The Department of Energy and Climate Change (DECC) has recently introduced the Energy Saving Opportunity Scheme (ESOS) in response to the requirement for all Member States of the European Union to implement the Energy Efficiency Directive. ESOS is administrated by the Environment Agency.
Who does ESOS affect?
ESOS applies to large UK undertakings and their corporate groups.
It mainly affects businesses but can also apply to some public sector
or not for profit organisations such as universities, which meet the
following criteria:
• 250 or more employees
• employs less than 250 people but has an annual turnover in excess
of 50 million euro and an annual balance sheet in excess of 43
million euro
What happens if you don’t comply?
Failure to comply with ESOS can result in fines of up to £50,000, with
potential additional fines for each day of non compliance.

turnover and balance sheet totals from the accounts for the
financial year ending either:
• on the qualification date of 31 December 2014
• in the 12 months immediately preceding the qualification
date of 31 December 2014

What do I need to do to comply?
To become ESOS compliant you’ll need to carry out an ESOS
assessment which includes:
• Measuring your organisation’s total energy consumption
for buildings, industrial processes and transport.
• Identifying areas of significant energy consumption.
• Reviewing energy consumption and complete site audits
to identify practical efficiency recommendations.
• Reporting compliance to the Environment Agency.
If you qualify for ESOS and your organisation is fully
covered by ISO 50001, you don’t need to carry out an ESOS
assessment. You just need to notify the Environment Agency
that you are compliant with ESOS.
Your ESOS assessment needs to be carried out by a Lead
Assessor, who can either help with the whole process or
simply sign off the assessment. ESOS works in four yearly
compliance phases, so you’ll need to submit your first
notification of compliance by 5 December 2015, and if
applicable, every four years afterwards.
