TheDaemenCollegeManhattanCampusishousedonthe3rdand4thfloorsofthebuildinglocatedat1032AvenueoftheAmericas.Classesareofferedonthe3rdfloorofthebuilding,whiletheschool’sadministrativeoffices,records,andcertainstudentresources(computerlab,library,studentadvisors)arelocatedonthe4thfloor.ThebuildingdoeshouseothertenantsunrelatedtoDaemen’sand/orIAA’soperationsonthe2ndand4thfloorsofthebuilding;the3rdfloorisexclusivetoIAA.Accesstothebuildingisrestricted(thebuildingislockedatstreetlevelwithonlyauthorizedtenantsbeinggrantedkeyaccess).EntrytotheDaemenCampusbystudentsandthepublicisgrantedthroughanelectronicintercomsystemmaintainedbythebuildingwherebystudentsorothervisitorsmustringabuzzeronthegroundfloorwhichsoundsonthe4thfloorofficesofIAA,alertingtheIAAstaffthatentrytothebuildingisbeingrequested.Staffwillremotelyunlockthedoortopermitaccesstothebuilding.Itshouldbenotedthatthesystemofgrantingaccesstothebuildingoffersalowlevelofsecurity.VisitorsrequestingintercomaccesstothebuildingcannotbeseenorspokentobyDaemenstaffpriortoentry,andthereforeanyrequestforentrytothebuildingisgenerallygrantediftheintercomsystemisused.Further,anyothertenantmaysimilarlygrantaccesstothebuildingiftheirintercomsystemsaredeployedwithoutIAA’sknowledgeorconsent.
Daemencurrentlyemploysafull‐timestaffmemberatitsManhattanCampustoprovideoversightoftheoperationsandthefacility,ensuringthatallDaemenpoliciesandproceduresaremaintained.Thestaffdoesnothaveauthoritytodetainorarrestindividualsbutwillcontactlocalpolicemunicipalitiesinthecaseofcrimeoremergency.Duringtheweek,thebuildingisinspecteddailybytheDaemenSiteDirector,theexecutiveand/oradministrativestaffofIAA,and/orthesuperintendentofthebuilding(anagentofthelandlord)foranysafetyhazardswhichareimmediatelyaddressed.IAAdoespossesstherequiredCertificateofOccupancyfromNewYorkCitycertifyingthatthebuildinghascompliedwithlocaloccupancyregulations.
WrittenMemorandumofUnderstanding(MOU)hasbeenrequestedbyDaemenCollegetotheMidtownSouthprecinctpolicedepartmentwhichprovidesaidtotheManhattanCampus.GENERALCONDUCTPOLICIESDaemenCollegeexpectsitsstudentstoobeyallapplicablefederal,state,andlocallaws,tobehaveinmoral,ethical,professional,civil,andcourteousways,andtoobservethespecificpolicies,procedures,regulations,rules,andstandardsthatarepromulgatedbyDaemenCollegeforconductingitsownaffairs.THECOLLEGERESERVESTHERIGHTTODISMISSORREQUESTTHEWITHDRAWALOFANYSTUDENTWHOSEACADEMICSTANDING,ACADEMICORSOCIALCONDUCT,ORMANNERRENDERSHIS/HERCONTINUEDATTENDANCEATDAEMENCOLLEGEUNDESIRABLE(seetheCollegeCatalog).Prohibitedconductisgenerallyamatterofcommonsense.Listedbelowaresomeofthebasicrulesgoverningaperson'sbehavior.Violation(s)oftheserules,orotherconductwhichreflectsunfavorablyonthestudentortheCollege,mayresultindisciplinaryactionuptoandincludingexpulsionfromtheCollege.ThefollowingisPROHIBITEDandisconsidereddisorderlyconduct:1. Asamatterofpolicy,theCollegewillcooperatefullywithalllawenforcementagenciesintheinvestigationandprosecutionofsubstanceabuseandtraffickingcases.Violationsoftheseregulationswillcausethestudenttobesubjecttocriminalprosecution,disciplinaryaction,orboth.Distribution,sale,oruseofdrugswillordinarilyresultinexpulsionfromtheCollege.Prohibiteddrugsaredefinedasincluding,butnotlimitedto:

5. Whileon‐campusorparticipatinginDaemenCollegeactivities,possessionoruseofexplosives,firearms,fireworks,
knives,incendiaries,orotherdangerousweapons,includinggasorairguns.
