INTRODUCTION
The present study, like other similar studies of comparative analysis of the skills
certification and qualifications recognition processes in Italy, Spain, Germany, Denmark,
Great Britain and the Czech Republic, is one of the results of the project „ The Network of
Competent Authorities for Professional Qualifications in Romania (IMI PQ NET Romania)”
implemented by the Ministry of National Education (MNE) in partnership with the National
Qualifications Authority (ANC) and the Institute for Social Policies (IPS), co-financed from
the European Social Fund through the Sectoral Operational Programme for Human Resources
Development 2007 – 2013 (POSDRU).
The overall objective of the project „ The Network of Competent Authorities for
Professional Qualifications in Romania (IMI PQ NET Romania)” is to create and strengthen
of the IMI network (Internal Market Information) for professional qualifications in Romania
(IMI PQ NET) in order to support the EC initiative regarding the development of the internal
market information system, the development of a joint initiative in this regard, nationwide, in
order to strengthen the capacity of the social partners (government agencies and
organizations, professional associations) to promote the sustainable development by creating
appropriate tools and communication channels and mutual consultation, in order to achieve
an efficient communication with similar organizations in the European Union and European
Economic Area (EEA) through the IMI platform.
In order to achieve the comparative studies, the methodological experts of NQA have
researched the external sources of information at national level (of the analyzed country and
of Romania) and at the community level (comparative studies conducted in the European
Union) and attended to study visits in several European Union Member States (EU MS), in
which they were able to complete their documentation work by exchanging the experience
with the representatives of various competent authorities for various professions regulated
in those countries.

The ultimate goal of the studies conducted for the benefit of IMI PQ NET network
members and of the study visits aim to achieve the specific objectives of the project, of
creating of communication channels and mutual consultation between both national network
members and between them and their counterparts in EU MS visited, of development and
implementation of common reference terms regarding the certification standards of the
competences and the recognition of professional qualifications (by acquiring and adapting the
best practice examples known and better understood during study visits), strengthening the
capacity of IMI PQ NET Romania network members to engage in the information exchange
mediated by the IMI platform.

1. SKILLS CERTIFICATION PROCESS
IN GREAT BRITAIN
1.1. Education system and diplomas / certificates acquired
In Great Britain, the Law regarding the education and skills development (The Education
and Skills Act) of 2008 requires for all young people to participate in education or training
until the age of 18, by:
- full-time education type or professional training;
- part-time education type or professional training;
- work-based learning.
The minimum age at which young people can complete the learning period will be
increased in two stages: 17 years starting with 2013 and 18 starting with 2015.
Education in England differs from the education system implemented in other parts of
the United Kingdom. In practice , there are two systems: one applies to England Wales and
Northern Ireland, and one is available in Scotland. The two educational systems are different.
Traditionally, the first educational system emphasizes the consistency of the educational
process, while the second Scottish system is distinguished by variety and amplitude. Thus,
pupils and English, Welsh and Irish students support upon graduation of the study cycles a
small number of tests, but of high complexity, while Scottish pupils or students support a
greater number of tests, but of low complexity.
High schools in the UK, most often work in partnership with colleges or further
education institutions. Currently, in high schools are organized also training courses and
practice at the workplace for people between 14 -16 years. Also, for mature students (over 19
years, but most are older ) without formal qualifications, are organized in the high schools
preparatory courses for the access to higher education.
Education in Wales differs slightly from the system used in England, education is
structured as follows:
- primary education (from 4-5 years to 11 years);

- secondary education (from 11 years to 18 years);
secondary school (gymnasium) , high school or secondary school (from 11 to 14
years ) which ends with the national standard assessment test known as SATs
(Standard Assessment Tests);
high school or secondary school (from 14 to 16 years) which ends with the
appropriate exam level A (old) or GCSE (new);
high school, secondary school, or college (16 to 18). After completing the first
year of study after passing the exams, is obtained the AS degree level, and after
the second year is obtained the degree level A2. Both degrees are included in the
study level A.
An overview of the UK education system (primary and secondary) is presented in Table
1.

- secondary education (from 11 years to 18 years).
In Scotland there are two types of national exams:
- exams that certify the basic education (Grade examinations) supported after the fourth
year of secondary school;
- exams that certify higher level of education (Advanced higher).
Education in Northern Ireland is distinguished by the consistent knowledge gained in the
educational process, comparatively to the English and Gaelic school systems. Most of the
national tests (SATs) and of the curricula available in schools in Northern Ireland are set by
the Council for Curriculum, Examinations and Assessment - CCEA. Between school
holidays from the three educational systems there are small differences in terms of duration.
The structure of the education system in Northern Ireland is identical to that in Scotland.
Professional education aims the young people who want a more practical approach of
the education and that can attend to vocational courses obtaining upon completion various
qualification certificates as follows:
- BTEC qualifications (Business and Technology Education Council) aimed at
preparing students tilt the technician level. After graduation, holders may enter the
labor market or continue their studies in their chosen field. Study programs are
designed in partnership with companies in various fields, in order to give students the
skills and knowledge required by the employers. BTEC courses combine theory with
practice and may involve performing stages. BTEC National Diploma is accepted for
admission to the university, if students have obtained qualifications D (distinction) or
M (merit). Further details can be found on the website of the certification body of
these types of qualification, Excel1;
- NVQ certificates (National Vocational Qualifications) are qualifications at the
workplace based on preset National Occupational Standards. Courses can be followed
by all persons, regardless of previous academic or vocational training. We distinguish
5 levels of qualification - from 1 to 5 (the highest). Professional skills are usually

