Unit 8 Discussion

• One Sandwich Blitz location is near a public assistance housing complex, which is populated by a large segment of displaced hurricane victims, many of whom are of various ethnic minority groups. While sales are still good, this location has been the target of two armed robberies over the past year. Some employees have voiced their concern over working at this particular location. Local community leaders have urged Jack and Jenny to keep this location open and told them about a local neighborhood improvement initiative designed to make this neighborhood safer and more attractive. Sandwich Blitz has one more year left on a five-year lease.

Unit 8 Assignment• Each Sandwich Blitz location is situated on very small out parcels of land. This

original strategy has contributed to somewhat lower operating expenses for the business and both Jack and Jenny view this as a competitive advantage. New county health regulations require that trash dumpsters be a minimum of 30 feet from the rear entrance. County zoning ordinances require all out buildings to be at least six feet from the property lines.

• In order to meet the county health codes, the enclosure that houses the trash dumpster would be five feet from the property line. The zoning inspector has told the unit manager that he would be willing to approve this if Sandwich Blitz provides the food for his department's holiday party. The location manager has conveyed this information to Jack.

• After reading the scenario please respond to the following:

• Identify and discuss at least two ethical issues that the location manager faces in this scenario

• Identify and discuss at least two ethical issues that Jack faces in this scenario

• Ethical Issue-Situation, problem, or opportunity in which an individual must choose among several actions that must be evaluated as morally right or wrong

Sarbanes-Oxley Act

• SARBANES OXLEY ACT-Created a national Accounting Oversight Board-Audit records must be preserved-Requires auditor rotation (5 years)-CEO and CFO must certify the results of the audit-Imposes fines or imprisonment on anyone who defrauds shareholders

Corporate Social Responsibility

• Defined by our text as-Obligation towards society assumed by business

-A socially responsible business maximizes its positive effects on society and minimizes its negative effects.

CSR Examples

-Starbucks- The foundation of everything we do at Starbucks is our Mission Statement and Guiding

Principles. Although we haven’t always been perfect, we have always been dedicated to being the kind of company that is trustworthy and authentic. Being transparent and openly sharing our successes and challenges through our Corporate Social Responsibility Annual Report is an important part of our strategy. Another component is our support of the 10 universal principles of the United Nations Global Compact.

What constitutes sexual harassment?

• Who is involved? • Is it only verbal? • What other means of sexual harassment might be

used?

What is sexual harassment?

Sexual Harassment is…

• Conduct of a sexual nature that has negative consequences for employment

• Two categories-Quid pro quo: submission to or rejection of sexual conduct is used as a basis for employment decision.

-Hostile environment: when unwelcome sexual conduct “has the purpose or effect of unreasonably interfering with job performance or creating an intimidating, hostile, or offensive working environment.”

Components of a Sexual Harassment Policy

1. Develop a comprehensive organization-wide policy on sexual harassment and present it to all current and new employees.

2. Hold training sessions with supervisors to explain Title VII requirements, their role in providing an environment free of sexual harassment, and proper investigative procedures when charges occur.

3. Establish a formal complaint procedure in which employees can discuss problems without fear of retaliation.

4. Act immediately when employees complain of sexual harassment.

5. When an investigation supports employee charges, discipline the offender at once.

6. Follow up on all cases to ensure a satisfactory resolution of the problem.

Federal Laws

•Title VII of the Civil Rights Act of 1964 (Title VII), which prohibits employment discrimination based on race, color, religion, sex, or national origin;

•The Equal Pay Act of 1963 (EPA), which protects men and women who perform substantially equal work in the same establishment from sex-based wage discrimination;

•The Age Discrimination in Employment Act of 1967 (ADEA), which protects individuals who are 40 years of age or older

Federal Laws (cont)

•Title I and Title V of the Americans with Disabilities Act of 1990 (ADA), which prohibit employment discrimination against qualified individuals with disabilities in the private sector, and in state and local governments;

•Sections 501 and 505 of the Rehabilitation Act of 1973, which prohibit discrimination against qualified individuals with disabilities who work in the federal government; and

•The Civil Rights Act of 1991, which, among other things, provides monetary damages in cases of intentional employment discrimination.