6. Tamperingwithfirealarmsand/orotherfiresafetyequipmentorotherwisehinderingtheproperfunctionoftheCollege'sfireand/orsafetyprocedures.Nofiresmaybesetbystudentsatanytimeforanyreason.
7. Cheating,plagiarism,oranyotherformofacademicdishonesty(see"AcademicHonesty"intheCollegeCatalogandintheStudentHandbookunderSpecificPoliciesforadditionaldescription).
8. AbusiveordisruptivebehavioroncampusoratanyCollegeactivityorevent(onoroffcampus),theeffectofwhichmightbringdiscredittoDaemenCollege.
9. Disregardoftherightsofothermembersofthecampuscommunityand/ortheirguests.
10. FailuretofollowthedirectiveofanofficialoftheCollegeorhis/herrepresentative.

CRIMEREPORTINGPROCEDURES/POLICYDaemenCollegestrivestomaintainasafecampusandreliesonallmembersofthecampuscommunitytodotheirparttokeepourcampussafe.Anymemberofthecampuscommunity–faculty,student,staff,trustee–whoobservescriminalactivityontheDaemenManhattancampusoratanyoff‐campusinstructionalsiteisexpectedtoreportsuchconductpromptlytothepoliceandtocampusorbuildingsecurity.Criminalactivityincludes,butisnotnecessarilylimitedto:physicalassault,includingsexualassaultandabuse,burglary,robbery,arson,unauthorizeddisplayoruseofadangerousweapon,andtheillegaldistributionormanufactureofcontrolledsubstances.Ifyouobserveacrime,phone911immediatelyandfollowtheinstructionsofthepolice.ContactimmediatelythereaftertheDaemenSiteDirector(bydialingextension23fromanytelephonelocatedattheCampus,orat646‐366‐8500fromoutsidethebuilding,orat917‐991‐4790afterhours),theexecutiveoradministrativestaffofIAA(bydialinganyextension11through18fromtheCampusorat646‐366‐8500fromoutsidethebuilding),andtheBuildingManagerat212‐302‐3000.Anycrimedirectlyinvolvingamemberoftheoff‐campuscommunity,whetherasvictimorallegedperpetrator,shouldalsobebroughttothepromptattentionoftheDaemenSiteDirectorandtheDaemenCollegeOfficeofthePresident.Inaddition,thereareoccasionswhenminors(personsunder18yearsofage)maybeattheCampusorinvolvedinCollegeevents.Anypersonwhoobservesthesexualabuseofaminororhasareasonablesuspicionofsuchabuse,shouldimmediatelynotifythelocalpoliceauthorities(call911).AcallmayalsobemadetotheNYSChildAbuseHotlineat1‐800‐

SECURITYOFANDACCESSTOCAMPUSFACILITIESTheDaemenCollegeManhattanCampusatIAAisgenerallynotopentothepublic,exceptaspreviouslydescribed.AccesstotheCampusisformallyavailabletoourstudents,staff,facultymembersandguestsofIAAwhenDaemenorIAAstaffisondutyduringthehoursof9AMto8PMweekdays,andonweekendswhenclassesarebeingoffered.Duetolateeveningcoursescheduling,weekdayeveningclassesareroutinelyconducteduntil10PM,whichresultsinaperiodoftimebetween8PMand10PMwhenthefacilityhasnoDaemenorIAAadministrativeorsupervisorysecuritypersonneloncampus.Duringthisinterimperiod,facultyareexpectedtoremainvigilanttopossiblebreachesinsafetyorsecuritywhileoncampusandtotakewhateveractionstheydeemappropriatetomaintainsafetyandsecurityofDaemenstudentsduringthesehours.ToensureCampussecurityduringthelateevening,priorto8PMthedepartingDaemenorIAAstaffwillcloseoffelevatoraccesstothe3rdfloorandwilllocktheinteriorstairwayaccessdoorstothe3rdfloorwhereclassesareheldandtothe4thfloorwhereadministrativeofficesarelocated.Entrytotheseareasisnotpermittedoncetheseaccessdoorsarelocked.After8PM,IAAstaffisnolongeravailabletorespondtooutsideintercomaccessrequeststoenterthebuilding.Onceclassesarecompleted,theCampusfacultyensuresthatstudentshavesafelyleftthebuildingandareexpectedtoextinguishalllightsandshutdownequipmentandappliancespreviouslyinuse.Upondepartingtheaccessdoorsareagainlockedsothatentrybyanyoutsidersisdenied.DaemenCollege’sManhattanCampusdoesnotofferresidencehousing.