assessed in the workplace or practice. With the introduction of the new CNC in
England, Wales and Northern Ireland, all qualifications must comply with the new
criteria and educational standards set by the government;
- C&G qualifications (City and Guilds). City and Guilds London Institution is a leading
professional certification body in the UK. There are over 8,000 colleges providing
training courses in 81 countries2;
- apprenticeship certificates (Apprenticeships). By the apprenticeship contracts, the
employer must assure the apprentice training practice and theory. Training duration
can be between one and four years, depending on the course of the apprenticeship, the
apprentice competencies and skill area. The peculiarity of this type of training is that
the duration of the contract, the apprentice receives a salary and is entitled to paid
leave3.
Professional qualifications provided by the United Kingdom are among the most
recognized in the world. They can be obtained in important areas such as: businesses,
computer science, engineering, art and design, but we must not forget options such as the
hotel industry, catering, tourism and fashion. Professional education can be done in colleges,
professional schools and higher education institutions. These qualifications tend to be related
to the practice rather than to the academic job, but can help the individual to advance current
career, open the prospect of a new career or help students to access academic studies.
Courses in this educational sector tend to be extremely flexible, many of them do require
special admission conditions, so that, regardless of the qualifications the learner has at the
enrollment, will be able to attend to a course that would allow him raising his education.
Professional courses involve hours of theory, written papers, practical activities.
The number of students in a class is relatively small, allowing them to receive highly
attention from the trainer (there are continuous assessments throughout the course and exams
upon completion, including practical examination).

Higher education in Great Britain is education provided by universities and other
institutions, such as university and liberal arts colleges that confer academic titles. Higher
education includes both teaching activities and research at universities, conducted at both
undergraduate (undergraduate level) and postgraduate level (postgraduate level), as shown in
figure 1. Higher education differs from other forms of post- secondary education, such as for
example vocational education. However, vocational education is part of higher education and
many postgraduate qualifications are in the fields of law, medicine, etc.
A graduate student is a person who has a bachelor's degree and who has the opportunity to
continue his education in order to obtain a master's degree or doctorate.
The costs needed in order to benefit of normal education in the UK are differentiated as
follows:
for primary education: no charge;
for secondary education: no charge;
in order to continue secondary education: no charge if the person is under 19 years old
(in that academic year) or has low incomes;
for higher education (university) the tuition fee per year varies between 1.000 - 9.000
£.

British government recognizes the higher education institutions by Royal Charter and the
list of the authorized training providers can be accessed from the website of the Department
for Business, Innovation and Skills4.
Independent schools (private) in Britain are famous worldwide for the excellent
conditions they offer. There are a variety of schools in England, Wales, Scotland and
Northern Ireland, which accepts students from the first school age (5 years) and up to 18
years. After going through the private school system in the United Kingdom, besides the fact
that the child received one of the best educational experiences in the world, it is also a good
speaker of English. Taking the British educational model as an example of good practice in
terms of institutional and funding system, in Romania should be a closer cooperation between
state institutions and MEN, NQA and sectoral committees with the aim of developing new
qualifications and training programs correlated with labor market demand, based on
occupational standards.

1.2. Adults' education
In the last years national policy in the field of adult education has been in a significant
change, education becoming a complex process of lifelong learning, which includes
compulsory schooling, vocational education and higher education.
A national concern of Learning and Skills Council (LSC) s to increase the number of
adults to improve their skills and achieve qualifications each year, at all levels, in terms of
written and spoken English and mathematics. Among the priorities we can remark:
- courses in literacy, numeracy and IT for adults;
- level 2 qualification for adults who lacked this level;
-level 2 of professional qualification courses for working adults;
- level 3 of qualification for those aged 19 to 25 years.
In Great Britain, the significance of the term "adult" varies from a training provider to
another. The training courses conducted at the National Institute of Adult Continuing
Education (The National Institute of Adult Continuing Education - NIACE) is aimed at people
aged over 17 years. Instead, some government funded incentive programs have addressability
limited only to persons aged under 25 years. NIACE informs on its website that adult
education is aimed at people of all ages and can occur either in educational institutions or in
the workplace or at home or by leisure activities.
In general, adult education means the participation at the continuing education
throughout life, which takes place in universities and colleges. Training providers that are
part of Authorized Suppliers Registry (Qualified Provider Framework) can access funding
for educational courses5. These courses can be financed from public funds at the initiative of
the local authorities, in partnership with the Workers' Education Association - WEA, or
according to the needs of the community. Adults access to this type of education for several
reasons: to obtain skills / re-qualifications / qualifications / improvements or for leisure
purposes.

