I. INTRODUCTION
1.1 Introduction of the Project
The Government of Vietnam has requested the Asian Development Bank (ADB) to
provide a loan to construct new electricity distribution system including a 436.673
km – long Pleiku – My Phuoc – Cau Bong 500kV transmission line from Pleiku to
Cau Bong via My Phuoc in southern area of Vietnam. The proponent and Executing
Agency for the loan is the National Power Transmission Corporation (NPT). The
Central Power CPMB (CPMB) is responsible for the operation of the power system
in central Vietnam and will be the Executing Agency of the project.
NPT has identified the 500kV Pleiku – My Phuoc - Cau Bong transmission line as a
high priority project and one of several projects for the purpose of connecting 90%
of the population to electricity by 2020 and 100% by 2025. The proposed Pleiku-
My Phuoc – Cau Bong 500kV transmission line will meet energy demand in the
South of Vietnam which is growing at 14% per year and expected to balloon out to
25% by 2015. The construction of 500 kV Pleiku – My Phuoc – Cau Bong
transmission line together with expansion of Pleiku substation will be an enhanced
and more reliable energy supply to the Southern provinces in Vietnam, especially
for industrial zones in the area.
Objectives of the Project are as follows:
- The Pleiku – My Phuoc – Cau Bong 500kV transmission line Project is a part of
the National electricity transmission network which was developed to maintain
the power supply that meet the demand of economic growth in the Southern area
during 2014-2015. Besides, the Project will ensure the connection of
transmission network within Vietnam, Laos and Cambodia by 2015.
- The Project also helps to increase the reliability of power supply, reducing the
risk of electricity losses. It will also optimize capacity of power plants in order
to provide electricity continuously and safely to the sub-loading lines of the
South in particular and the whole country in general.
1.2. Objectives of independent monitoring
1.2.1. Overview of the monitoring work
The implementation of REMDP is a complicated task that requires regular
monitoring of CPMB and relevant local authorities. This monitoring process is
known as the internal monitoring. Besides internal monitoring, ADB always
requires that REMDP implementation is monitored by a professional independent
monitoring unit for ensuring regulations in REMDP are properly implemented as
approved REMDP, concurrently giving arisen problems during REMDP
implementation, and then proposing overcome measures.
1.2.2. Objectives of the monitoring work
The main objective of the monitoring and consulting service is to make sure the
APs of the 500kV Pleiku – My Phuoc – Cau Bong Project will receive full supports
and benefits as stated in approved REMDP.
The monitoring activities are conducted in order to:

(i) Ensure the rehabilitation and improvement of APs’ livelihood;
(ii) Supervise the whole Project to check if the current resettlement activities
are aligning with the RP or not. Propose addressing methods if necessary;
(iii) Assess if the rehabilitation and compensation methods are fully complied
with the REMDP, and ADB’s SPS (2009 and other amended) or not;
(iv) Detect arising problems during the implementation of the Project and
propose mitigation measures.
1.2.3 Monitoring locations
Monitoring area is divided into 2 places as follows (i) administrative agencies
relating to the project and (ii) construction area of the project. Specially:
(i) In office of CPMB, Compensation Committee/CLRD of districts,
wards/Commune the project goes through

In the third monitoring visit, the Consultant unit has worked with representatives of
following CPMB, CLRD of districts and PC of communes:

1.2.4. Sampling
According to the contract between the Project Management Unit and the
Consultant, the sampling process must involve at least 10% of the AHs along the
corridor according to compensation plan issued by the authority, which ensures the
selection criteria as following:
(1) All communes in project area will be monitored;
(2) All severely AHs will be interviewed;
(3) AHs interviewed contain severely AHs, households of ethnic minority and
vulnerable group.

