Possibly the complacence withwhich tho community contemplatesthe steerage accommodation of thoHawaiian Band, has Its foundation Inthe desire to reach tho small farmer.
Japan might, of course," refuse analliance with Russia for conscience's
'sake. Practical national combinationshowever, result from a deslro to Joinwith any country that will return thogreatest benefits and come tho nearestto fulfilling selfish ambitions.

TURN ON THE 8BARC1ILIGIIT
The situation found by TreasurerTrent In the garbage department pay-
roll demands n most searching andvigorously Just Investigation.
Common Justlco presupposes thatevery man Is Innocent until he Isfound guilty. Common Justice alsodemands that an apparent smirch up-
on a man's character shall bo fullycleared up for tho benefit of all con-
cerned. The public, tho taxpayers of the
County of Oahu, want to know thefacts and all tho facts regarding thomethods of dealing with the payrollsIn the department whero TreasurerTrent has opened up a condition tbatis peculiar, to say tho least.
According to the statement of factsTreasurer Trent has put before theSupervisors and tho people of this

County, '"there havo b'een 'irregularitiesIn handling tho garbage labor payroll. These Irregularities may be th$ re-
sult of carelessness or they may becriminal graft, Thero are possibili-
ties for both. The undeniable fact Is, tint the pay-
roll according to tho statement of menreceiving money, was not correct. They were not paid less than was duethem. They were paid more. Tho pay
roll called for this amount. The public, the taxpayers of tho
County, want to know why this con-
dition of affairs has been allowed toexist.
They want to know whether themethod of paying tho men of this andoilier departments Is equally lax
to that the only thing that stands be-
tween tho taxpa)crs' money and a
stuffed payroll Is the probable hones-ty of an unbonded official.
They want to know if tho Supervi-sors believe In this method of doingbusiness. This wilt bo determined by
the vote for or against Its continu-ance.
They will await with Interest who-thc- r
tho Investigation Isor Is gone at with a view to getting atthe true state of affairs and openingIt out fully to the citizens whose mon-
ey Is being used. Whether It Is Justor politically "diplomatic."
One thing the public will naturallyask of Treasurer Trent Is, why hostopped his quest for apparent Irrcg--,
mantles niter Having encountered tnofirst two or threo men. Why didn'the keep on down tho whole line?
The charge which Treasurer Trenthas made Is serious. It must not bo
handled In a spirit of factional or par-tlzn- n
politics. It cnrrles with it allsortf, of suppositions and Innuendo. Itattacks the Integrity of Individual of-
ficials nnd n system of payment forwhich prominent officers of the Coun-- 'ty havo stood sponsor. Tho peoplewill not accept nil Indifferent scanningwith tho announcement that It doesn't1
amount to anything anyway and theold system Is nil right.
For some time past tho most prodigal charges hnvo been made against'the department now In question and'tho road department. Always, howcv-- !
it, accompanied with the statement)that the author would lose his Job If!
he said anything. Naturally, a manguided by Kiich Ideals of honesty Isnot taken as especially courageous, or(worthy more than passing consideration. A man claiming to possess In-
formation of wrongdoing but refusesto disclose what he knows, properlygets credit for knowing nothing andpossessing ability only to defnme andgossip.
Treasurer Trent has brought beforethis community a specific Instance ol
what Is cither graft or an evidence of
tho tremendous opportunity for graft,It Is unfortunate that the bead of thedepartment Is not hero, but that doesnot prevent tlit progress of a searchlight campaign.
Nor does It prevent tho Board ol
Supervisors taking Immediate actionto establish a system for handling tho
labor payrolls of this and every otherdepartment that will Insuro tho most
strict 'integrity In dealing with thefunds of tho people, and an honest ac-
counting for every cent that passesthrough the hands of departmentmanagers.

Tho pay roll presented to the Countyis on the same lines as those lierctrr-for- e

It hns been the custom In theDepartment of Public Works wheremen arc hired by tho month, unlessotherwise specified to consider themonth by the number of Its calendardays. Hence a man who put In thofull number of working days In thomonth of say 31 dayB received pay forSundays and all. If the full monthwero worked It would matte no difference how many Sundays were In themonth.
The Garbage men have received asalary of $13.00 per month of 31 daysor 30 days, according to tho number ofdays In the calendar month, and forevery day, Sundays and all, the labor-