GrievanceProcedureinDiscriminationandHarassmentCasesGrievancesorcomplaintsallegingaviolationoftheCollege'snondiscriminationpolicyandpolicyprohibitingunlawfulharassmentshouldbesubmittedtotheAssociateVicePresidentforAcademicAffairs/EOAAOfficerandTitleIXCoordinator,RoomDS102,716.839.8301.GrievanceformsareavailableintheofficeoftheEOAAOfficer,butanyformorformatmaybeusedprovideditisidentifiedasagrievance.Agrievanceshouldcontainastatementofthefactsidentifyingtheviolationandasmuchsupportingdocumentationaspossible.Uponrequest,assistanceinpreparingthegrievancewillbesuppliedbytheEOAAOfficer.Thosefilingagrievanceshouldalsoexpresstheirviewofapossibleresolutiontotheproblem.Agrievanceshouldbefiledassoonaspossibleaftertheallegeddiscriminationhasoccurred(usuallywithin30days).AdelayinfilingagrievancemayimpacttheabilityoftheCollegetoinvestigateandresolvethegrievance.
GrievanceProcessingStep1.TheEOAAOfficerwillattempttoresolvethematterassimplyandasquicklyaspossiblebyinformallymeetingwiththerelevantpersonsinanefforttoreachanacceptableagreement.Ifthecomplaintinvolvesanallegedsexualassault,thematterwillbeaddressedatStep2below;noinformalmediationwillbeundertaken.

Step2.UnlessanacceptableresolutionisreachedinStep1,thegrievantmayrequestthatthematterbereferredtotheappropriateCabinetmemberforaformalinvestigation.Suchrequestmaybemadeatanytime,butnotlaterthanten(10)daysafternotificationthattheStep1procedureiscompleted.Thereafter,theCabinetmember/VicePresidentorhis/herdesignatedrepresentative(GrievanceOfficer)willconductaninvestigationwithrespecttothegrievance.Effortswillbemadetocompletetheinvestigationwithin45daysafterStep2isinitiated. Duringtheinvestigation,thegrievantshallhavetherighttopresentevidenceandwitnesses.TheGrievanceOfficerwillalsoexamineotherrelevantevidenceandwitnesses,includingprofessionalswhereappropriate. StandardsofConduct:Theunlawfulpossession,useordistributionofalcoholandillegaldrugsbystudentsandemployeesoncollegepropertyorwhileengagedinCollegeactivitiesofftheCollegecampusisprohibited.WhiletheCollegepermitsthelawfuluseofalcoholbystudentsandguestsoncampusinaccordancewiththeCollegealcoholpolicy(seefollowingsection),anyabuseofthisprivilegewillbesubjecttoCollegedisciplinaryactionand/orappropriatecriminalsanctions.