For example, Adult and community education is made by educational institutions or
community colleges and are organized locally or regionally.
Higher Education Funding Council for England’s has implemented a workforce
development programme in England by which will help universities to increase their offer to
employers developing new specializations and providing an educational process appealing for
the learner. Between 2008-2011, 150 million pounds were directed to about 90 institutions of
higher education in order to support a wide range of educational projects at the request of the
employer. Most of these projects are made in state- employer partnership in the sense that the
total costs involved in developing educational processes are divided between the two
partners.
In England, for adults who want to have access to academic education the state provides
loans in advance for tuition fees and reimbursement shall be charged at the end of training
courses and is subject to salary. Adults who wish to undertake postgraduate studies which are
not currently supported by public funds, may apply for a loan for professional development
and career (Professional and Career Development Loan-PCDL). The maximum loan amount
is £ 10,000, the banks approve the loan and the repayment is made after the course
completion.
Also, the British government recognizes the importance of the study conducted in part-
time regime (recommended for mature students) and the role that employers have in
supporting learners, especially those who want to have an academic education.
In Northern Ireland there are other courses for adults (academic, vocational, recreational)
than those offered by regional colleges, respectively a number of 6 courses.
In Scotland, funding for adult courses is provided by the 32 local authorities that support
the Community Learning Strategy Partnerships. Strategic plans are sent to all partner
organizations in order to jointly decide how the funds will be used to open new learning
opportunities.
Article 1, lifelong learning is a right guaranteed by law and includes all learning activities
undertaken by each person, starting with early education, in order to acquire the knowledge,
skills training / abilities and development of significant skills from the personal, civic , social
and / or occupational perspective.

Comparatively, Romania has an adult vocational training system based on occupational
standards, no regulations regarding the authorizing of the training companies managed by the
National Qualifications Authority - ANC and there is an occupational standard for the of
trainer profession.

1.3. Evaluation and certification of professional skills
acquired in formal and informal contexts
Validation of non-formal and informal learning is regulated throughout the UK for each
level of education: secondary and higher education. England recognizes the qualifications
obtained in other member states of the UK based on legislative support The statutory
regulation of external qualifications in England, Wales and Northern Ireland 2004 și The
Learning and Skills Act 2000. Qualification and Curriculum Authority (QCA) issued in 2006
a Code of Practice which must be complied by all authorized bodies to carry out the
educational process. In Great Britain the suppliers of non-formal and informal education are
subject to internal and external assessments for accreditation of their work. For this purpose
was developed a special training program for assessors who has three levels: assessor level
A1; internal assessor level V1; external assessor level V2.
In Great Britain, the access to information is made through instruments such as:
electronic system with which is created the educational portfolio, web page etc..
Competencies thus identified must then be certified by the appropriate documents. If the
evidence presented contains competencies imposed by the occupational standards, it is issued
a certificate certifying that qualification. Otherwise, is issued a certificate certifying only
certain competencies.
The main mechanisms used in the process of recognition of prior learning include6:
- in England: interview, file with supporting documents, examination;
- in Scotland: application, test, interview, evaluation (on request), school transcript,
project, Europass CV / Language Passport, portfolio;

- in Northern Ireland: portfolio, interview, examination.
Currently, the main objectives for the issuance of certificates / reports recognizing non -
formal and informal learning are:
- access to professional study programs and higher education;
- exemption from certain specific training modules or units of a qualification
recognized by the equivalence of credits;
- facilitating employment;
- motivating potential learners.
In Great Britain there are three sets of general principles for ensuring the quality of
recognition of non-formal and informal learning. Each set is designed to meet the specific
roles and responsibilities of key stakeholders: providers (colleges, universities), organizations
with a role in monitoring / regulating the educational process and candidate's sponsors
(employer or learner) 7
.
Learning at home and community initiatives are examples of this type of education that
is diverse and should be complementary and not seen as a substitute for a formal system. This
education often tends to be oriented towards disadvantaged groups and has specific
objectives. For some students with disabilities, non-formal education can be more flexible
and more effective than formal education system and provide either a form of preparation, a
supplement or an alternative to formal schooling. Non-formal education is supported by
Article 24 of the Convention on the Rights of Persons with Disabilities8.
Scotland has an important contribution to the recognition of non-formal and informal
learning, which allow workers to develop their cognitive skills so they can work in different
contexts, learn new occupations and behave well in new jobs occupied - throughout life.
In Romania, the entire process of quality assurance at the institutional level is at the
beginning, with varying degrees of implementation, depending on the type of organization:

for higher education institutions exist the Bologna requirements and other institutions have
implemented ISO standards.
In this context, recognition of non-formal and informal learning was regulated nationally
through licensing methodology for evaluation and certification centers developed by the
National Council for Adult Vocational Training and approved by the Ministry of Labour,
Social Solidarity and Family and by the Ministry of Education by the Order no. 4543/468 of
23.08.2004.
The initial assessment was conducted in 14 centers in the country for adults who wanted
the certification of their competencies according to the occupational standards and national
recognition, following to be applied this assessment also in the other training centers around
the country9.