2.1 Project documents
2.1.1. RAP and REMDP
Objectives of REMDP are as follows:
- REMDP which is planned during project preparation is to minimize negative
impacts of the Project on AHs;
- Land acquisition and resettlement caused by the Project must be limited to
the minimum;
- To improve or at lease maintain living standards of APs equal to prior to the
Project;
2.1.2 Impacts of project resettlement
Pleiku - My Phuoc- Cau Bong 500kV transmission line goes through 20
communes/6 districts in the area of Dak Nong province. The Project must
implement acquire land permanently of 279 households with 237 pole positions,
mainly in which are agriculture land. Project implementation also impacts on 103
households and 349 other works.

2.1.3 Impact of land acquisition
With 32m width of safety corridor, on total 115.933 km of line route on provincial
area, 3,344,356 m2
of land is under safety corridor, in which 106,855 m2 will be
permanently acquired for the purpose of tower construction. The affected land is
classified into agricultural lands, paddy lands for growing rice, forest lands and
residential lands.

2.1.4. Impacts on trees-crops
Total affected trees are 31,389 in which mainly high productive industry trees
including coffee, rubber, cashew, others are fruit trees, timber trees, shade trees, etc.

2.1.5. Impacts on houses and other structures
The project in Dak Nong area has impacts on 103 houses but partially house for
guarding field, preserving agricultural materials and products. Besides, line route
also impacts on 349 other structures such as kitchen, yard, and house to guard field,
bathing room/WC or animal shelter of households. Affected houses are determined
according to Decree 106/ND-CP and Decree 81/ND-CP on Protection of Safety
corridor of High-Voltage Power Grid Works.

2.1.6. Severely Affected Households
According to REMDP, Severely Affected Households (SAHs) refers to affected
households who will lose 10% or more of their total productive land and/or
productive assets, have to displace; and/or lose 10% or more of their total income
sources due to the Project. There are 90 households having houses in row, in which
number of Kinh households is 66 and 24 other are ethnic minorities ones.

2.2. Legal framework in benefit calculation
The legal framework and policies for compensation and resettlement under the
Project is defined by the relevant laws issued by the Government of Viet Nam:
- Law on Land issued by Vietnam’s National Assembly on 26 November 2003;
- Law on Complaints, approved by the National Assembly in 2011;
- Decree No.181/2004/ND-CP dated 29/10/2004 issued by the Government on
implementing Law on Land;
- Government’s Decree No.84/2007/ND-CP, dated May 25, 2007, providing
additional guidance on the grant of land use right certificates, land recovery,
exercise of land use rights, order and procedures for compensation, support
and re-settlement when land is recovered by the State;
- Decree No. 197/2004/ND-CP dated 03/12/2004 issued by the Government on
regulating compensation, support and resettlement when the State acquires
land. This Decree provides guidance on compensation for land and assets,
support and resettlement policy related to land acquisition.
- Decree 188/2004/ND-CP dated November 16, 2004, on methods to identify
land price and land price frame for different types of land;
- Decree No.123/2007/ND-CP dated 13/08/2009 amending, supplementing
some Articles of Decree No.188/2004/ND-CP;
- Decree No.69/2009/ND-CP dated 13/08/2009 issued by the Government on
supplementing regulations on land use, land acquisition, compensation,
support and resettlement in case of acquiring land, setting land price, granting
land and leasing land and additional requirements related to land use right;
- Decree No.106/2005/ND-CP dated August 17, 2005, regulating the protection
and safety corridor of high-voltage power grid works. Some articles of this
decree was amended and supplemented by Decree 81/2009/ND-CP dated
October 12, 2009;
- Circular No.144/2004/TT-BTC, dated November 26 2004, of the Ministry of
Finance providing guidelines on the implementation of Government’s Decree
188 on land price evaluation;
- Circular No. 14/2009/TT-BTNMT of the Ministry of Natural Resources and
Environment, detailing the compensation, support and resettlement and order

