President Donald Trump Legal Team Press Conference Regarding Evidence of Election Fraud
Statements by Rudy Giuliani, Sidney Powell, and Jenna
Ellis
November 19, 2020
1
RUDY GIULIANI: Good afternoon and thank you very much 1
for coming. This is representative of our legal team. 2
We're representing Trump and we're representing the 3
Trump campaign. When I finish, Sidney Powell and then 4
Jenna Ellis will follow me and we will present, in 5
brief, the evidence that we've collected over the 6
last -- I guess it is two weeks. Also, Joseph DiGenova 7
and Victoria Toensing are here with me. There are a lot 8
more lawyers working on this, but I guess we're the 9
senior lawyers, and Boris Epshteyn. 10
So, I guess the best way to describe this is when 11
we began our representation of the President, we 12
certainly were confirmed with a very anomalous set of 13
results with the President way ahead on election night, 14
700,000 or 800,000 in Pennsylvania. Somehow, we lost 15
Pennsylvania. We have statisticians willing to testify 16
that that's almost statistically impossible to have 17
happened in the period of time that it happened. But, 18
of course, that's just speculation. As we started 19
investigating, both our investigations and the very 20
patriotic and brave American citizens that have come 21
forward are extraordinary. An extraordinary number of 22
people -- extraordinary number of witnesses. And what 23
emerged very quickly is -- is it's not a singular voter 24
fraud in one state. This pattern repeats itself in a 25
2
number of states -- almost exactly the same pattern 1
which, to any experienced investigator or prosecutor 2
would suggest that there was a plan from a centralized 3
place to execute these various acts of the voter fraud, 4
specifically focused on big cities and specifically 5
focused on -- as you would imagine -- big cities 6
controlled by Democrats, and specifically focused on 7
big cities that have a long history of corruption. 8
The number of voter fraud causes in Philadelphia 9
could fill a library. Just a few weeks ago there was a 10
conviction for voter fraud and one two weeks before 11
that. And I've often said, I guess sarcastically, but 12
it's true -- the only surprise I would have found in 13
this was if Philadelphia hadn't cheated in this 14
election, because for the last 60 years, they've 15
cheated in just about every single election. 16
You could say the same thing about Detroit. Each 17
one of these cities are cities that are controlled by 18
Democrats. Which means that they can get away with 19
anything they want to do. It means they have a certain 20
degree of control over -- certainly control the 21
Election Board completely and they control law 22
enforcement. And unfortunately, they have some 23
friendly judges that will issue ridiculously irrational 24
opinions just to come out in their favor. 25
3
So, let's start with the specifics. Pennsylvania: 1
In Pennsylvania, the margin of victory now for Biden, 2
which is a -- not a victory -- it's fraud -- is 69,140 3
votes. The reality is that we are now at a count of 4
618,770 ballots, for which have we have affidavits that 5
there was no inspection of that ballot at the time that 6
it was entered in the vote. 7
If it was a mail ballot -- mail ballots are 8
particularly prone to fraud -- we were warned about 9
that by Jimmy Carter -- President Jimmy Carter and 10
Secretary Baker, in a report about a dozen years ago, 11
in which they said that mail balloting is particularly 12
susceptible of fraud, that we should very carefully 13
consider ever doing it, and that it can be taken 14
advantage of. Justice Souter warned us of the same 15
thing, in a comment in an election law case. And even 16
the New York Times wrote articles about how dangerous 17
mail-in voting was. And this is the first time we ever 18
did it en masse and I think we proved that all three 19
are prophets. 20
It's not only susceptible to fraud, it is easily 21
susceptible to fraud, particularly if you have a plan 22
or scheme which sounds eerily similar to what Joe Biden 23
told us before the election -- that he had the best 24
voter fraud team in the world. Well, they were good. 25
4
I don't know that they were that good because they made 1
significant mistakes, like all crooks do, and we caught 2
them. One of them was pushing out Republican 3
inspectors. 4
Every state -- almost every civilized 5
country -- even Tanzania and places where you wouldn't 6
think of, have rules about inspectors, particularly for 7
the mail-in ballots. And why particularly for mail-in 8
ballots? Because they can more easily be defrauded, 9
and you can't check on it. 10
People who have never done a mail-in ballot, I'm 11
going to show you why it’s so easy. Well, you fill out 12
an envelope like this. You put your -- usually in New 13
York it would be your assembly district and the 14
precinct in which you're voting. You fill out your 15
name and address and you sign it. You then use an 16
inner envelope and you put the ballot inside the inner 17
envelope. You seal it off and you send it in. When 18
it's being counted, almost invariably in the in United 19
States, up until the mass cheating that went on in this 20
election, a Republican and a Democrat inspector, as 21
well as others if there are other parties, is allowed 22
to watch the unsealing of this ballot. Used to go on 23
all over America when we conducted honest elections 24
because the only time you can ever find out if it's a 25
5
fraudulent ballot is when it is looked at. The minute 1
you approve this, you just throw it away -- gone for 2
eternity -- the only thing left is the vote. That 3
could have been Micky Mouse. That could have been a 4
dead person. That could have been not filled out 5
properly. That could have been the same person 30 6
times. All these things have happened, by the way. That 7
could have been nothing filled out. We'd never know. 8
So, for example, the recount being done in Georgia 9
will tell us nothing because these fraudulent ballots 10
will just be counted again, because they wouldn't 11
supply the signatures to match the ballots. So, it 12
means nothing to have counted these ballots because, 13
for example, in Pennsylvania, where we have probably 14
our most precise evidence, 682,770 of these ballots 15
were cast, put in and they weren't inspected, which 16
renders them marked. They weren’t inspected, which 17
renders them ballots that are null and void -- cannot 18
be counted, have to be removed from the vote. Why? For 19
several reasons, not the least of which is, that was 20
