SUMMARY OF STATEMENT OF ESTIMATED
REGULATORY COSTS AND LEGISLATIVE
RATIFICATION:
The Agency has determined that this will not have an adverse
impact on small business or likely increase directly or indirectly
regulatory costs in excess of $200,000 in the aggregate within
one year after the implementation of the rule. A SERC has not
been prepared by the Agency.
The Agency has determined that the proposed rule is not
expected to require legislative ratification based on the
statement of estimated regulatory costs or if no SERC is
required, the information expressly relied upon and described
herein: During discussion of the economic impact of this rule at
its Board meeting, the Board, based upon the expertise and
experience of its members and the substance of the rule
amendment, determined that a Statement of Estimated
Regulatory Costs (SERC) was not necessary because the rule
does not impose additional rights, obligations, or duties on any
persons or businesses, and that the rule will not require
ratification by the Legislature. No person or interested party
submitted additional information regarding the economic
impact at that time.
Any person who wishes to provide information regarding a
statement of estimated regulatory costs, or provide a proposal
for a lower cost regulatory alternative must do so in writing
within 21 days of this notice.

64B9-3.002 Qualifications for Examination.
An applicant seeking certification to take the licensure
examination shall submit a completed Nursing Licensure by
Examination Application, form number DH-MQA 1094, 01/18
07/16, hereby incorporated by reference, and may be obtained
from http://www.flrules.org/Gateway/reference.asp?No=Ref-
08265, or Nursing Licensure by Re-Examination Application,
form number DH-MQA 1120, 01/1807/16, hereby incorporated
by reference, and may be obtained from
http://www.flrules.org/Gateway/reference.asp?No=Ref-
08266, demonstrating that he or she meets the qualifications
prescribed by the Nurse Practice Act, Chapter 464, F.S. These
forms are also available from the Board office or on the Board’s
website: http://floridasnursing.gov. The demonstration shall
include:
(1) through (3) No change.
(4) If the applicant is a graduate of a foreign prelicensure
education program not taught in English, or if English is not the
applicant’s native language, successful completion of one of the
following: Successful completion of any one of the methods
listed below:
(a) A minimum score of 540 on the paper version; (207 on
the computerized version, or and 76 on the internet based
version), on the Test of English as a Foreign Language
(TOEFL) Examination;
(b) A minimum score of 79% on the Michigan English
Language Assessment Battery (MELAB);
(c) A minimum MELAB converted score of 79% on the
Michigan Examination for the Certificate of Proficiency in
English (ECPE Examination);
(c)(d) A minimum score of 725 on Test of English for
International Communication (TOEIC);
(d)(e) A minimum score of 6.5 overall with a 7.0 on the
spoken portion of on the academic version of International
English Language Testing System (IELTS); or
(e) A minimum score of 51 on the Pearson Test of English
Academic (PTE Academic).
(f) Completion of a nursing program given in English in
another country;
(g) A passing score on a nursing licensing examination
which is given in English;
(h) A certificate from the Commission on Graduates from
Foreign Nursing Schools or other agency which indicates
successful completion of TOEFL, TOEIC, or IELTS;
(i) Graduation from a high school with the curriculum
given in English;
(j) Completion of a college level course for academic credit
in a U.S. institution.

Notice is hereby given that the following changes have been
made to the proposed rule in accordance with subparagraph
120.54(3)(d)1., F.S., published in Vol. 41 No. 211, October 29,
2015 issue of the Florida Administrative Register, and updated
with a notice of change published in Vol. 42, No. 10, January
15, 2016, issue of the Florida Administrative Register.
61D-11.001 Definitions.
(1) through (15) No change.
(16) “Designated player” means the player identified by the
button as the player in the dealer position.
(17)(16) “Drop” means the procedure to remove drop
boxes before counting the total amount of money, chips, and
tokens removed from the drop box.

