1.0 IntroductionIn accordance with the Declaration of Covenants, Conditions and Restrictions for the
Braemar Community Association, Inc. the Board of Directors has created the CovenantsCommittee. The Covenants Committee for the Association is created in order to assure that
the Property shall always be maintained in a manner: (i) providing for visual harmony and
soundness of repairs, (ii) avoiding activities deleterious to the aesthetic or property values of
the Property; and (iii) promoting the general welfare and safety of the Owners. (See Article
9, Section 9.1(a) of the Declaration.) Further, it is the duty of the Covenants Committee to
propose Design Standards for approval by the Board of Directors. Please note that these
Design Guidelines are in addition to rules and regulations set forth in the Declaration itself or
in the approved By-Laws. In the event of any conflict between these Design Guidelines and
the rules and regulations set forth in the Declaration or the Bylaws, the rules and regulations
set forth in the Declaration and Bylaws shall control. The Design Standards for the
Community are set forth in this document. This guideline will in no way conflict withregulations of Prince William County or the Commonwealth of Virginia.
However, the Design Guidelines cannot envision every type of improvement for which an
application can be submitted and, as such, there must be latitude for the Covenants
Committee to review applications based on certain criteria. Judgments of acceptable design
are based on the criteria listed below which, depending on the particular application, may not
be all inclusive. The applications shall be based on appropriate design. However, it does
mean that the Covenants Committee can evaluate each application based on its individual
merits and specific circumstances, such as characteristics of the housing style, the individual
site and relationship to environmental features. As such, what may constitute an acceptable
design and approvable application in one case may not in another.
1.1 Relation to Environmental Conditions and Community Open Space: Harmony of adesign with its surrounding natural environment is an important factor. Fencing, in
particular, can have damaging effects on open space. Other factors, such as the
removal of trees, disruption of the natural topography, vegetation and changes in rate
or direction of storm water run-off, also adversely affect the environment in terms of
aesthetics or functionality.
1.2 Validity of Concept: The basic idea must be sound and appropriate to itssurroundings.
1.3 Design Compatibility: The proposed improvements must be compatible with thearchitectural characteristics of the applicants house, adjoining houses, and the
neighborhood setting. Compatibility is defined as similarity in architectural style,
quality of workmanship, similar use of materials, color and construction details.

1.4 Location and Impact on Neighbors: The proposed alteration should relate favorablyto the landscape, the existing structure and the neighborhood. The primary concerns
are access, view, sunlight, ventilation, and drainage. For example, fences may
obstruct views, breezes, airflow or access to neighboring property; decks or largeradditions may cause unwanted shadows on adjacent patios or infringe on a neighbors
privacy and view. For another example, an inappropriate clutter of play equipment
or ill-planned landscape scheme may also affect existing neighbors.
1.5 Scale: The size (in three dimensions) of the proposed alteration should relate well toadjacent structures and its surroundings. For example, a large addition to a small
house may be inappropriate.
1.6 Color: Color may be used to soften or intensify visual impact. Parts of an additionthat are similar in design to an existing house, such as roofs and trim, should match in
color and composition. A sample board of exterior materials, finishes, and colorsmay be required at the sole discretion of the Covenants Committee.
1.7 Materials: Continuity is established by use of the same or compatible materials aswere used in the original house. The options may be limited somewhat by the design
and materials of the original house. For instance, vertical wood siding on the original
house should be retained on an addition. On the other hand, an addition with wood
siding may or may not be compatible with a brick house.

2.0 Modifications Requiring Review and Approval by theCovenants Committee
The general conditions for the design review requirements are stated in Article 7, Section
7.5(a)(1) of the Declaration:
No person shall make any addition, alteration or improvement in or to any Lot or any portion
of the Property (other than for normal Upkeep and not including area within a building visible
from the exterior only because of transparency of glass doors, walls or windows) which is
visible from the exterior of the Lot or such portion of the Property, without the prior writtenconsent of the Covenants Committee. No person shall paint, affix a sign not permitted by the
Rules and Regulations, alter the exterior of any improvement, including the doors and
windows, if such exterior is visible from another lot or Common Areas, without the prior
written consent of the Covenants Committee.