basically only one of two places in the state where it 21
was done. So, in the other parts of the state there 22
was a legitimate inspection of the ballots. So, if you 23
have two different standards in different parts of the 24
state -- one favoring one part of the state, the other 25
6
disfavoring the other part of the state, that's classic 1
violation of the Equal Protection Clause of the United 2
States Constitution, Bush v. Gore being the most recent 3
case that teaches that. 4
That's not the only fraud that went on in 5
Pennsylvania. All of the other frauds carried out in 6
the other states by the Democrat bosses happened there 7
as well. For example, if you made a mistake in that 8
ballot and you lived in Philadelphia or in Pittsburgh, 9
you were allowed to fix the mistake. But if you lived 10
in the -- what would be considered more 11
Republican -- more Trump part of the state -- you were 12
given no such right. 13
One of our plaintiffs, Mr. Henry, cast an absentee 14
ballot and he failed to put it in the secure envelope 15
inside -- just put it in open, naked. That ballot was 16
cast aside because it was invalid, because that breaks 17
the privacy of the vote. In Pittsburgh and in 18
Philadelphia, if they noticed that there wasn't an 19
inner envelope, they'd contact the voter and allow them 20
to vote again or if he didn't fill it out completely, 21
or if he made a mistake and didn't sign his full name, 22
he was allowed to cure it. There is no such provision 23
under the law in Pennsylvania the Democrat Secretary of 24
State made that up in order to maximize the votes in 25
7
Philadelphia and Pittsburgh and to minimize the votes 1
in the other parts of the state. Clearly illegal, 2
clearly voter fraud, easily provable, hundreds of 3
witnesses, maybe thousands. 4
We have -- to give you another example -- we have 5
17,000 provisional ballots cast in Pittsburgh. Do you 6
know what a provisional ballot is? A provisional 7
ballot usually happens this way -- about 15,000 of the 8
17,000 happened this way. You walk in and say, "I'm 9
here to vote today." 10
11
"Oh, Mr. Giuliani, you already voted." 12
13
"I did? I don't remember voting." 14
15
"Oh yes, yes. You cast an absentee ballot." 16
17
"No, I didn't?" 18
19
"Yes, you did." 20
21
Why does that happen 17,000 times in Pittsburgh? 22
People walked in thinking -- actually 15,000 to be 23
precise -- why did it happen 15,000 times that people 24
in Pittsburgh walked in to vote and they had already 25
8
voted according to the Democrat election machine? Did 1
they forget -- that many people with bad memories in 2
Pittsburgh? Or is the following correct, that as 3
witnesses will testify, they were instructed by the 4
Democrat bosses, when they had a ballot in which there 5
was no one registered, just assign it to somebody. 6
Just assign it to Rudy Giuliani, so when Rudy 7
Giuliani -- maybe Rudy Giuliani won't show up to vote. 8
And if he does show up to vote, we'll give him a 9
provisional ballot. 10
That is what we call circumstantial evidence of 11
the fraud. The direct evidence of the fraud are people 12
who testified that, in fact, that's what happened to 13
them, as well as 50 to 60 witnesses we have for the way 14
they were treated and not allowed to inspect the 15
ballots. They aren't just not allowed to do it, they 16
were pushed. In a few cases they were assaulted. In 17
all cases they were put in a corral, so far away, 18
probably the closest they got is from here to the back 19
of that room. We could do like a -- did you all watch 20
My Cousin Vinny? It's one of my favorite law movies, 21
because he comes from Brooklyn. And when the nice lady 22
said she saw, and then he says to her, "How many 23
fingers have I got up?" And she says, "Three." Well, 24
she was too far away to see it was only two. These 25
9
people were further away than My Cousin Vinny was from 1
the witness. They couldn't see a thing. 2
Now, I don't know, are you going to tell me that 3
sixty people are lying? They didn't just tell me this. 4
They swore under penalty of perjury, which is something 5
no Democrat's ever done. You don't even ask Biden 6
about this. You don't put him under penalty of 7
perjury. He doesn't even get asked questions about it 8
He doesn't get asked questions about all the evidence 9
of the crimes that he committed. These people are 10
under penalty of perjury. Their names are on an 11
affidavit. They swear that they weren't allowed to 12
carry out their function as expected. 13
And it's not just a technical thing -- there's a 14
reason they did it. Why would you not allow people to 15
carry out the function they've been allowed to do for 16
50 years, 60 years? Why wouldn't you allow inspections 17
of those ballots? Because you knew you were going to 18
use those ballots to catch Biden up, and you had a big 19
road ahead of you. You had to catch him up for 700,000 20
to 800,000 votes that he was behind, and the only way 21
you were going to do it is with the mail-in ballots. 22
You couldn't have a Democrat and Republican inspector 23
around. They don't even have Democrats watching them, 24
10
because they'd be afraid that they'd be honest 1
Democrats who would say "You're cheating." 2
So that takes us to Michigan, where there was an 3
honest Democrat who said they were cheating. Let me 4
show you her affidavit, because I know you keep 5
reporting falsely that we have no evidence, that we 6
have no specific acts of fraud. That's because the 7
coverage of this has been almost as dishonest as the 8
scheme itself. The people are entitled to know this. 9
You don't have the right to keep it from them. You 10
don't have a right to lie to about it. They are. You 11
don't report to them that a citizen of this country, 12
very fine woman, who is willing to allow me to give you 13
her name -- I can't give you all these affidavits 14
because if I do these people will be harassed, they'll 15
be threatened, they may lose their job, they will lose 16
their friends. We've lost lawyers in this case because 17
they've been threatened. We've had lawyers that need 18
protection. What's going in this country is horrible, 19
and the censorship that you're imposing is making it 20
worse. 21
But Jessie Jacob is an adult citizen of the state 22
of Michigan. She's been an employee of the city of 23
Detroit for Decades. I know her age, but she can tell 24
you her age. She was assigned to voting duties in 25
11
September, and she was trained by the city of Detroit 1
in the State of Michigan. She was basically trained to 2
cheat. She says, I was instructed by my supervisor to 3
