Hate CrimesUnder the CleryAct, a hate crime is defined as a criminal offense committed against aperson or property which is motivated, in whole or in part, by the offender's bias.Bias refers to a "preformed negative opinion or attitude toward a group of persons basedon their race,gender,religion, disability, sexual orientation, gender identity, ethnicity, ornational origin:' If any of the aforementioned Clery crimes involve such biases,thoseincidents are also considered hate crimes.Other crimes considered when hate crimesare being assessedinclude: larceny/theft, simple assault, intimidation, and damage/destruction/vandalism of property.
• In 2016,one on-campus incident characterized by national origin bias occurred when acar was vandalized in a University parking lot.
Unfounded CrimesThe VAWA/CampusSaVEAct requires institutions to provide statistics on crime reportsthat were unfounded. Only law enforcement is permitted to unfound a report that wouldotherwise be submitted as a Clery statistic. If the campus police or local law enforcementdeem the report false or baseless,the officer(s) must be able to articulate why the reportwas given that status. No other university affiliates have the legal authority to unfound areport and thus must submit any and all Clery crime reports they received,no matter whatthe outcome of the investigation was and no matter if a dean or other university official didor did not take disciplinary action.