1.4. National Qualifications Framework reported to
European Qualifications Framework
Great Britain has implemented a national qualifications framework since 1997. In
January 2012 was developed for the EQF, a report (Implementation of the European
qualifications framework in the Great Britain: 2010-2011) of the results obtained, structured
as follows:
- Credit and Qualifications Framework for Wales – CQFW;
- Qualifications and Credit Framework - QCF;
- Scottish Credit and Qualifications Framework – SCQF.
CNC Great Britain was revised in September 2004, from entry level 8, in order to have
nine levels, and levels 4 and 5 were assigned to levels 4, 5, 6, 7 and 8 (figure 2).

National Coordination Points (NCPs) for EQF in Great Britain have prepared for
implementing a program of activities which have communicated EQF targets of the
stakeholders receiving feedback from them about their needs regarding optimal
implementation strategy at European level.
National levels of education and vocational qualifications / titles obtained in schools /
colleges / universities are organized as follows:
- level 5: Higher level qualifications;
- level 4: Higher level qualifications;
- level 3: advanced level;
- level 2: intermediate level;
- level 1: basic level;
- entry level.
A correspondence between the two qualifications frameworks in Europe and in the United
Kingdom is made in Table 2.

In Romania, the European Qualifications Framework is implemented only for higher
education, being created the National Register of Qualifications in Higher Education in
Romania. For preuniversitary education the National Qualification Framework (NQF ) is in
public debate.
In Great Britain there are organizations or professional associations for all regulated
occupations and professions. For admission in such a professional body or association it is
necessary that the aspirant (s), usually possess a certain level of professional qualification or
sometimes to take a particular exam.
OFQUAL (Office of Qualifications and Examinations Regulation) in England, along with
partner regulators in Wales (Department for Children, Education, Lifelong Learning and
Skills - DCELLS) and Northern Ireland (Council for the Curriculum, Examinations and
Assessment - CCEA), is the institution in the United Kingdom responsible for the regulation
of professional qualifications. Their types are:
- functional skills: qualifications that allow to students to acquire practical skills, such
as English, mathematics and ICT. In Scotland, functional abilities are known as basic
skills;
- entry-level qualifications (E1, E2, E3 ) designed for students who do not feel ready
yet to obtain the General Certificate of Secondary Education (GCSE);
- GSCEs qualifications: GCSEs programs are designed for children with ages from 14
to 16 years and are also available for adults;
- A and AS level qualifications: for students aged 16-18, and those who have
completed GCSEs;
- International Baccalaureate (IB) Diploma: internationally recognized qualification
which is an alternative to A and AS level qualifications. IB programs are selected by
students who want to study more subjects from the previous level (level 3 QCF);
- professional qualifications: available at different levels, which can be compared with
other qualifications (level 3 vocational qualification, for example, is equivalent to A
of level qualifications);
- higher education qualifications: corresponding approximately to levels 4 to 8 in the
QCF (in SCQF, they correspond to levels 7 to 12).

Even if in Great Britain there is no national system of credit transfer, regional or local
systems does exist. Credit transfer dates from the founding of the University in the UK in the
1970s.
Open College Network and the former CNAA (Council for National Academic Awards)
used first as a reference the concept of full academic year in which a year was equivalent to
1200 hours and 120 credits.
In Great Britain academic standards are controlled only by universities, but their
evaluation is done independently by the Quality Assurance Agency for Higher Education
(QAA). Occupational standards are governed by the national occupational standards (NOS).
Professional organizations may also develop and manage standards. Sometimes even the
government makes this thing, especially in basic skills field such as math and literature.
The English QCF (Qualifications and Credits Framework) is based on learning units with
credit value and level of training (education) (from the basic to the upper level 8). One credit
equals 10 or fewer hours of learning, allowing the student to evaluate how long it takes to get
the desired professional qualifications. Thus, in the UK there are three types of titles issued
for the qualifications in the QCF as follows:
- certificate of competency (1-12 credits that are equivalent to 10 to 120 hours of
learning);
- certificate of competence (13-36 credits i.e. 130 to 260 hours);
- diploma (37 credits or more).
This Framework (QCF) is based on structured learning modules, supported by an
accumulation of transferable credits in education and training system. It aims to enable
students to gain qualifications at their own pace throughout the entire life. Because of this
system of education, it is recognized a wider range of training modules attended by a student
than CNC and allows all the institutions in which they are able to continue professional
training to recognize prior learning. Similar to the QCF English system, SCQF (Scottish
Credit and Qualifications Framework) includes schools, colleges and all vocational training
centers in Scotland10
. Compared with the English system (QCF ), the SCQF Scottish system