adjust the mailing date of these absentee ballot 4
packages to be dated earlier than when they were 5
actually sent in. The supervisor made that 6
announcement for all workers to engage in that 7
fraudulent practice. 8
That's not me saying that, that's this American 9
citizen saying that, under oath. I don't know, maybe 10
you could say she's lying, but you can't say there's no 11
evidence. This is what we call evidence. This is 12
direct evidence, not circumstantial. I've tried many, 13
many cases as have my colleagues here. You put a 14
witness on a witness stand, the witness is testifying 15
to their own knowledge. This witness goes on the 16
witness stand and she will say, "I was told to adjust 17
the date on the absentee ballots. I witnessed election 18
workers and employees going over to the voting booths 19
with voters in order to watch them vote and coach them 20
for whom to vote." Completely. She will testify to 21
that. I don't know. Biden's people can cross-examine 22
her, but you can't just throw it away. "Gee, there's 23
no evidence." Next time you say that you'll be lying 24
because there is evidence. 25
12
By the way, this is public. You can all get it. 1
Its attached to the complaint in Constantino v. The 2
City of Detroit. Then, she was instructed by a 3
supervisor not to ask for a driver's license or any 4
photo ID when a person was trying to vote. Don't ask 5
for an identification. Why would you not ask for 6
identification? Because you knew that a lot of people 7
not entitled to vote are going to come in and early 8
vote -- because you knew that illegal immigrants were 9
going to be allowed to vote. You knew if you lived in 10
Philadelphia, unless you're stunad, that's an Italian 11
expression for stupid, unless you were stupid, you knew 12
that a lot of people were coming over from Camden to 13
vote. They do every year -- happens all the time in 14
Philly. It's about as frequent as getting beaten up at 15
a Philadelphia Eagle football game. Happens all the 16
time -- all the time. And it is allowed to happen 17
because it is a Democrat, corrupt city and has been for 18
years, many, many years. 19
And they are carried it out in places they could 20
get away with it. They didn't carry it out in neutral 21
places. They didn't carry it out in Republican places. 22
They didn't carry it out where the law is respected. 23
They carried it out in a corrupt city where the 24
13
District Attorney releases criminals en masse, which is 1
why it has so much crime. 2
She also said, "I observed a large number of 3
people who came to the satellite location to vote in 4
person, but they had already applied for and submitted 5
an absentee ballot." So, she observed a lot people 6
voting twice. Again, this is Jessie Jacob, not me. I 7
was instructed not to invalidate any ballots and not to 8
look for any deficiency in the ballots. Why would you 9
do that? Because you're cheating -- on 10
purpose -- cheating. Intentionally cheating. You're 11
cheating as an institution. This is an instruction 12
from the Election Commission, or the employer to the 13
worker. Don't look for any deficiencies in the 14
ballots. "I was instructed not to look at any of the 15
of the signatures on the absentee ballots." If she was 16
instructed not to look for any of the signatures on the 17
absentee ballots, why the heck do you sign it in the 18
first place? In order to identify it. She was 19
instructed not to do that because many of the absentee 20
ballots were fraudulent and they knew that. And they 21
didn't want to have a count of that. 22
"On November 4, 2020, I was instructed to 23
improperly pre-date the absentee ballots when the 24
receipt date was actually was after November 3rd, 25
14
2020." Now this is really significant because Justice 1
Alito of the Supreme Court instructed Pennsylvania that 2
any ballot that comes in after 8:00 o'clock on 3
November 3rd 2020, had to be put aside and not only 4
because it's a question as to its legality and its 5
constitutionality. What she's telling you is that they 6
blatantly disregarded that order, that they took 7
ballots that were marked the 4th and the 5th and the 8
6th, and they marked it down for the 3rd in blatant 9
disregard of the order of the United States Supreme 10
Court. 11
This is -- I don't know if she's a Democrat or a 12
Republicans, I assume if she's working for the City of 13
Detroit that she's a Democrat. I assume, but I may be 14
wrong. She's a citizen. I have never met her -- never 15
coached her. And I'd like you to know that it's signed 16
under penalty of perjury. We have a hundred more of 17
these. I can't show them to you because those people 18
don't want to be harassed. They don't want to have 19
their lives torn apart by the goons on the other side. 20
We don't do that to them. They've done that to a lot 21
of our people. They've done it for four years. And 22
it's outrageous that it's tolerated. And it's 23
tolerated because you condone it in the press. You 24
don't cover it. You don't condemn it. And it 25
15
shouldn't happen to a Republican, or a Democrat. A 1
lawyer shouldn't have to withdraw from a case because 2
he's representing the President of the United States. 3
There are many more affidavits here. I'd like to 4
read them all to you, but I don't have the time. You 5
should have had the time and energy to go look for 6
them. That's your job like it's my job to defend the 7
President. And I represent the President. It’s your 8
job to the read these things and not falsely report 9
that there's no evidence. Do you know how many 10
affidavits we have in the Michigan case -- 220 11
affidavits. They're not all public, but eight of them 12
are. Four affiants here -- those are people who give 13
affidavits -- who report an incident that under any 14
other circumstances would have been on the front page 15
of all of your newspapers if it didn't involve the 16
hatred that you have -- the irrational, pathological 17
hatred that you have for the President. 18
What they swear to is that at 4:30 in the morning 19
a truck pulled up to the Detroit center where they were 20
counting ballots. People thought it was food, so they 21
all ran to the truck. It wasn't food. It was 22
thousands and thousands of ballots. And the ballots 23
were in garbage cans. They were in paper bags. They 24
were in cardboard boxes, and they were taken into the 25
16
center. They put out a number of tables. At that 1
time, they thought all the Republican inspectors had 2
left. All but two had. And an employee of Dominion, 3