of and procedures for land recovery, allocation and lease.
Beside Laws and Decrees forming legal framework that allows local authorities in
province and locality to apply through decrees and regulation in places, in
accordance with registration, especially for compensation price and level used for
calculating compensation and other support for households affected by land
acquisition and resettlement. Decisions issued by Dak Nong province include:
- Decision No. 05/2010/QD-UBND dated February 23, 2010 of the PC of Dak
Nong Province on Policy of Compensation and Support for People Whose
Lands are acquired by the State in Dak Nong Province.
- Decision No.12/2011/QD-UBND dated March 01, 2011 of the PC of Dak
Nong Province on Amending and Supplementing Some Articles of the
Decision No. 05/2010/QD-UBND.
- Decision No. 13/2012/QD-UBND dated 20/08/2012 of the PC of Dak Nong
Province on amending Point B, Clause 6, Article 1 in the Decision
12/2011/QD-UBND which is dated 1/3/2011 of the PC of Dak Nong Province
on amending and supplementing some Articles of the Decision 05/2010/QD-
UBND dated 23/2/2010;
- Decision No. 27/2010/QD-UBND dated 09/0/2010 the PC of Dak Nong
Province issuing regulation of compensation and support for land and assets
associated to land under protective scale of safe corridor of high-voltage grid;
- Decision No. 43/2010/QD-UBND dated December 12, 2010 of the PC of Dak
Nong Province on Setting Land Price Brackets for Land Categories in Dak
Nong Province in 2011.
- Decision No. 35/2011/QD-UBND dated December 28, 2011 of the PC of Dak
Nong Province on Setting Land Price Brackets for Land Categories in Dak
Nong Province in 2012.
- Decision No. 23/2012/QD-UBND dated December 28, 2012 of the PC of Dak
Nong Province on Setting Land Price Brackets for Land Categories in Dak
Nong Province in 2013.
- Decision No.27/2011/QD-UBND dated 01/11/2011 2012 of the PC of Dak
Nong Province on regulating compensation price of crop are acquired by the
State in Dak Nong province.
- Decision No. 18/2010/QD-UBND dated 14/07/2010 of the PC of Dak Nong
Province on issuing price levels on newly-constructed house, assess and
architectural objectives in Dak Nong province.

III. 4TH
MONITORING RESULT AND EVALUATION OF THE REMDP
IMPLEMENTATION
Survey results through household questionnaires, consultation, participation and
dissemination of information must be conducted throughout the project preparation
stage, the compensation is open to the public and transparency. The compensation
policy, support is fully compliant REMDP and achieve consensus of households.
3.1. Information dissemination
By the time of the 4th
monitoring session, compensation, support, resettlement and
construction in Dak Nong province has been completed. The dissemination of
information and communications adhere well under REMDP. Through monitoring, the
Consulting unit recognized the common forms of information dissemination which
were carried out as follows.

The above table shows that activities of information dissemination and publicity are
properly implemented according to REMDP. Due to proper implementation of
information dissemination to AHs, almost households interviewed think that they
understand policies of compensation and support and how to proceed with complaints
when necessary.
3.2. Inventory and compensation plan
By the time of monitoring, the inventory has completed. Currently, Dak Nong
province does not record any cases of deficient inventory and waiting for adding.
The inventory process had the participation of household-headed person,
representative of CPC, hamlet, village and compensation committee as well as the
Investor. Each household’s assets were listed in the inventory minute and detailed
compensation plan. In the 4th
monitoring session, 100% interviewed people responded
“yes” to participation in inventory with compensation committee and signing in the
asset inventory minute. These households also confirmed that they had reviewed the
compensation plan made by compensation committee before receiving the money,
which presented precisely the affected assets as well as the applied price. Those
compensation plans were publicly listed in CPCs.
3.3 Application price
In Dak Nong province, price applied is issued by PPC. Before applying this price,

