COMES NOW the Plaintiffs, LUIS GARCIA and ROCIO GARCIA , by and
through their undersigned attorneys and i le a Motion for Protective Order objecting to the
production of documents requested in multip le subpoenas duces tecum (the "Suboenas") issued
by Defendants Church of Scientology Flag Service Organization , Inc. and Church of Scientology
Flag Ship Service Organization, Inc. ("Defendants)" . The document requests issued by
Defendants, as set forth in Exhibit A to the Subpoenas, are identical, and impermissibly seek the
sweeping production of docum ents by (i) the separate law firms representing Plaintiffs, (ii)
individual counsel within those law firms; and (ii i) non-party Michael Rinder . Because the
document requests are patently overbroad and unduly burdensome, Plaintiffs object, on their own

beha lves and on behalf of each of the recipients of the Subpoenas, to the production sought by
the Subpoenas.1 (True and correct cop ies of the Subpoenas are attached as Composite Exhibit A.)
Defendants purport to serve the Subpoenas in order to obtain discovery rdaiting to its
motion to disqualify all three law firms representing Plaintiffs in this action. The motion to
disqualify is premised on the contention that the law firms of Babbitt Johnson Osborne &
LeClainche and Weil Quaranta McGovern received con fidential information from Gray
Robinson,s representation of Defendants over ten years ago. Yet Defendants, motion is now
being used in an attempt to discover every communication among counsel relating to this suit for
fraud against the Church of Scientology Defendants, including all communications with non-
party individuals named in these subpoenas . The document requests - catching in their net
irrelevant and privileged communications among attorneys and their clients and their lega l
consultants - are indefensibly overbroad.
As a preliminary matter, before permitting discovery, the Court shou ld determine
whether a conflict of interest even ex ists as a result of M r . Johnson,s past represen tation of FSO
under Rule 4-1.9. This is particularly compelling in this case as Defendants do not allege that
Mr. Johnson (i) ever represented Defendants in connection with this fraud suit by the Garcias,
(ii) knew of the Garcias when he represented FSO over ten years ago , or (iii) has any confidential
information about this case. Rather, Defendants allege that Mr. Johnson's past representation of
Defendants on general matters, somehow, makes this case substantially related ! prior
representation. Before requiring Plaintiffs to file a privilege log de tailing all privileged

communications, the Court shou ld make that preliminary determination. If, in fact, no conflict
exists, communications among the individuals subpoenaed are not on ly irrelevant and/or
protected rom discovery pursuant to the doctrines of work-product and attorney-client privilege,
bu t the ef forts requ ired by Plaintiffs and their counsel which Defendants seek to trigger by the
Subpoenas are unnecessary and , as such, burdensome and harassing .

{c) Protecting a Person Subject to a Subpoena.
(1) Avoiding Umfue Burden or Expe11se; Sam::tions. A par1y or
attorney responsible fo r issuing and serving a subpoena must take
reasonable steps to avoid imposing undue burden or e;-cpense on a

for a deposition. hearing, or trial.
(B) Olljeclions. A person commanded to produce documents or

itselfprivileged or protected, will enable the parties to assess the
claim.
( B ) ' i ~ j o r m a t i o n Prcduced. I f nformation produced in response to a
subpoena is subject to a claim of privilege or of protection as trialpreparation material. the person making the claim ma y notify ru'ly
·party that received the information of the claim and the basis for it.
After being nofificd, a party must promptly return, sequester, or
destroy the specified information and any copies it has; must not use
or disclose the iofurmation until the claim is resolved; must takereasonable steps to retrieve th e information if the par1y disclosed itbefore being notified; and may promptly present the information to the
court under seal fori. determination"of he claim. Th e person who
produced the information must preserve the information until-the claim

Federal Rule of Civil Procedure 45 (c), (d), an d (e) (Effective 12/1/07)
(c) Protecting a Person Subject to a Subpoena.
(I ) Avoiding Undue Burden or Expense; San.clions. A party or
attorney responsible for issuing and serving a subpoena must take
reasonable steps to avoid imposing undue burden or expense on a
person subject to the subpoena. The issuing court must enforce this
duty and impose an appropriate sanct ion- which may include lost
earnings and reasonable attorney's f ees - on a party or attorney
who fails to comply.(2) Command to Produce Materials or Permit Inspection.
(A) Appearance Not Required. A person commanded to produce
documents, electronically stored information, or tangible things, or
to permit the inspection of premises, need not appear in person at the
place of production or inspection unless also commanded to appear
for a deposition, hearing, or trial.
(B) Objections. A person commanded to· produce documents or
tangible things or to permit inspection may serve on the party or
attorney designated in the subpoena a written objection to
inspecting, copying, testing or sampling any or all of he materials or
ro inspecting the premises- or to producing electronically stored
information in the form or forms requested. The objection must be
served before the earlier of the time specified for compliance or 14
days after the subpoena is served. If an objection is made, the
following rules apply:
(i) At any time, on notice to the commanded person, the serving
party may move the issuing court fo r an order compelling production
or inspection.
(ii) These acts may be required only as directed in the order, and
the order must protect a person who is neither a party nor a party' s
otiicer from significant expense resulting from compliance.
(3) Quashing or Modifying a Subpoena..
(A) When Required. On timely motion, the issuing court must
quash or modify a subpoena that:
(i) fails to allow a reasonable time to comply;
(ii) requires a person who is neither a party nor a party' s officer
to travel more than 100 miles from where that person resides, is

(i) disclosing a trade secret or other confidential research,
development, or commercial information;
(ii) disclosing an unretained expert's opinion or information that
does not describe specitic occurrences in dispute and results from
the expert's study that was not requested by a party; or
(iii) a person who is neither a party nor a party's officer to incur

(d) Duties in Responding to a Subpoena.
(I ) Producing Documents or Electronically Stored Information.
These procedures apply to producing documents or electronically
stored information:
(A) Documents. A person responding to a subpoena to produce
documents must produce them as they are kept in the ordinary course
of business or must organize and label them to correspond to the
categories in the demand.(B) Form for Producing Electronically Stored Information Not
Specified. If a subpoena does not specify a form for producing
electronically stored information, the person responding must produce
it in a form or forms in which it is ordinarily maintained or in a
reasonably usable form or forms.
(C) Electronically Stored Information Produced in Only One Form.
The person responding need not produce the same electronically stored
information in more than one form.
(D) Inaccessible Electronically Stored !nformation. The person
responding need not provide discovery of electronically stored
information from sources that the person identities as not reasonably
accessible because of undue burden or cost On motion to compel
discovery or for a protective order, the person responding must show
that the information is not reasonably accessible because of undue
burden or cost If that showing is made, the court may nonetheless