is based on awarding points for loans that reveals the professional qualification, the training
levels being 12 instead of 8 in the English system. Also similarly to England, Wales and
Northern Ireland, a credit point in Scotland represents 10 hours of learning.
In terms of education and higher education in Scotland, credits are administered by
universities after their evaluation by the Scottish Qualifications Authority (SQA), for the
post-secondary education and by the higher education institutions (HEIs) for higher
education. The rating is relatively formal and takes place in three stages, with the right to
appeal in case of failure. The system is based on the time required, in principle, to obtain a
credit which is equivalent to 10 hours of study. SCQF introduced guidelines for the
recognition of non - formal and informal learning that can be accessed online by those
interested.
As part of its strategy for lifelong learning, Scotland emphasizes the role of experience
acquired in saving certain professions distressed because of lack of competent personnel
considering the economy based on growing knowledge. Five authorities have special request,
namely knowledge, practical skills, cognitive skills, communication skills (including
arithmetic) and autonomy (including teamwork and interpersonal skills). These skills are
meant to make people to be active and responsible in society. Scotland highlights that the
need for these skills can be transferable to employment. The concept is not new and refers to
knowledge, skills and competencies that can be reused in different sectors and jobs. In
addition, SCQF refers to regulated professions such as those covered by the Scottish Social
Services Council (SSSC).
In Romania, the National Qualifications Authority is the institution that manages the
National Register of Qualifications and has the mission to make a correlation between the
National Qualifications Framework and CEC / EQF. It is now proposed to the Government
the approval of a draft legislation whose main objective is to complete the 5 existing skill
levels, followed by the introduction in ISCO 08 of the occupational skill levels from the
same occupational field.

2. The recognition process of professional qualifications in Great Britain
2.1. Legal and institutional framework for the recognition of the
qualifications acquired in other MS of the EU, EEA and Swiss
Confederation
Most professions in the UK are not regulated, but, however, there are currently 220
regulated professions, mostly in the medical, legal and teaching fields. Professions regulated
by law are those that involve the application of specialized knowledge acquired during
training. The access or the practice of a regulated profession is restricted by the national
legislation in the United Kingdom (through the implementation of Directive 2005/36/EC on
the recognition of the professional qualifications) . The Directive is transposed by Law no.
2781 from 2007 called Recognition of Professional Qualifications - Regulations.
In Great Britain, if the profession is regulated, the applicant must apply to the competent
authority to obtain professional recognition of qualifications and to be able to practice their
profession.
In Great Britain it is not mandatory holding a professional title issued by a professional
association to practice, but a large number of specialists choose to join professional
associations due to professional status which they confer.
The competent authorities are responsible for receiving applications of EU citizens with
professional training regulated. The National Contact Point for existing qualifications in
Great Britain is Great Britain NCP having the following website address:
https://www.naric.org.uk. Through this contact point, any person who holds a qualification
obtained in Great Britain and is interested to practice in the EU is guided in the process of
recognition of his professional qualifications.
Great Britain NARIC is national agency (National Recognition Information Centre)
responsible for providing information advice and expertise on qualification worldwide.

Any national of an EU MS, European Area (EEA) or Switzerland has the right to work, to
the development and implementation of a business or services in any Member State, therefore
in Great Britain also. A person is free to practice in the Great Britain, as long as there is no
national law requiring specific qualifications for access to the profession (like regulated
professions). Such unregulated profession can be exercised freely and the individual is not
required to hold a specific qualification, but it is required by law to register with the
appropriate AC to be able to practice the profession in the Great Britain.
There are certain regulated professions that require harmonization of basic training in all
Member States, so that qualifications obtained in each Member State should be recognized
between them, based on automatic recognition of qualifications.
In Great Britain it is not necessary for a person to have a professional qualification
acquired in a licensed institution in order to work, but this is recommended, due to special
professional status in the field of their specialization conferred by possession of a recognized
professional certificate / issued by an authorized body. There are situations where, for the
recognition of professional qualifications obtained in other countries than the Great Britain,
AC has to request a certificate of experience that shall be issued only if the destination
Member State stipulates that the profession is regulated. For more information you can visit
the website www.certex.org.uk. Experience certificate is a document that details the work
experience and qualifications obtained by a person in a particular profession in the Great
Britain. Once issued, this certificate helps the person to work in a regulated profession in
another Member State without the need for additional training or experience. For the
application to obtain the experience certificate shall contact The National Contact Point of the
Member State where the person wants to work to find out if you need this certificate.

Documents required for application are:
- Relevant certificates and / or diplomas to certify the occupation;
- two personal reviewers;
- valid passport;
- letter from the local Inland Revenue office to confirm the status of self-employed.

