of Shiva.There was a time for even Shakti to be in tapas. To throw anarrow you have to first pull it backward. Shravan maas is thatnivrutikala, where even Shakti goes inward. The restlessness ofthe soul is quenched by this tapas.In life, there is contrast everywhere, opposites co-exist. Heatand cold, mountain and valley, greenery and snow - there areseveral such instances. Dynamism and stillness are the contrastof energy. It is this contrast that adds juice to life.As Shiva's ardhangi, they represent all the beautiful contraststhat enhance the quality of our lives. Shiva is full of compassionand she is full of grace. Shiva is the still substratum of thiscreation and she is the dynamic expression. Shiva is benevolentand she is magnificent. Shivais intelligence with innocence sheis intelligence with skill. In this way, they share all the qualities.Shiva and Parvati are self-luminous and are the guiding lightfor others. Parvati is the embodiment of love, innocence,caring, and of honoring the roles. She is the perfect daughter,

wife and mother. She is the landmark for dampatya.Parva means celebration; the celebrative aspect that comes outof sattva. When tamasdominates, there is only inertia, nocelebration. Any celebration born out of Rajogun cannot last.Only in sattva can we be in celebration constantly. Shiva is theAdipati of celebration with purity of mind, intention, thought,feeling, speech, and action. Eternal celebration is therepresentation of Parvati. Eternal peace is Shiva. They are anexemplary couple guiding many lives. One can't even saycouple because they are really just one.Jagadapitarauvandeparvatiparameshwarau. They areworshipped as the parents of this creation. Pa is the root wordwhich refers to parabrahma, paramatma. Pa is the root forParvati and for Parameswara. They represent the principles thatare beyond the material. They are eternal symbol of celebration,joy, benevolence and love.When you go inward, when you are established in yourself,celebration happens around you. That is why this month is fullof festivals. Sri Sri says Life is love, joy and enthusiasm. Loveand joy without enthusiasm is still inert. The enthusiasm isParvati. Shiva is the tranquil stillness. It is strange and saddening that theChinese ambassador in India Luo Zhaohui has followed uphis hush hush meeting with Congress vice-president RahulGandhi with meetings with a battery of opposition leaderswho are especially inimical towards the Narendra Modidispensation. Evidently, the Modi government was not keptinformed about the content of these meetings. Also, there isno word about what transpired at these meetings andwhether there was a set agenda. The Central government hasbeen tight-lipped about its reaction over the meetings thoughthere is an element of concern and disquiet that isunderstandable.The question is does China allow such gestures on the partof India’s Ambassador in China? Certainly not! By allaccounts, the opposition leaders who besides Rahul Gandhiincluded West Bengal Chief Minister Mamata Banerjee,Kerala Chief Minister Pinarayi Vijayan, former Assam ChiefMinister Tarun Gogoi, former National Security AdviserShivshankar Menon have also not briefed governmentrepresentatives of what precisely they discussed and whatthe stand of the Chinese envoy was. Significantly, LuoZhaohui even had a meeting with the District Magistrate ofDarjeeling which has been in the thick of a violent agitationfor carving out a new state of Gorkhaland from within WestBengal. It is a measure of the Indian government’s passiveacceptance of Chinese impropriety that the Chinese envoyhas not been summoned to the External Affairs Minister toanswer questions on the interactions.That these meetings have taken place in times when Indianand Chinese troops are in a standoff situation at the tri-junction between India, China and Bhutan with Chinaclaiming that the Bhutanese territory belongs to it under amore than a century-old treaty makes the Chinese moveparticularly unpalatable. The Modi government needed totell the Chinese envoy in no uncertain terms that thisamounted to an avoidable interference in India’s internalaffairs. There is little point in swallowing our pride andgiving China a long rope and then regretting why we wereunduly soft and not forthright.The opposition leaders who met the Chinese envoy mustalso be asked in writing to respond when they met him, whatthey discussed and what was it they told the envoy. As withother countries that uphold their pride as nations, India mustput national interest above everything else all the time. Hadthe government protested strongly to Rahul Gandhi when hemet the Chinese envoy, perhaps the message would havegone home to the others who later met him. That theCongress party had no intention of briefing the governmentabout the meeting was clear from the fact that the party firstdenied that the meeting had taken place and when it foundthat the cat was out of the bag it acknowledged that themeeting had occurred while contending that it was no bigdeal. Even now, the Modi government must call the leaderswho met the Chinese envoy for a de-briefing. If they stayaway, the country needs to be told so.

