FamilyEducationalRightsandPrivacyActANNUALNOTICE(ReleaseofStudentDirectoryInformationtothePublicand/orMilitaryRecruiters)

TheFamilyEducationalRightsandPrivacyAct(FERPA)affordsparents,legalguardiansandstudentsage18oroldercertainrightswithrespecttotheirstudent'seducationrecords.Theserightsare:(1)Therighttoinspectandreviewthestudent'seducationrecordswithin45daysofthedaytheschoolreceivesarequestforaccess.Parents,legalguardiansandstudentsage18oroldershouldsubmittotheschoolprincipalawrittenrequestthatidentifiestherecord(s)theywishtoinspect.Theschoolwillmakearrangementsforaccessandnotifytheparents,legalguardiansandstudentsage18orolderofthetimeandplacewheretherecordsmaybeinspected.(2)Therighttorequesttheamendmentofthestudent’seducationrecordsthattheparents,legalguardiansandstudentsage18orolderbelievesareinaccurate.Parents,legalguardiansandstudentsage18oroldermayasktheschooltoamendarecordthattheybelieveisinaccurate.Theyshouldwritetheschoolprincipal,clearlyidentifythepartoftherecordtheywantchanged,andspecifywhyitisinaccurate.Iftheschooldecidesnottoamendtherecordasrequestedbytheparents,legalguardiansandstudentsage18orolder,theschoolwillnotifythemofthedecisionandadvisethemoftheirrighttoahearingregardingtherequestforamendment.(3)Therighttoconsenttodisclosuresofpersonallyidentifiableinformationcontainedinthestudent'seducationrecords,excepttotheextentthatFERPAauthorizesdisclosurewithoutconsent.Oneexception,whichpermitsdisclosurewithoutconsent,isdisclosuretoschoolofficialswithlegitimateeducationalinterests.Aschoolofficialisapersonemployedbytheschoolasanadministrator,supervisor,instructor,orsupportstaffmember(includinghealthormedicalstaffandlawenforcementunitpersonnel);apersonservingontheschoolboard;apersonorcompanywithwhomtheschoolhascontractedtoperformaspecialtask(suchasanattorney,auditor,medicalconsultant,ortherapist);oraparentorstudentservingonanofficialcommittee,suchasadisciplinaryorgrievancecommittee,orassistinganotherschoolofficialinperforminghisorhertasks.Aschoolofficialhasalegitimateeducationalinterestiftheofficialneedstoreviewaneducationrecordinordertofulfillhisorherprofessionalresponsibility.Uponrequest,theschooldiscloseseducationrecordswithoutconsenttoofficialsofanotherschooldistrictinwhichastudentseeksorintendstoenroll,includinghighereducationrecruiters.ForpurposesofFERPA,USD458hasdesignatedcertaininformationas“directoryinformation,”whichmaybedisclosedforanypurposewithoutpriorconsent.Theprimarypurposeofthisdesignationisfordistrictuseoftheinformationinschoolpublications,suchasnewsletters,dramaplaybills,recognitionlistings,graduationprograms,sportsteamrostersandyearbooks.USD458considersthefollowing“directoryinformation:”studentname,address,telephonenumber,dateandplaceofbirth,participationinofficiallyrecognizedactivitiesandsports,weightandheightofmembersofteams,datesofattendance,honorsreceived,themostrecentpreviousschoolattended,classdesignationandphotographs.ReleaseofStudentDirectoryInformationtoMilitaryRecruitersInaddition,twofederallaws:Section9528ofESEA(20U.S.C.7908),asamendedbytheNoChildLeftBehindActof2001(P.L.107-110),and10U.S.C.503,asamendedbysection544,theNationalDefenseAuthorizationActforFiscalYear2002(P.L.107-107),requireeducationalagenciestoprovidemilitaryrecruiters,uponrequest,students’names,addressesandtelephonelistings.Parents,legalguardiansandstudentsage18orolderwishingtowithdrawconsentforreleaseofdirectoryinformationmustcompleteaFERPAOptOutformavailableuponrequestatanyschooloffice,thedistrictofficeandwww.usd458.org.USD458assumesthereisnoobjectiontothereleaseofdirectoryinformationifthissignedformisnotreturnedtotheschooluponenrollment.(4)TherighttofileacomplaintwiththeU.S.DepartmentofEducationconcerningallegedfailuresbyUSD458tocomplywiththeserequirements.ThenameandaddressoftheofficethatadministersFERPAare:FamilyPolicyComplianceOffice,U.S.DepartmentofEducation,400MarylandAvenueSW,Washington,DC20202-5901.