Also, for employment in the Great Britain license is required - Accession Worker Card or
Registration Certificate. The timeframe for processing the application for this permit varies
from a minimum of 20 days to a maximum of six months.
The procedure for obtaining a work permit under the program Business and Commercial
involves going through two steps:
- British prospective employer requests the issuing of a Letter of Approval (Letter of
Approval), by filling in WP1. The form shall be accompanied by documents
confirming that the conditions imposed under the program Business and Commercial;
- After the issuance of the Letter of Approval, the worker will ask for the Work
Authorization (Accession Worker Card) by completing the form BR3. The permit is
valid only for the employer and the job for which initial approval was obtained.
To highly skilled workers is facilitated their access to the labor market if the conditions
imposed in the Highly Skilled Migrant Programme - HSMP are meet or if they have
graduated a form of higher education organized by a recognized educational institution in
Great Britain. Graduates of higher education institutions recognized in the United Kingdom
of Great Britain and Northern Ireland and Scotland, who have obtained in the last 12 months
a university diploma, a master degree, a postgraduate degree or doctorate (Bachelor’s degree,
Master’s degree, PhD or equivalent Postgraduate Certificate or Postgraduate Diploma),
achieve free access to the UK labor market, according to foreign graduates Programme
(International Graduates Scheme). HSMP programme is based on a system consisting of a
number of points, the access in the programme is obtained by the accumulation of at least 75
points. The points are awarded based on 5 evaluation criteria as follows:
- degree (PhD - 50p master - 35p, postgraduate studies - 30p);
- income earned in the last 12 months prior to submitting the application;
- previous experience gained in the UK, for which are granted 5p;
- age (less than 27 years - 20p, 28 and 29 - 10p, 30 and 31 years - 5p over 32 years -
0p);
- agraduation of a master programme in Business Administration (MBA) offered by an
eligible institution guarantees the obtaining of 75 points.

The access to the labor market for Romanian citizens who have exercised their right of
residence for the purpose of education / training is provided in any of the following situation:
- Romanian citizens can work full-time while studying if they follow a training course
that contains besides theoretical also practical component at the workplace (NVQ).
The workplace in this case must be relevant to the training programme developed;
- the development of labor relations during the studies is allowed only after obtaining a
certificate of registration (Yellow Registration Certificate) issued by the UK Border
Agency;
- conditions that need to be met to issue the registration certificates ( BR1 FORM): The
applicant attends an educational institution accredited in the UK or the applicant has
sufficient resources to support himself without relying on resources from the British
system of social assistance.
Unskilled workers are allowed access to the labor market only in agriculture and food
processing industry, if the required conditions for Seasonal Agricultural Workers Scheme -
SAWS or the Sectors Based Programme-SBS are fulfilled. The conditions imposed to the
workers employed within SAWS are the following: Romanian citizenship, at least 18 years,
work permit (SAWS card) issued by one of the operators licensed by the UK Border Agency.
Employment contracts are concluded for periods ranging from 5 weeks to 6 months, a new
job can be obtained within SAWS after a break of three months. There are no restrictions for
Romanian workers who operate on their own in the Great Britain.
There are many types of work permits or certificates of registration, namely:
- Yellow Card is issued obligatorily to students who want to work while studying and
optional performing self activities (self-employment) and to those who have sufficient
resources to support themselves in UK without having to work in this state (self –
sufficient);
- Blue Card / Blue Registration Certificate is issued: to those who have continuously
and legally worked in the UK as employees for at least 12 months, and their family
members - optional ; to family members of a Roman citizen who has the status of
"student", "self- sufficient" or "self-employed - optional, to family members of

workers who have a work permit (AWC / SAWS card) - optional , to family members
of non-EEA citizen who has the right to stay and work in the UK - optional , to family
members of citizens of other EU countries - optional ; to workers " highly qualified "
who meet the requirements of HSMP / IGS / SGS (compulsory) and to their family
members (optional);
- Purple Card / Accession Worker Card / AWC is issued to: those who occupy a skilled
job for which there is no demand from British citizens or from those of other Member
States (mainly those who have made an application for a work permit under the
Business and Commercial programme) - compulsory, to those who were granted the
right to work in the Sector Based Scheme - obligatory; to the "authorized" family
members of a Romanian citizen who owns a AWC - compulsory.
The Register of qualifications and of the certifying bodies of Great Britain responsible for
issuing qualifications can be found by visiting the website:
www.accreditedqualifications.org.uk. You can find information on the classification of the
aimed profession in the regulated profession or not, where the profession is regulated,
identify the organization that is competent and manages the process of recognition of the
profession.
In order recognize professional qualifications obtained in another Member State of the
European Union, the competent authorities require usually the accomplishment of the
following formalities:
- filling in of a form;
- presentation of a document that contains the proof of citizenship (passport, identity
card or birth certificate);
- presentation of a diploma or of a document certifying the completion of training
courses required to obtain access to the regulated profession, the proof of completion
of a period of internship or the registration with a similar body in the country of
origin;
- the proof of the work experience;
- medical certificate;

- the certificate regarding the professional reputation issued by the competent authority
of the country of origin.
The competent authorities after recognizing the professional qualifications shall
communicate to the applicant within one month if the file is complete or if is necessary the
submission of additional documents. Authorities have available a maximum period of four
months from the date of submission of the complete file to issue a decision on access to the
profession in question. For processing the applications is possible to be requested the
payment of some fees but them can not be greater than the costs incurred by the competent
authorities to provide this service. Authorities may decide to grant recognition of professional
qualifications and the right to pursue a regulated profession in the UK and can recommend
the application of compensatory measures where there are differences between higher
education in the State of origin and qualifications required in the UK to pursue a regulated
profession. Compensatory measures may take the form of an adaptation period not exceeding
three years or of an aptitude test. In most cases (except for professions legally regulated)
persons seeking access to a regulated profession will be able to choose between the two
compensatory measures. For the recognition of professional qualifications in Romania, NCP