3.0 Application and Review ProceduresApplication and review procedures that will be used by the Covenants Committee are
detailed below:
3.1 Applications: All applications for proposed improvements must be submitted inwriting using the application form authorized by the Covenants Committee. A copy of
this form is included as Exhibit A to this document. Until notified to the contrary,
homeowners should mail or drop off applications to the following address:
Covenants Committee, Braemar Community Association c/o Community
Management Corp., 12300 Iona Sound Drive, Bristow, VA 20136. All applications
must be submitted seven (7) days prior to a meeting date to be considered at the
meeting.
3.2 Right to Deny: The Covenants Committee has the right to deny any application froma homeowner in the event the unit has an outstanding violation of the Design
Guidelines which is not under appeal or in litigation.
3.3 Supporting Documentation: The application must include a complete and accuratedescription of the proposed improvements, including all plans and drawings.
Surveyor certified plat drawings are required when adding structures such as decks,
landscaping, or making other physical changes to the property. Improvements should
be drawn on plat with dimensions.
3.4 Time Frame for Completion of the Review: The Covenants Committee is required toprovide notification to homeowners of the approval or disapproval of any proposed
improvement within forty-five (45) days after receipt of completed application. If the
Covenants Committee does not respond within forty-five (45) days, the case will
automatically be referred to the Board of Directors. The Board is required to respond
within fifteen (15) days from the date of referral from Covenants Committee; failure
to act will constitute approval of the requested improvement. The Covenants
Committees forty-five day (45) review period will commence upon receipt of a
complete application, including any required exhibits.
3.5 Notice of Decision: Verbal notice is available within two (2) business days of thedecision and written notice thereafter as soon as possible following forty-five (45)days after receipt of a complete application.
**Approved project may not begin until 10 calendar days after the approval of the
application to allow an appropriate appeal period.

3.6 Appeals Procedure: Homeowners may appeal adverse decisions of the CovenantsCommittee to the Covenants Committee for reconsideration and, if necessary, to the
Board of Directors in accordance with the procedures below.
3.6.1 A homeowner may appeal a decision of the Covenants Committee bysubmitting a written request for reconsideration to the Covenants Committee.
This request should include any new or additional information which might
clarify the requested change or demonstrate its acceptability. The Covenants
Committee must respond, in writing, to a request for reconsideration within
forty-five (45) days from the date of receipt of such request and all required
exhibits.
3.6.2 If a request for reconsideration is denied by the Covenants Committee, thedecision may be appealed in writing to the Board of Directors using the
procedures detailed above. No appeals will be considered by the Board ofDirectors unless a prior appeal has been made to the Covenants Committee.
3.6.3 An appeal by a non-applicant homeowner must be received by the Board ofDirectors within ten (10) days following the date of the decision of the
Covenants Committee which is the subject of the appeal. The appeal must
detail the specific reasons why the decision of the Covenants Committee is
being appealed.
3.6.4 Upon receipt of such an appeal, the Board shall notify the homeowner, whoseapproved design review application is the subject of an appeal by certified
mail, return receipt requested, within forty-eight (48) hours after the date ofreceipt of an appeal by the Board. This notice shall inform the homeowner
that the decision of the Covenants Committee is being reviewed by the Board
of Directors pursuant to an appeal and that the homeowner shall not proceed
with any improvements until notified by the Board.
3.6.5 The Board must provide a written notice to both applicant and non-applicanthomeowners within fifteen (15) days after the date of receipt of the appeal by
the Board. This response shall be sent by certified mail, return receipt
requested.
3.6.6 All decisions made by the Board of Directors on appeals from the CovenantsCommittee shall be final as to all parties involved and no further appeal or
reconsideration shall be entertained.
3.7 Presence at Covenants Committee Meeting: Homeowner applicants and non-applicant homeowners on the agenda for a meeting may appear at the Covenants
Committee meeting to clarify their applications. This clarification shall not be in

place of clear documentation. Clarification statements shall not exceed five minutes
per application. After a brief question and answer period, the Covenants Committee
will reconvene into executive session.
4.0 Enforcement ProcedureThe Declaration empowers the Board of Directors to enforce compliance with the
Associations Architectural and Design Standards. The following enforcement procedures
will be used to ensure compliance.
4.1 The Board of Directors or its designee, on behalf of the Association, has the authorityto issue a Violation Notice to any Lot Owner whose conduct, behavior or use of the
property does not conform to the Governing Documents of the Association (e.g.
Declaration, Bylaws, etc.) and/or Rules, Regulations or Resolutions (hereinafter the
Rules), or for the conduct, behavior, or violations of the Governing Documents orRules by the occupants of the Lot of the Lot Owner, or for the conduct, behavior, or
violations of the Governing Documents and/or Rules by the Lot Owners guests,
invitees, employees and licensees, or who intentionally falsely accuses another Lot
Owner of a violation or infraction.
4.2 Except when an emergency requires immediate action by the Association, said Noticereferenced in paragraph 4.1 above shall be in writing and served by hand delivery or
by regular first class mail to the Lot Owner at the address which the Lot Owner shall
designate in writing and file with the management company (as agent for the
Association), or if no such address is designated by the Lot Owner, at the address of
the Lot of the Lot Owner.
4.3 The Violation Notice shall inform the Lot Owner of the nature of the offense and theprovision of the Governing Documents and/or Rules which has allegedly been
violated, specify the remedy required, state the corrective action required (if
applicable), and state the number of days within which the Lot Owner must complete
the corrective action (if applicable). Unless otherwise determined by the Board, the
Association shall provide the Lot Owner fifteen (15) days from the date of the
Violation Notice within which corrective action must be completed; however, the
Board of Directors reserves the right to change this time period as may be necessary
to fit a particular circumstance.
4.4 If the Lot Owner does not remedy the offense within the number of days stated in theViolation Notice, the Board of Directors shall set the time, date and place of the
hearing, at its discretion, with reasonable consideration given to the scheduling needs
of the Lot Owner. A Hearing Notice shall then be delivered to the Lot Owner which
shall state that the Lot Owner is entitled to a hearing before the Board of Directors to
contest the citation and that the Lot Owner may be represented by his or her counsel