who we will address a little bit later -- Dominion. 4
And here's what they jointly swear to: That every 5
ballot that they could see everything they could 6
hear -- these were ballots for Biden. When they saw a 7
ballot, these were ballots only for Biden, meaning 8
there was no down ticket, just Biden. Many of them 9
didn't have anything on the outer envelope because 10
these ballots were produced very quickly, very swiftly, 11
and they're estimated to be minimum of 60,000 maximum 12
of 100,000. Many of them were triple-counted which 13
means they were put into the counting machine this way 14
– once, twice, three, times. 15
I didn't see that. I don't know that but for the 16
fact that three American citizens are willing to swear 17
to it. And we're not going to let them go to court and 18
do that? We're going to let this election go by, and 19
when there are, in this case, 60 witnesses that can 20
prove what I'm saying to you and other acts of fraud in 21
Michigan? And what's happened to this country if we're 22
going to let that happen? What's happened to this 23
country if we're going to cover that up? We let Al 24
17
Gore carry on an election dispute longer than this one 1
has been going on for one state and for chads. 2
This happened in Pennsylvania, it happened in 3
Michigan. Michigan, probably right now if I count up 4
the affidavits, just one case alone, Trump v. Benson, a 5
case that we dismissed today because that case was 6
attempting to get the Wayne County Board of Supervisors 7
to certify. Well, they didn't; they decertified. That 8
case has 100 affidavits and the hundred affidavits show 9
essentially what I've talked to you about -- counting 10
ballots improperly, counting them three or four times, 11
having people vote three or four times, changing and 12
backdating ballots to the point of at least 300,000 13
illegitimate ballots that we can specifically identify. 14
The margin in Michigan was is 146,121, and these 15
ballots were all cast basically in Detroit that Biden 16
won 80/20. So, you see it changes the result of the 17
election in Michigan if you take out Wayne County, so 18
it's a very significant case. That is being raised in 19
the case of Constantino v. The City of Detroit, not by 20
us, by an individual plaintiff. We are helping and 21
assisting in that case, however. And you can find all 22
the affidavits that you want filed in that case. You 23
can find out not just allegations; they're allegations 24
supported by sworn testimony, which is a lot better 25
18
than Joe Biden has ever done on anything. He doesn't 1
answer questions, must mush lest give sworn affidavits. 2
Wisconsin: Wisconsin had a very small 3
margin -- 20,544 last time I looked. And Wisconsin, 4
without going into great detail -- very similar plan 5
with the Republicans shut out in the city of Milwaukee 6
and also in Madison -- Republicans almost universally 7
shut out from the absentee process, not allowed to 8
inspect, not allowed to look at the ballots. 9
We have in Milwaukee and in the state of 10
Wisconsin a much stricter law. Wisconsin doesn't allow 11
mail-in ballots. They didn't buy into the big mail-in 12
ballot situation. Wisconsin, when you look at their 13
constitution, it almost seems to not like absentee 14
ballots. They state it's not a right, it’s a 15
privilege. And they have very, very strict procedures. 16
And the strict procedure says that you can't be given 17
an absentee ballot, you have to personally apply for 18
one. It's illegal, basically, to solicit a vote. And 19
they have actually, many reasons for it. It probably 20
goes back to their progressive days. When I say 21
progressive, I mean late nineteenth century, early 22
twentieth century progressive, when that really meant 23
progressive, not retrogressive. 24
19
So, there were 60,000 ballots in Milwaukee County, 1
and 40,000 ballots in Madison that, as far as we can 2
tell, and this is why we've ordered, because we have 3
very good information that numbers are going to come 4
out about here, that don't have applications. Under 5
the law of the State of Wisconsin, which has already 6
decided if there's no application for an absentee 7
ballot, the absentee ballot is thrown away. This all 8
happened in two places in Wisconsin. It didn't happen 9
in northern Wisconsin. It didn't happen in Republican 10
Wisconsin. It didn't happen in neutral Wisconsin where 11
there's an equal number of Republicans and Democrats. 12
It happened in a place where the vote was 75-80% for 13
the Democrat. You take away any number of those and 14
that 20,000 lead disappears. In other words, if you 15
count the lawful votes, Trump won Wisconsin by a good 16
margin. Indeed, if you count the lawful votes in 17
Pennsylvania, he won by about 300,000 votes. 18
Also, in the lawsuit filed Wisconsin which is 19
really a petition because of their procedures, there 20
were no inspectors provided for the counting of illegal 21
ballots. There were numerous backdated ballots. We're 22
just counting them now, run over into the thousands. 23
And there were many precincts in which there was an 24
overvote. And let me explain to you what an overvote 25
20
is, which is something you should have explained to the 1
American people because it's about the clearest 2
circumstantial evidence of massive fraud can you have. 3
An overvote is if 200% of the people who are registered 4
in the district vote. Think about that: 200% of the 5
registered voters in the district vote. What does that 6
mean? That means somebody voted twice. That means 7
somebody who's not entitled to vote, voted -- an 8
illegal, a person from another city or state, a person 9
who's not registered. But what it means is that those 10
were illegitimate votes. You don't have an overvote of 11
200 percent or 300 percent. You don't have an overvote 12
of 100%. Most precincts don't have a 100% turnout. In 13
fact, classically it's considered to be an overvote if 14
you go over 80%. Well, in Michigan and Wisconsin we 15
have overvotes in numerous precincts of a 150% or 200% 16
and 300%. One of the reasons why the two Republicans 17
didn’t certify, in Wayne, Michigan -- Wayne County, 18
Michigan -- is because the overvote was so high, 19
monstrously high, in about two-thirds of the precincts 20
in the City of Detroit, which means, magically, 21
two-and-three times the number of registered voters 22
turned out to vote. In fact, we have precincts in 23
which two times of the number of people who live there, 24
including children, voted. It's absurd. 25
21
The frustration of this is, what I'm describing to 1