DPC conducted surveys and consultations for the functional rooms of the district, and
then submitted report to PPC as a basis for approval of the compensation rate. The
decision to approve / adjust price were issued, including:
- Decision 43/2010/QD-UBND dated 30/12/2010 of Dak Nong PCP regulating
unit prices of land types in Dak Nong province in 2011;
- Decision 35/2011/QD-UBND dated 28/12/2011 of Dak Nong PCP regulating
unit prices of land types in Dak Nong province in 2012;
- Decision 23/2012/QD-UBND dated 28/12/2011 of Dak Nong PCP regulating
unit prices of land types in Dak Nong province in 2013;
- Decision 27/2011/QD-UBND dated 01/11/2011 of Dak Nong PCP regulating
compensation for crop prices on land when the State recovers land in Dak Nong
province;
- Decision No 18/2010/QD-UBND dated 14/07/2010 of Dak Nong PCP on
issuing price of new house construction, properties and structures in Dak Nong
province
Relating to compensation price of assets and architecture objects, PPC has issued
Decision No. 26/2013/QD- UBND regulating price adjustment coefficients for new-
constructed house in provincial area replacing to Decision No. 18/2010/QD- UBND
dated July 14, 2010 issuing price frame for new-constructed house, architecture
objects in provincial area. By which, adjustment coefficient is 1.5 instead of 0.983.
In project scale, one AH which has housing under transmission line and must be
displaced (Ha Van Gioi household in Nam Dong commune, Cu Jut district) has many
complaints of land compensation price, architecture assets. District Compensation and
Site Clearance Committee (of Economic- Infrastructure Department) hired Central
Information and Valuation system JSC (CIVS) for land price and asset evaluation.
Therefore, the Consultant has Valuation Certificate No. 14/05/046 dated May 14th
,
2014 which has lower price than price issued by PPC (refer to annex)
3.4 Compensation payment
By the time of the forth monitoring, compensation activities for AHs in Dak Nong
province are as follows:

3.5. Providing supports
Supports under REMDP which are being applied in Dak Nong province (based on
regulations of the State and PPC) are as follows:

under protective scale of safe corridor of high-voltage grid)
(i) For residential land: the support of 80% depending on land value at that
time; in case of having certificate of land use right or if not, qualify
compensation condition for living land regulated in Land Law;
(ii) For agricultural land: the support of 25% of agricultural land for the
entire area of agricultural land under the ROW.
b. Support for relocation and house rental
- Support for house relocation in the same district, town: the displaced household is
supported in cash with an amount of 3,000,000 VND.
- Support for house relocation in other district of the same province: the displaced
household is supported in cash with an amount of 4,000,000 VND.
- Support for house relocation in other province: the displaced household is
supported in cash with an amount of 6,000,000 VND.
- For households eligible to resettlement, during resettlement arrangement, they will
be supported house rental in 6 months, support amount is as follows:
- Households have 05 people downwards living together: support of 1,200,000
VND/household/month;
- Households have 06 people downwards living together: support of 1,500,000
VND/household/month
c. Support for life and production stability
- Recover from 0.3ha to 0.7ha of agricultural land for perennial crops, annual crops;
recover from 0.2ha to 0.3ha one-crop season and 0.1ha of two-crop season wet
rice land, the household is supported VND300,000 / person / month for 12 months
if not relocate and for 24 months if relocation
- Recover more than 0.7ha of agricultural land for perennial crops, annual crops;
recover over 0.3ha one-crop season and 0.2ha of two-crop season wet rice land,
the household is supported VND300,000 / person / month for 24 months if not
relocate and for 36 months if relocation
d. Support for family under preferential treatment policy, vulnerable households
- Households having wounded soldiers and martyrs, contributed to the revolution
are supported with amount of 2,000,000 VND/household.
- Households who are extremely poor and lose all agricultural land are supported
with amount of 5,000,000 VND/household;

- Households having disable-aged person are supported with amount of 5,000,000
VND/household;
e. Support for job change
- According to regulation of Dak Nong province, only households which are
permanently acquired over 3000 m2 will receive support for job change and within
the project frame, there is no households acquired to such level, thus, no
households receives job change support. It can be considered a disadvantage for
households acquired land in Dak Nong in comparison with other project provinces
(according to Decision No. 12/2011/QD-UBND dated 01/03/2011 of Dak Nong
PC on amendment, supplement of some articles of Decision No. 05/2010/QD-
UBND dated 23/02/2011 of Dak Nong PC providing guidance on some contents
on compensation, support and resettlement when the State acquires land in Dak
Nong province.

