Industries impose curb onentry of tankers at night

Ahmedabad : Whileindustries at Sachin GIDC areyet to fully comply with theorders of the National GreenTribunal (NGT) on illegaldumping of chemicalsfollowing the gas leak incidentthat had claimed six lives, theyhave taken some measures tocurb the illegal activities. TheNGT in its order on Thursdayhad stated, “All GIDC may havetoll (amount may be onlytoken) at entry & exit pointsand CCTV camera to identifythe movement of such tankersand all the tankers shouldhave GPS enabled trackingsystem for the transportationof all chemicals andwastewater like hazardouswaste.”Sachin IndustrialCooperative Society (SICOS)has banned the entry of alltypes of tankers between 8 pmand 7 am in the industrial area.

It has also planned to installbarriers at entry points.

When questioned aboutthe implementation of the NGTorder, leader of industries inSachin GIDC, MahendraRamoliya said, “We are yet tostudy the order. Necessary

Wrong remedy: On IAS, IPSdeputation rule changesThat the wrong remedy

could exacerbate an ailmentand not cure it is a wellunderstood adage. This holdstrue for the Uniongovernment’s (Department ofPersonnel & Training – DoPT)proposals to amend Rule 6related to deputation of cadreofficers of the IAS (Cadre)Rules 1954. Reports haveshown that the deputationfrom States to the Uniongovernment has been uneven.Some States have notnominated officers fordeputation adequately to workwith the Union government; inthis, West Bengal (11 out ofthe 280 officers are on centraldeputation), Rajasthan (13out of 247) and Telangana (7out of an authorised strengthof 208) stand out. This has ledto vacancies across Uniongovernment ministries.Numbers accessed by TheHindu show that actualdeputation as a percentage ofthe mandated reserves fellfrom 69% (2014) to 30%(2021), suggesting that thereis merit in the DoPT’sidentification of shortages indeputation being an issue. Butdoes this necessitate the rulechanges proposed by theDoPT, which include acquiringoverriding powers for theUnion government that will doaway with seeking approvalfrom the States fortransferring IAS and IPSofficers? Besides, a State-by-State look at deputation thatdisincentivises those Stateswhich depute officers much

below the mandated numbersto the Union government byadjusting future cadrestrength reviews by the UnionPublic Service Commissionshould also address theshortage problem. Thesesteps are better than any rulechanges that amount to fiatsstriking at federalism.

Two of the rules areparticularly problematic — incase of any disagreementbetween the Union and Stategovernments, the States shallgive effect to the former’sdecision “within a specifiedtime”. And in some “specificsituations”, States would haveto depute certain cadreswhose services are sought bythe Union government. Thesechanges amount to arm-twisting States and unwillingbureaucrats to be deputed toserve the Union governmentand also presenting a faitaccompli to States for “specificsituations” which have notbeen defined and prone tomisinterpretation andpoliticisation. These proposedchanges have unsurprisinglyraised the hackles of Stategovernments. As governanceresponsibilities during thepandemic have shown, Statesare quite dependent upon thebureaucracy, and deputationto the Union governmentshould not be done at the costof State requirements. Also,the Union government mustaddress the key question ofthe reluctance of capable civilservants to be deputed awayfrom the States. Reports have

The vociferous protestsbeing heard from variousquarters at the shifting of theAmar Jawan Jyoti — theeternal flame which honoursIndia’s “unknown soldier” —from its location under IndiaGate to the National WarMemorial (NWM) not onlyrepresent an irony for India’smilitary veterans, but also adeep schism in India’s socio-political landscape.

Let us first address the“schism”. Such is the level ofsuspicion and distrust inIndia’s contemporary politics,and so heated is theenvironment, that every actionby the government of the dayis seen as a move to bolsterthe electoral prospects of theruling party. Nowhere is thistrend more perceptible than inthe military sphere. Ever sincethe Prussian strategistClausewitz classified “war asa continuation of politics…”

politicians, worldwide — fromIndira Gandhi to MargaretThatcher — have unabashedlymade political capital out ofmilitary achievements.