you is massive fraud. It isn't a little teeny one. 2
It's isn't, you know, a hundred votes switched here or 3
there. Georgia -- we're about to file a major lawsuit 4
in Georgia. That will be filed, probably tomorrow. I 5
don't need to go through it -- virtually the same 6
things I told you before. In the City of Atlanta, the 7
Republicans were not allowed to watch the absentee 8
mail-in ballot process. Inspections were completely 9
cast aside. And we have numerous double-voters. We 10
have numerous out-of-state voters. And we have 11
specific evidence of intimidation and changes of vote. 12
That will all be in the lawsuit that comes out 13
tomorrow. 14
Arizona is a state that we're looking at very, 15
very carefully. I would say we're probably going to 16
bring a lawsuit in Arizona -- more than probably. I 17
think we are going to bring a lawsuit in Arizona; we're 18
still collecting that evidence. And the state that 19
we're looking at that would surprise you is, we have 20
very, very significant amount of fraud allegations in 21
the state of New Mexico, which -- and we have a 22
significant number of allegations in the state of 23
Virginia. We don't know yet whether the number in 24
22
Virginia will reach a number that can turn the 1
election. 2
The states that we have indicated in -- Georgia 3
Pennsylvania, Michigan, Wisconsin, Nevada, and Arizona, 4
we have more than double the number of votes needed to 5
overturn the election, in terms of provable illegal 6
ballots. All you got to do to find out if I'm 7
misleading you at all is to look at the lawsuits. Look 8
at what's alleged. Look at the affidavits. Maybe we 9
can supply more affidavits. In order to do it I need 10
to get permission from the people, but in the materials 11
I have here there are at least ten that come from 12
citizens. We have a thousand, at least. And we're 13
getting more every day, and there are other aspects of 14
this fraud that at this point I really can't reveal. 15
This is really enough. It's enough to overturn any 16
election. It's disgrace what happened. 17
And I'll conclude by asking you to just think 18
about this for a minute: What happened on the morning 19
of November 3rd when they were going to count this new 20
kind of ballot -- this mail-in ballot? Did every 21
Democrat leader in Pennsylvania and in Michigan and in 22
Wisconsin and in Georgia and in Nevada and in 23
Arizona -- did they all wake up and all separately have 24
the same idea? Did they all separately have the idea 25
23
that we are going to put Republican inspectors in 1
pens -- we're not going to let them look at mail-in or 2
absentee ballots? Did they all independently come up 3
with that, just by coincidence? Hey, we're going to 4
put the Republicans in pens and corrals -- we're going 5
to do it in Pittsburgh; we're going to do it in 6
Philadelphia; we're going to do it in Detroit; we're 7
going to do it in Milwaukee; we're going to do it in 8
Las Vegas; we're going to do it in Phoenix; we're going 9
to do it in Atlanta -- or, is it the logical conclusion 10
that I think any jury would accept as they heard this 11
evidence that somebody had this plan? Maybe that was 12
always the plan -- to do this very, very questionable 13
form of voting which has been criticized by President 14
Carter, by Secretary Baker, by most experts on election 15
reform. I think the logical conclusion is this is a 16
common plan and a common scheme that comes right 17
directly from the Democrat Party and it comes from the 18
candidate. Clearly. That's the reason why Hillary 19
Clinton said, "Don't concede if even if you're losing." 20
That's the reason we had a Freudian slip by the 21
candidate when he said he had the best voter fraud team 22
in the country. That's the reason why he probably 23
didn't have to go out and campaign. He had to have 24
known what they were going to do. This had a to be 25
24
planned in advance. I'm kind of checking, did they go, 1
you know, to the same contractor to get the corrals to 2
put the republicans in. 3
This is a disgraceful thing that was done in this 4
country, probably not much more disgraceful than the 5
things these people did in office, which you didn't and 6
don't bother to cover and you conceal from the American 7
people. But we let this happen. You know, we use 8
largely the Venezuelan voting machine, in essence, to 9
count our vote. We let this happen, we're going to be 10
become Venezuela. We cannot let this happen to us. We 11
cannot allow these crooks, because that's what they 12
are, to steal an election from the American people. 13
They elected Donald Trump. They didn't elect Joe 14
Biden. Joe Biden is in the lead because of the 15
fraudulent ballots, the illegal ballots, that were 16
produced and that were allowed to be used after the 17
election was over. Give us an opportunity to prove it 18
in court and we will. 19
Now I'm going to ask. Sidney Powell to describe 20
to you what we can describe about another totally 21
outrageous situation. I don't think most Americans 22
know that our ballots get calculated -- many of 23
them -- outside of the United States and are completely 24
open to hacking -- completely open to change -- and 25
25
it's being done by a company that specializes in voter 1
fraud. I'll let Sidney describe that to you. 2
3
SIDNEY POWELL: Thank you, Rudy. What we are really 4
dealing with here and uncovering more by the day is the 5
massive influence of communist money through Venezuela, 6
Cuba, and likely China in the interference with our 7
elections here in the United States. The Dominion 8
voting systems, the Smartmatic technology software and 9
the software that goes in other computerized voting 10
systems here as well, not just Dominion, were created 11
in Venezuela, at the direction of Hugo Chavez, to make 12
sure he never lost an election after one constitutional 13
referendum came out the way he did not want to come 14
out. 15
We have one very strong witness who has explained 16
how it all works. His affidavit is attached to the 17
pleadings of Lin Wood in the lawsuit he filed in 18
Georgia. It is a stunning, detailed affidavit because 19
he was with Hugo Chavez while he was being briefed on 20
how it works. He was with Hugo Chavez when he saw it 21
operate to make sure the election came out his way, 22
that was the express purpose for creating this 23
software. He has seen it operate, and as soon as he 24
saw the multiple states shut down the voting at on the 25
26
night of the election, he knew the same thing was 1
happening here, that was what had gone on. 2