Beside above supports, in Dak Song district, 14 households having wire under ROW
constructed by themselves were supported 40% of wiring cost equivalent to 4,000,000
VND/household; there is one household receiving one unit of infrastructure investment
for self resettlement according to Item 2, Article 10, Decision No. 05 dated February
23rd
, 2010 (equivalent to 30,000,000 VND).
By checking compensation plan and interviewing the staff and AHs, the Consultant
has found that the assistances for AHs of the Project have been applied in accordance
with current regulations of the State and the PC of Dak Nong province and compliance
with the approved REMDP.
3.6. Severely affected and displaced households
According to the definition stated in REMDP, severely affect households include
households which are: (i) acquired from 10% of production land and/or assets
onwards, (ii) relocated and/or affected from 10% of their income onwards. Number of

permanently AHs is presented below.
3.6.1. Severely affected households
Among households affected by the project, no household was recovered from 10% of
productive land or more, so there is no household who is severely affected by the
impact of the implementation of the project.
3.6.2. Households have to displaced
From the 4th
monitoring result, 90 displaced households received compensation and
self resettle near the old living place, in which 24 households are ethnic minorities and
66 households are Kinh people. Detail of the household and compensation payment is
presented in the following table.

Among the displaced households above, there are 9 households granted land for
resettlement, among which 7 households in the district of Krong No and 2 households
in Tuy Duc district. 7 households in Krong No district were arranged resettlement in
resettlement area in the northern of Duc An town. 2 households in Tuy Duc are
awaiting resettlement layout near the district center. In the mean time, one household
bought land to build a house in the district of Dak R'Lap (close to the displaced
position) and 1 household is living with children.
3.7. Vulnerable households
Project’s REMDP in Dak Nong province mentioned 6 vulnerable groups, which is (i)
Poor, (ii) women-headed household, (iii) The single elderly households, (iv)

households with disabled, (v) policy-preferential households, and (vi) ethnic minority
households.
Within the project scale, there are five vulnerable groups, which is (i) Poor, (ii)
women-headed household, (iii) households with disabled, (iv) policy-preferential
households, and (v) ethnic minority households. In which poor households, households
with disabled persons and policy-preferential households mostly live in the Dak Song
district at the rate of 68.42%, 100% and 80% respectively. Female-headed households
mostly live in Cu Jut district with the rate of 28.13%.
According to a survey of vulnerable households affected by the project, in addition to
compensation for land and property on the land, they are supported with an amount of
5,000,000 VND / household for poor households and households with disabled people,
and policy-preferential households are supported an amount of 2,000,000 VND /
household.

3.8 Gender issues
According to REMDP, gender issue should be concerned during the project
implementation. Women must be involved in consultation meeting, be members of
Redressing Grievance Board, be trained in management. The old, female household
head… must be enjoyed more special policy when affected by the project.
However, according to the Consultant’s evaluation, women have just participated in
consultation meetings, while other matters have not been concerned. In consultation
meetings, the proportion of women participating only accounts for 38 – 40%. Almost
opinions support the project implementation but they expect compensation equal to
market price, at the same time, some female participants require to loan with
preferential interest rate to recover production.
3.9. Living rehabilitation
As the Project only acquires negligible land area for tower foundation construction and
does not impact much on AH’s production, AHs in ROW also cultivate perennial
crops which have high value such as coffee tree and pepper.
Regulations for AHs’ benefits are fully applied in compensation and site clearance
implementation such as (i) occupational changing support for AHs having production
land acquired; (ii) supports in housing relocation and living stability in case of
relocation; (iii) supports in decreasing land using capacity (production land in ROW).
According to the Consultant’s assessment, these supports are suitable for AHs.