at the hearing at the Lot Owners expense. The Hearing Notice shall further warn the
Lot Owner of the monetary charges or other specific sanctions that may be imposed
for the alleged violation of the Governing Documents and/or Rules. The Hearing
Notice shall be sent by hand delivery or by registered or certified mail, return receiptrequested, to the Lot Owner at least fifteen (15) days in advance of the hearing date
and shall state the time, date and place of the hearing. At the hearing, the Lot Owner
shall be given a reasonable amount of time to present any and all defenses to the
citation.
4.5 Following the hearing, the Board of Directors may convene in executive session todetermine whether satisfactory proof of the alleged violation was presented, and if so,
whether monetary charges should be imposed and/or whether the Lot Owners rights
and privileges should be suspended in accordance with Article 12, Section 12.1(h) of
the Declaration. Such suspension includes, but is not limited to, the suspension of
voting privileges and pool privileges. Monetary charges may not exceed $50.00 for asingle offense or $10.00 per day for any offense of a continuing nature, up to a
maximum of ninety (90) days; although the Board reserves the power to increase
these maximum charges if the Virginia General Assembly enacts legislation in the
future that permits the Board to do so. The Association shall treat monetary charges
as an assessment against the Lot of the Lot Owner. The Board of Directors may also
suspend the right of the Lot Owner, the right of any occupant of the Lot of the Lot
Owner, and any guests, licensees or other invitees to use the Common Element
facilities for the nonpayment of assessments, which are more than sixty (60) days past
due, until the delinquent balance due to the Association is paid in full.
4.6 The Association (through the Boards designee) shall advise the Lot Owner of thehearing results in writing delivered by hand or mailed by registered or certified mail,
return receipt requested, to the Lot Owner at his or her address of record with the
Association within seven (7) days of the date of the hearing.
4.7 The Board of Directors reserves the power to hold Lot Owners legally responsible forensuring that their employees, tenants, guests, agents or invitees comply with the
Governing Documents and Rules.
4.8 The procedures outlined in this Resolution shall be applied to all violations of theGoverning Documents and Rules other than the nonpayment of assessments, but do
not preclude the Association from exercising other enforcement procedures andremedies authorized by the Governing Documents and Virginia law, including, but
not limited to, the initiation of a lawsuit or self-help remedies. The Board of
Directors reserves the power to assign all of its powers and responsibilities herein to a
standing or special committee of its choice or to management.

4.9 The enforcement provisions set forth in this Resolution shall supersede and replaceany previously adopted enforcement provisions set forth in the Associations Rules or
Resolutions. Accordingly, the enforcement provisions set forth in the Associations
Design Guidelines and the Associations Lawn and Property Maintenance Resolutionare hereby void and replaced by reference with the policies and procedures set forth in
this Resolution.
5.0 Architectural and Design GuidelinesThe specific guidelines detailed below have been adopted by the Board of Directors and shall
be employed by the Covenants Committee in reviewing proposed modifications and
improvements.
5.1 Additions to home:5.1.1 The design of new space requires an application and all applicable county
permits.
5.1.2 Must be compatible in scale, massing, character, materials, and colorwith the original house. New windows and doors should match, and be
located to relate well with existing windows. The new roof pitch should
match the original roof.
5.1.3 The location of an addition should not have an adverse impact onneighboring properties or impair the view of neighbors. Additions should
be located to minimize the removal of trees and the destruction of natural
areas.
5.1.4 The Covenants Committee may require supplemental landscapetreatment to compensate for the removal of vegetation, or to soften the
addition visually.
5.1.5 Changes in grade or drainage must not adversely affect adjacent property.5.2 Air Conditioning Units (Window Mounted): Window Air Conditioning Units are not
permitted in any unit type within the Community.
5.3 Antennas and Satellite Dishes: Satellite dishes which are larger than one meter indiameter are prohibited. Satellite dishes which are one meter in diameter or less,
television antennas and MMDS (multi-channel, multipoint distribution) antennas are
permitted. Antennas and satellite dishes are subject to the guidelines below and do
not require prior approval from the Covenants Committee.