In India, however, giventhat elections are an endemicphenomenon, there is a needfor governments to exerciseprudence in this context anddraw “red lines” forthemselves. The concern hereis not so much about theundue advantage accruing toparties as about the corrosiveinfluence of excessive politicalposturing and exposure, whichcan undermine the integrityand cohesion of our — so far— apolitical militaryleadership as well as the rankand file. The political theatreabout the shifting of the AmarJawan Jyoti, being enacted liveand on social media, is merelythe latest manifestation of thisschism.

As for the “irony”, it

requires us to take a look backat recent history. For as longas one can remember, India’sservicemen had ruefully notedwhat seemed like not just alack of gratitude, but also anacknowledgement, on the partof their compatriots of thesacrifices of their soldiers.Since November 3, 1947,when the gallant MajorSomnath Sharma fell in theBattle of Badgam, earningIndia’s first Param Vir Chakra,there has hardly been a dayin the life of our embattlednation when some grievingfamily somewhere has notwelcomed home a hero —someone’s father, son orhusband, brought to thedoorstep in a tricolour-drapedcoffin.

For years, post-independence, while ourwayward media took cursorynote of such episodes,politicians studiously ignoredthe soldiers’ sacrifices inupholding the nation’sintegrity. As the adventurismof our neighbours led toconflicts in 1947, 1962, 1965and 1971, pleas from veteransand citizens that the gallantryand sacrifice of our armedforces deserved recognition inthe form of a war memorialcontinued to fall on deafpolitical ears.

This indifference was instark contrast with the attitude

of other nations. Whether itwas the Arlington Memorial inWashington, the Cenotaph inLondon, the Arc de Triomphein Paris or the Liberation Warmemorial in Dhaka, thesemagnificent monumentsacknowledged the sacrifice oftheir warriors and enabledfellow citizens to pay homage.Finally, in recognition of thesacrifices of our soldiers,Prime Minister Indira Gandhiinaugurated the Amar JawanJyoti at India Gate on January26, 1972. Such was the feelingof relief and elation at thisbelated gesture that most ofus overlooked two glaringincongruities.

Firstly, the locationchosen for the flame was notthe most appropriate. IndiaGate, Edward Lutyen’s half-hearted attempt to copy themagnificent French Arc deTriomphe was a war memorialerected by the British, in 1921in memory of soldiers whodied in World War I and theThird Anglo-Afghan War. Whilemost of the names engravedon the granite walls are ofIndian soldiers, a few Britishofficers and soldiers find aplace too. The monumentdoes not celebrate a nationalwar and could, at best, be anad-hoc memorial for India’sfallen. Secondly, the cenotaphwas surmounted with what isknown as the “battlefield

cross”, consisting of an upright7.62 mm rifle embedded bythe barrel, with a steel helmetmounted on its butt. Thissymbology originated from anAmerican Civil War custom,wherein it was used as atemporary marker for thelocation of a soldier’s body onthe battlefield till it wascollected for permanentinternment. It was expectedthat a suitable, stonemonument would be erectedin memory of India’s“unknown warrior” but nothingof the sort happened and weretained the “battlefield cross”for 50 years.

There were other slightsto soldiers too. Thegovernment’s inexplicablerefusal for many years to payhomage to fallen soldiers onthe anniversaries of theBangladesh and Kargil wars orthe Sri Lanka IndianPeacekeeping Force (IPKF)operations on political groundsrankled. The crowningignominy was the fact that theSri Lankan governmenterected an impressivemonument to the IPKF deadin 2008, while these bravesoldiers remained unsung intheir motherland.

Against thisbackground, the BJP’s 2014election manifesto, whichcontained a pledge to “Build aWar Memorial to recognise

and honour the gallantry ofour soldiers” brought hope tomany veterans. Five yearslater, the pledge wasredeemed with theinauguration of a 40-acreNWM complex in a centrallocation in the Capital. Thiswas seen by veterans not onlyas a belated mea culpa by thenation and its politicalestablishment, but also amorale-booster for a millionand a half men and womenbearing arms. The NWM isnow a place for citizens to payhomage to our fallen militaryheroes. Co-locating the AmarJawan Jyoti with the NWMseems a logical step, andneed not become a subject ofpolitical controversy.

