WHAT HAPPENED TO THE SUMMARYJUDGMENT AND APPEAL? Some contend that the art of preparing a case for dis-positive motion has been lost. Unfortunately, there areseveral factors in today’s litigation practice that validatethis contention. We will examine several of those fac-tors, including the differing outcomes and costs associ-ated with pursuing such motions in state court versusfederal court, the ever-growing trend of early case reso-lution, overall risk adversity due to unpredictable andoutrageous jury verdicts and a general cost/benefitanalysis. We will also examine how failing to posture acase for summary judgment can cost one considerablesettlement leverage at the mediation table.
INITIAL CASE ASSESSMENTS ANDEVALUATIONS: WHAT DOES THE RETAILCLIENT WANT TO KNOW AND WHEN? With the proliferation of advertising firms filing firstnotice lawsuits coupled with 98% of filed civil casesbeing settled, what are clients looking for and when indeveloping internal reserves, settlement authority andclaim strategies. NIPPING THE “EXTORTION CASE”IN THE BUDOn the other side of the economics spectrum we have“Extortion Cases,” which present questionable theoriesof liability and limited damages, but can be difficult –and expensive – to get rid of. Our panelists share theirthoughts and methods about how to dispose of thesematters as efficiently as possible.
THE “NEW” STANDARD OF CARE – TECHNOLOGY The plaintiff’s bar is now asking what you didn’t have onyour truck. Is the failure to use technology a legitimatecause of action? In this session, we explore whether col-lision avoidance technology is the current standard ofcare. In addition, we will discuss the current status ofrulemaking with respect to this technology.
TECHNOLOGY ON ITS HEADWhat happens when technology does not do what it issupposed to do? Ourpanel members discuss the status of autonomous trac-tors and their impact on the industry, including whetherthey will help with qualified driver shortages and howthey present exposure to new forms of risk.