5.3.1 Location: Devices are not to be installed in the front of the lot or on thefront facade of a residence so long as another location exists on the lot or
residence from which an acceptable quality signal can be received. They
are to be located so as to be as visually unobtrusive as possible, withoutunreasonably increasing the cost of installation, maintenance and use and
without precluding the reception of an acceptable quality signal.
Whenever possible, the devices should be located in the rear yard, below
the height of privacy fencing. If they must be installed at roof level, then
they should be situated on the rear side of the roof ridge line, so as to
have no, or minimal, visibility from the front of the home.
5.3.2 Screening: To the extent possible, dishes and antennas should bescreened so that they are not visible either from the street or to other lot
owners.
5.3.3 Color: In order to minimize any adverse visual impact, a device which isaffixed to a residence should be painted to match the color of the portion
of the house to which it is attached, so long as painting the device will not
void the manufacturers warranty.
5.4 Awnings: Awnings require approval of the Covenants Committee. Only retractableawnings will be considered if demonstrated to be clearly compatible with the
architectural design and qualities of the home. They should be consistent with the
visual scale of the house to which attached.
Awnings must meet the following criteria:
5.4.1 Structural Supports: Canvas awning supports (or similar material) mustbe painted to match the trim or dominate color of the house.
5.4.2 Location: The location of any awning cannot adversely affect views,light, or natural ventilation of adjacent properties. Awnings must be
located in the rear yard and incorporated into a deck or patio design.
5.4.3 Material and Color: Fabrics must be either solid colors or stripes (two,one of which must be white), which are compatible with the color
scheme of the house. Color scheme of the home must be attached to theapplication. Pipe frames and mechanical devices for awnings should be
painted to match trim or dominant color of the house.
If awnings are removed for winter storage, frames should be secured or removed to
the extent possible. All awnings must be maintained in good condition.

the side wall, such as bay windows and HVAC units. Rear
plane is defined as the rear most corner of the structure on a
particular side of the structure. For example, rear corners of the
home may vary depending on the side of the home selected; therear plane is defined as the rear corner for the specific side of
the home.
5.8.1.2 Scale and Style: Decks, particularly elevated decks, will be of ascale and style compatible with the existing home. Specific
dimensions will be considered on a case by case basis.
5.8.1.3 Material: The vertical support posts, floor joists, floor of thedeck and any steps must be constructed of pressure treated
southern yellow pine, #2 grade or better. Synthetic or other
non-slip materials of comparable quality may be considered bythe Covenants Committee.
5.8.1.4 Standard Details: Decks must be constructed in accordancewith the standard design (illustrated in Appendix A-1)
irrespective of the size of the deck.
Three (3) alternative railing details are permitted, a modifiedChippendale, straight picket and black metal (illustrated in
Appendix A-4).
The decorative colonial post cap and the exterior fascia boardsincluded in the standard detail for picket railings may beomitted at the discretion of each applicant.
A reasonable number of sunburst panels may be installed witheither railing detail.
5.8.1.5 Color: Decks may be stained to match the existing wood trimof the home, clear, a natural wood color, or left untreated. All
colors shall be reviewed by the Covenants Committee.
5.8.1.6 Under-deck Lattice: Elevated decks have an under deck areawhich can have a negative visual impact on adjoining
neighbors, particularly when used as an informal storage space.
The use of decorative screening and landscaping to minimize
adverse visual impact is encouraged and may be required by the
Covenants Committee, particularly in the case of high decks.
The installation of framed lattice to screen the deck undercroft
is permitted for elevated decks. While it is preferred that tight
weave one inch wide lattice is used, all under deck lattice will

maintain a diagonal pattern. Any lattice will follow deck color
guidelines.
5.8.1.7

indicated. Note that all units have specific locations. See
Appendix A-2.
5.8.4.2 Scale and Style: Decks must be constructed in accordance withAppendix A-2. The maximum size of the deck varies
according to the type of unit.
5.8.4.3 Deck Stairs: All sizes shown in Appendix A-2 include theplacement of stairs. Stairs shall be set within the designated size
footprint. Generally, stairs from the deck are to be constructedwithin the deck footprint. However, if that is not possible, then
a standard run of stairs is permitted, in the area adjacent to the
home, shown leading away from the deck/patio footprint
(Appendix A-2). A standard run of stairs is defined as the
minimum steps required to reach ground level while meeting
county code requirements for riser height.

5.9 Gazebos and Screened Enclosures on Decks: (Not permitted in townhomesCondominium, Patio homes, or Courtyard homes.) For all other homes, materials
shall comply with that used for decks. Siding, trim, gutters, downspouts and shingles
shall match that of the home. The homeowner may enclose the lower portion of the
gazebo or leave it open. If left open, it shall comply with deck railing detail
(Appendix A-1). The structure may be stained to match the existing wood trim of the
home, clear or a natural wood color. All other colors must be submitted with a colorsample to be reviewed by the Covenants Committee.
5.10 Dog Houses / Dog Runs: Dog runs are prohibited. Dog houses may be permitted infenced yards, subject to approval by the Covenants Committee.
5.11 Exterior Decorative Objects: Approval will be required for all exterior decorativeobjects, whether natural or man-made, which were not part of the original
construction design, either as a standard or optional feature. Examples include;
bird houses, bird baths, driftwood, weather vanes, sculptures, fountains, free
standing poles of all types, house address numerals, and any items attached to
approved structures.
These will be evaluated in terms of their general appropriateness, size, location,
compatibility with architectural and environmental design qualities and visual
impact on neighborhoods and the surrounding area. Sculpture, bird baths, bird
houses and similar items are restricted to rear yard locations and should not be
visible from the front yard or a street.

