Purchaser does hereby indemnify and hold harmless Auctioneerand Seller from any and all damages, claims or liabilities from injuriesto persons or property of any type whatsoever caused during the saleor by the removal of items purchased. Purchaser assumes all riskand liability whatsoever resulting from the use of the item(s) soldhereunder; and shall defend, indemnify, and save harmlessAuctioneer and Seller from any liability.
9. If the foregoing conditions or any other applicable conditions arenot complied with, in addition to other remedies available toAuctioneer and Seller by law, including without limitation, the right tohold the purchaser liable for the bid price, the Auctioneer, at theiroption may (1) resell the property publicly or privately, with purchaserbeing liable for the payment of any deficiency plus all costs incurred,or (2) cancel the sale, retaining liquidated damages on all paymentsmade by purchaser, Auctioneer commission and all other incidentaldamages will be charged.
10. Information in brochures, catalogs and other advertisements arefrom sources believed to be reliable; however prospective purchasersare urged to inspect the inventory or property to satisfy themselvesas to condition, model, manufacturer, year, features, mileage, survey,acres, etc. Neither the Auctioneer or our client make any guaranteesand are not responsible for listing or advertising inaccuracies ordiscrepancies.
11. All statements made by the Auctioneer the day of the auction takeprecedence over oral statements and/or printed materials.
12. THERE WILL BE NO SHIPPING FOR THIS AUCTION . All itemsrequire local pickup at the home. If you need an item shipped you willbe responsible for co-coordinating with a shipper that can pick theitems up at the Auction Site on the scheduled pickup days.
13. Items not picked up at the home will be considered abandonedand may be disposed of at the Discretion of the Auction Co.
14. By registering for the Auction you hereby agree to receive mailand/or email correspondance from the auction Co. from time to time.You can unsubscribe at any time.