National capitals,worldwide, are replete withmemorials to wars andwarriors, heroic statues ofsoldiers and squares andavenues named aftergenerals, admirals andfamous battles. In India,statues and street namesfocus mainly on politiciansand, occasionally, on religiousfigures, business tycoons orscholars, with soldiers mostlyforgotten. In this context,displaying the statue of NetajiSubhas Bose, a freedom-fighter and a quasi-militaryIndian icon, on his 125th birthanniversary, at India Gatecanopy is to be welcomed.

Justice in the time of virusJudges are constantly

confronted with new crisesthat demand responsibleadjudication. This is whatmakes the practice of law —both at the bar and on thebench — exciting. In the pastfew weeks, two fascinatingcourt cases involving Covid-19vaccination regimes havecaptured the publicimagination and warrantedthe attention of judges in theUnited States and Australia.

On January 13, 2022,the United States SupremeCourt (SCOTUS) delivered a

judgment in NationalFederation of IndependentBusiness v Department ofLabour, Occupational Safetyand Health Administrationpertaining to the Joe Bidenadministration’s vaccine orweekly-test mandate for allemployers with 100 or moreemployees. In a 6-3 decision,the judges ruled that theOccupational Safety andHealth Administration (OSHA)had exceeded its power inissuing such a mandate,minus an authorisation fromCongress. The majority

comprised the six conservativejudges appointed byRepublican administrations.

The majority’s rationalewas that while Congress hasgiven OSHA the power toregulate workplace dangers,it “has not given that agencythe power to regulate publichealth more broadly.” Thecourt reasoned that whileCovid-19 “is a risk that occursin many workplaces, it is notan occupational hazard inmost.” Noting that Covid-19can spread practicallyanywhere that people gather,the court declared that theuniversal risk the viruspresents is no different fromthe day-to-day dangers thatpeople confront from crime orair pollution.

Yet, in a companion caseBiden v Missouri, SCOTUSallowed the government totemporarily enforce a vaccinemandate for healthcareworkers at facilities thatreceive federal funding. Thistime, the court was split 5-4,with Chief Justice John Robertsand Donald Trump appointeeJustice Brett Kavanaughjoining the three liberaljudges Justices StephenBreyer, Elena Kagan and SoniaSotomayor.

I highlight the politicalpersuasions of the rulingmajorities and dissentingminorities in these casesbecause vaccines andmasking are deeply politicisedissues in the United States.Conservatives, including manyRepublicans, fiercely opposeboth vaccine and maskmandates, viewing them asinfringing upon freedom, while

also questioning their utility.Justice Neil Gorsuch, a Trumpappointee, has reportedlyrefused to wear a mask whilehearing cases in physicalcourt. Meanwhile, his seniorcolleague Justice SoniaSotomayor has been hearingcases from home because shehas diabetes, an underlyingcondition that puts her at agreater health risk should shecontract Covid. In ordinarycourse, Justices Sotomayorand Gorsuch sat next to eachother, and Justice Gorsuch’srefusal to wear a mask hasresulted in a controversy abouthis bench etiquette.

Prior to his arrival inAustralia, Djokovic chose notto get vaccinated, andconsistently played down thethreat of Covid-19. Shortlyafter he tested positive in earlyDecember 2021, he continuedto attend public events inSerbia unmasked.

Covid-19: 50 Rajkot Civil Hospital staff infected

Ahmedabad : Around 50staffers of the civil hospital inRajkot city, including doctors

and nurses, have testedcoronavirus positive, an officialsaid Sunday. Since none of

them are in a seriouscondition, they are undergoingtreatment in home isolation,Superintendent of CivilHospital R S Trivedi said.

"Heal thcare staf fmembers of the hospital,who come in direct contactwith the patients, weretested for Covid-19. Almost50 of them, inc lud ingparamedical staff, nursesand doctors, were foundinfected. But the good thingis that nobody is in a seriouscondition, and most of themare in home isolation," he

said. There are 7,653 activecases in Rajkot district atpresent, as per the statehealth department’s Covid-19dashboard. The districthas so far reported 69,414infection cases and 61,025recover ies, wi th 736patients dying so far, as perthe heal th departmentupdate.