5.12 Exterior Lighting: Lighting which is part of the original structure may not be alteredwithout prior approval of the Covenants Committee.
5.12.1 Applications for replacement or additional exterior lighting should include: the wattage height of the fixture above ground location on the property (shown on a certified plat for the lot) a description of the fixture(s) and, preferably, a photograph or cut sheet
from a catalogue
Proposed additional lighting will not be approved if it will result in an adverse
visual impact to adjoining neighbors due to location, wattage or other features.
5.12.2 Proposed replacement or additional fixtures must be compatible in style andscale with the applicant's house. Additionally, all light fixtures on a specific
side of the home will match in design, style and color.
5.12.3 Exterior lighting, including motion sensors, flood lights and entrance lightsshall be directed downward and not outside of the applicant's property. The
light should not illuminate outside of the applicants property. Low voltage
landscape lighting located along a walkway or among shrubbery may be
considered so long as it does not distract from the overall appearance of the
home.
5.13 Exterior Painting: Painting or staining to match the original color does NOT requirean application. Any exterior color change requires a Design Review Application be
submitted to the Covenants Committee. This requirement applies to:
siding doors shutters trim roofing other appurtenant structures
5.14 Fences: The Covenants Committee will review all fences prior to installation. Allhome types must refer to their specific home style for fence detail. Additionally, as
to maintain neighborhood harmony, homeowners are strongly encouraged to
consider their neighborhood's existing fence styles when selecting their design.
Gates may not connect / access to adjoining lots.
** Chain link fences are prohibited for all home styles.

5.14.1 Single-Family Detached Homes Lot-Line Fences (With the exception ofCourtyard Homes, Patio Homes, Duplex/Link Homes and Carriage
Homes)
5.14.1.1 Materials: It is preferred that fences be constructed of cedar,except that support posts should be constructed of pressure
treated southern yellow pine (#2 grade or better) Synthetic
materials are permitted, however, a material list along with
samples, brochures and pictures will be required for approval.
For child or pet restraint or pool security, a dark-colored vinyl
coated, 10 to 16 gauge wire mesh, in 2 x4 grid may be
securely and permanently attached to the lot side (interior) side
of the fence. Mesh shall not extend above the top rail of the
fence.
5.14.1.2 Fence Placement: Fences shall be lot line fences, therebyallowing adjacent homeowners to attach to existing fences.
Fences shall connect to the rear plane (or rear corners) of the
home on each side and shall not be erected forward of the rear
plane of the dwelling unit. In general, rear yard fences must be
located on the rear yard lot lines. However, precise fence
placement will be considered on a case by case basis. Any
precise fence placement exceptions due to, for example,
downspouts and trees, will be considered on a case by case basis.
5.14.1.3 Standard Fence Detail: Four (4) standard fence styles may beconstructed, although two are not permissible for all locations
within the community. The permissible standard fence styles are
described below and illustrated in Appendices B-1 through B-5.
Fences shall be installed so the finished side is seen when
looking at the fence from locations external to the lot (i.e., the
street). Alternative materials are allowed provided however that
they have a straight point top as illustrated in Appendix B-5.

beyond the side plane of the home to encompass the portion of
the yard between the lot line and the side plane of the home.
5.14.2.3 Standard Fence Detail: All lot line fences for single familyattached units shall be six foot high Board-on-Board (also known
as Shadow Box) Privacy Fence. This fence style is illustrated in
Appendix B-6.
5.14.2.4 Color: All fences must be stained with a natural wood color orclear sealant to preserve the wood.
5.14.3 Carriage Style (Side Driveways) and Alley Home Fences5.14.3.1 Materials and Standard Fence Detail: Standard features of each
carriage and alley homes are white vinyl gothic spaced picket
fences, which were installed by the Builder. In the event that
these fences require repair or replacement, the lot owner may
repair or replace with white vinyl or wood painted white tomatch material and fence style. The continuance must be
uniform. Fences must be constructed in accordance with the
standard fence detail in Appendix B-4. Side and rear yard fences
may also be constructed of either white vinyl or wood. Any
installed gates must conform to the style of fence so that in
essence one cannot notice a gate exists. Gates that extend across

