• 50% of the underlying fee ownership has joined as Co-Applicant in recognition of NBCC’s right to secure CDP

• 56 years remain on ground lease

• Consistent with City of Newport Beach Certified Coastal Land Use Plan (LUP) designation of open space which “is intended to provide areas for a range of public and private uses to meet the recreation and open space needs of the community…” (Newport Beach Local Coastal Program Coastal Land Use Plan, p. 2-4)

• Consistent with Chapter 3 Policies of the Coastal Act as indicated in the Staff Report

• No environmental resources or Coastal Act issues

PROJECT COMPONENTS

• Reconstruction of 58 year old clubhouse

• Increase in size of clubhouse required to comply with building and public safety code requirements and to modernize existing uses

• Single new use – 1,800 s.f. fitness center for club members

• Replacement of maintenance facility and ancillary support uses

• Water Quality Features

• Treatment of all runoff (existing runoff is discharged untreated into impaired Newport Harbor)

• Reduction from current runoff rates through increase in permeable areas (i.e., permeable paving, directing runoff into vegetated areas)

• Drought Tolerant, Non-Invasive Landscape Plan

Conclusion: No Coastal Act issues have been raised by the opposition, as indicated in the Staff Report
