Objective

➢ The EU AEO programme is a security programme but also one of

the main tools for strengthening the competitiveness of

European businesses through the facilitation of legitimate trade.

➢ Need for continued guidance and coordination, in order to

guarantee a uniform approach and to ensure an effective,

efficient and uniform implementation throughout EU

➢ The Legislator's intention is to ensure that knowledge is available

competence or professional qualifications

• Article 27 UCC IA (1) (b) – professional qualifications

• 1. The criterion laid down in Article 39(d) of the Code shall be

considered to be fulfilled if any of the following conditions are

• (b) the applicant or the person in charge of the applicant’s

customs matters has successfully completed training covering

customs legislation consistent with and relevant to the extent of

his involvement in customs related activities, provided by any of

the following:

providing such qualification, by the customs authorities or a body

of a Member State responsible for professional training;

QU’EST-CE QUE LA REPRÉSENTATION EN DOUANE EN L’AN 2018?

• Jusqu’en 2014 inclus = expéditeur en douane « activité d’une personne physique ou d’une personne morale intervenant à titre professionnel auprès de l’AGDA en tant que représentant indirect. »

• À partir du 12 mai 2014 = représentant en douane « toute personne remplissant des formalités douanières selon la représentation directe ou indirecte. »

QUE SONT LES FORMALITÉS DOUANIÈRES?

CDU, article 5: « l'ensemble des opérations que doivent exécuter une personne et les autorités douanières afin de se conformer à la législation douanière. »

Spécifiquement pour un représentant en douane, les formalités suivantes peuvent être d’application en faisant:

- une déclaration sommaire d'entrée;

- une déclaration sommaire de sortie;

- Une déclaration de dépôt temporaire;

- Une déclaration en douane avec application des différents régimes douaniers

- Une déclaration de réexportation

- Une notification de la réexportation

- AR 18 mars 2016 conditions pour l’inscription dans le registre d’immatriculation

- AR 13 mars 2016 preuve de la connaissance suffisante de la réglementation liée à

la douane et aux accises

- AR 13 en 18 mars 2016: toute personne qui souhaite représenter des personnes pour l’accomplissement des formalités douanières auprès de l’AGDA doit répondre aux conditions de l’article 127, §2 de la LGDA

1* Reconnu comme opérateur économique agréé ou

2* Preuve de la connaissance suffisante de la réglementation liée aux douanes et accises

APTITUDE PROFESSIONNELLE - FORMATION BELGIQUE

• Critère repris dans le CDU pour les opérateurs OEA (art. 39 d)

• Critère repris dans la LGDA et dans les arrêtés d'exécution pour les représentants en douane(art. 127 §4 LGDA); (art.3 §3 AR 13 mars 2016)

• Agrément de la formation par l'Administration générale des Douanes et Accises

FORMATION PROFESSIONNELLE

• Tant les entreprises OEA que non-OEA doivent satisfaire aux normes de compétences professionnelles

• Les instituts de formations prévoiront des formations douanières agréées

• Un processus d’agrément et une procédure de demande officielle seront publiés ultérieurement
