Anatomy of a Foreclosure Fraud at Trial

On February 26, 2013 in Middlesex County New Jersey, Rounpoint Mortgage Servicing, Inc. presented a fraudulent promissory note during the course of a foreclosure trial. The following slides show the actual promissory note executed by the homeowner on the left, and the fraudulent promissory note on the right. The first slide isolates the signatures of the homeowner and the closing attorney. Clearly, the signatures are very different, particularly for the homeowner. The remaining slides show the complete promissory note and fraudulent promissory note side by side. The fraudulent promissory note is missing the indorsements that appear on the actual note, and the fraudulent note contains an allonge which is absent from the actual note. After Defense Counsel pointed out the discrepancy at trial, the case was dismissed. At this time, it is unknown how or when the fraudulent document was created. At this time it is also unknown who is responsible for creating the faked promissory note. The matter has been forwarded to the Middlesex County Prosecutors Office in the hopes that the matter will be investigated for criminal wrongdoing.