(18)(17) “Drop Box” means a locked container
permanently marked with the number corresponding to a
permanent number on the card or domino table.
(19)(18) “Facility” means the cardroom, any storage area
for card or domino tables, cards, chips, tokens, dominoes, drop
boxes, tip boxes, records relating to cardroom activity, and
other cardroom supplies, the count room, and imprest vault.
(20)(19) “Game” means the completion of all betting
rounds and final determination of a winner based upon the
comparison of all cards dealt and held by players at the end of
all betting at a table.
(21)(20) “Hand” means the group of cards dealt to a player
in a game.
(22)(21) “Imprest tray” means any tray in which a
predetermined dollar amount of chips, tokens, or U.S. currency
is kept.
(23)(22) “Jackpot pool” means an accumulation of money
collected from card games to be awarded to a player or players
in accordance with section 849.086(7)(d), F.S.
(24)(23) “Licensee” means a person or entity holding any
license issued by the division for purposes of cardroom
operations.
(25)(24) “Operate” means to conduct authorized games
pursuant to Section 849.086, F.S.
(26)(25) “Pot” means the total amount wagered in a game
of games of poker or dominoes.
(27)(26) “Proposition player” means a player who is
employed by a cardroom operator, but who uses his own money
to initiate or play in games.
(28)(27) “PTZ Camera” means a light-sensitive color video
camera that has pan, tilt, and zoom capabilities.
(29)(28) “Raise” means to increase the size of the
preceding bet.
(30)(29) “Re-buy” means the additional tournament chips
purchased by players according to the schedule of re-buys
prominently displayed in the cardroom during tournament play.
(31)(30) “Round of play” means, for any game of poker,
the process by which cards are dealt, bets are placed and the
winner is determined and paid in accordance with the rules of
Chapter 61D-11, F.A.C.
(32)(31) “Shill” means a player in a game provided by or
employed by a cardroom operator who only bets with money
provided by the cardroom operator.
(33)(32) “Showdown” means the point in a poker game in
which all hands are fully revealed to all other players and the
hand with the best combination becomes the winner.
(34)(33) “Side bets” means additional wagers made
between two or more persons on the outcome or any portion of
an authorized game.
(35)(34) “Supporting areas” means those areas supporting
the operation of the cardroom including, but not limited to,
surveillance, cashiers’ cages, podiums, vaults, and count rooms.
(36)(35) “Surveillance room” means a secure location in a
pari-mutuel facility used for cardroom surveillance.
(37)(36) “Surveillance system” means a system of video
cameras, monitors, recorders, and other ancillary equipment
used for cardroom surveillance.
(38)(37) “Tip box” means a locked container into which all
dealer tips must be inserted.
(39)(38) “Tournament chips” means chips that have no
cash value that are used in tournament play.
(40)(39) “Vault” means a secure location where chips and
currency are maintained.

61D-11.002 Cardroom Games.
(1) No change.
(2) The cardroom operator shall prominently display a list
of all games available for play in the cardroom that have been
reviewed by the division for compliance with Chapter 849, F.S.,
and are included within the cardroom’s House Rules internal
controls.
(3) No change.
(4) Card games that utilize a designated player that covers
other players’ wagers shall be governed by the cardroom
operator’s house rules. The house rules shall:
(a) Establish uniform requirements to be a designated
player;
(b) Ensure that the dealer button rotates around the card
table in a clockwise fashion on a hand by hand basis to provide
each player desiring to be the designated player an equal
opportunity to participate as the designated player; and
(c) Not require the designated player to cover all potential
wagers.

61D-11.0021 Cardroom Game Rules Submissions
(1) A cardroom operator or business occupational licensee
shall include in its House Rules submit to the division, office of
auditing, a complete cardroom game submission for review and
evaluation of compliance with the provisions of Section
849.086, F.S., and Chapter 61D-11, F.A.C., prior to the game
being included in any cardrooms’ internal controls. The game
submissions shall include all of the following:
(a) through (j) No change.