DDC inspects district hospitalBANDIPORA, JUL 18District Development Commissioner (DDC) Bandiporatoday made a surprise visit to District Hospital Bandiporaand checked the staff attendance. Progress under NSM reviewedPULWAMA, JUL 18District Development Commissioner Pulwama todayconvened a meeting to review progress and challenges in theeffective implementation of National Saffron Mission(NSM). Chief Agriculture Officer Pulwama, ExecutiveEngineer MED Anantnag, Srinagar, District AgricultureOfficer Pulwama, Tehsildars of Pampore, Kakapora andAwantipora were also present in the meeting. It was givenout that National Mission on Saffron has been sanctioned bythe Centre at a total cost of Rs 372.18 crore. The Missionaimed at Economic Revival of Saffron Sector in the State isproposed to be completed within a period of 4 years; whileas 86 percent of the total funding is being spent in districtPulwama on rejuvenation, strength of irrigation system,enhancing product quality, mechanization, providinginfrastructure facility, establishment of quality testing andmarket facilities. The meeting was informed that the totalsaffron land in the district is 3200 hectare and till date,1690.5 hectares have been rejuvenated and Rs 78.92 crorewere incurred on it, so far.It was given out that 361 weeders and 525 vermicompostunits have been distributed in Pulwama district. However,one more farmer had diedlater, with his kin accusingthe police of assaulting him.“Six persons were killed andas many others were injuredin the police action,including firing, to checkunruly protesters during thefarmers’ unrest inMandsaur,” Home MinisterBhupendra Singh told theLegislative Assembly here.He was replying to anadjournment motion on thesecond day of the monsoonsession.Describing the unfolding ofthe events on June 6, Singhsaid, “Besides blocking ahighway, the protesters hadalso damaged and torchedvehicles. They were peltingthe police with stones, whichforced the police to fire inself defence at PipaliyaMandi in Mandsaurdistrict.”He said the police had used

A youth in his twenties was killed and 30 people receivedinjuries after a private bus from Punjab carrying pilgrimsrammed into a tree before hitting a road divider nearPanniwala village of Sirsa district on Tuesday. The bus,which was carrying 42 pilgrims, including 31 women, washeading to the Radha Soami Satsang dera near Sirsa townfrom Punjab’s Malout. The accident took place at about8am when the bus driver lost control over the vehicle.Twenty three women are among those injured. Somevillagers, who were working nearby, informed the policeand started rescue work. Police personnel and officialsfrom the local administration reached the spot and withthe help of the locals sent the injured to three hospitals anda nearby primary health centre. The deceased, identifiedas Amit Makkar (26) of Malout, was sitting in the seatnext to the driver. Police sent his body to the generalhospital in Sirsa for post-mortem examination. Talking tomediapersons, tehsildar Vazir Singh said, "Forty-twopilgrims were on their way to attend a discourse at RadhaSoami Satsang near Sikandarpur village. The bus driver,identified as Malkeet Singh (32), lost control over thevehicle. Amit Makkar died on the spot.” Bus conductorRohit Kumar (25) received minor injuries. He said all thevictims are residents of Malout. New Delhi:British liquor giant Diageo has decided to withholdremaining $35 million due to Vijay Mallya as partof the $75 million (Rs 515 crore) sweetheart dealfor his exit from United Spirits Ltd, a sourcefamiliar with the development said.Also, Diageo is looking to recover dues from thefugitive businessman, who is wanted in India withregard to cases of loan default and diversion offunds.Diageo had last year paid $40 million to Mallya aspart of its payout package.“They have decided not to pay the remaining $35million as there was violation of terms ofagreement by the other side,” a source said on thecondition of anonymity.The British liquor giant was supposed to pay theremaining $35 million in two equal amounts.The source, however, refused to share theconditions of their “terms of agreement”, whichwere violated by Vijay Mallya.In July 2016, United Spirits disclosed Rs 1,225.3crore worth fund diversion and impropertransactions with entities associated with Mallyaincluding Kingfisher Airlines and his Formula Oneteam.Making it clear that the settlement reached earlierwith Mallya would cover the latest disclosures,USL -- now controlled by Diageo -- had said theformer Chairman would be liable for claims overthe amount.

New Delhi:The GST Council has raised thecess on cigarettes to take away anestimated Rs 5,000 crore annual“windfall” manufacturers couldhave reaped from lower GSTrates, finance minister ArunJaitley said on Monday.However, cigarette prices will notchange as a result of the increasedcess which would be effectivefrom midnight.This was the first meeting of theCouncil after the Goods andServices Tax (GST) was rolled outon July 1.Briefing reporters after anemergency meeting of the Councilwas held through videoconferencing, Jaitley said it hadpreviously fixed a peak GST rate

of 28%?on cigarettes.On top of it, a cess was levied tocreate a corpus for compensatingstates for any loss of revenue fromimplementing the GST, whichsubsumed over a dozen centraland state levies.The cess was made up of 5%?advalorem rate and a fixed perthousand stick rate based onlength of cigarettes.The peak GST rate of 28%?as alsothe 5%?ad valorem cess willcontinue but the fixed cess hasbeen hiked in the range of Rs 485and 792 per thousand sticks, hesaid.The hike has been necessitated asthe GST rate together with cesswas found to be lower than thecombined incidence of central