LegalSanctionsAlcohol:UnderNewYorkStatelawitisillegal: Toprovidealcoholtopersonsundertheageof21ortopersonswhoarevisiblyintoxicated.Providingalcoholto
personsundertheageof21isaClassAmisdemeanorwhichispunishablebyimprisonmentforuptooneyear,afineofnotmorethan$1,000and/orthreeyearsprobation;
Tomisrepresenttheageofapersonundertheageof21forthepurposeofinducingasaleofalcohol.Thosefoundguiltyofviolatingthislawshallbepunishedbyafineofnotmorethan$200,orbyimprisonmentfornotmorethanfivedays,orbybothfineandimprisonment;
Forapersonundertheageof21topossessalcoholwiththeintenttoconsumeit.Thosefoundguiltyofviolatingthislawshallbepunishedbyafineofnotmorethan$50and/orrequiredtocompleteanalcoholawarenessprogramand/orrequiredtoprovideupto30hoursofcommunityservice;
Foranypersonundertheageof21topresentorofferanywrittenevidenceofagewhichisfalse,fraudulentornotactuallyhisown,forthepurposeofpurchasingorattemptingtopurchasealcohol.Thosefoundguiltyofviolatingthislawshallbepunishedbyafineofnotmorethan$100,and/orrequiredtocompleteanalcoholawarenessprogramand/orrequiredtoprovideupto30hoursofcommunityservice.Additionally,ifitisfoundthataNewYorkStatedriverlicensewasthewrittenevidenceofageusedforthepurposeofthepurchaseorattemptedpurchase,theperson'slicensetodriveamotorvehiclemaybesuspendedfor90days.Lastly,alterationoftherequiredformsofidentification(driverlicense,passportorarmedforcesIDcard)mayconstitute"possessionofaforgedinstrument…withintenttodefraud,"whichisaClassDfelonyunderNewYorkStatepenallaw.
LegalConsequencesofOperatingaVehicleWhileUndertheInfluenceofAlcoholorDrugs OperatingaMotorVehicleAfterConsumingAlcoholWhileUnderAge21.Anypersonunderage21whooperates
amotorvehicleafterhavingconsumedalcohol,asdeterminedbyablood‐alcoholcontentofatleast.02%,maybereferredtotheDepartmentofMotorVehiclesforlicensesuspensionorrevocation,anda$125charge.V&TLaw§1192‐a,
DrivingWhileAbilityImpaired(DWAI)(morethan.05%butlessthan.08%BloodAlcoholContent(B.A.C.)Firstviolation(TrafficInfraction):Mandatory$300‐$500fine;and/orimprisonmentupto15days;mandatory90daylicenserevocation.Subsequentviolationsincreasethefine,possibleimprisonmentandlengthofrevocation.
DrivingWhileIntoxicated(DWI)(.08%B.A.C.orhigherorwhileimpairedbytheuseofadrug)1stViolation(Misdemeanor):Mandatory$500‐$1,000fineand/oroneyearimprisonment;Mandatory6‐monthminimumlicenserevocation.Twoviolationswithintenyearscanresultinjailforuptofouryearsandaoneyearrevocationofyourlicensetodrive.Ifthereispersonalinjuryapossiblelifetimerevocationcanresult.
Ifyouareundertheageof21andchargedwithDWAI,orDWI,andyouareconvictedofsuchcharges,yourlicensewillberevokedforaminimumofoneyear.Ifyoudrivewhileyourlicenseissuspendedorrevoked,orifyourefuseachemicaltest,youfaceamandatoryjailtermof7‐180daysandamandatoryfineof$500‐$1,000.
Drugs:ThereareseveralNewYorkStateandFederallawsprohibitingtheuseand/orsaleofcontrolledsubstances(drugssuchasmarijuana,heroin,cocaine,PCP,LSD,methamphetamineandfentanyl).Aconvictioncanresultinasubstantialfine

and/oralengthyimprisonment.Rememberthattheconvictionofacrimewillremainonyourrecordandcanimpactyourabilitytofindsuitableemployment,getaprofessionallicenseandimpairyourabilitytotravel. DrugLawViolationsisdefinedastheviolationoflawsprohibitingtheproduction,distributionand/oruseofcertaincontrolledsubstancesandtheequipmentordevicesutilizedintheirpreparationand/oruse.Theunlawfulcultivation,manufacture,distribution,sale,purchase,use,possession,transportationorimportationofanycontrolleddrugornarcoticsubstance.Arrestsforviolationsofstateandlocallaws,specificallythoserelatingtotheunlawfulpossession,sale,use,growing,manufacturingandmakingofnarcoticdrugs.Therelevantsubstancesinclude:opiumorcocaineandtheirderivatives(morphine,heroin,codeine);marijuana;syntheticnarcotics—manufacturednarcoticswhichcancausetrueaddiction(Demerol,methadone);anddangerousnonnarcoticdrugs(barbiturates,Benzedrine).