(2) A game submission will not be considered reviewed
until the division has posted the game submission to
www.myfloridalicense.com/dbpr/pmw.
(3) A cardroom operator may include in their internal

NOTICE IS HEREBY GIVEN that on November 3, 2017, the
Florida Department of Law Enforcement received a petition for
a permanent waiver of Rule 11B-30.008(1), F.A.C., from Kevin
W. Nash.
Petitioner wishes to waive that portion of the Rule that states,
in pertinent part: Administration of the Computer-Based State
Officer Certification Examination (CB-SOCE) shall be limited
to test sites authorized by the Commission and located within
the State of Florida. In justification of his petition for waiver,
Petitioner asserts that on June 21, 2017 he completed and
passed Basic Law Enforcement Training at the North East
Criminal Justice Training Center Region 5. Petitioner further
asserts that he then logged onto the Pearson Vue Testing
Facility website and registered for the State Officer
Certification Exam. He was provided the option for a SOCE
testing site in Savannah Georgia which he selected and
subsequently passed the SOCE at that location on June 27,
2017. During this time the Petitioner applied for a position with
the Jacksonville Sheriff’s Office. On July 21, 2017 the JSO
researched the Petitioner’s ATMS global profile which showed
that petitioner had taken and passed the SOCE. On September
18, 1027, Petitioner obtained employment with the Jacksonville
Sheriff’s Office as a certified police officer. On October 6, 2017
Petitioner received notice that he was ineligible for a position
as a certified police officer because he had taken the SOCE out
of state. Petitioner alleges that, should the waiver not be
granted, Petitioner will suffer a substantial hardship as he would
be unable to continue to work in the law enforcement officer
position for which he was trained and hired until he sits for and
passes a Florida SOCE administered within the State of Florida.

Agency is hosting a working group meeting regarding transition
to a prospective payment system for nursing home
reimbursement under the Florida Medicaid program.
The 2017 Legislature required the Agency to convene a
working group to review relevant issues and make
recommendations specific to the transition to a prospective
payment system for nursing home reimbursement under the
Florida Medicaid program. The group shall consist of
representatives of nursing home providers and other interested
stakeholders. The working group’s focus shall include, but not
be limited to: any adjustments needed to existing targets and
ceilings applicable to rate calculations; any adjustments needed
to existing direct care and indirect care subcomponents;
development and refinement of quality measures to be used; the
frequency of rebasing under prospective payments; any
exemptions from prospective payments; considerations for
supplemental payments as part of prospective payments; and a
phase-in timeline, if needed, including the need for any
transition payments during phase-in. The working group shall
submit a report and any recommendations to the agency, the
Governor, the President of the Senate, and the Speaker of the
House of Representatives by December 1, 2017.

scheduled two Alternatives Workshop Public Meetings to
discuss the NW 27th Avenue Premium Transit Project
Development and Environmental (PD&E) Study along SR-
9/SR-817/NW 27th Avenue from approximately NW 38th
Street to approximately NW 215th Street (at Unity Station) and
from the Miami Intermodal Center (MIC) (at Miami
International Airport (MIA)) to NW 27th Avenue via SR-112.
The Alternatives Workshop being held on Wednesday,
November 15, 2017, will take place at the Cosmopolitan Baptist
Church - Fellowship Hall, located at 3003 NW 207th Street,
Miami Gardens, FL 33056. The Alternatives Workshop being
held on Thursday, November 16, 2017, will take place at
Corporate Academy North – Library, located at 5120 NW 24th
Avenue, Miami, FL 33142.
The Alternatives Public Workshops are being held to present
the results of the PD&E Study to date and obtain input on the
alternatives under consideration. These workshops will provide
an opportunity for the public to learn about the project and
provide initial feedback on several proposed alternatives. This
workshop will be held in an informal, open house format.
Attendees are encouraged to come at any time to review the
proposed improvements. Notices have been sent to property
owners and tenants located within at least 330 feet on either side
of the proposed alignment and to other public officials,
regulatory agencies, organizations, and individuals interested in
the project.

