BackgroundAccording to the REACH regulation1, the use of some chromates2 will be banned in Europe from
September 2017 unless a specific Authorisation has been granted for a specific use and a specificchemical supply-chain, for a limited time period, and for the specific cases where no suitablealternativescanbeimplementedbeforetheSunsetDates.
ApplicationsforAuthorisationcurrentlybeingpreparedApplications for Authorisation have therefore been prepared by some industrial consortia for someAerospaceusesofsomechromates.Due to the nature and complexity of the Aerospace supply chain, a top-down approach based onApplications for Authorisation submitted by the chemical suppliers (i.e. substance Manufacturer orImporterorFormulator)andpreparedwithstrongsupportfromend-users(sincetheyhaveknowledgeonpotentialalternativesandassociatedimpacts)hasbeenapplied3.Thefollowingdossiershavebeenprepared:
- ApplicationsforAuthorisationhavebeenpreparedbytheCTACconsortiumforsomeusesofchromiumtrioxide.TheseapplicationshavebeensubmittedtoECHAinMay2015bytheCTAC-Subconsortium.
- ApplicationsforAuthorisationhavebeensubmittedtoECHAinNovember2015bytheCCSTconsortiumforsomeusesofotherchromates4.
- OtherApplicationsforAuthorisationmaybeinpreparation.
Some Original Equipment Manufacturers have compiled through CTAC and CCST a list of specificapplicationsusingsubstancesofconcern incertainend-usersdesigns that requireAuthorisation.TheywillnotbeseekingAuthorisationforthosesubstancesinalluses.
Each company in the supply-chain should in any event check with its chemical suppliers whetherAuthorisationisbeingsoughtforsubstance(s)andforwhichuse(s)toensurethatitwillbecoveredasneeded.Pleasefindattachedtherelatedpressreleasesandasummarytableinwhichyouwillfindmoredetailsabouttheusesandthelistofcompanies(legalentities)whichhaveappliedforanAuthorisationwiththesupportoftheCTACandCCSTconsortia,aswellasthelinktothedossierspublishedontheECHAwebsite.

Dueto thenatureandcomplexityof theAerospacesupplychain,anApplication forAuthorisation inanyother format than
these upstream applications would have extremely limited benefit and result in an unacceptably high risk of supply-chain
disruption, since an end-user can apply for his uses but not for uses upstream in the supply chain e.g. formulations or sub-
contractedactivities.4

SomeconsequencesforthesupplychainOriginalEquipmentManufacturersexpectthatthesuppliersinall levelsofthesupply-chainmanage
their own solutions on substances of concern to complywith legislation and prevent supply chain
disruption.AccordingtotheREACHregulation, thegrantedAuthorisation forspecificuse(s)willonlyapply tothechemicalsuppliersthatareapplicantsfortheAuthorisationandtheirdownstreamsupply-chain. ItwillnotapplytootherchemicalsupplierswhichhavenotappliedforanAuthorisation.
Therefore,after thesunsetdate,downstreamuserswillnotbeallowedtouse in theEEA5substancesandformulationssuppliedbyachemicalsupplierwhichisnotcoveredbyagrantedAuthorisation.Therefore,anycompany(forexample-butnotlimitedto-subcontractors)willonlybecoveredbythe
Authorisationforaspecificuseif(foreachlegalentity)thethreefollowingconditionsaremet:
- Theuseofthesubstancebythiscompanyfallsundertheauthorisedusedefinition;
- ThecompanyissuppliedbyachemicalsuppliercoveredbytheAuthorisation;
- Thecompanycomplieswiththeworkplacesafetyandenvironmentalrequirementsdescribedin
theChemicalSafetyReportwhichisincludedintheApplicationforAuthorisation,aswellaswith
anyspecificconditionswhichmaybeassociatedtotheAuthorisation.Pleaseseemoredetails
below.
EachcompanythereforeneedstocheckthattheAnnexXIVsubstances6andproductscontainingAnnexXIVsubstanceswhich ituses,andforwhichthere isnocertified/approvedsuitablealternative,willbecoveredbyanAuthorisation.DownstreamuserswhichdonotfallundertheusedefinedintheupstreamAuthorisationwillneedtofindothersolutions,e.g.filetheirownApplicationforAuthorisation,butwillalsoneedtoensurethatalllevels of their upstream supply chain also apply for or are coveredbyAuthorisation for their uses toavoidsupplychaindisruption.Downstreamuserswhichfallundertheusedefinitionbutarenotsuppliedbyanauthorisedsourcewillneedtofindothersolutions,e.g.changetheirmeansofsupplyorasktheirsuppliertosubmitorensurethat it is covered by an Application for Authorisation. Particular care should also be taken withFormulations(non-EuropeanaswellasEuropeanones).Each company may need to engage with its suppliers to monitor their plans with regards toAuthorisation.CertainrequirementsafteranAuthorisationhasbeengrantedIfanAuthorisationisgrantedforaspecificuse,chemicalsupplierswhichareupstreamapplicantsshallinclude the Authorisation number on relevant labels, and update the Safety Data Sheets with thespecificsetofconditionsdefinedintheAuthorisation.
All companies thatmay be permitted under the Authorisation regime to use a substance -must, inaddition to other applicable legal requirements, comply with the conditions of the Authorisation
specified by the European Commission. These conditions may include safety and environmental

protectionmeasures suchas,butnot limited to, engineering controls, personalprotectiveequipmentandemissionsandexposuremonitoring.Please refer to the workplace safety and environmental requirements described in the Chemical
Safety Reports which are included in the Applications for Authorisation. These documents areavailableontheECHAwebsitefromthestartofthePublicConsultations.TheCTACandCCSTdocumentsarepubliclyavailableontheECHAwebsite(seelinksintheAnnex).Particular attention should be paid to the fact that the Authorisation conditions may be more
stringentthancurrentrequirements.
Downstream users which are continuing using the substance under the Authorisation regime -mustmake a notification of this use to ECHA within three months of the first supply of the substance
{REACHArt.66(1)}.Suchnotificationswillbekept ina registermaintainedbyECHAandwillbemadeavailabletothenationalAuthorities.Pleasenotethatitcouldtakeuptotwoyearsormoreafterthesubmissiontogettoafinaldecisionon
theAuthorisation. The submissionof anAuthorisationdossier doesnot guarantee thegrantingof the
Authorisation. If an Authorisation is granted it may be time-limited and shorter than the requested