the driveway of Carriage Style and Alley homes may be installed
in two ways (1) to connect from the rear corner of the home and
to the fence on the other side of the driveway or (2) to connect to
the builder-installed fence at the front corner of the home andextend to the fence on the other side of the driveway.
5.14.3.2 Location: Fences must be located on the lot lines. The builder-installed fence will be three feet (3) in height. All fencing
behind rear plane of home will be four feet (4) in height and
comply with fence detail (shown in Appendix B-4) and shall be
placed along the perimeter of the property line up to the rear
plane of the house. The fence placed in the front of the rear
plane of the house, to connect to the builder fence, will reduce to
a height of three feet (3),as detailed in Appendix B-4. Corner
lot fence height will be looked at on a case by case basis. AlleyCarriage style homes must go around the rear driveway and may
not have a driveway gate. All other material, fence detail,
location, and color are consistent to all Alley and Carriage
Homes; those details are contained in paragraphs above. This
fence location is illustrated in Appendix B-10.
**Gates for Carriage Style Homes with a Side Driveway (gates
that extend across the driveway). The gate may connect to the rear
corner of the home and attach to the fence on the other side OR the
gate may connect to the front corner of the home (builder installed
fence) and attach to fence on the other side.
5.14.3.3 Color: All fences will be white vinyl or wood painted white tomatch the front yard builder-installed fences. If the Carriage
Style home backs to a non-Carriage Style single family home,
the fence on the rear lot line (facing the non-carriage style home)
may be a natural wood color. The fencing facing the street must
remain white. All other carriage style homes will still be required
to paint the fencing white.
5.14.4 Barrhill Condominium FencesAn application must be made to the Covenants Committee prior to the
installation or extension of any fence in the Community. Unit owners may
apply for permission to enclose their Limited Common Element area with a
fence placed on or within the rearmost boundary of their rear yard Limited
Common Element.

5.14.7 New Castle Village Link/Duplexes Fences (Section JJ)The permissible standard fence style is the 6 foot high, white vinyl 6 SolidPrivacy with Framed Picket Top (Appendix B-7). A three foot wide gate
should be installed in the location indicated in the diagram and any installed
gate must conform to the style of the fence so that in essence one cannot
notice a gate exists. These fences must be located as shown in A-3.
5.15 Firewood:No application is required, provided firewood is kept neatly stacked,located to the rear of the residence and in such a manner as to avoid adverse visual
impacts for adjoining properties. Screening may be required in certain cases. Other
than a limited quantity of firewood intended for immediate use, firewood shall not
be stacked on patios or decks. Homeowners will take actions to discourage rodents.
** Firewood may not be stored within the boundaries of Barrhill property.
5.16 Flagpoles and Masts:5.16.1 Barrhill: It is prohibited to install free-standing or anchored flagpoles
and/or stationary masts or similar structures within the front or rear yard
Limited Common Element areas, within any Reserved Common Element
area designated by the Board, or within the Barrhill Common Element areas.
Banners and flags, as described below, may be displayed from a flag-pole,
no longer than six (6) feet, attached to the building at an angle.
5.16.2 All Other Home Styles: Flagpoles no longer than six (6) feet in length,which are attached to the building at an angle, shall be permitted on all
home styles. Free-standing poles require application to and approval by the
Covenants Committee. In reviewing such applications, the Committee will
examine the proposed pole size and position in relation to the size and style
of the home. Because of the smaller scale of courtyard, patio, townhome
and link/duplex homes, free-standing poles will generally not be permitted.
5.17 Garages: Garages may not be converted from use as vehicle storage to another usewithout permission from the Covenants Committee. A copy of the plans and
construction detail for structural alteration of a garage must be submitted to and
reviewed by the Covenants Committee prior to construction start.
For single family Carriage Style home garages see Appendix F for design detail.
The design detail laid out in Appendix F is for double car garages, but single car
garages are approvable with the same design detail followed.

5.17.1 Garage Door Replacement: If original garage doors require repair orreplacement, they must be repaired/replaced with the same style and color as
the original builder-installed garage door. The allowed exception will be
that the repaired/replacement garage door may have rectangular windowswith sunburst inserts installed in the following manor:
Double car garages with one door will have (8) rectangular windows. Double car garages with two doors will have (4) rectangular windows
per door.
Single car garages will have (4) rectangular windows. (Note: Garagedoor windows are not permissible in Barrhill).
Sunbursts inserts may be placed on the windows as follows:
Double car garages with one door will have four (4) inserts creatingone whole sunburst pattern and another (4) inserts creating one whole
sunburst pattern starting at the fifth window.
Double car garages with two (2) doors will have four (4) insertscreating one whole sunburst pattern.
All windows and inserts must be short panel, placed on the top row of the
garage door(s) and the same color as the original builder-installed door(s).
5.18 Hot Tubs/Spa: All Hot Tubs/Spas require a completed application and an approvalby the Covenants Committee. Hot Tubs/Spas shall be located only on the ground
level in the rear of the home, within the fence, and as close to the house as possible.The exterior finish or an elevated hot tub or spa will blend with the exterior finish
of the home, deck or patio to which attached or most closely related. Hot tub/spa
covers shall be of a solid neutral color.
5.19 Landscaping: There shall be no adverse drainage impact to adjacent neighborsand/or common area. Landscape plantings shall not interfere with any site distance
easements along streets maintained by the Virginia Department of Transportation
(VDOT). Plantings should also not impact ingress and egress to any driveway
and/or entrance. Additionally, plantings will be maintained to a clean and neat
appearance.
5.19.1 No application is required for the following modifications:5.19.1.1 Plantings of annuals or perennials in existing beds.5.19.1.2 New beds around house foundation (or deck, patio, or fence if
present) and around perimeter of the rear lot, provided that the