TO HURRICANE IRMA
EMERGENCY FINAL ORDER
Pursuant to sections 120.569(2)(n), 252.36, and
252.46, Florida Statutes, and upon consideration of the State of
Florida Executive Order No. 17-235 and the following findings
of fact, the State of Florida Department of Economic
Opportunity (Department) enters this Emergency Final Order
(Order), including Findings of Fact and Conclusions of Law, in
response to the imminent or immediate danger to the public
health, safety, and welfare of the citizens of the State of Florida
posed by Hurricane Irma (hereinafter “the Hurricane”).
FINDINGS OF FACT
1. On September 4, 2017, by State of Florida Executive
Order No. 17-235 (“Executive Order 17-235”), the Governor
declared that a state of emergency exists throughout the State
of Florida based upon the serious threat to the public health,
safety, and welfare posed by the Hurricane. On November 2,
2017, the Governor issued Executive Order No. 17-287
(“Executive Order 17-287”), which extends Executive Order
17-235 for 60 days following the issuance of Executive Order
No. 17-287.
2. The Department has the ultimate authority over the
administration of Florida’s Reemployment Assistance (RA)
Program pursuant to sections 20.60(5)(c)(3) and
443.1317(1)(a), Florida Statutes, and Chapters 73B-10 and
73B-11, Florida Administrative Code.
3. On September 14, 2017, the Department publicly
announced that Disaster Unemployment Assistance (DUA) was
available to Florida businesses and residents whose
employment or self-employment was lost or interrupted as a
direct result of the Hurricane.
4. DUA Straight is available to individuals whose
employment or self-employment was lost or interrupted as a
direct result of the Hurricane. This benefit covers individuals
who would not typically be eligible for regular RA benefits.
5. DUA Related is for individuals who are eligible for
regular RA benefits, pursuant to Chapter 443, Florida Statutes,
but whose employment was lost or interrupted as a direct result
of the Hurricane. The one week waiting period requirement
pursuant to section 443.091(1)(f), Florida Statutes, applies to
DUA Related claims.
6. Executive Order 17-235, recognizes that special
duties and responsibilities rest upon some State, regional, and
local agencies and other governmental bodies in responding to
the emergency may require waiver or deviation from the
statutes, rules, ordinances, and orders those agencies and
governmental bodies administer. Pursuant to Executive Order
17-235, the Department, as a State agency, may suspend the
provisions of any regulatory statute prescribing the procedures
for conduct of state business or the orders or rules of the
Department, if strict compliance with the provisions of any such
statute, order, or rule would in any way prevent, hinder, or delay
necessary action in coping with the effects of the Hurricane.
7. The Department finds that the Hurricane creates a
state of emergency threatening the public health, safety, and
welfare throughout the State. As a result of the emergency and
for the administration of DUA, it is necessary to immediately
waive the one week waiting period requirement pursuant to
section 443.091(1)(f), Florida Statutes, for DUA Related
claims.
8. The Department finds that immediate, strict
compliance with section 443.091(1)(f), Florida Statutes, for
DUA Related claims would prevent, hinder, or delay necessary
action in coping with the emergency, and the actions authorized
under this Order are narrowly tailored to address the immediate
need for action and are procedurally appropriate under the
circumstances.
DUA Straight is eligible to individuals who would not typically
be eligible for regular RA benefits (i.e., individuals who are
self-employed or someone who was getting ready to start a job
but was unable to because of the Hurricane). The one week
waiting period requirement pursuant to section 443.091(1)(f),
Florida Statutes, does not apply to DUA Straight.
To be eligible for DUA Related, an individual must meet the
eligibility requirements listed in section 443.091, Florida
Statutes, which requires an individual to have been unemployed
for a waiting period of one week. See section 443.091(1)(f),
Florida Statutes.
CONCLUSIONS OF LAW
1. Based on the findings recited above, it is hereby
concluded that the emergency caused by the Hurricane poses an
immediate danger to the public health, safety, or welfare and
requires an immediate order of the Department.
2. Pursuant to Executive Order 17-235, as amended by
Executive Order 17-287, and sections 120.569(2)(n), 252.36,
and 252.46, Florida Statutes, the Executive Director, or
designee, of the Department is authorized to issue this
Emergency Final Order.
3. The waiver of section 443.091(1)(f), Florida Statutes,
for DUA Related claims is required so as not to prevent, hinder,
or delay necessary action in coping with the emergency.
THEREFORE, IT IS ORDERED that the one week waiting
period requirement pursuant to section 443.091(1)(f), Florida
Statutes, is hereby waived for DUA Related claims. This
Emergency Final Order shall take effect immediately upon
execution by the Executive Director, or designee, and shall
expire on November 14, 2017, unless modified or extended by
further order.