ADMIRABLEDAVID HAREM.
Among the books that will llvo andbe read as long a the English Lan-guage Is spoken Is that Admirable cha-racter sketch, David Harem. Now, Da-vid was an honest man In every re-
spect but one, he had a passion forskinning, even his best friend, In aIIOSS trade. Strange, Isn't It, thatone's conscience can be so elastic Ina HOSS trade? Strange, but too true.As a feature of a literary production, skinning a friend In a HOSS trademakes good reading, but applied to abusiness such as ours, would never do.If you have a horse to buy or sell, come around and wo will treat youfair; or If you want to take yourfriends out In an elegant e tally-
-ho, or a drive behind a nlco span, ora single horse, wo keep nothing butthe very best of vehicles and roadsters. Our prices are the same as others; ourconveyances are twice as good. Now,If you should want anything in ourlino call around nt tho TERRITORYSTABLES, or ring up Main 35. Wocall for and deliver rigs to any part oftho city. Gtvo us a call. 1 HIP. Danson Kcllett, the former clerknt Judge Do Uolt's court, who Is nowcharged with embezzlement of thofunds of the cstato of tho late M. A.Ilarette, of which ho was tho trustee, was seen by a IluIIetln reporter thismorning shortly before the beginningof the preliminary hearing before JudgoRobinson. Kcllett was asked what heknew about the 13300 bond which hofurnished as trustee, and which is nown. Using.
"I never saw that bond since thotime I (lied It," said Kellett. "WhenSlmonton asked me about It on thoSaturday before .last, I looked for Itbut could not find It I did not thenconsider It such a serious matter, butlater I saw that Its dlsappearancowould place me In a still worse lightI therefore looked all over for It, butI could not locate It. I thought Itmight possibly be among my estate pa-
pers, which I keep at home, so I madea thorough search of these but It wasnot there."It has very frequently happened that
pepers have been missing up here. Insomo cases they liao been found lat-er mixed up with other documents. It Is absurd to nccuso me of taking thobond away. As n matter of fart 1
wish that I could find It myself. Ithink that If I hnd been nhlo to findthat IjoiiiI I would have escaped thiscriminal proceedings altogether."
EMBEZZLEMENT LAW CANNOTREACH TRU8TEE.
(Continued from Page 4.)preliminary hearing to determinewhether tho cldcnco against Kcllettwas sufficient to warrant his commit-tal to tho Grand Jury. It was not a
trial. Tho char go ngalnst Kcllettcharged htm with embezzling a specificsum on a specific dntc and thus met alltho requirements. Tho other facts ask-
ed for by tho defense were mattersof proof. The only bill of particularshe would give was that Kellett on July1, 1905, embezzled the sum of (834.40
for taxes, which was the property oftho heirs and legatees If tho lato M
A. Darete.Ltgbtfoot and Magoon both argued In
favor of tbo rendering of the bill olparticulars, but Judge Itoblnson heldtbat tho defense was not entitled to It
as a matter of right Douthttt mightgho them ono by courtesy It he want-
ed to.The preliminary hearing was then
proceeded with.M. T. Slmonton, clerk of Judge Itob-
lnson, who reported on Kellctt'a ac-
counts, was tho first witness placed onthe stund by tho prosecution. Ho pro-
duced tho order appointing Kelletttrustee of tho estato of llurcto undera U'iOO bond. '
Magoon objected to tho Introductionof this as cUdcncc on tho grounds thatthero Vas not any stntuto In Hawaiiunder which a trustee could ho charg-ed with embezzlements of funds underhis charge as such. Tho trustee hadtnc logal title to the property In hischarge, and no ono could ho held forembezzlement of a thing to which hoheld the legal title. I.tghtfont followedwith, argument on tho same lines.Douthltt on the other hand held thattrustees could bo Includod under thoHawnllan embezzlement law, Tho mat-
ter wob finally continued until 2 p. m.

BRECKONS SO HOLDS
IN LEQAL OPINION
HOLDS THAT TERRITORIAL ACTIS CONTRARY TO CONSTITU-
TION AND ALSO TOTREATY.
" la an opinion delivered to the Hawaii Shlnpo United Stntcs District At-
torney Urcckons shows that tbo Terri-torial law excluding Japanese frompublic works Is unconstitutional. Thisopinion Is in part as follows:
The fourteonth amendment to thsConstitution brovldcs as follows;
"No state shall make or enforce anylaw which shall abridge the privilegesor Immunities of citizens of the UnitedStates; nor shall any stuto deprive anyperson of life, liberty, or propertywithout due process of law, nor denyto any person within Its Jurisdictionthe equal protection of the laws."
Tills provision is nlso enforced byBee. 1077, Revised suites, whlph Is aifollows:
"A!! persons within the Jurisdictionof the United States shall have thesame right In every State ond Terri-tory to make and enforce contracts, insue, ho parties, give evidence, nnd tothe full and equal benefit of nil lnwiand proceedings for the security ofpersons nnd property ns Is enjoyed bywhlto citizens, nnd shall ho subject tolike punishment, .pains, penalties, tnxta, licenses nnd exactions of ctery kind, nnd to no other."
Tho latter part of the amendment"nor deny to any person within ItsJurisdiction the equal protection of thelaws" has In every Instnnro In whichIt has been before the courts, been heldto cover tho caso of alt persons, wheth-er citizens or aliens, residing withinthe Jurisdiction; henco all aliens, resi-dents within tho Territory of Hawaii, nrc protected by tho clause.
The law of tho Territory of Haw-all- .
certainly discriminates between per-sons resident within tho Territory.By Its terms all persons are not equal-ly entitled to acquire and enjoy prop-erty. By Its terms, Impedimenta aroInterposed to tho pursuits of somewhich are not applied to the same pur-
suits by ths others. The Territorial Act Is as palpably
aimed at Japancso and Chinese labor,as though It had said so In as manywords. A very large percentage of laborers In tho Territory aro cither Jap-anese or Chinese. Under the laws ofthe United States neither Chinese norJapanese can become naturalized. Theact might Just as well liavo said thateverybody but Japanese and Chinesemight be employed on public works,Irrespectively of their citizenship.
I am not prepared to sny what myopinion would bo as to the validity ofa law preventing all aliens from engaging In public works.
Breckons further holds that thetreaty between Japan and the UnitedStates, ratified In 1895. opposes the Ter-ritorial law, which distinguishes clear-ly between subjects of Japan and thoseof other countries.