Now the software itself was created with so many 3
variables and so many back doors that can be hooked up 4
to the internet, or thumb drive stuck in it, or 5
whatever, but one of its most characteristic features 6
is its ability to flip votes. It can set and run an 7
algorithm that probably ran all over the country to 8
take a certain percentage of votes from President Trump 9
and flip them to President Biden, which we might never 10
have uncovered had the votes for President Trump have 11
been so overwhelming in so many of these states, that 12
it broke the algorithm that had been plugged into the 13
system, and that's what caused them to have to shut 14
down in the states they shut down in. That's when they 15
came in the back door with all the mail-in ballots, 16
many of which they'd actually fabricated. Some were on 17
pristine paper with identically matching, perfect 18
circle dots for Mr. Biden. Others were shoved in in 19
batches -- they're always put in in a certain number of 20
batches, and people would rerun the same batch. This 21
corresponds to our statistical evidence that shows 22
incredible spikes in the vote counts at particular 23
times and that corresponds to eyewitness testimony of 24
27
numerous people who have come forward and said they saw 1
the ballots come in the back door at that time. 2
Notably, the Dominion executives are nowhere to be 3
found, now. They're moving their offices overnight to 4
different places. Their office in Toronto was shared 5
with one of the Soros Entities. One of the leaders of 6
the Dominion project overall is Gordon Malloch-Brown, 7
Mr. Soros' number-two person in the UK and part of his 8
organization. There are ties of the Dominion 9
Leadership to the Clinton Foundation and to other known 10
politicians in this country. Just to give you a brief 11
description of how this worked, I'm going to quote from 12
a letter that was written, and I will read that to make 13
sure I get the quotes right. This person was objecting 14
to the United States acquisition of is he Sequoia 15
Voting Systems by Smartmatic, a foreign owned company: 16
17
"I believe this transaction raises exactly the 18
sort of foreign ownership issues that Cepheus is 19
best positioned to examine for national security 20
purposes. It's undisputed that Smartmatic is 21
foreign-owned and that it has acquired Sequoia." 22
23
They keep changing the names as they go along. 24
Different times, when a problem comes up you can just 25
28
create a different corporation and call it a different 1
name, but it was a voting machine company doing busines 2
in the United States. 3
“Sequoia voting machines were used to record over 4
125,000,000 votes during the 2004 Presidential 5
election in the United States. Smartmatic, now 6
acknowledges that Antonio Mugica, a Venezuelan 7
businessman, has controlling interest in 8
Smartmatic, but the company has not revealed who 9
all the Smartmatic owners are. According to the 10
press, Smartmatic's owners are hidden through a 11
web of offshore private entities, and that is, in 12
fact true. Smartmatic has been associated with 13
the Venezuelan government led by Hugo Chavez, 14
which is openly hostile to the United States.” 15
and of course as we all know communistic and really 16
brutalizing its own people. 17
“The system has been continued there by 18
Mr. Maduro; it insured his election. Smartmatic's 19
possible connection to the Venezuelan government 20
posits a potential national security concern in 21
the context of its acquisition of Sequoia because 22
electronic voting machines are susceptible to 23
tampering and insiders are in the best position to 24
29
engage in such tampering. This letter expresses 1
the concern of the Chicago 2006 primary election. 2
And it ends by saying, 3
“The products and services that are of Venezuelan 4
origin and evaluates Smartmatic's ownership to 5
determine who could have influence and control 6
over these and other Sequoia products and services 7
are important to the national security of the 8
United States.” 9
This letter was written to Hank Paulson on 10
October 6, 2006 by Congresswoman Carolyn B. Maloney. 11
Senators Klobuchar and Warren have raised these 12
concerns as recently as December 2019. Why our 13
government has not taken them seriously is beyond my 14
comprehension unless some of the three-letter agencies 15
have used them themselves in other parts of the world. 16
We know that the technology was exported to affect an 17
election in Argentina. That's admitted by our friend 18
who wrote the affidavit about Hugo Chavez and his 19
interest in Smartmatic. Again, in 2006, Carolyn 20
Maloney wrote the Honorable John Snow, the Secretary of 21
the Treasury about the issues. 22
Speaking of Smartmatic's leadership, one of 23
Smartmatic's patent holders -- Eric Coomer, I believe 24
his name is -- is on the web as being recorded in a 25
30
conversation with Antifa members saying that he had the 1
election rigged for Mr. Biden, nothing to worry about 2
here. And he was going to -- they were going to 3
"F- Trump." His social media is filled with hatred for 4
the President and For the United States of America as a 5
whole, as are the social media accounts of many other 6
Smartmatic people. 7
There has been widespread use of this. Dominion 8
itself is utilized in 2,000 jurisdictions in 30 states. 9
It has been uncertifiable in multiple states who 10
realized all of the problems that it has including 11
Texas. Experts have described it across the board from 12
a Princeton group of three professors to experts that 13
we've talked to about its end user vulnerabilities. 14
People can admittedly go in and change whatever they 15
want. They can set the ratio of votes from one thing 16
to another. They can say that a Biden vote counts as 17
1.25 and a Trump vote counts .75, and those may be the 18
numbers that were actually used here. 19
It's not just the swing states that were affected. 20
The algorithm was likely run across the country to 21
affect the entire election. Like I said, we only 22
discovered it this year because of the overwhelming 23
number of votes for President Trump in the swing states 24
that caused machines to have to shut down for them to 25
31
backfill for adding votes. We have evidence of 1
different numbers of votes being injected into the 2
system, the same, identical, unique six-digit number 3
multiple times in at least two states that we've 4
analyzed so far, and I'm talking about 341,542 votes 5
for Biden and 100,012 for Trump. There's no 6
explanation, no logical explanation for the same 7