3.10 Grievances and grievances redress
Complaints and questions relating to any aspects in implementation of compensation,
support and resettlement will be solved in accordance with current regulations of
Vietnam. Grievances procedure and redressing measures of the Project complies with
steps outlined in the initial REMDP reports. Grievances issues in Dak Nong province
mainly relate to compensation price on land, trees or crops. Some households send
petitions to CPC and CLRD, concurrently the Centre also has written reply to
households’ recommendation, particularly as follows:

3.11. Cooperation between relevant agencies
PC of city and CPMB: at the preparation period for construction, CPMB under
guidance of city’s PC has combined with relevant branches and agencies to prepare the
Project’s location, route direction, project scale as well as request for principle on
compensation on the Project area. City’s PC has directly conducted the meeting to
instruct relevant parties to support CPMB at their best, in site clearance, construction
activities, to complete the Project’s implementation as schedule.
District’s PC/ Board of compensation and site clearance: PC of district has directed the
District’s Board of compensation and site clearance to ensure the progress of site
clearance for the construction unit. District’s Board of compensation and site clearance
has closely coordinated with CPMB in conducting information dissemination, asset
inventory, compensation plan establishment and payment for households, receiving
and settling complaints and questions. Until now, those works are conveniently

implemented.
CPMB: appoints officials to regularly monitor the Project’s implementation,
combining with local authorities to timely detect difficulties and report to the higher
level for settlement. So that all raising matters during the Project’s implementation can
be settled in time to ensure project’s progress.
CPC: consulting AHs, appointing officials to participate in the inventory of land and
asset in the affected land, identifying the legality of affected assets; supporting Board
of compensation and site clearance of district to publicly post the compensation plan
and payment for households. A special element contributing to the rapid settlement of
complaints of AHs is that communal PC is the office directly receiving complaints and
questions of AHs. If possible, the communal PC shall directly explain to households,
or they can transfer the complaints to higher level for settlement as regulated by law.
Due to the close cooperation during the Project’s implementation, progress of site
clearance and compensation has been accelerated.
IV. CONCLUSION AND RECOMMENDATION
4.1. Conclusion
From analysis mention above, REMDP implementation in districts of Dak Nong
province basically complies with approved REMDP. The Consultant has some
comments on implementation activities as follows:
- Structure of implementation organization: Relevant agencies as prescribed in
REMDP perform well their duties. It ensures that project implementation is
carried out conveniently;
- Project information, compensation policies, complaint process and settlement are
disseminated sufficiently in activities of information public to AHs. Therefore, no
household has complaints due to thoroughly understanding project information;
- Property inventory, compensation planning and payment are implemented with
high agreement of almost AHs. Almost interviewed households said that their
properties are inventoried to making plan and sufficiently paid. It shows that the
completeness and timeliness of compensation are complied;
- Compensation price: It is sensitive problem and always reason for complaints in
many projects. To 500kV Pleiku – My Phuoc- Cau Bong transmission line
project, analyzing and comparing applied price with price mentioned in REMDP
shows that the compensation price is applied as prescribed by Dak Nong province;
- Complaint situation and settlement: All questions, complaints of households in
officially or verbally manner are verified or solved by REMDP implementing
agency according to regulated procedures.
4.2. Recommendation
In general, implementation activities of REMDPs are met required demand. However,
to ensure smooth implementation of REMDPs’ activities and general progress of all
projects, the Consultant unit has some following recommendations:

- CLRD and relevant agencies need to accelerate progress of measurement,
inventory and compensation planning, submit compensation approval and
payment for items of land area supplement, corridor expanding or tree cutting in
order to avoid dissatisfaction of APs due to late compensation;
- For the households have recommendation that the measurement, inventory and
construction time of works on land are not proper, etc, it is suggested that CLRD
coordinates with relevant agencies to recheck and premeasured in order to have
facility to reply/solve recommendation satisfactorily.
- For HHs having recommendation of price unit, suggest relevant parties to review,
research and have suitable plan for solving these cases.
