Preventing the immigration detention of children
UNHCR’s position on the detention of refugee and migrant children
• Children should not be detained;
• Detention is never in their best interests;
• Appropriate care arrangements and community-based programmes need to be in place.
Convention on the Rights of the Child
• Appropriate protection and humanitarian assistance for asylum-seeking children (Article 22);
• Deprivation of liberty (Article 37b);
• The best interests of the child principle (Article 3).