In Romania, the National Centre for Recognition and Equivalence of Diplomas (CNRED)
works as a Department of the Ministry of Education, Research , Youth and Sports ( MECTS)
and has both NARIC and NRP role in Romania. Thus, it has the task of recognition and
equivalence of diplomas and certificates obtained in pre-university education (vocational and
technical) and in the academic studies and of the certificates attesting the legality of
educational documents issued by the educational institutions accredited in Romania. In case
of the regulated professions, the recognition of qualifications is done by each competent
authority in part, based on public information provided by CNRED. In addition, CNRED is
the national coordinator for the transposition of Directive 2005/36/EC on the recognition of
the professional qualifications, legislative coordinator area within the IMI system and
represents the Ministry of Education, Research, Youth and Sports at the European Committee
for the recognition of professional qualifications and at the European Group of national
coordinators for the recognition of professional qualifications.

2.2 Regulated professions and competent authorities
In the ANNEX are centralized all regulated professions in Great Britain, and the
competent authorities with a role in their regulation.
A. Professions in healthcare field
In Great Britain the legislation regarding health and safety is drafted and enforced by the
Health and Safety Executive and by the local authorities (local councils) in accordance with
the Health and Safety at Work Act 1974. European Agency for Safety and Health at
Work (EU-OSHA) was created in 1996 in Bilbao, Spain, under the European Council
regulation (EC) No. 2062/94 of 18 July 1994. Agency's mission is "to do their jobs in Europe
safer, healthier and more productive. This is possible by uniting and sharing all knowledge
and information in order to promote a culture of risk prevention".
In 2005, within EU- OSHA was created the European risk observatory. Demographic
changes and developments in work organization and production methods have led to new
types of risks for the safety and health of workers. This observatory aims to identify new and
emerging risks and to promote urgent action of prevention. It describes the trends, highlights
the factors and anticipates changes in the working environment and the likely consequences
on health and safety.
Healthcare in Great Britain is regulated by nine organizations that have different goals
and objectives, such as establishing standards of conduct, competence and education that
healthcare professionals and must meet; maintaining records of healthcare professionals, in
order to have the right to practice in Great Britain; establishing sanctions imposed in the
event of failure of professional obligations. Thus, some regulators check the quality and
safety of services - for example, in England the Commission for the quality of healthcare or
in Northern Ireland the Regulatory and Quality Improvement Agency. Other organizations

are the object of the quality and safety of medicines and medical devices – e. g. the
Regulatory Agency for Medicinal and Medical Products.
The largest organization in Great Britain in the field of occupational safety is the
Institution of Occupational Safety and Health (IOSH), (source: www.iosh.co.uk). The role of
this organization is to help practitioners to achieve the highest professional standards.
IOSH sets standards, develops and connects its members to resources, guidance, events
and training, being the largest organization in the world in healthcare and safety fields, and
the first non-governmental organization recognized by the International Labour Organisation
- ILO. In Great Britain there is also the International Institute of Risk and Safety
Management-IIRSM11
, to which are affiliated internationally qualified professionals
especially for professional security.
The professions in the healthcare field in Great Britain, automatically12

Chemical pathology, Child and adolescent psychiatry, Clinical genetics’, Clinical
neurophysiology, Clinical oncology, Clinical pharmacology and therapeutics, Clinical
radiology, Dermatology, Occupational medicine, Oral and maxillo-facial surgery,
Emergency medicine, Endocrinology and diabetes mellitus, General (internal) medicine,
Genito-urinary medicine, Geriatric medicine, Hematology, Immunology, Infectious diseases,
Legal Executive, Medical microbiology and virology, Medical oncology, Obstetrics and
gynaecology, Occupational Therapist, Occupational medicine, Ophthalmology,
Otolaryngology, Paediatric surgery, Paediatrics, Renal medicine, Respiratory medicine,
Rheumatology, Plastic surgery, Public health medicine, Tropical medicine, Urology.
The nine regulators in Great Britain and the professions they manage are:
- The General Board of Chiropractor for the Chiropractic profession;
- The General Dental Council for the following professions: dentist, dental assistant,
dental technician, dental hygienist, dental therapists, clinical dental technician,
orthodontist;

- The General Optical Council for the following professions: optometrist, ophthalmic
optician;
- The General Osteopathic Council for osteopathic profession;
- The General Pharmaceutical Council for the following professions: pharmacist,
pharmacy technician;
- The Board of Healthcare Professions for the following professions: physician,
biomedical scientist, chiropodist / podiatrist, clinical researcher, dietitian, devices and
hearing equipments, occupational therapists, practitioner surgeries, orthoptist,
paramedic, physical therapist, psychologist, prosthetist / orthotist, radiologist, social
workers, speech and language therapist;
- Nurses and Midwives Council for the following professions: nurses, midwives;
- Pharmaceutical Society of Northern Ireland for the profession of pharmacist.
In Romania, the professions regulated in the health sector (automatic recognition system)
and the CA governing the professional training are:
- Ministry of Health, College of Physicians in Romania for the medical profession;
- Ministry of Health, Romanian Dental College for dental profession;
- Ministry of Health, the College of Pharmacists of Romania for the profession of
pharmacist;
- Ministry of Health, the Order of Nurses and Midwives in Romania for the following
professions: nurse, midwife.
Health professions regulated in the health field that require at least 3 years of higher
education are: dental technician, pharmacist assistant, analyst in pharmacology, hygiene and
preventive dental assistant, dental assistant, medical acoustics technician, audiologist,
therapist, laboratory assistant, dietitian / nutritionist, radiology assistant. If the case of
different assistant professions, the Order of Nurses and Midwives in Romania is the CA, and
the case of dental technicians, the CA is the Dental Technicians Order of Romania.

