Selling to the Federal Government
In order to do business with the Federal Government to include the Department of State, there are required procedures you must follow.

The first and most critical step is online registration with the Federal Government’s System for Award Management (SAM).
Once registered, your company will be able to sell to all Federal Agencies that have an interest in your products. Registration enables purchase orders to be sent to your company as well as payments to be made via electronic funds transfer (EFT) for goods received.

Disadvantages of GSA Supply Schedule
• Sales are never guaranteed
• You must have a good team that can take care of the paperwork and
track the sale.
• Your team must be compliant with the terms of the contract and keep
good records.
• You have to be competitive with current contractors on GSA.
• Lastly, contracts can be terminated by GSA if contractors do not have a
min. $25,000 sales in 24 months.
• 40% of GSA contractors fail and contracts terminated.

Considering Participation in a Contract

Important Last Notes on GSA
• GSA MAS contracts aren’t necessarily a good fit for all businesses
– Need to have been in the commercial market for a few years and been successful
– Need to be willing to put time and resources into this process
• You need to give GSA your best pricing
• The average time that people are awarded contracts is six to twelve months
• 60% of all offers are initially rejected because the contractor:
– Does not fully understand the process
– Sends incomplete information
– Does not qualify for the Schedule they have applied

The Federal Funding Accountability and Transparency Act of 2006 (FFATA) was signed into law on September 26, 2006. The legislation required that federal contract, grant, loan, and other financial assistance awards of more than $25,000 be displayed on a searchable, publicly accessible website, USAspending.gov, to give the American public access to information on how their tax dollars are being spent. As a matter of discretion, USAspending.gov also displays certain federal contract s of more than $3,000.
Federal agencies are required to report the name of the entity receiving the award, the amount of the award, the recipient’s location, the place of performance location, as well as other information.
Buy American
Federal agencies are required to buy domestic goods/construction materials
• “Domestic” defined as being manufactured in the United States and the cost of domestic components must exceed 50 % of the cost of all components
• Establishes price preferences for domestic. Federal agencies can waive the domestic requirement

for reasons of price, non-availability (domestic goods not available in sufficient quantity or quality), and public interest (“public interest” is undefined)
• Under the Trade Agreements Act of 1979, if a procurement is covered under a trade agreement, then the Buy American Act of 1933 is waived

Buy American
• In those situations, Federal agencies can only buy either the domestic products or products from trade agreement countries. Trade agreements include all of our FTA’s (except the U.S.-Jordon FTA) or the WTO Agreement on Government Procurement (GPA)
• GPA is a plurilateral agreement that includes 47 countries including the United States. Mostly developed nations such as Canada, the EU member states, Japan, Korea, Singapore, Switzerland
• Important note: what is “covered” and what is excluded from our trade agreements. For purposes of textiles, there are exclusions (Berry Amendment, Kissell Amendment) that can be found in all our trade agreements

Buy American Executive Order
• On April 18, 2017, President Donald Trump signed Executive Order 13788 entitled “Buy American and Hire American.”
• The EO orders:
– U.S. agencies to review procurement and grant programs for compliance with Buy American requirements (more than just the Buy American Act of 1933) and provide recommendations on how to strengthen compliance in the future;
– A review of how trade agreements (FTAs and the GPA) impact U.S. compliance with Buy American Requirements;
– Bidding processes to take into account unfair trade practices (such as dumping); and
– The promotion of American-made steel

Keep Your Eye on Innovation
• As with all industry markets, innovating new fabrics and products is the best chance to get and keep a piece of the military pie
• Keep your eye on innovation because it is the key to the future
• For textiles, the emergence of new fibers, new fabrics, and innovative process technologies are fueled by market growth

The Defense Threat Reduction Agency (DTRA) Chemical Biological S&T program seeks closer ties with manufacturers to address and
develop technological approaches for next generation garments. It is important to note that DTRA ha R&D funding available to support

• The FMS program is a fundamental US foreign policy tool with the goal of:
– Achieving world peace
– Strengthening the security of the United States
• The Foreign Military Sales (FMS) program is:
– U.S. Government's program for transferring defense articles and services and training to other sovereign nations and international organizations
– When defense articles or services are required, the requesting country’s representative provides a Letter of Request (LOR) to their U.S. counterpart
• FMS is managed and operated by DoD on a no-profit and no-loss basis:
– Countries and international organizations participating in program pay for
• Defense articles and services at prices that recoup actual costs incurred by United States.
– This includes a fee (currently 3.5% of what the defense articles and/or services cost, in most instances) to cover the cost of administering program