numbers being injected 20 minutes apart into the 8
machine. 9
The software manual itself, you can download it 10
from the internet, and I would encourage you all to 11
read it because it specifically advertises some of 12
these things as features of system. Why it was ever 13
allowed into this country is beyond my comprehension 14
and why nobody has dealt with it as absolutely 15
appalling. The machines were easily accessible to 16
hackers. There's video on the net that will explain to 17
you how a kid with a cell phone can hack one of these 18
voting machines. 19
There's been no oversight of Dominion or its 20
software. Workers in each county were trained by 21
Dominion, but there's no evidence of any monitoring 22
otherwise. We have testimony of different workers 23
admitting that they were trained how to dispose of 24
Trump votes and add Biden votes. The software has a 25
32
feature pursuant to which you can drag and drop any 1
number of batches of votes to the candidate of your 2
choice or simply throw them away, so we have 3
mathematical evidence in a number of states of massive 4
quantities of Trump votes being trashed -- just simply 5
put in the trash like you would in your computer with 6
any file, and Biden votes being injected. That's in 7
addition to the flipping. 8
I mean, it really happens in two ways. There's an 9
algorithm that runs that automatically flips all of the 10
votes and then each operator has the ability to go in, 11
override settings, they can ignore signature, they can 12
ignore the top line of the ballot, they can go down 13
ballot and select who they want to change the results 14
for, The gentleman who founded Smartmatic, there's 15
video of him on the internet explaining that, yes, on 16
at least one occasion he admits they changed a million 17
votes with no problem. 18
Many of the jurisdictions that have had this 19
problem might not have known of the issues, but many 20
did. And I think a full-scale criminal investigation 21
needs to be undertaken immediately by the Department of 22
Justice and by every State's equivalent Attorney 23
General's office or state investigatory unit because 24
there's evidence of different benefits being provided 25
33
to the people who spent $100,000,000 of money at the 1
last minute for their state to get the Dominion voting 2
systems put in in time for election in different ways. 3
There's one person that a lawyer told me got election 4
insurance, meaning that he would be able to make sure 5
he was elected. I'm sure they explained that feature 6
in detail to many people who expressed interest in 7
putting this voting system in. 8
Texas denied certification of the Dominion system 9
in 2019, but there are, no doubt, issues with the 10
software that Texas did use unbeknownst to Texas, I 11
would imagine, since they went to great trouble to 12
examine the Dominion systems and reject them, but other 13
software in the source code that does the alterations 14
is embedded, we've been told, in the source code all 15
across the country in all the voting machines. There's 16
no doubt it has been used to alter elections in other 17
countries. We know specifically that Venezuela 18
exported it for that purpose to Argentina and other 19
Latin American countries to make sure that the corrupt 20
rulers who were willing to pay the highest price for 21
being in office were allowed to rig their elections. 22
This is stunning, heart-breaking, infuriating, and 23
the most unpatriotic acts I can even imagine for people 24
in this country to have participated in, in any way, 25
34
shape, or form, and I want the American public to know 1
right now that we will not be intimidated. American 2
patriots are fed up with the corruption from the local 3
level to the highest level of our government, and we 4
are going to take this country back. We're not going 5
to be intimidated. We're not going to back down. We 6
are going to clean this mess up now. President Trump 7
won by a landslide. We're going to prove it, and we're 8
going to reclaim the United States of America for the 9
people who vote for freedom. 10
11
JENNA ELLIS: My name is Jenna Ellis and I'm a senior 12
legal advisor to the Trump campaign and I'd like to 13
just explain now where we've been and where we're at, 14
and what you can expect from this process. 15
So, what you have heard, I'm sure, in the fake 16
newspapers tomorrow will be one of two things, either 17
there was not sufficient evidence that we've presented, 18
or we spoke too long. Okay, so what you've heard now is 19
basically an opening statement. This is what you can 20
expect to see when we get to court to actually have a 21
full trial on the merits, to actually show this 22
evidence in court and prove our case. This is not a 23
Law and Order episode where everything is neatly 24
wrapped up in 60 minutes. 25
35
For those of you who are here in this room or have 1
maybe tuned out in other networks, clearly, you've 2
never been court reporters. Trials take time. Putting 3
on evidence takes time. This is basically an opening 4
statement so the American people can understand what 5
the networks have been hiding and what they refuse to 6
cover, because all of your fake news headlines are 7
dancing around the merits of this case and are trying 8
to delegitimize what we're doing here. 9
Let me be very clear that our objective is to make 10
sure to preserve and protect election integrity. 11
President Trump has been saying from day one that this 12
is about maintaining free and fair elections in this 13
country. It is not about overturning an outcome. It 14
is about making sure that election integrity is 15
preserved, and every American should want that. If 16
every American is not onboard with that you have to ask 17
yourself why. And if your fake news network is not 18
covering this, or allowing you cover it fairly and 19
accurately, you should ask yourself why. It is 20
absolutely a legitimate legal basis. 21
We have been asked to provide an entire case that 22
generally would take years in civil litigation. I've 23
been a prosecutor. I have tried cases with far simpler 24
36
facts. One thing happened in a matter of minutes and 1
it still takes days. And we go through a jury process. 2
This is the court of public opinion right now. We 3
are not trying our case in the court of public opinion, 4
because if we were, we would get unbiased jurors. I 5
would strike 99% of you from the jury and I would be 6
allowed to because of the fake news coverage you 7
provide. You're not unbiased jurors and until you step 8
out of your role as a journalist and actually go into a 9
