OWNER: STS, A California General Partnership – Todd Sperber (Representative) APPLICANT: Arturo Ramos STAFF RECOMMENDATION: Staff recommends that the Zoning Administrator adopt a resolution (Attachment 1):
1) Finding Project #EG-15-027exempt from CEQA pursuant to Section 15301; and 2) Approving Project #EG-15-027, subject to the conditions of approval (Exhibit C).
PROJECT DESCRIPTION: The proposed Project is a Minor Conditional Use Permit to utilize an existing 7,920 square foot warehouse building in the Light Industrial (LI) zoning district for an indoor youth soccer training facility for small class sizes averaging 12-18 students. No physical changes to the building are proposed. PROJECT BACKGROUND: The building is located directly adjacent to Soccer World within an industrial park on Kent Street. Soccer World (EG-09-053), located at 9756 Kent Street, Ste. 110, was approved January 21, 2010 to allow a “Fitness and Sports Facility”. The facility operates league play and other soccer-related uses within an 18,088 square foot tenant space previously utilized for warehousing. Additional improvements within the suite included seating for spectators, a small snack bar area, a small retail area, as well as storage, offices, and locker rooms. As part of the original project, 124 parking spaces were required to be installed to meet the parking requirements for the “Indoor Sports and Recreation” use. PROJECT ANALYSIS: Although under the same ownership, the proposed Project is not an expansion of Soccer World, but a separate use entirely. Instead of providing an expanded place for competitive adult soccer games, the proposed Soccer World Academy would operate as a specialty school for youth soccer training. Title 23 of the Municipal Code (hereinafter referred to as the “Zoning Code”) requires a Minor Conditional Use Permit (MUP) to allow a “Schools – Specialized Education and Training/Studio” within the Light Industrial (LI) zoning district. The Zoning Code defines this use as the following:

“Specialized Education and Training/Studios. Specialty schools for instructing and training students in a variety of specialized programs, including, but not limited to, the following:
i. Computers and electronics training schools;
ii. Drama schools;
iii. Driver educational schools;
iv. Language schools;
v. Music schools;
vi. Professional, vocational, and trade schools of a non-industrial nature (e.g., culinary, cosmetology, arts and media, accounting and finance, health and dental including nursing, legal, psychology, and technology); and
vii. Studio-style facilities including, but not limited to, dance/ballet, art, photography, yoga, martial arts (e.g., karate, kung fu, judo, tae kwon do, jujitsu), and fitness studios other than “indoor fitness and sports facilities.”
This facility would be categorized as a “Specialized Education and Training/Studio” instead of a “Fitness and Sports Facility” because it would provide instruction to small classes by appointment only instead of allowing space for competitive events, having a much smaller number of participants and no spectators. Therefore, it will operate similar to a martial arts or yoga studio. By contrast, “Fitness and Sports Facilities” means predominantly participant sports, such as bowling alleys, billiard parlors, ice/roller skating rinks, soccer arenas, athletic clubs, etc., which would have more significant impacts to parking and various other factors. According to the applicant, the Soccer World Academy is designed for improving the soccer skills of youth players outside of regular team trainings. The program targets the players’ technical skills and would complement the players’ team training sessions. Players would follow a personalized development plan and participate in small group sessions of up to 5 players. Players would be placed in age- and level-appropriate groups which would maximize their progress and enjoyment of the sessions. The main hours of operation would be Mondays through Fridays from 3:30 p.m. to 8:30 p.m. and Saturdays and Sundays as necessary. There would be an average of 5 classes conducted per day, approximately 60 minutes each. The maximum number of students at any one time would be 18 with two instructors. Pursuant to the Zoning Code, “Specialized Education and Training/Studios” require one (1) parking space per 2 students, plus one (1) parking space/employee. Based on the occupancy numbers above, the proposed use would require approximately 11 parking spaces. The building currently has 124 parking spaces in the designated parking area to accommodate the requirements for Soccer World. In addition, 15 parking spaces would be added directly south of the existing parking area to meet the requirements of the proposed Project. This would exceed the requirements of the Municipal Code by 4 spaces. The Project was originally routed to all applicable departments on August 26, 2015. All comments were addressed in the second project submittal, submitted November 18, 2015. No further comments or conditions were received from any departments.

ENVIRONMENTAL DETERMINATION: The Project is exempt from CEQA pursuant to CEQA Guideline Section 15301 (Existing Facilities) of Title 14 of the California Code of Regulations. CEQA Guidelines Section 15301 applies to projects that consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures facilities, mechanical equipment, or topographical features, involving negligible or no expansion or use beyond that existing at the time of the lead agencies determination. The Project involves locating a “Specialized Education and Training/Studio” use into an existing industrial facility. There would be no expansion of the existing building. No special circumstances exist that granting a Minor Conditional Use Permit would create a significant adverse effect on the environment. Note: This project is appealable to the Planning Commission and the City Council, if applicable. Attachments:

A RESOLUTION OF THE ZONING ADMINISTRATOR OF THE CITY OF ELK GROVE FINDING THE PROJECT EXEMPT FROM CEQA AND
APPROVING A MINOR CONDITIONAL USE PERMIT