English and are required to possess a certificate of language proficiency IELTS minimum
level compatible with 6.5. The validity of these certificates is of two years.
B. Professions in education field
The legislation regulating the professions in education in Great Britain is The Education
Act 2011 (with effect from April 1, 2012) and Teachers’ Standards May 2012.
People who want to work in Great Britain in regulated educational professions should
contact Nuffic for their professional qualification recognition. In turn, Nuffic releases for free
within a week a recognition statement for the professional recognition called Professional
recognition (NCP).
In Great Britain are regulated the following professions in education13
: teachers for
primary / secondary education (School Teacher in State maintained schools –
Primary/Secundary). The competent authorities managing these professions are: Teaching
Agency, England, General Teaching Council for Scotland, General Teaching Council for
Wales, General Teaching Council for Northern Ireland. The body that validates and certifies
the profession in Great Britain is the General Teaching Council of England.
The access conditions for the regulated professions in education require the applicant to
have: Bachelor's degree (with a duration of 4 years), in England the Qualified Teacher Status
certificate (QTS) issued at the graduation of Initial Teacher Training (ITT) consisting of
theoretical lessons and 18 weeks of practice in the field, in Scotland the Teaching
Qualification certificate (TQ) obtain upon graduation of the Initial Teacher Education (ITE).
Additionally, the applicant can prove that it has a similar teaching qualification in the country
of origin. For applicants who are from Great Britain it is necessary to have a work permit
called the Blue card.
In Romania, according to Law 200/2004, the teacher qualifications in both undergraduate
education and higher education is regulated profession managed by the Ministry of
Education, Research, Youth and Sports.
The National Education Law known as Law no. 1/2011, published in the Official Gazette
no. 18 of 10 January 2011, regulates the structure, the functions, the organization and
operation of the national system of state, private and confessional education. The law
promotes a values-oriented education, creativity, cognitive, volitional capacities and

capabilities act fundamental knowledge and knowledge , skills and abilities of direct utility in
the profession and in society.
In education, in the IMI systems are registered two professions regulated in Romania:
teacher in higher education system and secondary school teacher.
C. The mediator profession
A difference between Romania and the Netherlands exist regarding the mediator
profession.
In our country this profession is regulated (CA: Mediators Council of Romania), while in
Great Britain the profession is not regulated. Due to this situation, a Romanian mediator who
wishes to practice in Great Britain does not need to seek professional recognition, but a
British mediator who wishes to exercise the right to practice as a mediator in Romania is
forced to seek recognition of its qualification by the Mediators Council of Romania.

Great Britain is situated on the first rank among the EU countries in terms of the volume
of applications received in responses, and Romania is on the same place but in terms of the

CONCLUSION
From the comparative study made between the UK and Romania, in terms of skills
certification and recognition of professional qualifications processes, have resulted the
following conclusions:
- the education systems in the UK and in Romania clearly specify the level of studies in
order to obtain a professional qualifications;
- the certification processes of the non-formal and informal learning outcomes are
regulated both in Romania and in the UK, with the difference that in our country this
activity has recently started (according to the National Education Law no. 1 of 2011).
The same statement can be made also for the recognition of the forms of continuing
education of adults, which is regulated by the same law;
- the National Qualifications Framework in the UK is linked to the European
Qualifications Framework ECQ / EQF , but in Romania this process is almost
completed, the European Qualification Framework being implemented only for
Higher Education, achieving a National Qualifications Register for Higher Education
in Romania;
- in the UK there are 220 regulated professions, according to official data of the
European Commission on the European single market;
- in the health sector there is the largest number of regulated professions, both in
Romania and in the UK, and recognition is done automatically as there are no
problems in this field;
- the recognition of the regulated professions in the UK are made by the competent
authorities who have a role in regulating that profession, similar to the situation in
Romania, under the Directive 2005/36/EC on the recognition of the professional
qualifications;
- in the UK, there is a large number of professional associations, so that in order the
exercise certain professions should be made the evidence of professional affiliation,

whereas in Romania there are a small number of such professional organizations /
colleges / orders;
- the statistics on the mobility of workers within the European Union indicate that
workers in the UK have had extremely low mobility in Romania, the most
demanded professions for recognition of professional qualifications in the UK have
been: psychotherapist (5 applications), prosthetics/orthotics (2 applications),
security guards (2 applications), psychologist (1 application), radiologist (1
application), and so on, while in Romania: specialist in orthodontics and dent facial
orthopedics (2 applications).