courtroom and you are a judge on a bench that has sworn 10
an oath to be unbiased in our separation of powers, 11
then your opinion does not matter. The facts matter; 12
the truth matters, and if you are fair reporters, you 13
will cover that fairly and appropriately and you will 14
allow coverage of our media team and our legal team. 15
That is absolutely shocking that all you cover are 16
around the margins. And I've seen all of you taking 17
pictures right now, and I anticipate what your 18
headlines are going to be. If you are not willing to 19
talk about the evidence that has been presented, then 20
that is absolutely unacceptable for journalistic 21
standards. This is an opening statement. This is 22
something where we have told you what the evidence will 23
show. And we have given you a brief description. That 24
happens in a courtroom all the time where that's not 25
37
the fact-finding process, that is just an overview. 1
That is what we have given you today because the 2
American people deserve to know what we have uncovered 3
in the last couple of weeks. 4
Remember, this is such a short time frame, and 5
this is an elite strike force team that is working on 6
behalf of the President and the campaign to make sure 7
that our constitution is protected. We are a nation of 8
rules, not a nation of rulers. There is not someone 9
that just gets to pick who the next President is 10
outside of the will of the American people. 11
And that is our task, because when we talk about 12
voter fraud, it's actually election official fraud. 13
That cannot stand. The constitution requires that the 14
state legislatures are the ones that make election law. 15
It still has to go by the US Constitution, but what has 16
happened in this case is that state and local level 17
officials and all the way up, have changed the rules. 18
That's what the Democrats do if they don't like the 19
rules -- they change them, and they change them at the 20
last minute. They manipulate them, they want to tear 21
down our American system. 22
Our founders were so brilliant that they 23
anticipated this, that there would be corruption, there 24
would be foreign influence, there would be attempts to 25
38
manipulate the outcome of the election, especially with 1
who they called our Chief Magistrate. I would encourage 2
you to go home and actually read Alexander Hamilton 3
Federalist 68 and see what he described as an advocacy 4
position to adopt and ratify the electoral college and 5
the process by which we select our President. We 6
select our President through the electoral college not 7
because it disenfranchises voters but because it is a 8
security mechanism for exactly the type of corruption 9
that we're uncovering. And every American should be 10
grateful and thankful that our founders had the 11
foresight to put in those protections and provisions to 12
make sure that your legitimate, legal vote is not 13
disenfranchised. That is what we're advocating for. 14
We want to make sure to protect election integrity 15
and your president -- President Trump -- we are so 16
proud that he is in this fight, because he understands 17
that when he swore his oath of office, he swore an oath 18
to uphold and defend the United States Constitution. 19
That is what he is doing and that is what we are doing. 20
We're confident that through this multiple pathways to 21
victory, we will get to the actual outcome that the 22
evidence shows. But this is not about overturning an 23
election on our part, it's about making sure that we 24
39
protect and preserve free and fair elections for all 1
future American elections. 2
If the United States caves to corruption or this 3
type of election integrity disaster, then no election 4
will be secure from here on out, and we all need to be 5
keenly aware of that. We are the representatives here 6
that are standing in this gap and defending President 7
Trump and defending you, the American people at the end 8
of the day. This is ultimately about the United States 9
of America and we want to make sure to protect and 10
defend that, and as my colleagues have said, we will 11
not back down. We won't be intimidated. President Trump 12
will not be intimidated. You, the American people 13
should not be intimidated. 14
You, the press, should cover this fairly and 15
should know that this matters to election integrity and 16
it matters to the future of our nation. So, we've 17
given you an overview, but recognize this is not a 18
court of law. We will get there, and we have time, and 19
we have constitutional provisions that will step in 20
when we show the corruption and the irredeemably 21
challenged and overturned votes that are absolutely 22
corrupt in all of these counties. It is irredeemably 23
compromised. We will show that, but you have to give 24
us that opportunity. This has been just our opening 25
40
statement, and we have an opportunity to get there, and 1
we have time, and we will do that. This is the United 2
States of America and we stand proudly for President 3
Donald J. Trump. Thank you. 4
5
SIDNEY POWELL: The world is watching this. I have 6
gotten multiple emails from people in other countries 7
who watched the same pattern happen there. We have 8
witness testimony that the same things were done in 9
those countries as this was exported from Venezuela and 10
by Maduro and by Mr. Chavez and by Cuba, and of course 11
we know China also has a substantial presence in 12
Venezuela and substantial interest in making sure that 13
President Trump does not continue in office. 14
This is the consummate foreign interference in our 15
election, in the most criminal way you possibly 16
imagine. It must be shut down. We know, for example, 17
that one of the Dominion's highest level employees, or 18
officers, went to Detroit himself to man the Detroit 19
operation center where he could watch the votes coming 20
in real time and decide what file folder in the system 21
to put those votes into. That's why you see massive 22
spikes after hours when people were told that all the 23
votes were in and all the votes were counted. 24
41
Many Dominion employees have already reached out 1
to us to tell us the truth. They are Americans who 2
want to ensure election integrity like we do. I would 3
encourage every Dominion or Smartmatic employee who is 4
fed up with the corruption in this country to come 5
forward as soon as possible because these are serious 6
federal offenses that I'm confident the Department of 7
Justice will be in pursuit of in very short order if 8
they are not already. 9