WHEREAS, the Planning Division of the City of Elk Grove received an application on August 24, 2015 from Arturo Ramos (the Applicant) requesting a Minor Conditional Use Permit to utilize a suite within an existing building zoned Light Industrial (LI) for a “School – Specialized Education and Training/Studio” use, (the Project); and
WHEREAS, the proposed Project is located on real property in the incorporated portions of the City of Elk Grove more particularly described as APN: 134-0100-022; and
WHEREAS, the Project qualifies as a project under the California Environmental
Quality Act (CEQA), Public Resource Code §§21000-21189.3 but is exempt; and WHEREAS, Section 15301 (Existing Facilities) of the California Code of Regulations, Title 14, (State CEQA Guidelines) applies to projects that consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures facilities, mechanical equipment, or topographical features, involving negligible or no expansion or use beyond that existing at the time of the lead agencies determination; and
WHEREAS, based on staff’s review of the Project, no special circumstances exist that would create a reasonable possibility that granting a Minor Conditional Use Permit for this Project will have a significant effect on the environment; and
WHEREAS, the Planning Department considered the Project request pursuant to the Elk Grove General Plan, the Elk Grove Municipal Code Title 23 (Zoning), and all other applicable State and local regulations; and
WHEREAS, the Zoning Administrator held a duly noticed public hearing as required by law to consider all of the information presented by staff, information presented by the Applicant, and public testimony presented in writing and at the meeting.

NOW, THEREFORE, BE IT RESOLVED that the Zoning Administrator of the City of Elk Grove finds the Project exempt from the provisions of CEQA under Section 15301 (Existing Facilities) of Title 14 of the California Code of Regulations based upon the following findings:
CEQA
Finding: The Project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301 (Existing Facilities) of Title 14 of the California Resources Code of Regulations. Evidence: CEQA Guidelines Section 15301 applies to projects that consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures facilities, mechanical equipment, or topographical features, involving negligible or no expansion or use beyond that existing at the time of the lead agencies determination. The Project involves locating a “School – Specialized Education and Training/Studio” use into a suite within an existing industrial facility. There will be no expansion of the existing building. No special circumstances exist that granting a Minor Conditional Use Permit would create a significant adverse effect on the environment.
AND, BE IT FURTHER RESOLVED, that the Zoning Administrator of the City of Elk Grove
approves the Project as described in the Project Description provided in Exhibit A, incorporated herein by this reference, the Project Plans as illustrated in Exhibit B, incorporated herein by this reference, and subject to the Conditions of Approval as provided in Exhibit C, incorporated herein by this reference, based upon the following findings: Minor Conditional Use Permit
Finding #1: The proposed use is consistent with the General Plan and all applicable provisions of Title 23 of the Municipal Code (Zoning Code).
Evidence: The General Plan land use designation for the subject property is Light Industry and the zone district is Light Industrial (LI). The proposed “School – Specialized Education and Training/Studio” use is a conditionally allowed use in the LI zone. Thus, the issuance of a Minor Conditional Use Permit for the proposed youth soccer school would maintain consistency with the General Plan and Zoning Code. Finding #2: The establishment, maintenance, or operation of the use applied for will not, under the circumstances of the particular case (location, size, design, and operating characteristics), be detrimental to the health, safety, peace, morals, comfort, or general welfare of persons residing or working in the neighborhood of such use, or the general welfare of the City.
Evidence: Surrounding uses in the immediate vicinity of the Project are light industrial on all sides. The proposed use is compatible with the adjacent

developments, which primarily consists of an indoor competitive soccer facility. The proposed use would not introduce or create any conflicts by changing the nature of the existing development in any significant way. The operation would be completely screened from public view, class sizes would be small, and there the project has ample space to meet the parking requirements if the Municipal Code. Thus, the establishment of the proposed “School – Specialized Education and Training/Studio” use would not create any foreseeable hazards that would be detrimental to the health, safety, peace, morals, comfort, or general welfare of persons working in the area.
The foregoing Resolution of the City of Elk Grove was passed and adopted by the Zoning Administrator on the 14th day of December, 2015.

On-Going 1. The development approved by this action is for a Conditional
Use Permit to operate a School – Specialized Education and Training/Studio in the Light Industrial zoning district (LI). Deviations from the approved plans shall be reviewed by the City for substantial compliance and may require amendment by the appropriate hearing body.

2. The Applicant/Owner or Successors in Interest (hereby referred to as the “Applicant”) shall indemnify, protect, defend, and hold harmless the City, its officers, officials, agents, employees, and volunteers from and against any and all claims, damages, demands, liability, costs, losses or expenses including without limitation court costs, reasonable attorney’s fees and expert witness fees arising out of this Project including challenging the validity of this Project approval or any environmental or other documentation related to approval of this Project.

5. The Applicant shall pay all plan check fees, impact fees, or other costs as required by the City, the Cosumnes Community Services District (CCSD), Sacramento Area Sewer District (SASD), Sacramento County Water Agency (SCWA), or other agencies or services providers as established by law.

stops shall be installed directly south of the existing parking area to be utilized for Soccer World Academy parking.

10. The new parking area shall comply with all lighting requirements of the Elk Grove Municipal Code. A photometric plan shall be submitted with building plans which shows that all new parking spaces are illuminated with a minimum maintained one foot-candle (1 fc) of light and an average not to exceed four foot-candles (4 fc) of light during hours of operation.