excise, state VAT and other leviesput together.“Now the total revenue gain ofthis is estimated to be about Rs5,000 crore per annum and thisgain otherwise would have eitherresulted in reduction of cigaretteprices or would have gone asbalance profit to the cigarette

companies,” Jaitley said.The cess which was earlier fixedby the GST Council had resultedin a windfall profit for cigarettecompanies.“There were two things that thecigarette companies could do --either reduce the price ofcigarette, which because of thehealth consequences of cigarettesis not a very desirable thing. Sothey probably would haveresorted to the other option oftransferring this windfall profitsto their balance sheet. This wasnot the intention of the Council,”he said.The GST Council had on May 18fixed 28%?as the top rate forcigarettes. A 5%?ad valorem cesswas levied on top of it and Rs

1,591 per thousand sticks as fixedcess on both filter and non-filtercigarettes of not exceeding 65 mmlength.The new cess rate for non-filterand filter cigarettes of length notexceeding 65 mm would be5%?plus Rs 2,076 per thousandsticks. For non-filter cigarettes of65 mm to 70 mm length, the ratewould be 5%?plus Rs 3,668 perthousand sticks as against5%?plus Rs 2,876 currently.Filter cigarettes of 65 to 70 mmlength would now attract a5%?plus Rs 2,747 per thousandstick cess as compared to present5%?plus Rs 2,126. The same for70 mm to 75 mm cigarettes wouldbe 5%?plus Rs 3,668 per thousandsticks.

Thegovernment had proposednames of five eminent doctorsto replace it.“The doctors proposed are alloutstanding people. We aresatisfied with the names,” afive-judge Constitution Bench

It gaveliberty to the governmentreplace any one in the newpanel with another if theperson wished to be relieved.However, the Bench alsocomprising Justices JChelameswar, RK Agrawal,DY Chandrachud and S AbdulNazeer, wanted to be sure thatthe doctors suggested to be onthe panel to replace LodhaCommittee had time to take upthe new responsibility.The Bench passed the orderafter Solicitor General RanjitKumar said that their consent

had already been taken.The doctors who will bepart of the new panel are:Dr VK Paul, Dr NikhilTandon, Dr Jagat Ram,Dr BN Gandharan andDr Randeep Guleria.The panel is to be

notified on Tuesday itself.Many private medicalcolleges wanted the term ofLodha panel to be extended.On behalf of certain privatemedical colleges, seniorcounsel Kapil Sibal had toldthe Bench on Monday that noalternative mechanism hadbeen put in place by theCentre to replace theoversight panel. He accusedMCI of not followingdirections of the oversightpanel.Senior advocate MukulRohatgi, representingHamdard Institute of Medical

A Five-JudgeBench headed by ChiefJustice of of India JS Kheharon Tuesday referred the issueto a Nine-Judge ConstitutionBench for an authoritativedetermination.Commencing its hearing onWednesday, the Nine-JudgeBench will review the topcourt's earlier verdicts thatsaid citizens didn't have afundamental right to privacyunder the Constitution.An Eight-Judge ConstitutionBench had in MP Sharma'scase in 1954 ruled thatcitizens didn't have afundamental right to privacy.The ruling was followed by asix-Judge Bench in KharakSingh's case in 1962.There was a huge uproar inJuly 2015 when thenAttorney General MukulRohatgi — based on thesetwo verdicts — saidConstitution didn't give anyfundamental right to privacyto citizens.On Tuesday, a Five-JudgeConstitution Bench headedby CJI Khehar said the issueneeded to be determined

before it decided petitionschallenging the validity ofAadhaar scheme on theground it violated right toprivacy."It has become essential forus to determine whetherright to privacy is afundamental right under theConstitution," the CJI said."The determination of thisquestion would essentiallyentail whether the decisionrecorded by an eight-judgebench in 1954 and also by asix-judge bench in 1962 thatthere is no such fundamentalright is the correctexpression of constitutionalprovisions," the Benchnoted.It said after the Centre'ssubmission that right toprivacy was not afundamental right it hadbecome necessary to send itto a larger Bench.During the hearing onTuesday, Attorney GeneralKK Venugopal said, "Ourfounding fathers haveencompassed all rights. There is a shortage of over 5lakh police personnel in thecountry as compared to theiroverall sanctioned strength,the Government toldParliament today.The Union home ministry, ina written reply to the LokSabha, also said that there arelesser Indian Police Service(IPS) officers in positionacross the country, than theirauthorised strength.

"As on January 1, 2017, thereare 3,905 IPS officers inposition against an authorisedstrength of 4,843," Ministerof State for Home Hansraj GAhir said.The minister said thataccording to the Bureau ofPolice Research andDevelopment (BPRD), as onJanuary 1, 2016, against theauthorised strength of22,80,691, there are17,31,666 police personnel inposition.