5.19.1.4 New beds around a mailbox post and around transformer/utilityboxes, provided that the new bed is less than two (2) feet squared
and plants installed have a mature height of less than three (3)
feet.
5.19.1.5 Edging material around existing or approved beds, provided thatit is installed at ground level.5.19.1.6 Individual trees or shrubs on the lot, provided that the tree or
shrub:
At maturity will not encroach beyond the property line. At maturity will be in scale with the home and lot. Does not interrupt designed drainage patterns, swales and
fence placement.
Dead tree removal within a homeowners property lines doesnot require approval by the Covenants Committee.
5.19.2 An application and review by the Covenants Committee is required forany other landscaping modifications, including those listed below:
5.19.2.1 Grass removal (other than that described in Paragraphs 2, 3, and4 above) and replacement with mulch or landscape ground cover.
Generally, applications for this type of grass removal will be
considered for limited areas; such as steep slopes.
5.19.2.2 Walls as landscape features and constructed of stone, masonry orkeystone. Walls should not exceed two feet in height. Natural
stone is the preferred material. However, brick or cultured stone
may be approved if consistent with design characteristics of the
home and adjoining properties.

5.19.2.3 Modifications requiring construction or that may result in agrade change, including retaining walls or garden structures,
such as trellises or gazebos.
5.19.2.4 Proposed improvements of a scale or type as to be potentiallyinconsistent with the scale and design features of the home,
adjacent homes and the surrounding area.
5.19.2.5 Shrubs or trees that at maturity will be more than three feet inheight and are intended to form a hedge or natural screen.
Landscape screens or barriers are not permitted on front
yard lot lines. Landscape screens or barriers in rear yards may
be approvable where intended to define private space or block
undesirable views. However, the Committee will consider any
adverse impacts on adjoining lots, including the disruption ofsight lines for adjoining properties and interruption of designed
drainage patterns.
5.19.2.6 Cutting of any live tree with a diameter exceeding four inches,measured twelve inches above ground. Cutting of flowering tree
(such as dogwood or redbud) or broad leaf evergreens (such as
holly, laurel, or rhododendron) with a trunk diameter exceeding
two inches and measuring twelve inches above ground.
5.19.2.7 Cutting of any live vegetation on slopes of greater than twentypercent gradient or marked no cut areas on approved siteplans. (Per the Braemar Community Association Declaration of
Covenants (Article 8, Section 8.2, paragraph k).
5.19.3 Courtyard Homes and New Castle Village Duplexes: Home landscapeplantings allowed will depend on the type and location of the unit, either
end or interior unit. Refer to Appendix G for details.
5.20 Mailbox Post and Box Color: Only mailboxes and post/newspaper boxes meetingthe design guidelines described below and shown in Appendix H are permitted.
The maintenance of the mail and newspaper box and post is essential for curb
appeal and is the responsibility of the homeowner.
5.20.1 Metal Mailbox Paint and Color: Rust-OleumOil-based - Hunter Green(#7538) or equivalent.

5.20.3Newspaper Box Color and Paint: Newspaper box and post should bepainted with McCormick Georgetown Green State Home Exterior Luster
(#27220 00) acrylic paint or equivalent.
5.20.4Newspaper Box Materials: Newspaper box should be made of pressuretreated 1 x 6 and 1 x 4 boards. The post is 4 x 4 pressure treated
wood with a gothic top. (See illustration in Appendix H).
5.21 Patios: All patios must be located in rear yards and require design applicationreview by the Covenants Committee. All applications submitted for patios shouldinclude construction detail and dimensions, including fire pits, sitting walls, stairs
and other details that will be constructed with the patio. The following will be
considered with each patio application:
5.21.1 Size of the patio will be reviewed for appropriateness of scale to lot andhouse.
5.21.2 Patio size and location must allow a minimum of 2 feet between patio andrear and side lot lines.
5.21.3 Patio construction materials shall be compatible with the overall colorscheme of the house.
Any adverse drainage impact which might result from the construction of a patio
should be addressed in the application, specifying the method to be used to remedy
the impact. The use of a partially porous patio surface or the installation of mulch
beds adjacent to the patio are ways to eliminate drainage concerns.
5.21.4 Courtyard Homes and Duplexes in New Castle Village: Maximum patiosize and location vary by unit type and are specified in Appendix A-2 and
A-3. The homeowner will consider and remedy any adverse drainage.
While brushed concrete is preferred for New Castle Village Link/duplexhomes, any non-slip material may be considered.
5.22 Recreation and Play Equipment: Permanent or semi-permanent play equipmentwhich constitutes a structure require a Design Review Application be submitted to
the Covenants Committee. These include: swing sets, playhouses, sand boxes,
trampolines, etc. All play sets or play equipment must meet the guidelines below:

5.22.1 Location: All play equipment must be located in the rear yard and should beset back a minimum of six feet (6) from the rear and side property lines.
The play area around the equipment should not encroach on otherproperties.
5.22.2 Size and Scale: The size of any play equipment should be compatible withthe size of the lot.
5.22.3 Screening: Play equipment should be sited to ensure minimal visual andnoise impact on adjoining lots. The Covenants Committee may require
landscape screening to minimize any adverse impacts.
5.22.4 Material and Colors: The use of wooden play equipment is preferred. Metalplay equipment, exclusive of the wearing surfaces, should be painted darktones to blend with the natural surroundings or, if located adjacent to a
home, painted to match the background or screening structure. The use of
bright colors on play equipment should be minimized. Where the play
structure includes bright colored plastic and/or fabric elements, these will
generally be acceptable if the basic structure itself is wood or metal which
can be painted in accordance with this guideline. Applications for such play
equipment should include a color photograph or catalogue cut sheet, the
physical dimensions of the equipment and proposed location on the lot
drawn on the plat. Equipment shall be kept in operable condition and shall
not become visually obtrusive.
5.23 Signs: No signs on common area. Generally, allowable signs include those listedbelow. Signs other than those listed below require that an application be submitted
to the Covenants Committee.
5.23.1 Real estate signs (of no more than four (4) square feet in area and placedonly in the front yard of a lot) advertising a property for sale or rent.
5.23.2 Home security signs (up to 2) located in the front and/or back of the homewithin 6 feet of the house.
5.23.3 Signs for political candidatesLimit of one (1) political sign per candidateper house. Political signs may be installed three (3) weeks prior to the
election date and must be removed the day after the election date.
5.23.4 Signs required by law (such as building permits).

5.24 Storage Containers: Applications are required for all containers. Only one freestanding composite container (such as Rubbermaid) will be allowed per home.
Containers must be colors such as beige, grey, clay or match the color of the home.
Applications must include a color photo and plat showing location of proposedcontainer.
5.24.1 Single Family Detached Homes: The container must be placed behind the rear plane of the home, abutting
the house or the deck. Where the rear yard is fenced, and the container
does not exceed four (4) feet in height, the container may be placed in the
corner of the rear yard.
Containers must be placed on a level surface. Maximum overall dimensions shall not exceed 5' wide x 4' deep x 4' in
height. Containers to be placed on a deck must not exceed the height of the deck
railing.
5.24.2 Townhomes: Containers must be located on a level surface and placed immediately
adjacent to the townhome or privacy fence, as shown in Appendix C.
Maximum overall dimensions shall not exceed 5' wide x 4' deep x 6' inheight.
5.25 Storage Sheds: Storage sheds are prohibited for single-family detached homes.Townhome owners, except Barrhill, may construct a rear yard storage shed, which
conforms to the standard detail illustrated in Appendix D. Sheds must be
constructed of siding trim and materials, which match the townhome in both
material and color. Doors must be centered in the wall facing the lots interior and
be painted or stained the same color as the entry door to the townhome.
5.26 Storm and/or Screen Doors: Full-view storm doors, defined as doors where theglass comprises at least 80 percent of the door surface, are permitted. Provided that
this criterion is met, there is latitude for a number of styles, including a
conservative design and amount of etching on the glass. Approved storm doorstyles are illustrated in Appendix E. Doors shall be white or painted to match the
color of the home entrance door behind the storm door. Doors which comply with
these guidelines do not require approval from the Covenants Committee. An
application is required for any storm door that does not conform to these guidelines.
Doors with decorative treatment, such as grills, are not permitted.

5.27 Swimming Pools: Only in-ground pools for single-family detached homes arepermitted. The Covenants Committee must review all pools. The Committee may
require appropriate screening of mechanical equipment to minimize any negative
visual impact. Please note, the Covenants Committee will not consider a poolapplication without inclusion of proper perimeter fencing.
5.28 Trash Container Enclosures or Landscape Screening: All trash containers must bestored out of view of the front of the home at all times except designated trash
pickup days. With Covenants Committee approval, appropriate exterior screening,
fencing or landscaping may be constructed behind the rear plane of the home.
5.29 Walkways: The Covenants Committee must review all walkways prior toinstallation.
5.29.1 Courtyard Homes: Walkways may be constructed from the front to the rearyard and from access doors to decks and patios. Stepping stones are
recommended for such access. Please consult Miss Utility of Virginia (1-
800-552-7001) prior to construction.
5.29.2 All Other Homes: Walkways in the front yard shall be limited to front doorto driveway or street curb. Walkways will be permitted in homes with side
entry garage doors to the driveway upon the submission of an application
with construction details of walkway installation. All walkways shall
conform to the color scheme of the home and the neighborhood setting.
Generally, walkways in the backyard should be kept to the minimum.Please consult Miss Utility of Virginia prior to construction (1-800-552-
